MINUTES: ON MOTION BY LIPPS AND SECOND BY CROSBY THE MINUTES OF
THE REGULAR MEETING OF APRIL 4, 1979, WERE APPROVED BY
THE FOLLOWING VOTE:

ADMINISTRATIVE REVIEW NO. 79-29
Applicant: Pizza Time Theatre, Inc.
To permit a family pizza restaurant with family entertainment
to be located on the west side of Edwards Street, and south of
McFadden Avenue.
This request is a Class 1 Exemption, California Environmental
Quality Act, 1970.
Mr. Gene Landrum, President of Pizza Time Theatre, Inc. and Mr.
George Cohen, were present to represent the application.
The Chairman outlined the proposal to the Board. Acting Secre-
tary Lipps outlined various concerns revealed by the plan check.
He stated that the plan as proposed was deficient in parking
spaces and further outlined how the amount of parking spaces
required are determined by the amount of seating area provided.
Mr. Landrum informed the Board that the game area was only to
be utilized by patrons of the pizza parlour and was not open
to the general public not patronizing the food portion of the
proposal. Therefore, Mr. Landrum stated that additional parking
was not necessary for the game room portion of the proposal.
He further stated that the establishment was only open to
adults over 18 years of age and children accompanied by adults,
thereby eliminating the "teenagers" from using the game room only.
Mr. Landrum further cited that these restrictions were being
strictly enforced by his other two establishments.

Circulation and ingress and egress was discussed. It was noted
that a trash enclosure was present on the property and it was
the consensus of the Board to require the applicant to present
a revised plan depicting 25 feet of clearance along west side of
building to Fire Department connections. It was further noticed
by the Board that a field check indicated the presence of a truck
well and storage structure at the rear of the building. The
possibility of utilizing the storage structure as trash area
was also discussed.
Board discussion followed. Conditions of approval were discussed.
ON MOTION BY LIPPS AND SECOND BY CROSBY ADMINISTRATIVE REVIEW
NO. 79-29 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE
FOLLOWING VOTE:
CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:

shall be the approved layout,

a. Revise parking layout to provide makimum number of parking
spaces in compliance with Article 979 of the Huntington
Beach Ordinance Code and reflecting a minimum 25 foot
accessway from McFadden along the easterly building line
to a point in line with the southerly most driveway on
Edwards Street and continuing through the parking lot
along that line to Edwards Street.

b. Revise plan to show elimination of fenced area along the
southerly line of the building.
C. Revise plan to reflect truck well, loading zone, and storage
structure at rear of building or show plan to eliminate
these structures.
A plan delineating said modifications shall be submitted to
the Secretary of the Board. If such plan complies with the
modificiations outlined by the Board, said plan shall be
approved and made a permanent part of the administrative file.
In its approval action, the Board of Zoning Adjustments considered
the following issues relating to the conceptual plan:

Traffic circulation and drives;
Parking layout;
Lot area;
Lot width and lot depth;
Type of use and its relation to property and improvements in
the immediate vicinity;
Past administrative action regarding this property.
2. The following plans shall be submitted to the Secretary of
the Board:
a. Landscape and irrigation plan complying with Article 979
of the Huntington Beach Ordinance Code and landscaping
specifications on file in the Department of Public Works.
b. Rooftop mechanical equipment screening plan. Said plan
shall indicate screening.of all rooftop mechanical
equipment and shall delineate the type of material pro-
posed to screen said equipment.
C. An outdoor lighting plan shall be submitted to and approved
by the Secretary of the Board prior to issuance of Build-
ing Permits.
d. A plan showing trash enclosure with minimum 25 foot clearance
along west side of building to Fire Department connections
shall be submitted to the Secretary of the Board.
GENERAL CONDITIONS:
1. Game area shall be restricted to dining customers only.

SPECIAL EVENT NO. 79-6
Applicant: Golden West College
To permit a 10 kilometer run on Saturday, May 19, 1979 from 8:30 a.m.
to 11:00 a.m. located throughout the City of Huntington Beach.
Chairman Crosby stated that the applicant had submitted a letter
to the Board requesting a one week continuance of the item to allow
time for the college to consider changing the date or changing the
proposed route for the special event. Board concurred with con-
etinuance.

WAS CONTINUED TO APRIL 18, 1979, BY THE FOLLOWING VOTE:

SPECIAL EVENT NO. 79-7
Applicant: American Heart Association/Orange County
To permit a Cyclethon on Sunday, May 6, 1979 between the hours of
9 a.m. and 5 p.m. to be located throughout the City with eight (8)
checkpoints totalling 27.3 miles.
Mr. Stewart was present to represent the application. He outlined
the proposed route for the Board and stated that this was a sponsored
event for fund raising.
Board reviewed the proposed route and correspondence from the Fire
Department.
ON MOTION BY CROSBY AND SECOND BY BURNEY SPECIAL EVENT NO. 79-7 WAS
APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: •
CONDITIONS OF APPROVAL:
1. The plot plan received April 11, 1979, shall be the approved
layout.
2. A certificate of insurance form shall be filed in the Finance
Department five (5) days prior to the event.
3. The riders shall obey all vehicle code and City requirements.
4. The course should be monitored at various locations to assure
that riders do not obstruct traffic flow or emergency vehicle
responses.
5. All riders must be made aware of the above requirements.
6. All rules of the road shall be followed by riders.
7. Riders shall stay within bike trails wherever possible.

SPECIAL EVENT NO. 79-8
Applicant: SS Simon and Jude School
To permit a bike-a-thon to be held on April 29th from 1:30 p.m.
to 4:30 p.m. along Indianapolis Avenue, Newland Street, Yorktown
Avenue, and Bushard Street.
Sister Carolyn was present to represent the application. The
Board reviewed the proposed route with the applicant's representative.
Conditions of approval were discussed.

WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE:

CONDITIONAL EXCEPTION NO. 79-8 (RECONSIDERATION)
Applicant: Dave McGuiness_
To permit a reduction in sideyard setbacks for the construction of a
single-family dwelling located on the south side of Memphis Avenue,
approximately 100 feet west of Huntington Street.
This request is a Categorical Exemption, Class 5, California Environ-
mental Quality Act, 1970.

Acting Secretary Lipps stated that the applicant had submitted a
letter to the Board requesting reconsideration of his application
based on new information submitted whereby the proposal meets'ad-
ditional Ordinance Code requirements.
ON MOTION BY CROSBY AND SECOND BY LIPPS CONDITIONAL EXCEPTION NO.
79-8 WAS RECONSIDERED BY THE FOLLOWING VOTE:
AYES: Lipps, Crosby, Burney
NOES: None
ABSENT: None
The applicant was not present. Chairman Crosby reopened the public
hearing. There being no parties present to speak on the application,
the public hearing was closed.
Board discussed the revised plan as submitted by the applicant and
noted that the plan has been revised substantially creating a
minimal encroachment, necessary to provide proper parking and
to obtain parity with surrounding properties in the same zone
classification.
ON MOTION BY LIPPS AND SECOND BY CROSBY CONDITIONAL EXCEPTION NO. •
79-8 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITION, BY
THE FOLLOWING VOTE:
FINDINGS•
1. Due to lot width, applicant is unable to provide required parking
in order to obtain parity with surrounding properties in the
same zoning classification.
2. Because of lot width, the applicant would be unable to provide
required parking and the reduced setback on the interior property
line will afford buildable area comparable to that enjoyed by
a 25 foot corner lot in this zoning district.
3. The granting of the Conditional Exception will not constitute
a grant of a special privilege inconsistent upon other properties
in the vicinity and under an identical zone classification.
4. Because of special circumstances applicable to the subject property,
including size, shape, topography, location, or surroundings, the
strict application of the zoning ordinance is found to deprive the
subject property of privileges enjoyed by other properties in
the vicinity and under identical zone classifications.
5. The granting of a conditional exception is necessary in order to •
preserve the enjoyment of one or more substantial property rights.

6. The granting of a conditional exception will not be materially
detrimental to the public welfare, or injurious to property in
the same zone classification.
7. The granting of the conditional exception will not adversely
affect the Master Plan of the City of Huntington Beach.

1. The plan received and dated April 9, 1979, shall be the approved
layout.
