Schmidt To permit the construction of a 5-story commercial/office building located on the south side of Ellis Avenue, approximately 462 feet to'the centerline of Beach -Boulevard. This -application is covered by Negative Declaration No. 79-23. The -Chairman outlined the proposal to the Board. The public hearing was opened. There being no -parties present to speak on the appli- cation, the public hearing was closed. Secretary Spencer suggested the application be referred to the Planning Commission to be heard in conjunction with a conditional exception filed by the applicant. Board concurred with the referral. Maurer To permit the construction of a 13,848 square foot industrial building located on the east side of Gothard Street, approximately 540 feet north of Slater Avenue. This application is covered by Negative Declaration No. 79-28. ON MOTION BY SPENCER AND SECOND BY CROSBY THE BOARD, HAVING FOUND THAT THE PROPOSED PROJECT WILL NOT HAVE A SIGNIFICANT ADVERSE EFFECT ON THE PHYSICAL ENVIRONMENT, ADOPTED NEGATIVE DECLARATION NO. 79-28 WITH THE MITIGATING MEASURES CONTAINED IN ADMINISTRATIVE REVIEW NO. 79-24 GENERAL CONDITIONS B 1-6 IMPOSED ON THE AD- MINISTRATIVE REVIEW APPLICATION, BY THE FOLLOWING VOTE: AYES: Spencer, Crosby, Ott NOES: None ABSENT: None Mr. Thomas J. Maurer was present to represent the application. Chairman Crosby outlined the proposal to the Board. Secretary Spencer noted that the plan check revealed the application to be within substantial ordinance code conformance, however, access off Gothard was discussed and it was noted that the Traffic Engineer expressed concern over the location of the truck door and driveway from Gothard Street. Chairman Crosby outlined to the applicant the possible traffic hazard that could be created by allowing the applicant to proceed with the truck door and driveway as proposed. It was the consensus of the Board to condition the applicant to alleviate the truck door and drive- way off of Gothard Street. Possible rearrangement of parking area was discussed. Further Board discussion ensued. ON MOTION BY CROSBY AND SECOND BY SPENCER ADMINISTRATIVE REVIEW NO. 79-24 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received March 14, 1979 shall be the approved layout, subject to the modifications described herein: a. Revise plan to provide 24 foot drive approach. b. Revise plan to depict deletion of truck door and driveway from Gothard Street. Minutes: H.B. If such plan complies with the modifications outlined by the Board, said plan shall be approved and made a permanent part of the administrative file. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: Traffic circulation and drives; Parking layout; Lot area; Lot width and lot depth; Type of use and its relation to property and improvements in the immediate vicinity; Past administrative action regarding this property. 2.- The following plans shall be submitted to the Secretary of the Board: a. Landscape and irrigation plan complying with Article 979 of the Huntington -Beach Ordinance Code and landscaping specifications on'file in the Department of Public Works. b. Rooftop mechanical equipment screening plan. Said plan shall indicate screening of all rooftop mechanical equip- ment and shall delineate the type of material proposed to screen said equipment. B. GENERAL CONDITIONS: 1. Natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 2. Low volume heads shall be used on all spigots and water faucets. 3. All building spoils; such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 4. If lighting is included in the parking lot, high pressure sodium vapor lamps shall be used for energy savings. All outside lighting shall be directed to prevent "spillage" onto adjacent properties. 5. A detailed soils arialysis shall be prepared by a registered soils engineer. This -analysis shall include on -site soil sampling and laboratory testing of materials to provide detailed recommendations regarding gradipg, chemical and fill properties, foundations, retaining walls, streets, and utilities. 6. If foil -type insulation is to be used, a fire retardant type shall be installed as _approved by the Building Department. Minutes: H.B. The size, depth, frontage, street width, and other design and improvement features of the proposed subdivision are proposed to be constructed in compliance with standard plans and specifi- cations on file with the City as well as in compliance with the State Map Act and supplemental City Subdivision Ordinance. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCELS FOR ANY PURPOSE: 1. The tentative parcel map received by the Planning Department on March 27, 1979, shall be the approved layout. 2. Corriere (La Plaza Restaurant) To permit the encroachment of a patio cover into the sight angle requirement located on the northwest corner of Warner Avenue and Goldenwest Street: IN CONJUNCTION WITH: ADMINISTRATIVE REVIEW NO. 79-30 Applicant: Joseph A. Corriere (La Plaza Restaurant) To permit the construction of an open patio cover and solid roofed patio cover on an existing restaurant located on the northwest corner of Warner Avenue and Goldenwest Street. These two applications are categorical exemptions, Class 5, California Environmental Quality Act, 1970. Mr. Joseph A. Corriere was present to represent the application. The Chairman outlined the proposals to the Board. The public hearing was opened. The extent of the encroachment was discussed by the Board. It was the consensus of the Board that the.Administrative Review request was within substantial ordinance code conformance. Discussion ensued regarding creating an additional landscaped area where a drive area presently exists to lessen the encroach- ment request and beautify the front'of the building. Applicant concurred with the Board's suggestion to landscape the existing drive area directly adjacent to the front of the building. There being no further parties present to speak on the application, the public hearing was closed. Board discussion ensued. ON MOTION BY SPENCER AND SECOND BY OTT CONDITIONAL EXCEPTION NO. 79-12 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: 1 Minutes: H.B. Board of Zoning Adjustments Wednesday, April 18, 1979 Page Seven FINDINGS• 1. Does not constitute a grant of special privilege inconsistent upon other properties in the vicinity and under identical zone classification. 2. Is not detrimental to the public welfare or injurious to property in like zone classifications. 3. Will not adversely affect the City's General Plan. 4. That amount of encroachment is found to be minimal. CONDITIONS OF APPROVAL: 1. That the proposed shelter be solid roofed and open sided. 2. That the existing drive area directly adjacent to front of building be converted to a landscaped area. The applicant was not present. Secretary Spencer informed the Board that the application was improperly advertised and therefore, suggested a two week con- tinuance -of the application. Board concurred with the continuance. ON MOTION BY SPENCER AND SECOND BY OTT CONDITIONAL EXCEPTION NO. 79-13 WAS CONTINUED TO MAY 2, 1979, BY THE FOLLOWING VOTE: AYES: Spencer, Crosby, Ott NOES: None ABSENT: None ADMINISTRATIVE REVIEW NO. 79-31 Applicant: Thomas J. Horan To permit the construction of a 19,250 square foot industrial building located on the west side of Commerce Lane, approximately 500 feet south of McFadden Avenue. This application is covered by EIR 73-16, approved by the City Council on March 18, 1974. Minutes: H.B. Board of Zoning Adjustments Wednesday, April 18, 1979 Page Nine Mr. Thomas J. Horan, the applicant, was present. The presence of hazardous storage tanks on the property was discussed. Mr. Horan explained various setbacks he had in his business due to the storage of hazardous materials necessary for his business. Board discussed circulation and proper sprinklering of the proposed project, as well as trash bin locations. It was the consensus of the Board that proper storage of underground tanks would be covered in the Fire Code and that the applicant will be conditioned to meet all requirements of that code. Further Board discussion ensued and conditions of approval were discussed. ON MOTION BY SPENCER AND SECOND BY CROSBY ADMINISTRATIVE REVIEW NO. 79-31 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The revised conceptual plot plan received April 6, 1979, shall be the approved layout, subject to the modification described herein: a. Applicant shall submit revised elevations. A plan delineating said modification shall be submitted to the Secretary of the Board. If such plan complies with the modification outlined by the Board, said plan shall be approved and made a permanent part of the administrative file. Jarrard To permit the construction of an office professional building located at the southwest corner of Florida Street and Kartron Avenue. This application is covered by Negative Declaration No. 78-101, I previously approved. Messrs Lortie and Jarrard were present to represent the application. Chairman Crosby outlined the proposal to the Board. Secretary Spencer noted that the applicant was short in parking spaces and Mel Ott discussed locations of existing and future fire hydrants to service the proposal. Possible landscaping along the existing right-of-way as well as elevations were discussed between the Board and applicants. Mr. Jarrard noted that his calculations in square footage differed with those of the plan check. It was then determined that the stairways and open balconies will not be included as open area for purpose of parking count. Board discussion followed. Conditions of approval were discussed. ON MOTION BY SPENCER AND SECOND BY CROSBY ADMINISTRATIVE REVIEW NO. 79-32 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual site plan received and dated April 4, 1979, shal be the approved layout. A landscape plan shall be submitted to the Secretary of the Board for review and approval. The Tentative Parcel Map consolidating the lots shall be recorded and proof of recordation submitted to the City. 2. An irrevocable offer of dedication for reciprocal easements for circulation over and across subject property to the adjacent properties shall be submitted to the City Attorney for approval as to form and content. This offer shall become void in the event that adjacent property owners do not agree to submit like r easements for interior circulation over and across their proper- ties for the benefit of the subject development within ten (10) . years of this date.
