BOARD MEMBERS: LIPPS, CROSBY, OTT MINUTES: ON MOTION BY OTT AND SECOND BY CROSBY, THE MINUTES OF THE REGULAR MEETING OF APRIL 18, 1979, WERE APPROVED BY THE FOLLOWING VOTE: AYES: Ott, Crosby NOES: None ABSENT: None ABSTAIN: Lipps REGULAR AGENDA ITEMS: USE PERMIT NO. 79-9 Applicant: Manthei/Buccella Investments To permit the storage of recreational vehicles located at east side of Gothard Street, approximately 840 feet north of Talbert Avenue. This application is covered by Negative Declaration No. 79-15, previously approved. The Chairman outlined the proposal to the Board. The public hearing was opened. Messrs. Manthei and Buccella, the applicants, were present. Acting Secretary Lipps stated that this application was for the development of Parcel #4 of previously approved Tentative Parcel Map No. 79-558. He further stated that the plan check revealed the application to be within substantial ordinance code conformance except that the proposal was approximately 4,000 square feet short in landscaping. He further explained the requirement of six percent of the site to be landscaped. The placement of storm drain and sewer easement along the easterly property lines of Parcels #3 and 44 was discussed. It was agreed that the developer would provide such easement to the approval of the Department of Public Works. Type of surfacing of storage spaces was discussed. Mr. Lipps informed the applicants that the code required all travel lanes must be paved and that emergency accessways would be to the approval of the Fire Department. Mr. Bill Sullivan addressed the Board and questioned what type of fencing was to be provided by the applicant. Mr. Lipps further explained that certain type of fencing is required when a development directly abuts a residential development. Mr. Sullivan further questioned what materials would be utilized in ground cover, i.e., driveways, etc. Secretary Lipps informed Mr. Sullivan that the code required all drives to be paved and that the type of surfacing of storage spaces was to be approved by the Building Department, and that the surfacing of the 25 foot emergency accessway was to the approval of the Fire Department. Mr. Sullivan further questioned the Board as to what type of lighting was to be provided. Acting Secretary Lipps informed Mr. Sullivan that the type of lighting was at the discretion of the applicant, however, the Secretary of the Board would review the lighting plan as it would affect the adjacent property. Proper turning radius was discussed to accommodate emergency vehicles. There being no further parties present to speak on the application, the public hearing was closed. Board discussion followed. Con- ditions of approval were discussed. ON MOTION BY LIPPS AND SECOND BY CROSBY USE PERMIT NO. 79-9 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS: 1. The establishment, maintenance, and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity. b. Property and improvements in the vicinity of such use or building. 2. The granting of a Use Permit will not adversely affect the Master Plan of the City of Huntington Beach. 3. The proposal is consistent with the City's General Plan of Lana Use. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received April 6, 1979, shall be the approved layout, subject to the modifi- cations described herein: a. Revise plan to reflect a minimum six (6) percent land- scaping as required by Article 979. A plan delineating said modifications shall be submitted to the Secretary of the Board. If such plan complies with the modifications outlined by the Board, said plan shall be approved and made a permanent part of the administrative file. [1 1 Minutes: H.B. Board of Zoning Adjustments Wednesday, April 25, 1979 Page Three In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: Traffic circulation and drives; Parking layout; Lot area; Lot width and lot depth; Type of use and its relation to property and improvements in the immediate vicinity; Past administrative action regarding this property. 2. The following plan shall be submitted to the Secretary of the Board: a. Landscape and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code and landscaping specifications on file in the Department of Public Works. B. GENERAL CONDITIONS: 1. Developer shall provide a 25 foot wide emergency easement along the easterly property line through Parcel #3 from Talbert Avenue north to and over Parcel 14 to a point adjoining the easterly and southerly drive on Parcel #4. 2. Developer shall provide a 20 foot storm drain and sewer ease- ment along the easterly property lines of Parcels #3 and #4. Easement to be approved by the Department of Public Works and recorded with the County of Orange within 30 days of record- ation of Tentative Parcel Map No. 79-558. 3. Type of surfacing of storage spaces, other than drives, to be to the approval of the Building Department. All travel lanes shall be paved. Surfacing of 25 foot emergency accessway shall be approved by the Fire Department. AYES: Lipps, Crosby, Ott NOES: None ABSENT: None ADMINISTRATIVE REVIEW NO. 79-33 Applicant: Manthei/Buccella Investments To permit the construction of a mini storage complex located on the east side of Gothard Street, approximately 320 feet north of Talbert Avenue. Buccella and Manthei were present to represent the appli- cation. The Chairman outlined the proposal to the Board. Acting Secretary Lipps noted that this application was for the development of Parcel #2 of previously approved Tentative Parcel Map No. 79-558. He further stated that the proposal was somewhat short in landscaping, that trash areas had not been shown on the plan, and that the code required the building to be set back along the southerly and northerly property line to zero foot setback. Access agreements between Parcels #2 and #4 were discussed as well as the Traffic Engineer's requirement of an increase in the drive approach to forty feet. Secretary Lipps noted that the proposal was within the Civic District, and therefore,required review by the Design Review Board. He further stated that the Design Review Board usually reviews the application, prior to Board review, however, since design review has not as yet been completed, the Board would recommend that recommendations of the Design Review Board would be integrated into the proposal if so stipulated by the Secretary of the Board. Mel Ott informed the applicant of Fire Department requirements regarding emergency access lanes and the posting of "No Parking" signs. Board discussion ensued, conditions of approval were discussed. ON MOTION BY CROSBY AND SECOND BY LIPPS, ADMINISTRATIVE REVIEW NO. 79-33 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOL- LOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received April 6, 1979, shall be the approved layout, subject to the modifications described herein: a. Relocate building along southerly and northerly property line to zero (0) foot setback. b. Revise plan to reflect minimum of six (6) percent landscaping. A plan delineating said modifications shall be submitted to the Secretary of the Board. If such plan complies with the modifications outlined by the Board, said plan shall be approved and made a permanent part of the administrative file. Minutes: H.B. An Irrevocable Access Agreement between Parcels #2 and #4 as shown on Tentative Parcel Map No. 79-558 shall be submitted to the Planning Department and recorded with the County of Orange prior to occupancy. 3. Increase drive approach to forty (40) feet radius type approach. 4. Recommendations of the Design Review Board shall be integrated into the plans if so stipulated by the Secretary of the Board. A memo from the Secretary of the Board to that effect shall be placed in the file. Buccella and Manthei were present to represent the appli- cation. The Chairman outlined the proposal to the Board. Acting Secretary Lipps stated that the plan check revealed the plan to be within substantial ordinance code conformance. Screening of the parking area was discussed and the applicant was informed that this could be treated with either a 32 inch high masonry wall or by intensified landscaping. The posting of "No Parking" along emergency vehicle access routes was discussed by Mel Ott. The applicant was made aware that the Traffic Engineer required the drive approach off Gothard Street to be 40 feet with standard type cut and 40 feet off Talbert Avenue with radius type cut. Acting Secretary Lipps noted that the proposal was within the Civic District and therefore, required review by the Design Review Board. He further stated that the Design Review Board usually reviews the application, prior to Board review, however, since design review has not as yet been completed, the Board would recommend that recommendations of the Design Review Board would be integrated into the proposal if so stipulated by the Secretary of the Board. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received April 6, 1979, shall be the approved layout, subject to the modifi- cations described herein: a. Revise plan to reflect method of screening of parking as required by Article 979. b. Revise plan to show a forty (40) foot drive approach off Gothard Street with standard type cut and Talbert Avenue with radius type cut. A plan delineating said modifications shall be submitted to the Secretary of the Board. If such plan complies with the modifications outlined by the Board, said plan shall be ap- proved and made a permanent part of the administrative file. IN CONJUNCTION WITH: ADMINISTRATIVE REVIEW NO. 79-36 Applicant: Sam Heyman To permit the construction of two (2) 8,528 square foot industrial buildings located on the west side of Enterprise Lane, approximately 427 feet from either Mountjoy Drive or Lindborg Drive. These applications are covered by Negative Declaration No. 74-150, previously approved. Minutes: H.B. Board of Zoning Adjustments Wednesday, April 25,,1979 Page Eight Mr. Sam Heyman, the applicant was present and indicated his receipt of and concurrence with the suggested conditions of approval for Tentative Parcel Map No. 79-36 previously forwarded to him. Chairman Crosby outlined the proposals to the Board. It was noted that the tentative parcel map was within substantial ordinance code conformance and findings and conditions were reviewed with the applicant. Acting Secretary Lipps informed the Board that the applicant only filed one administrative review request, therefore, only one structure can be addressed. The applicant chose for the Board to act on Parcel #1. The Board noted that a discrepancy was in existence along the southerly property line in regards to proper setbacks. Acting Secretary Lipps informed the applicant that the code defines setbacks as being either along the zero or fifteen foot property line, and due to the existing Edison Easement, the building -could not be located at zero setback. The Board informed the applicant that the only way they could address the setback problem was through a conditional exception application. It was the wish of the applicant to file a conditional exception citing the existence of the Edison Easement as placing a hardship on his property. Mr. Heyman further added that his intended use for the building was to lease the structure for general purpose use. Board discussion ensued, conditions of approval were discussed. ON MOTION BY CROSBY AND SECOND BY LIPPS, TENTATIVE PARCEL MAP NO. 79-564 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS• 1. The proposed division of one lot into two parcels for purposes of industrial development is in compliance with the size and shape of property necessary for that type of development. 2. The General Plan has set forth provisions for this type of land use as well as setting forth objectives for implementation of this type of use. 3. The property was previously studied for this intensity of land use at the time the land use designation for General Industrial which allows industrial buildings, was placed on subject property. 4. The size, depth, frontage, street width, and other design and improvement features of the proposed subdivision are proposed to be constructed in compliance with standard plans and specifi- cations on file with the City as well as in compliance with the State Map Act and supplemental City Subdivision Ordinance. 11 Minutes: H.B. The tentative parcel map received by the Planning Department on April 9, 1979, shall be the approved layout. 2. A parcel map shall be filed with, and approved by, the Depart- ment of Public Works, and recorded with the Orange County Recorder. 3. A copy of the recorded parcel map shall be filed with the Planning Department. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received April 9, 1979 shall be the approved layout, subject to the modifications described herein: a. A revised plan reflecting required setbacks in the event the applicant is unsuccessful in obtaining a conditional exception. A plan delineating said modifications shall be submitted to the Secretary of the Board. A reciprocal access agreement between Parcels #1 and #2 shall be submitted to and approved by the Public Works Department and recorded with the County'of Orange prior to occupancy. AYES: Lipps, Crosby, Ott NOES: None ABSENT: None MISCELLANEOUS• SPECIAL EVENT NO. 79-9 Applicant: Huntington Valley Sports & Tennis - Adidas To permit a 10 kilometer run to be held on July 4 throughout portions of the Huntington Beach Central Park and on Huntington Beach publi6 rights -of -way. Mr. Ed Brantley, was present to represent the application. 1 Acting Secretary Lipps informed the applicant of a memo received from the Police Department recommending various officers be provided (at applicant's expense) and that barricades and cones be provided (also at applicant's expense). He further informed the applicant of another memo received from the Department'of Public Works recommend- ing denial of the request due to amount of -impact on major street system, heavy holiday traffic, parade activities along the proposed route, and enforcement and crowd control requirements. Mr. Brantley stated that he had received support from then Mayor Pattinson to help promote the July 4th parade. He further stated that parts of the route would already be barricaded for parade activity. The Board noted, however, that the route of the run far exceeded the parade route and that barricades would have to be provided there. Mel Ott expressed concern over emergency Minutes: H.B. He further stated that a stand-by paramedic unit could not be provided for the runners, however, medical aid would be provided by paramedic units as any other emergency would be handled. The Board suggested that perhaps the run could be confined to the parade route only, or perhaps the route could be further changed. It was suggested to the applicant that he meet with Police Depart- ment and other staff members to work out a suitable route and a solution to the problems listed above. ON MOTION BY LIPPS AND SECOND BY CROSBY SPECIAL EVENT NO. 79-9 WAS CONTINUED TO MAY 16, 1979, BY THE FOLLOWING VOTE: AYES: Lipps, Crosby, Ott NOES: None ABSENT: None SPECIAL EVENT NO. 79-6 (Cont. from 4/18/79) Applicant: Golden West College To permit a 10 kilometer.run on Saturday, May 19, 1979 from 8:30 a.m. to 11:00 a.m. throught the City. The applicant was not present. The Board noted a lack of interest on the applicant's part due to no representation by them. The Board noted substantial problems on the application with recommendations by the Police Department for officers to be provided (at applicant's expense) and that barricades and cones be provided (also at applicant's expense). Traffic problems were also noted and it was agreed by the Board to continue the application for one week to allow applicant to be present at the meeting. Acting Secretary Lipps informed the Board that this application was brought back to the Board for reconsideration of two additional conditions of approval to be imposed on the application, which was originally approved April 18, 1979. ON MOTION BY CROSBY AND SECOND BY OTT TENTATIVE PARCEL MAP NO. 79-563 WAS RECONSIDERED BY THE FOLLOWING VOTE: AYES: Crosby, Ott NOES: None ABSENT: None ABSTAIN: Lipps A MOTION WAS MADE BY CROSBY AND SECONDED BY OTT TO IMPOSE THE FOLLOWING CONDITIONS IN ADDITION TO THE CONDITIONS IMPOSED ON THE TENTATIVE PARCEL MAP ON APRIL 18, 1979. 1. The wall of the building located on the north property line of Parcel #1 shall be constructed to meet current Building and Fire Codes prior to recordation of Tentative Parcel Map No. 79-563.
