Applicant: Abilio Hernandez
To permit the construction of a perimeter wall around a proposed
swimming pool located on the south side of Marina Bay Drive, approxi-
mately 540 feet east of Coral Cay Drive.
This application is a categorical exemption, Class 5, California
Environmental Quality Act, 1970.
The Chairman outlined the proposal to the Board. The public hearing
was opened.
Mrs. Hernandez was present to represent the application and stated
that her request was to seek a variance to permit the erection of
a fence around their swimming pool. She further stated that their
property was located on a private street.
Acting Secretary Lipps noted that due to the fact that the property
was located on a private street, only fifty percent of the length of the
wall would be encroaching.
There being no other parties present to speak on the application,
the public hearing was closed.
Board discussion ensued. Board concurred that a hardship exists
due to lot depth and configuration.

The Chairman opened the public hearings on the two applications.
Mr. Anthony Bartoli was present to represent the application.
Acting Secretary Lipps noted that the two applications were for
10 units each on adjoining lots with a proposed common drive.
Mel Ott expressed concern over proposed cantilever, which he
noted extends too far into the drive. He further noted that
the turnaround in the back of the proposals was not adequate
to accommodate emergency vehicles, and offered a suggestion
that a hammer head at the east end of the common drive may be
utilized. It was agreed between Board and applicant that the
applicant present a revised plan either reflecting a 31 foot
turnaround or a hammer head at the east end of the common drive
to the approval of the Fire Department.
There being no other parties present to speak on the applications,
the public hearing was closed.
Board discussion ensued. Conditions of approval were discussed.
ON MOTION BY CROSBY AND SECOND BY OTT USE PERMIT NO. 79-11 WAS
APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE
FOLLOWING VOTE:
FINDINGS•

a. The general welfare of persons residing or working in the

Plan of the City of Huntington Beach.
3. The proposal is consistent with the City's General Plan of Land
Use.
CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The conceptual plot plan and elevations received April 9, 1979
shall be the approved layout, subject to the modifications
described herein:
a. Revise plan to reflect a minimum 22 foot clear to the sky
access along the common drive.
b. Revise plan to reflect a 31 ft. radius turnaround or a hammer head
at east end of the common drive as required by the Fire
Department.

A plan delineating said modifications shall be submitted
to the Secretary of the Board. If such plan complies
with the modifications outlined by the Board, said plan
shall be approved and made a permanent part of the admini-
strative file.
In its approval action, the Board of Zoning Adjustments considered
the following issues relating to the conceptual plan:
Traffic circulation and drives;
Parking layout;
Lot area;
Lot width and lot depth;
Type of use and its relation to property and improvements in the
immediate vicinity;
Past administrative action regarding this property.
2. The following plan shall be submitted to the Secretary of the
Board.
a. Landsape and irrigation plan complying with Article 979
of the Huntington Beach Ordinance Code and landscaping
specifications on file in the Department of Public Works.
B. GENERAL CONDITIONS:
1. A reciprocal easement agreement providing for the common drive
shall be approved by the Public Works Department and recorded
with Orange County prior to issuance of a certificate of
occupancy.
2. Natural gas and 220V electrical shall be stubbed in at the
location of clothes dryers.
3. Natural gas shall be stubbed in at the locations of cooking
facilities, water heaters, and central heating units.
4. Low volume heads shall be used on all spigots and water
faucets.
5. All building spoils, such as unusable lumber, wire, pipe, and
other surplus or unusable material, shall be disposed of at
an offsite facility equipped to handle them.
6. The structures on the subject property, whether attached or
detached, shall be constructed in compliance with the state
acoustical standares set forth for units that lie within the
60 CNEL contours of the property. Evidence of compliance
shall consist of submittal of an acoustical analysis report,
prepared under the supervision of a person experienced in the
field of acoustical engineering, with the application for
building permits.

7. A detailed soils analysis shall be prepared by a registered
soils engineer. This analysis shall include on -site soil
sampling and laboratory testing of materials to provide
detailed recommendations regarding grading, chemical and
fill properties, foundations, retaining walls, streets, and
utilities.

The Chairman opened the public hearing. Mr. Bartoli was present to
represent the application.
Chairman Crosby stated that the Traffic Engineer had recommended
that the driveway approach at the northeast corner of the site be
widened to a 30 foot radius type or that the applicant obtain a
reciprocal drive agreement with the property to the east, and a
30 foot radius type drive approach on Alabama Street.
The applicant explained the grading and drainage proposal to the
Board. He noted that he proposed drainage to be connected into
the existing drainage system and that he had to follow existing
grade for a proper development.
Acting Secretary Lipps further noted that the plan check revealed
the landscaped area at the northwest corner was too narrow, and
should reflect six foot minimum inside dimension. Type of screening
along Alabama Street was discussed and the applicant was advised
that he could treat that portion with intensified landscaping or
a 32 inch masonry screen wall.
There being no other parties present to speak on the application,
the public hearing was closed.
Board discussion followed. Findings and conditions of approval
were discussed.

b. Revise Plan to show a 32 (thirty-two) inch masonry screen
wall or intensified landscaping along Alabama as required
by Article 979 of the Huntington Beach Ordinance Code.
C. Revise plan to show a minimum six (6) foot inside
dimension landscape area at northwest corner of site.
A plan delineating said modifications shall be submitted to
the Secretary of the Board. If such plan complies with the
modifications outlined by the Board, said plan shall be
approved and made a permanent part of the administrative file.

b. Rooftop mechanical equipment screening plan. Said plan
shall indicate screening of all rooftop mechanical equip-
ment and shall delineate the type of material proposed to
screen said equipment.
B. GENERAL CONDITIONS:
1. Allocation of floor area for commercial -retail uses and office -
professional uses shall be in compliance with parking require-
ments of Article 979.
2. All utility meters to be located along the west or north line of
building.
3. East building wall shall be of maintenance free masonry construct-
ion or a maintenance easement agreement obtained from property
to east prior to issuance of building permits.
4. Natural gas shall be stubbed in at the locations of cooking
facilities, water heaters, and central heating units.
5. Low volume heads shall be used on all spigots and water faucets.
6. All building spoils, such as unusable lumber, wire, pipe, and
other surplus or unusable material, shall be disposed of at
an offsite facility equipped to handle them.
7. If lighting is included in the parking lot, high pressure
sodium vapor lamps shall be used for energy savings. All
outside lighting shall be directed to prevent "spillage"
onto adjacent properties.

of certified mail. Board discussed proposal and found same
to be within ordinance code conformance.
ON MOTION BY CROSBY AND SECOND BY OTT, TENTATIVE PARCEL MAP NO.
79-565 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS,
BY THE FOLLOWING VOTE:
FINDINGS•
1.
The proposed establishment of a legal parcel from an existing
assessors parcel for purposes of existing commercial uses is
in compliance with the size and shape of property necessary
for that type of development.
2.
The General Plan has set forth provisions for this type of land
use as well as setting forth objectives for implementation of
this type of use.

The property was previously studied for this intensity of land

The previous sic (6) Administrative Review applications are covered.by
Environmental'Impact Report No. 73-16, approved by the City Council
on March 18, 1974.
Mr. Gary Schmidt, the applicant was present and submitted revised site
plans to the Board. Secretary Lipps noted that the plans submitted by
Mr. Schmidt had not been plan checked yet. The Board reviewed the
revised plans and noted a discrepancy in parking along the eastern
line of the building. It was noted that the parking spaces along
that line would overhang the landscaping, and the applicant was
told that the ordinance code did not allow for such overhang of
vehicles. Mr. Schmidt proposed that he would rearrange the land-
scaping to keep vehicles from overhanging into the landscaped area.
It was noted that a tentative parcel map was pending before the Board,
and would have to be approved by the Board, otherwise all six
administrative review applications would become void.
The applicant was informed that the water main was to be relocated
to the centerline of drive and a ten foot easement would have to
be provided to the City of Huntington Beach.
Board discussion followed, conditions of approval were discussed.

SPECIAL EVENT NO. 79-10
Applicant: Harbour View School
To permit a school PTO Carnival to be held May 12, 1979 from 10:00 a.m.
to 3:00 p.m. located on the east side of Pickwick Circle, approximately
one block from Heil and Saybrook.
Mrs. Carolyn Noring was present to represent the application.
Board discussed the proposal and reviewed the conditions of approval
with the applicant's representative.

To permit a 10.kilometer run (6.2 miles) to be held June 23, 1979 from
8:00 a.m. to 10:00 a.m. throughout the streets of Huntington Beach.
Mr. Fred Cotrell was present to represent the application and outlined
his proposal to the Board. He stated that the special event did not
necessitate the closing of any streets.
The Board noted that various other runs, now before the Board, had
been continued due to attempting to find a solution to the Police
and Fire Department's requirements of providing officers to block
off streets, the necessity of barriers and cones, these.. -Costs to
be`borne by the applicant. Further, Mel Ott stated that the Fire
Department could not have standby Paramedics available, and stated
that the Fire Department did not wish main response routes to be
blocked.
