BOARD MEMBERS: SPENCER, CROSBY, OTT MINUTES: ON MOTION BY OTT AND SECOND BY CROSBY THE MINUTES OF THE REGULAR MEETING OF MAY 9, 1979, WERE APPROVED AS TRANS- CRIBED, BY THE FOLLOWING VOTE: AYES: Ott, Crosby NOES: None ABSENT: None ABSTAIN: Spencer REGULAR AGENDA ITEMS: TENTATIVE PARCEL MAP NO. 79-568 AADlicant: Dewey Davide To permit the division of one 280' x 130' parcel of land into two separate parcels measuring 1301 x 146.501 and 130, x 133.501, respectively. This application is covered by Negative Declaration No. 79-36. ON MOTION BY SPENCER AND SECOND BY OTT THE BOARD, HAVING FOUND THAT THE PROPOSED PROJECT WILL NOT HAVE A SIGNIFICANT ADVERSE EFFECT ON THE PHYSICAL ENVIRONMENT, ADOPTED NEGATIVE DECLARATION NO. 79-36 WITH THE MITIGATING MEASURES CONTAINED IN TENTATIVE PARCEL MAP NO. 79-568, BY THE FOLLOWING VOTE: AYES: Spencer, Crosby, Ott NOES: None ABSENT: None Mr. Dewey Davide,•the applicant, was present to represent the application, and acknowledged receipt of the suggested conditions of approval through the mail. Board discussed the proposal and found same to be within Ordinance Code Conformance. Board made applicant aware of the necessity of a 20 foot_ radius right -of-._ __ way dedication to the City of Huntington Beach at the southeast corner of Huntington and Clay Streets. A reciprocal access and parking agreement was discussed between Parcel Nos. 1 and 2. Conditions of approval and findings were discussed. ON MOTION BY SPENCER AND SECOND BY CROSBY TENTATIVE PARCEL MAP NO. 79-568 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: Minutes: H.B. Board of Zoning Adjustments Wednesday, May 16, 1979 Page Two FINDINGS• 1. The proposed creation of one (1) parcel into two (2) parcels for purposes of apartment complex is in compliance with the size and shape of property necessary for that type of development. 2. The General Plan has set forth provisions for this type of land use as well as setting forth objectives for implementation of this type of use. 3. The property was previously studied for this intensity of land use at the time the land use designation for medium density residential, which allows apartment buildings, was placed on subject property. 4. The size, depth, frontage, street width, and other design and improvement features of the proposed subdivision are proposed to be constructed in compliance with standard plans and specifi- cations on file with the City as well as in compliance with the State Map Act and supplemental City Subdivision Ordinance. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCELS FOR ANY PURPOSE: 1. The tentative parcel map received by the Planning Department on April 24, 1979, shall be the approved -layout. 2. A parcel map shall be filed with, and approved by, the Department of Public Works, and recorded with the Orange County Recorder. 3. A copy of the recorded parcel map shall be filed with the Planning Department. 4. An irrevocable reciprocal access and parking agreement between Parcel No. 1 and Parcel No. 2 shall be submitted to the Planning Department and recorded with the County of Orange prior to recordation of the tentative parcel map. 5. A twenty (20) foot radius right-of-way shall be dedicated to•the City of Huntington Beach at the southeast corner of Huntington and Clay Streets. Board of Zoning Adjustments Wednesday, May 16, 1979 Page Three TENTATIVE PARCEL MAP NO. 79-570 Applicant: Jack Chalabian To create two (2) parcels from the existing four (4) parcels of land located on the south side of Argosy, approximately 400 feet east of Bolsa Chica Street. This request is covered by EIR 73-16, approved by the City Council on March 18, 1974. The applicant was not present. Chairman Crosby stated that since the applicant was not present to acknowledge receipt of suggested conditions of approval, a con- tinuance was in order to allow the applicant to either be present at the meeting or submit written consent of the suggested conditions of approval. ON MOTION BY CROSBY AND SECOND BY OTT TENTATIVE PARCEL MAP NO. 79-570 WAS CONTINUED TO MAY 23, 1979, BY THE FOLLOWING VOTE: AYES: Spencer, Crosby, Ott NOES: None ABSENT: None PLOT PLAN AMENDMENT NO. 79-3 Applicant: The Robert Warminaton Company To permit the elimination of the traffic circle at entranceways and modifying on -site parking as previously approved. Subject application is a categorical exemption, Class 5, California Environmental Quality Act, 1970. Mr. Kirk Evans was present to represent the application. The public hearing was opened. Mr. Evans presented his proposal to the Board stating that the traffic circle was to be eliminated from the original proposal thus adding better circulation, extna sidewalks, and a better parking arrangement to the plan. Secretary Spencer noted that an adjoining neighbor had requested an eight foot wall to be constructed along their property line, however, Mr. Evans was amenable to the required six _foo__t high wall and said that he was amenable to the property owners adding two additional feet to the wall at their cost. Trash location was discussed. There being no other parties present to speak on the application, the public hearing was closed. Board discussion ensued. Findings for approval were reviewed. Board of Zoning Adjustments Wednesday, May 16, 1979 Page Four ON MOTION BY SPENCER AND SECOND BY CROSBY PLOT PLAN AMENDMENT NO. 79-3 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITION, BY THE FOLLOWING VOTE: CONDITION OF APPROVAL: 1. The plan received and dated April 30, 1979, shall be the approved layout. FINDINGS• 1. The Amendment does not constitute a substantial change. 2.. The proposed use of property remains the same. 3. The dwelling unit density will not be increased. 4. The adjustment results in an improved plan. S. The approval of this amendment does not alter the original approval date. AYES: Spencer, Crosby, Ott NOES: None ABSENT: None CONDITIONAL EXCEPTION NO. 79-17 Applicant: Parkina Company of America To permit use of a temporary parking lot without site improvements as required by Code located at the northwest corner of Beach Boule- vard and Pacific Coast Highway. IN CONJUNCTION WITH: ADMINISTRATIVE REVIEW NO. 79-45 Applicant: Parkina Company of America To permit establishment of a temporary parking lot located at the northwest corner of Beach Boulevard and Pacific Coast Highway. These applications are categorical exemptions, Class 1, California Environmental Quality Act, 1970. Mr. Bob Webb was present to represent the applications. It was noted that the proposals had been previously approved for the summer season 1978. Chairman Crosby noted that the Traffic Department had no comments, however, the Police Department had not yet responded to the application, therefore, it was suggested that the applications be approved with identical conditions imposed upon the proposal in 1978. There being no other parties present to speak on Conditional Except- ion No. 79-17, the public hearing was closed. ON MOTION BY SPENCER AND SECOND BY CROSBY CONDITIONAL EXCEPTION NO. 79-17 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS OF THE BOARD: 1. The property on which the lot is proposed to be located is owned by Cal Trans and is under a 30-day lease to the Parking Company of America. 2. Since the Board has conditioned this use so that the approval shall expire the day after Labor Day, 1979, granting of this conditional exception will not adversely affect the General Plan of the City of Huntington Beach. 3. Granting of the conditional exception will not be materially detri- mental to the public welfare or injurious to property in the same zoning classification: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF PERMITS: 1. The site plan received and dated April 19, 1979, shall be the approved conceptual layout, subject to all conditions imposed on Administrative Review No. 79-45. AYES: Spencer, Crosby, Ott NOES: None ABSENT: None ON MOTION BY SPENCER AND SECOND BY CROSBY ADMINISTRATIVE REVIEW NO. 79-45 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: Minutes: H.B. Board of Zoning Adjustments Wednesday, May 16, 1979 Page Six gMITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF PERMITS: 1. The site plan received and dated April 19, 1979, shall be the approved layout. 2. The project shall comply with all seasonal parking lot standards set forth in the Huntington Beach Ordinance Code. B. GENERAL CONDITIONS: 1. This approval shall terminate the day after Labor Day, 1979. AYES: Spencer, Crosby, Ott NOES: None ABSENT: None MISCELLANEOUS• SPECIAL EVENT NO. 79-9 Applicant: Huntington Valley Sports & Tennis To permit a 10 kilometer run within portions of the Huntington Beach Central Park and on Huntington Beach public -rights -of -way. The applicant was not present. Board discussed the application. It was noted that the Traffic and Police Departments were not in favor of the application due to numerous traffic problems that might occur from such an event. ON MOTION BY SPENCER AND SECOND BY OTT SPECIAL EVENT NO. 79-9 WAS DENIED FOR THE FOLLOWING REASONS, BY THE FOLLOWING VOTE: REASONS FOR DENIAL: ----- -- --- 1. Too great of an impact on major street system, especially on a holiday. 2. There will be Fourth of July parade activities along the proposed route. 3. Shortage of Police manpower due to the events of the day (beach traffic, parade, etc.) would make enforcement and crowd control difficult. 4. Cost estimates for proper Police protection is considered to be too high for taxpayers to bear. Minutes: H.B. AYES: Spencer, Crosby, Ott NOES: None ABSENT: None SPECIAL EVENT NO. 79-13 Applicant: Huntington Beach -Fountain Valley Board of Realtors To permit the closure of Pomona Lane, between Lafayette Dr. and Auburn Drive on May 19, 1979 between the hours of 5:30 p.m. and 9:30 p.m. Mr. Paul Hutton was present to represent the application. Board reviewed the request and noted that no response has been received from the Police Department to date.- however, a condition would be imposed that applicant acquire a clearance from the Huntington Beach Police Department prior to the event. Mel Ott noted some concerns the Fire Department had with the event and suggested they be included as conditions of approval. Board concurred with this request. ON MOTION BY SPENCER AND SECOND BY CROSBY SPECIAL EVENT NO. 79-13 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1 — The plot plan received May 11, 1979, shall be the approved layout. 2. The Fire hydrant will be kept clear. No vehicles or barracade may obstruct its use. 3. One travel lane twelve (12) feet wide will be required along the west side of Pomona Lane. 4. A certificate of insurance form shall be filed in the Finance Department five (5). days prior to the event. 5. A clearance from the Huntington Beach Police Department is required prior to the event. Board of Zoning Adjustments Wednesday, May 16, 1979 Page Eight REVOCATION PROCEEDINGS Proposal to institute revocation of a Home Occupation Permit for Stewart's Concrete Pump, located at 8032 Ebbtide Circle, Huntington Beach. Chairman Crosby noted that the revocation proceedings were heard March 21, 1979 at which time the applicant was given a one month extension of time to correct the violation and bring the Home Occupation Permit within Ordinance Code Conformance. Bob Kirby, Land Use Technician, submitted a photograph of the violation to the Board whereby the violation was still existing on April 30, 1979. ON MOTION BY OTT AND SECOND BY-CROSBY THE HOME OCCUPATION FOR STEWART'S CONCRETE PUMP WAS''REVOKED FOR THE FOLLOWING REASON, BY THE FOLLOWING VOTE: PERMIT REVOKED FOR THE FOLLOWING VIOLATIONS: Concrete pumps, a spreader property and attached to a on the street.
