BOARD MEMBERS: SPENCER, CROSBY, OTT MINUTES: ON MOTION BY SPENCER AND SECOND BY CROSBY THE MINUTES OF THE REGULAR MEETING OF MAY 16, 1979, WERE APPROVED AS TRANS- CRIBED, BY THE FOLLOWING VOTE: AYES: Spencer, Crosby NOES: None ABSENT: Ott REGULAR AGENDA ITEMS: TENTATIVE PARCEL MAP NO. 79-570 Applicant: Jack Chalabian To create two (2) parcels from the existing four (4) parcels of land located on the south side of Argosy, approximately 400 - 1300 feet east of Bolsa Chica Street. This request is covered by EIR 73-16, approved by the City Council on March 18, 1974. Mr. Gary Schmidt was present to represent the application. Secretary Spencer stated that a legal opinion has been requested from the City Attorney's office regarding the legality of private streets in the proposed tract, however, the opinion has not been received from the Attorney's Office to date. Therefore, Secretary Spencer suggested a continuance of the application for two weeks. Board and applicant's representative concurred with the continuance. ON MOTION BY SPENCER AND SECOND BY CROSBY TENTATIVE PARCEL MAP NO. 79-570 WAS CONTINUED TO JUNE 6, 1979 BY THE FOLLOWING VOTE: AYES: Spencer, Crosby, Ott NOES: None ABSENT: None PLOT PLAN AMENDMENT NO. 79-4 Applicant: Frank Woolsey and Charley Hermansen 46 To permit the addition of a parking facility with two tennis courts located on roof of said parking facility located on the southwest corner of Heil Avenue and Green Street. Minutes: H.B. Board of Zoning Adjustments Wednesday, May 23, 1979 Page Two This application is a categorical exemption, Class 3, California Environmental Quality Act, 1970. The application was not represented. Secretary Spencer outlined the proposal to the Board. The public hearing was opened. There being no parties present to speak on the application, the public hearing was closed. Board noted proposal to be within substantial ordinance code con- formance. Findings for approval were discussed. ON MOTION BY SPENCER AND SECOND BY CROSBY PLOT PLAN AMENDMENT NO. 79-4 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. The plan received and dated May 11, 1979, shall be the approved layout. 2. The easterly driveway adjacent to the parking structure shall be increased to a width of 32 feet paved area. FINDINGS: 40 1. The amendment does not constitute a substantial change. 2. The use of the property remains the same. 3. The dwelling unit density will not be increased. 4. The adjustment results in an improved plan. AYES: Spencer, Crosby NOES: None ABSENT: Ott CONDITIONAL EXCEPTION NO. 79-25 Applicant: Donald Moberly To permit a reduction in the minimum dimension for open space located on the east side of Felcliff Lane, at Larkport Drive. This application is a categorical exemption, Class 5, California Environmental Quality Act, 1970. Mrs. Becky Moberly, the applicant was present. Minutes: H.B. Mrs. Moberly addressed the Board and stated that the request for reduction in the minimum dimension for open space was for an addition to their existing residence. Secretary Spencer noted that the remainder of usable open space in the rear yard exceeds 1250 square feet and approximately 561 square feet in the front yard,which far exceeds the minimum require- ments for open space. There being no other parties present to speak on the application, the public hearing was closed. Board discussion ensued. Findings for approval were discussed. ON MOTION BY SPENCER AND SECOND BY CROSBY CONDITIONAL EXCEPTION NO. 79-25 WAS APPROVED WITH THE FOLLOWING CONDITION AND FINDINGS BY THE FOLLOWING VOTE: CONDITION OF APPROVAL: 1. The plan received and dated May 4, 1979, shall be the approved site plan. 0 FINDINGS• 1. Remainder of usable open space in rear yard exceeds 1250 square feet. 2. The proposed addition has no adverse impact on adjoining properties. 3. Approval does not constitute a grant of special privilege. 4. Approval will not be detrimental to the public welfare or in- jurious to property in identical zone classifications. 5. Approval will not adversely affect the City's Master Plan. AYES: Spencer, Crosby, Ott NOES: None ABSENT: None USE PERMIT NO. 79-16 Applicant: Vincent Staaliano To permit the construction of a truck well located on the northwest corner of Manufacture Lane and System Drive. This application is covered by EIR 73-16, approved by the City Council March 18, 1974. Minutes: H.B. Secretary Spencer noted that the proposal is for a truck well of a previously approved industrial building. He further noted that the plan was within substantial ordinance code conformance. There being no parties present to speak on the application, the public hearing was closed. Findings and conditions of approval were discussed. ON MOTION BY CROSBY AND SECOND BY SPENCER, USE PERMIT NO. 79-16 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS• 1. The establishment, maintenance, and operation of the use will not be detrimental to: a. The general vicinity of persons residing or working in the vicinity; . b. Property and improvements in the vicinity of such use or building. 2. The granting of a Use Permit will not adversely affect the Master Plan of the City of Huntington Beach. 3. The proposal is consistent with the City's General Plan of Land Use. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received May 4, 1979, shall be the approved layout. 2. The loading facility shall be set back a minimum of forty-five (45) feet from the right-of-way line. 3. The loading facility shall not exceed a maximum width of twenty (20) feet. 4. The loading facility shall be located within a fully enclosed structure, screened from view, with doors of a color compatibles with the main building. Minutes: H.B. Adequate area shall be provided for the safe operation of trucks in loading areas. 7. Trucking areas shall be adequately paved for the type of operation intended. To create four (4) parcels and a residual parcel out of one parcel of land located on the south side of Slater Avenue, west of the centerline extension of Nichols Street. IN CONJUNCTION WITH: CONDITIONAL EXCEPTION NO. 79-19 Applicant: RMG Engineering, Inc. • To permit a reduction in building setback from five (5) feet to zero (0) feet adjacent to a 25 ft. waterline easement located on the south side of Slater Avenue, west of the centerline extension of Nichols Street. To permit the construction of a 9,946 square foot industrial building located on the south side of Slater Avenue, approximately 1000 feet east of Gothard Street. IN CONJUNCTION WITH: CONDITIONAL EXCEPTION NO. 79-21 Applicant: RMG Engineering, Inc. To permit a reduction in building setback from 5 feet to 0 feet adjacent to a 25 ft. waterline easement located on the south side of Slater Avenue, west of the centerline of Nichols Street. IN CONJUNCTION WITH: ADMINISTRATIVE REVIEW NO. 79-48 Applicant: Family Home Builders, Inc. To permit the construction of a 14,315 square foot industrial building located on the south side of Slater Avenue, approximately 1000 feet east of Gothard Street. IN CONJUNCTION WITH: ADMINISTRATIVE REVIEW NO. 79-46 Applicant: Family Home Builders, Inc. To permit the construction of a 10,339; square foot light industrial building located on the south side of Slater Avenue, approximately 1000 feet east of Gothard Street. IN CONJUNCTION WITH: ADMINISTRATIVE REVIEW NO. 79-35 Applicant: Family Home Builders, Inc. To permit the construction of a 12,937 square foot industrial building located on the south side of Slater Avenue, approximately 1000 feet east of Gothard Street. These applications are covered by Negative Declaration No. 79-35. Secretary Spencer suggested that the above applications be continued to the June 6, 1979 meeting to allow Tentative Tract Map 9921X to be heard by the Planning Commission (these buildings are all proposed within said tract). Minutes: H.B. Board of Zoning Adjustments Wednesday, May 23, 1979 Page Eight Mr. W. L. Hamm was present at the meeting and cited concern over the building of a retaining wall on his property. He further stated that RMG, Inc. had contacted him to install a retaining wall on his property to retain a seven foot elevation difference. Mr. Hamm cited opposition to RMG's proposal. Chairman Crosby informed Mr. Hamm that his concerns would be addressed at the Planning Commission meeting when Tentative Tract 9921X would come before the Commission for hearing.
