BOARD MEMBERS PRESENT: Lipps, Renna, Burney REGULAR'AGENDA ITEMS: ADMINISTRATIVE REVIEW NO. 79-58 Applicant: John P. Sweeny To permit the construction of an industrial building located on the northeast corner of Bolsa Chica and Argosy Ave. This application is covered by EIR 73-16, approved by the City Council on March 18, 1974. Mr. Sweeny, the applicant, was prisent. Acting Secretary Lipps outlined the proposal to the Board. Circulation was discussed and it was agreed between the Board and the applicant that an irrevocable reciprocal access agreement with adjacent parcel be obtained to eliminate possible future circulation problems. The applicant was also made aware of the requirement for an increased drive approach to 30 foot radius type. Deletion of sidewalk along Argosy was discussed as well as landscaping requirements. Conditions of approval were discussed between applicant and Board members. ON MOTION BY RENNA AND SECOND BY LIPPS ADMINISTRATIVE REVIEW NO. 79-58 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received May 29, 1979, shall be the approved:layout, subject to the modifications described herein: a. Provide 30 foot minimum drive radius type approach on Argosy. b. Revise plot plan to show correct dimension to centerline of streets, deletion of sidewalk, and the required 15 foot landscaped area. If such plan complies with the modifi- cations outlined by the Board, said plan shall be approved and made a permanent part of the administrative file. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: Traffic circulation and drives; Parking layout; Lot area; Lot width and lot depth; Type of use and its relation to property and improvements in the immediate vicinity; Past administrative action regarding this property.. 2. The following plans shall be submitted to the Secretary of the Board: a. Landscape and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code and landscaping specifications on file in the Department of Public Works. b. Rooftop mechanical equipment screening plan. Said plan shall indicate screening of all rooftop mechanical equip- ment and shall delineate the type of material proposed to screen said equipment. B. GENERAL CONDITIONS: 1. Applicant shall obtain irrevocable reciprocal access agreement with adjacent parcel. Said agreement shall be approved by the Planning Department prior to issuance of Building Permits and recorded with the County prior to issuance of Certificate of Occupancy. 2. An Administrative Review shall be approved by the Board of Zoning Adjustments on Parcel 41 prior to issuance of Building Permits. AYES: Lipps, Renna, Burney NOES: None ABSENT: None CONDITIONAL EXCEPTION NO. 79-29 Applicant: Anthony Boles To permit a reduction from the required five foot setback to a three foot setback for the accessway at garage located on the west side of Alabama Street, approximately 100 ft. south of Knoxville Avenue. 1 Minutes: H.B. Board of Zoning Adjustments Wednesday, June 13,.1979 Page Three This application is a categorical exemption, class 5, California Environmental Quality Act, 1970. Mr. Tom Wickstrom was present to represent the application. The public hearing was opened. Acting Secretary Lipps outlined the proposal to the Board. He noted that the intent of the code section (in which this application is in violation of) was intended to allow furniture to be moved easily in and out of the dwelling. However, the code was designed to apply to lots with alley access. The possibility of zero lot line construction was also discussed, however, was not found feasi- ble in this case. There being no other parties present to speak on the application, the public hearing was closed. Board discussion ensued. Acting Secretary Lipps also noted that a previous conditional exception has been granted for similar circumstances, thus establishing a precedent for this type of con- struction. Findings and conditions of approval were discussed. ON 'MOTION BY LIPPS AND SECOND BY RENNA CONDITIONAL EXCEPTION NO. 79- 29 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS• 1. A hardship exists upon the subject property because the Ordinance Code was structured to apply to lots with alley access. 2. A precedent for this exception has been established by approval of Conditional Exception No. 78-27 upon an identically situated property. 3. The access provided by the applicant meets the intent of the code provision from which he seeks exception. 4. Standard findings as set out in Section 9811.1.1 of the Huntington Beach Ordinance Code. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received May 25, 1979, shall be the approved layout, subject to the modifications described herein: a. Revise floor plan to provide a minimum three (3) foot door from garage to area adjacent to entry of family room. Minutes: H.B. If such plan complies with the modifications outlined by the Board, said plan shall be approved and made a permanent part of the administrative file. AYES: Lipps, Renna, Burney NOES: None ABSENT: None MISCELLANEOUS• ADMINISTRATIVE REVIEW NO. 79-62 Applicant: Ruth Ann Chase To permit the sale of cherries until July 1, 1979 located at the north- west corner of Gothard Street and Garfield Avenue. This application is a categorical exemption, Class 5, California Environ- mental Quality Act, 1970. The applicant was not present. Board reviewed the application and found same to be within ordinance code conformance. Conditions of approval were discussed. ON MOTION BY LIPPS AND SECOND BY BURNEY ADMINISTRATIVE REVIEW NO. 79- 62 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. The plot plan received June 7, 1979 shall be the approved layout. 2. The applicant shall obtain all necessary electrical permits (if applicable). 3. An on -site inspection by the Fire Department shall be required prior to the event. 4. A certificate of insurance form shall be filed in the Finance Department five days prior to the event. 5. Tobin To permit the construction of a single family dwelling with maid's quarters located on the west side of Tenth Street, approximately 50 feet south of Walnut Avenue. IN CONJUNCTION WITH: ADMINISTRATIVE REVIEW NO. 79-54 Applicant: Harold E. Tobin To permit the construction of a single family dwelling with maid's quarters located on the west side of Tenth Street, approximately 112.5 feet south of Walnut Avenue. IN CONJUNCTION WITH: ADMINISTRATIVE REVIEW NO. 79-55 Applicant: Harold E. Tobin To permit the construction of a single family dwelling with maid's quarters located on the west side of Tenth Street, south of Walnut Avenue. These applications are a categorical exemption, class 3, California Environmental Quality Act, 1970. The applicant was not present. Board reviewed the proposals. Acting Secretary Lipps stated that these proposals meet the development standards of two unit develop- ments within the City of Huntington Beach. However, he further stated that the request by the applicant for a single family dwelling with maid's quarters is not permitted by the Ordinance Code and that the Board of Zoning Adjustments views the proposed development as a two unit apartment building. Conditions of approval were discussed. ON MOTION BY LIPPS AND SECOND BY BURNEY ADMINISTRATIVE REVIEW NO. 79-53 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received May 18, 1979 shall be the approved layout. Minutes: H.B. The applicant shall acknowledge in written form to the Secretary of the Board, that this approval has not been granted for a development as described on the Administrative Review Application, but has been viewed as two attached dwelling units by the Board in compliance with Article 923 of the Huntington Beach Ordinance Code. AYES: Lipps, Renna, Burney NOES: None ABSENT: None ON MOTION BY LIPPS AND SECOND BY BURNEY ADMINISTRATIVE REVIEW NO. 79-54 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received 171ay 18, 1979 shall be the approved layout. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: Traffic circulation and drives; Parking layout; Lot area; Lot width and lot depth; Type of use and its relation to property and improvements in the immediate vicinity; Past administrative action regarding this property. B. GENERAL CONDITIONS: 1. The applicant shall acknowledge in written form to the Secretary of the Board, that this approval has not been granted for a development as described on the Administrative Review Application, but has been viewed as two attached dwelling units by the Board in compliance with Article 923 of the Huntington Beach Ordinance Code. AYES: Lipps, Renna, Burney NOES: None ABSENT: None ADMINISTRATIVE REVIEW NO. 79-44, - REVOCATION OF APPROVAL: Applicant: Parking Co. of America To permit the establishment of a temporary commercial parking lot located at the northeast corner of Pacific Coast Highway and Newland Street. IN CONJUNCTION WITH: Minutes: H.B. Board of Zoning Adjustments Wednesday, June 13, 1979 Page Eight CONDITIONAL EXCEPTION NO. 79-18 - REVOCATION OF APPROVAL: Applicant: Patkina Co. of America To permit use of a parking lot without site improvements as required by Code located at the northeast corner of Pacific Coast Highway and Newland Street. These applications are categorically exempt, class 1, California Environmental Quality Act, 1970. Mr. Chavez was present to represent the applications. Acting Secretary Lipps briefly explained the reason for revocation proceedings as being that the applicant has not complied with conditions of approval as outlined by the Board at its meeting of May 9, 1979. Specifically, Mr. Lipps stated that posts and cable with reflectors have not been provided and also the entry off Newland has not been repaired, thus allowing vehicles entering off Newland to crowd onto one side (where entry is somewhat smoother) and thereby causing traffic and safety problems. The public hearing was opened. Mr. Chavez addressed the Board and agreed that the ropes he was utilizing were not working very well, and agreed to replace them with cable and reflectors. He also stated that he would smooth out the entry off of Newland Street. Lt. Patton from the Police Department was present and stated that his department was concerned with safety aspects of the subject parking lot. He stated cable and reflectors were necessary and suggested that the Board leave the final approval up to his depart- ment as to type of posts and reflectors to be utilized. He also commented on the poor condition of the entryway off of Newland and requested it be repaired. Acting Secretary Lipps recommended that the applications be revoked with modifications until such time that all conditions of approval as set forth at the May 9, 1979 meeting plus an additional condition that type of fencing and amount and locations of required reflectors on cables and posts be to the approval of the Traffic Commander of the Huntington Beach Police Department. Board concurred with Mr. Lipps' recommendation. The public hearing was closed. ON MOTION BY BURNEY AND SECOND BY LIPPS ADMINISTRATIVE REVIEW NO. 79-44 AND CONDITIONAL EXCEPTION NO. 79-18 WERE REVOKED WITH THE FOL- LOWING MODIFICATION AND ADDITIONAL CONDITION OF APPROVAL AS FOLLOWS: Minutes: H.B. Board of Zoning Adjustments Wednesday, June 13, 1979 Page Nine The application has been revoked with modifications as follows: 1. The application has been revoked until all conditions of approval as set out by the Board of Zoning Adjustments in its approval of May 9, 1979 have been complied with and operation of said approval shall cease immediately until those conditions are met. In addition, the applicant shall -comply with the following: 1. Type of fencing and amount and locations of required reflectors on cables and posts shall be to the approval of the Traffic Commander of the Huntington Beach Police Department. Upon completion of the above conditions, applicant will be allowed to operate as set forth by the original approval,of Administrative Review No. 79-44 and Conditional Exception No. 79-18 dated May 9, 1979. AYES: Lipps, Renna, Burney NOES: None ABSENT: None Furthermore, the applicant of Administrative Review No. 79-44 and Conditional Exception No. 79-18 was admonished that continuance of operation without full compliance of conditions of approval would constitute a misdemeanor and require appropriate action by the City.
