CONDITIONAL EXCEPTION NO. 79-31 (Continued from June 27, 1979)
Applicant: Richard E. Jimenez
To permit an encroachment of six inches along the west property
line setback and an encroachment of twelve inches along the east
property line setback. Subject property is located on the south
side of Talbert Avenue, approximately 1,230 feet west of Beach
Boulevard.
This application is a categorical exemption Class 5, California
Environmental Quality Act, 1970.
Chairman Lipps opened the public hearing. The applicant was present
and explained the situation with the precisely aligned street
adjacent to the project site which necessitated the filing of a
conditional exception. Mr. Lipps informed that the project was
previously approved prior to the detection that the proposed street
required additional setbacks. The applicant desires to use the
plans and tailor them to fit the site.
Discussion followed on the possibility of moving the buildings to
the east, providing 450 angle parking, and need for the wall
abutting the residential property. Also, discussion ensued on the
access from Talbert and increasing the driveway approaches to a
30' radius type.

FINDINGS:
1. The encroachment will occur at the rear property line only a
distance of two (2) feet, which limits it to a 4.5% deficiency.
2. The applicant qualifies for approval of this Conditional Exception
request due to the fact that the property is specially circum-
stanced by the alignment of the street immediately adjacent to the
westerly property line of said parcel and the disproportionate
amount of dedication mandated by Specific Plan of Street Alignment
No. 73-1 and by the delay of notification to the applicant of this
requirement.
CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The conceptual plot plan and elevations received June 11, 1979, shall
be the approved layout subject to the modifications described
herein:
a. 26 foot setback along northerly property line.
b. If feasible, revise parking layout along easterly property
line to 450 angle to accommodate area for required wall and
additional one foot encroachment.
C. If feasible, revise plan to provide 15 foot setback along
westerly property line.
A plan delineating said modifications shall be submitted to
the.Secretary of the Board. If such plan complies with the
modifications outlined by the Board, said plan shall be approved
and made a permanent part of the administrative file.
In its approval action, the Board of Zoning Adjustments considered
the following issues relating to the conceptual plan:
Traffic circulation and drives;
Parking layout;
. Lot area;
Lot width and lot depth;
. Type of use and its relation to property and improvements in the
immediate vicinity;
. Past administrative action regarding this property.
2. The following plans shall be submitted to the Secretary of the
Board:
a. Landscape and irrigation plan complying with Article 979 of
the Huntington Beach Ordinance Code and landscaping specifi-
cations on file in the Department of Public Works.

b. Rooftop mechanical equipment screening plan. Said plan shall
indicate screening of all rooftop mechanical equipment and
shall delineate the type of material proposed to screen
said equipment.
B. GENERAL CONDITIONS:
1. Increase all drive approaches to 30 foot radius type.
2. Ingress and egress to Talbert Avenue to be approved by the
Traffic Division of the Public Works Department.
3. Right Turn Only sign to be posted at the exit from parking lot
onto Talbert Avenue.
4. No parking on Talbert Avenue.

(1) -To allow a minimum dimension of ten feet rather than 15 feet and

To permit the construction of a single family dwelling. Subject property
is located 60 feet from the northwest intersection of Florida and
Geneva Avenue.
These applications are categorical exemptions, Class 5, California
Environmental Quality Act, 1970.
Mr. Lipps opened the public hearing. The applicant was present and
referred to notes he submitted regarding his application. There being
no further comments, -the hearing was closed.

FINDINGS:
1. The granting of the Conditional Exception will not constitute a
grant of a special privilege inconsistent upon other properties in
the vicinity and under an identical zone classification.
2. -Because of special circumstances applicable to the subject property,
including size, shape, topography, location, or surroundings, the
strict application of the zoning ordinance is found to deprive the
subject -property of privileges enjoyed by other properties in the
vicinity and under identical zone classifications.
3. The granting of a Conditional Exception is necessary in order to
preserve the enjoyment of one or more substantial property rights.
4. The - granting of a Conditional Exception will not be materially
detrimental to the public welfare, or injurious to property in the
same zone -classifications.
5. The granting of the Conditional Exception will not adversely affect
the General Plan of the City of Huntington Beach.
CONDITIONS OF APPROVAL:
1. The•revised-conceptual plot plan and elevations received May 4, 1979,
shall be the approved layout.
In its approval action, the Board of Zoning -Adjustments considered
the following issues relating to the conceptual plan:
• Traffic circulation and drives;
• Parking layout;
• Lot area;
. Lot width and lot depth;
. Type of use and its relation to property and improvements in the
immediate vicinity;
. Past administrative action regarding this property.

WITH THE FOLLOWING FINDINGS AND CONDITIONS BY THE FOLLOWING VOTE:
FINDINGS:
1. The establishment, maintenance, and operation of the use will not
be detrimental to:
a. The general welfare of persons residing or working in the
vicinity;
b. Property and improvements in the vicinity of such use or
buidling.
2. The granting of a Use Permit will not adversely affect the General
Plan of the City of Huntington Beach.
3. The proposal is consistent with the City's General.Plan of Land Use.
CONDITIONS OF APPROVAL:
1. The revised conceptual plot plan and elevations received May 4, 1979,
shall be the approved layout.

PLOT PLAN AMENDMENT NO. 79-5
Applicant: West Coast Soccer League
To permit a plot plan amendment requesting the use of aluminum awning
cover instead of nylon screen cover. Subject property is located on
the north side of Center Drive, approximately-150 feet east of Gothard
Street (Unit 49). This application is covered by Negative Declaration
No. 75-68, previously approved.
The public hearing was opened and closed since there were no comments
from the applicant, Joe Bischof, or anyone else present.
Board discussion determined that there were no significant changes.

WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS BY THE FOLLOWING

FINDINGS:
1. The amendment does not constitute a substantial change.
2. The proposed use of, the property remains the same.
3. The dwelling unit density has not been increased.
4. The adjustment results in an improved plan.
CONDITIONS OF APPROVAL:
1. -The conceptual plot plan and elevations recieved June 19, 1979,
shall be the approved layout.
2. The amount of covering shall not exceed that covered by the
original nylon cover.

To permit a 119" encroachment into the front Yard setback. Subject
property, is located on the north side of Quail Circle, approximately
420 feet west of Bluebird Lane. This application is a categorical
exemption class 5', California Environmental Quality Act, 1970.
The public hearing was opened. The applicant was present to answer
any questions the Board might have. Discussion followed on the minor
encroachment of 14 square feet. The public hearing was closed.

OTION BY RENNA AND SECOND BY LIPPS CONDITIONAL EXCEPTION NO. 79-32
WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITION BY THE FOLLOWING
VOTE:
FINDINGS:
1. The structure extends into the front yard setback an average of
approximately 6" along ten feet of the face of the building
amounting to approximately 14 square feet of encroachment in an
area where the lot depth is less than 81 feet.
2. Because of the unique configuration and depth of this lot, the
applicant is deprived of parity with other properties in the vicinity.
3. The granting of the Conditional Exception will not constitute a
grant of special privilege inconsistent upon other properties in the
vicinity and under an identical zone classification.
4. The granting of a Conditional Exception is necessary in order to
preserve the enjoyment of one or more substantial property rights.
The granting of a Conditional Exception will not be materially
detrimental to the public welfare, or injurious to property in the

Applicant: Robert Chaurria
To permit a grand opening on July 7, 1979, between the hours of 12:00
and 5:30 p.m. at 8871 Adams Avenue.
The Board was concerned with the proposal in that it encroaches into
the roadway. After much discussion the Board agreed that if the applicant
vises the plot plan to meet Fire Department approval, the special event
uld be approved.

1. The plot plan received July 5, 1979, shall be revised to meet
Fire Department approval.
2.- The applicant shall obtain all necessary electrical permits.
3. An on -site inspection by the Fire Department shall be required prior
to the event.

FINAL TRACT 9438 Siting Plan
Applicant: The Stringer Company
As a condition of approval for Tentative Tract 9438 the Board of Zoning
Adjustments reviewed the precise plot plan prior to issuance of building
permits.
ON MOTION BY LIPPS AND SECOND BY RENNA FINAL TRACT 9438 SITING PLAN WAS
APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING VOTE:
CONDITIONS:
1. The precise site plan received and dated June 12, 1979, shall
be the approved layout.
2. The proposed project shall conform to the conditions of Tentative
Tract 5419.
3. The proposed project shall meet all requirements of the Huntington
Beach Ordinance Code.
