BOARD MEMBERS PRESENT: Lipps, Crosby, Ott OTHER'S PRESENT: Renna MINUTES: ON MOTION BY LIPPS AND SECOND BY RENNA THE MINUTES OF THE REGULAR MEETING OF JULY 5, 1979, WERE APPROVED AS TRANSCRIBED, BY THE FOLLOWING VOTE: AYES: Lipps, Renna NOES: None ABSENT: None ABSTAIN: Crosby, Ott REGULAR AGENDA ITEMS: USE PERMIT NO. 79-23 (Cont. from 7/11/79) Applicant: A. W. Chapman To permit a truck loading facility to face a public street located on the north side of Commercial Drive, approximately 100 feet east of Chemical Lane. IN CONJUNCTION WITH: ADMINISTRATIVE REVIEW NO. 79-67 (Cont. from 7/11/79) Applicant: A. W. Chapman To permit the construction of an 11,438 square foot industrial building located on the north side of Commercial Drive, approximately 100 feet east of Chemical Lane. These requests are covered by EIR 73-16, adopted by the City Council on March 18, 1974. Mr. Chapman, the applicant, was present. The Chairman outlined the proposals to the Board. The public hearing was opened on Use Permit No. 79-23. The applicant noted that the proposed truck well was located on a painted area inside the proposed building. The public hearing was closed. Board of Zoning Adjustments Wednesday, July 18, 1979 Page Two Acting Secretary Lipps informed the applicant that code requires that the proposed loading area was to be kept free of storage. The Board addressed itself to the Administrative Review request. The Board discussed a cutout to the proposed building and informed the applicant that the building would have to be constructed at either zero or 15 foot setback, that portions cannot be at zero and portions at 15 feet. The applicant indicated that this area was proposed for storage and that it was intended to be utilized with a future building adjacent to the proposal, since the adjacent property was owned by the same party. Furthermore, the Board found the proposals to be within ordinance code conformance. Conditions of approval and findings for approval for the use permit was discussed. ON MOTION BY LIPPS AND SECOND BY CROSBY USE PERMIT NO. 79-23 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS• 1. The establishment, maintenance, and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2:, The granting of a Use Permit will not adversely affect the Master Plan of the City of Huntington Beach. 3., The proposal is consistent with the City's General Plan of Land Use. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received June 21, 1979, shall be the approved layout. B. GENERAL CONDITIONS: 1. Loading zone as shown on plot and floor plan shall be striped with yellow paint to indicate loading area only and be kept free of any storage. Minutes: H.B. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received June 21, 1979, shall be the approved layout, subject to the modifications described herein: a. Revise plan to reflect compliance with setbacks for the district. A plan delineating said modifications shall be submitted to the Secretary of the Board. If such plan complies with the modifications outlined by the Board, said plan shall be approved and made a permanent part of the administrative file. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: Traffic circulation and drives; Parking layout; Lot arLaa; Lot width and lot depth; Type of use and its relation to property and improvements in the immediate vicinity; Past administrative action regarding this property. 2. The following plans shall be submitted to the Secretary of the Board: a. Landscape and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code and landscaping specifications on file in the Department of Public Works. b. Rooftop mechanical equipment screening plan. Said plan shall indicate screening of all rooftop mechanical equip- ment and shall delineate the type of material proposed to screen said equipment. Wonacott To permit the construction of a 19,331 square foot office/professional building located at the southeast corner of Warner Avenue and Leslie Lane. This request is -covered by Negative Declaration No. 79-50. ON,MOTION BY CROSBY AND SECOND BY OTT THE BOARD, HAVING FOUND THAT THE PROPOSED PROJECT WILL_NOT HAVE A SIGNIFICANT ADVERSE EFFECT - ON THE PHYSICAL ENVIRONMENT, ADOPTED NEGATIVE DECLARATION NO. 79-50 WITH THE MITIGATING MEASURES CONTAINED IN ADMINISTRATIVE REVIEW NO. 79-65 CONDITIONS B-3 THROUGH B-10, BY THE FOLLOWING VOTE: AYES: Lipps,-Crosby, Ott NOES: None ABSENT: -None Mr. Bill Wonacott, the applicant, was present to represent his application.- Acting Secretary Lipps outlined the proposal to the Board and stated that.a preliminary plan check revealed the pro- posal to be within substantial Ordinance Code conformance. The Board had stated some concern over existing grade differential, however, Mr. Wonacott stated that retaining walls would be constructed to provide adequate drainage and that accurate dimensions would be reflected on the grading plan. ON MOTION BY CROSBY AND SECOND BY LIPPS ADMINISTRATIVE REVIEW NO. 79-65 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received June 20, 1979 shall be the approved layout. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: Traffic circulation and drives; Parking layout; Lot area; Lot width and lot depth; Type of use and its relation to property and improvements in the immediate vicinity; Past administrative action regarding this property. Landscape and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code and landscaping specifications on file in the Department of Public Works. b. Rooftop mechanical equipment screening plan. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment. C. Revise Plan to show dimensions to centerline of streets prior to issuance of Building Permits. d. Heights and location of all walls shall be approved by the Secretary of the Board prior to issuance of Building Permits. B. GENERAL CONDITIONS: 1. The conceptual approval includes the building location, size, and configuration, parking layout and landscaped areas only and shall not be construed as approval of any grading, filling, or drainage system contemplated or subsequently proposed by the developer. 2. The office uses shall be limited to non -medical type. 3. Natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 4. Low volume heads shall be used on all indoor spigots. 5. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 6. If lighting is included in the parking lot, energy efficient lamps shall be used (e.g. high pressure sodium vapor, metal halide). All outside lighting shall be directed to prevent "spillage" onto adjacent properties. 7. A detailed soils analysis shall be prepared by a registered soils engineer. This analysis shall include on -site soil sampling and laboratory testing of materials to provide detailed recommendations regarding grading, chemical and fill properties, foundations, retaining walls, streets, and utilities. An engineering geologist shall be engaged to submit a report indicating the ground surface acceleration from earth movement for the subject property. All structures within this develop- ment shall be constructed in compliance with the g-factors as indicated by the geologist's report. Calculations for footings and structural members to withstand anticipated g-factors shall be submitted to the City for review prior to the issuance of Building Permits. 9. A plan for silt control for all storm runoff from the property during construction and during initial operation of the project shall be submitted to the California Regional Water Quality Control Board staff for their review prior to the issuance of grading permits. 10. Prior to approval of a grading permit the project developer shall provide written evidence to the director of Development Services that a qualified archaeologist has conducted all necessary subsurface testing and analysis and reporting of property's archaeological deposites to determine depth, nature, and extent of the deposites. If further mitigation is determined necessary it shall be carried out prior to grading in a manner satisfactory to the Director of Develop- ment Services. This request is covered by Negative Declaration No. 79-49. ON MOTION BY CROSBY AND SECOND BY LIPPS THE BOARD, HAVING FOUND THAT THE PROPOSED PROJECT WILL NOT HAVE A SIGNIFICANT ADVERSE EFFECT ON THE PHYSICAL ENVIRONMENT, ADOPTED NEGATIVE DECLARATION NO. 79-49 WITH THE MITIGATING MEASURES CONTAINED IN ADMINISTRATIVE REVIEW NO. 79-69 CONDITIONS B-2 THROUGH B-9, BY THE FOLLOWING VOTE: AYES: Lipps, Crosby, Ott NOES: None ABSENT: None Minutes: H.B. Acting Secretary Lipps stated that a preliminary plan check revealed the plan to be within substantial ordinance code conformance. Chairman Crosby noted two drives entering the building to be somewhat unusual and explained to the applicant that these drives would be to the approval of the Traffic Engineer. Conditions of approval were discussed. ON MOTION BY CROSBY AND SECOND BY OTT ADMINISTRATIVE REVIEW NO. 79-69 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received June 28, 1979, shall be the approved layout. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: Traffic circulation and drives; Parking layout; Lot area; Lot width and lot depth; Type of use and its relation to property and improvements in the immediate vicinity; Past administrative action regarding this property. 2. The following plans shall be submitted to the Secretary of the Board: a. Landscape and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code and landscaping specifications on file in the Department of Public Works. b. Rooftop mechanical equipment screening plan. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment. C. The driveway approach at the northeast corner of the property shall be a minimum of thirty (30) feet in width, radius type, according to standard plan 212(a)(b).
