Applicant: The Huntington Partnership
To permit the expansion and amendment to an existing retail center
and marina located on the east side of Pacific Coast Highway, approxi-
mately 660 feet southeast of Anderson Street.
This request is covered by Negative Declaration No; 79-54.
ON MOTION BY LIPPS AND SECOND BY CROSBY THE BOARD, HAVING FOUND
THAT THE PROPOSED PROJECT WILL NOT HAVE A SIGNIFICANT ADVERSE
EFFECT ON THE PHYSICAL ENVIRONMENT, ADOPTED NEGATIVE DECLARATION
NO. 79-54 WITH THE MITIGATING MEASURES CONTAINED IN USE PERMIT
NO. 79-25 GENERAL CONDITIONS B-5 THROUGH B-10 IMPOSED ON THE
USE PERMIT APPLICATION, BY THE FOLLOWING VOTE:

Mr. John Cope was present to represent the application. Chairman
Crosby outlined the proposal to the Board. The public hearing was
opened.
Mr. Cope submitted a letter to the Board in which he stated he had
outlined the four elements of the proposed amendment, as being (1)
the addition of a banking drive-thru teller facility; (2) architectural
block outs for additional retail/office square footages of 20,000
square feet on Area D, and 25,000 square feet on Area E; (3) The
plotting of the new Anderson Street alignment as presently approved
by both the City and Cal Trans; and (4) an expansion of the marina
by 81 additional slips.

Mr. Cope further stated that he had met with Planning Staff to
discuss the justification of joint use production. He added that
the parking need .for the addition is almost totally nighttime
and weekend parking which does not conflict with the financial
institutions or the office users during the day. In summation,
Mr. Cope stated that the marina parking needs are 213 spaces
which will be"offset by the fact -that The Huntington Partnership
has entered into legal agreements with both Broadmoor Homes, Inc.
and Continental Development which, when combined, are building
289 residential units, and added that these agreements provide
for a first right of refusal for each condo owner. Based on
existing percentages of 40 percent capture rate, these agreements
will reduce the marina parking by 116 spaces.
Bruce Crosby noted concern over possibility of marina intruding
into the channel thereby establishing a pier head line.. Mr. Cope
stated that the proposal has received verbal approval from the
Corps of Engineers, City of Seal Beach, and the County and that
proposed utility lines are proposed to be broughtthrough the
condominiums to the south.
There being no other parties present to speak on the application,
the public hearing was closed.
Board discussed proposal and cited findings and conditions of
approval.
ON MOTION BY LIPPS AND SECOND BY CROSBY USE PERMIT NO. 79-25 WAS
APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOL -
LOWING VOTE:
FINDINGS•
1. The establishment, maintenance, and operation of the use will not
be detrimental to:
a. The general welfare of persons residing or working in the
vicinity; ,
b. Property and improvements in the vicinity of such use or
building.
2. The granting of a Use Permit will not adversely affect the General
Plan of the City of Huntington Beach.
3. -The proposal is consistent with the City's General Plan of Land Use.

CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The conceptual plot plan received and dated June 29, 1979,
shall be the approved layout, subject to the modifications
described herein:
a. Applicant shall submit elevations and floor plans to
the Secretary of the Board.
A plan delineating said modifications shall be submitted to
the Secretary of the Board. If such plan complies with the
modifications outlined by the Board, said plan shall be
approved and made a permanent part of the administrative file.
In its approval action, the Board of Zoning Adjustments considered
the following issues relating to the conceptual plan:
Traffic circulation and drives;
Parking layout;
Lot area;
Lot width and lot depth;
Type of use and its relation to property and improvements in the
immediate vicinity;
Past administrative action regarding this property.
2. The following plans shall be submitted to the Secretary of
the Board:
a. Landscape and irrigation plan complying with Article 979
of the Huntington Beach Ordinance Code and landscaping
specifications on file in the Department of Public Works
for new or modified landscaping only.
b. Rooftop mechanical equipment screening plan. Said plan
shall indicate screening of all rooftop mechanical equipment
and shall delineate the type of material proposed to screen
said equipment.
B. GENERAL CONDITIONS:
1. The parties concerned in the joint use of the off-street parking
facility shall evidence an agreement for such joint use by a
proper legal instrument approved by the City Attorney as to form
and content,recorded with the Orange County Recorder, and a copy
filed with the Department of Development Services.
2. The parking reduction shall meet all requirements of Section
9794.1 of the Huntington Beach Ordinance Code.
3. The reduction in parking shall not -exceed twenty-seven (27)
percent.

4. The marina meet - all- requirements' -of the Public -Works Department
of the City of Huntington Beach.
5. Natural gas shall be stubbed in at the locations of cooking
facilities, water heaters, and central heating units.
6. Low volume heads shall be used on all indoor spigots.
7. All building spoils, such as unusable lumber, wire, pipe, and
other surplus" or unusable mate•rlal;`'``shall be disposed of at
an offsite facility equipped to handle them.
8.." If lighting is included in the parking lot, energy efficient
lamps shall be used (e.g. high pressure sodium vapor, metal
halide)..• All outside lighting shall be directed to prevent
"spillage" onto adjacent properties.
9,. -•A plan, -for silt control for all storm runoff from the property
during construction and during initial operation of the project
shall be submitted to the California Regional Water Quality
Control Board staff for their review prior to the issuance
of grading permits.
10. If dredging,i's necessary, _silt'screens shall be used to control
turbidity during construction.

Mr. Jack Schmier and Mr. Jim Moore, were present to represent the
applications.
Secretary Lipps introduced the applications to the Board and gave
a brief history. He stated that the applications had been previously
approved on November 22, 1978, at which time, due to a clerical error,
an adjoining property owner was inadvertently not notified of the
public hearing, therefore, the applications were renotified to allow
the property owner to the east to be present at the hearing.
The Chairman opened the public hearing. Mr. Alan Knox, representing
adjoining property owner, Mr. Topocer, addressed the Board and requested
to hear from the representatives of the application prior to his ad-
dressing the Board. Mr. Jack Schmier stated that these applications
had been previously approved and expressed regret that all adjoining
property owners had not been notified at the original hearing. He
further said that he was asking for a zero setback because this was
the only way he could acquire the required parking spaces. He
then stated that he was conditioned to erect.a decorative masonry
wall along the zero setback and that he had no objection to do so.
Mr. Schmier stated that he was unsuccessful in obtaining reciprocal
drive with the adjacent property owner, therefore, decided to apply
for the conditional exception.
Secretary Lipps stated that due to the lot width and ratio of depth,
it was impossible to develop the property with proper turning radius
with the granting of a conditional exception; and therefore, the
applicant was conditioned to provide a maintenance free masonry wall
along that zero property line.
Mr. Knox, representing Mr. Topocer, addressed the Board and stated
that it was a misstatement of fact that the applicant would have
an inability for future driveway. Mr. Topocer addressed the Board
and stated that he had a previous agreement with the applicant to
build a common driveway, however, he chose to ignore that agreement
and pursue a conditional exception. Mr. Schmier then stated that
Mr. Topocer agreed to sell a portion of his lot to be utilized as
a reciprocal drive between the two properties, however, he was unable
to bear the cost of that portion of Mr. Topocer's property at that
time.
Mr. Topocer and Mr. Schmier did not agree as -to the way the recipro-
cal drive could be used, and Chairman Crosby stated that it was not
the Board's concern who was telling the truth, but that in fact, the
Board would address itself to the application before them. The
Board discussed other units within the vicinity, and agreed that
a similar variance had been granted. Mr. Topocer expressed great
concern over the length of the proposed wall along the zero setback
line and objected to the wall extending along his property line.
The reversing of the plan was discussed, and Mr. Schmier stated that
the same condition would exist, only on the other side of the property,
therefore, the identical situation would exist.

Due to continuous arguing between the adjoining property owner and
applicant, and restating the same objections, the Chairman closed
the public hearing.
Board discussion followed. Findings on original conditional exception
and use',permit were reviewed by the Board. Board found same findings
in reviewing the applications the second time.
ON MOTION BY CROSBY AND SECOND BY LIPPS CONDITIONAL EXCEPTION NO.
78-55 WAS APPROVED WITH THE FOLLOWING -FINDINGS AND CONDITIONS,
BY THE FOLLOWING VOTE:
FINDINGS•
1: The granting of the Conditional Exception will not constitute
a grant of special privilege inconsistent -upon other properties
in the vicinity.
2.' Because of special circumstances applicable to the subject
property, including size, shape, topography, location, or
surroundings,'the strict'application of the zoning ordinance
is found to deprive the subject property of privileges
enjoyed by other properties in the vicinity and under identical
zone,classifications.
3.The granting of'a Conditional Exception is necessary in order to
preserve the enjoyment of one or more substantial property rights.
4. The granting of 'a Conditional Exception will not be materially
detrimental to the public welfare, or injurious to property in
the same zone classification.
5. The granting of a'"Conditional Exception will not adversely
.affect the Master Plan of the City of Huntington Beach.
6. The forty-five (45) foot lot width places physical constraints
upon this property that limits the available area for turning
radius into the garages. The .granting_of this conditional
exception allows the applicant parity with other developments
in the vicinity and under the same zoning classification.
CONDITIONS OF APPROVAL:

1. The conceptual plot plan and elevations received July 27, 1979
shall be the approved layout.
B. GENERAL CONDITION:

9. A detailed soils analysis shall be prepared by a registered
soils engineer. This analysis shall include on -site soil
sampling and laboratory testing of materials to provide detailed
recommendations regarding grading, chemical and fill properties,
foundations, retaining walls, streets, and utilities.
10. If foil -type insulation is to be used, a fire retardant type
shall be installed as approved by the Building Department.
11. An engineering geologist shall be engaged to submit a report
indicating the ground surface acceleration from earth movement
for the subject property. All structures within this develop-
ment shall be constructed in compliance with the g-factors
as indicated by the geologist's report. Calculations for
footings and structural members to withstand anticipated
g-factors shall be submitted to the City for review prior to
the issuance of Building Permits.
12. A plan for silt control for all storm runoff from the property
during construction and during initial operation of the project
shall be submitted to the California Regional Water Quality
Control Board staff for their review prior to the issuance
of grading permits.
13. Information on equipment or facilities which may generate air
pollutants shall be submitted to the South Coast Air Quality
Management District staff for their review prior to the
issuance of a Certificate of Occupancy for any use within
the building.

City Council.
The applicant was not present. The Chairman outlined the proposal
to the Board. The Secretary noted a shortage in parking and sug-
gested parking requirements be made a condition of approval.
He further stated that the remainder of the proposal was within
substantial ordinance code conformance. Conditions of approval
were discussed.

Secretary Lipps outlined t-he proposal to the.Board..,He stated that
the applicants had received previous,approval for this property for
the proposed storage of recreational vehicles. Secretary Lipps
noted that the parking spaces were not shown on the plan and noted
concern, over access,to .the property. Board member Burney stated that
a restriction fl£--emergency access was in existence." Mr. Manthei
suggested that the -emergency access could'be-transferred to adjacent
property for which -the -.applicants -have an.emergency vehicle access
agreement_,with •,the".property owner of, that parcel. Further drive
widths and" emergency vehicle- circulation' was-'disscussed.

CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The conceptual plot plan and elevations received July 24,
1979, shall be the approved layout, subject to the modifi-
cations described herein:
a. Revise plan to show required parking per Article 979.
b. Revise plan to provide a minimum.twenty-five (25) foot
opening from emergency access easement through Parcel #3
into drive area of Parcel #4.
C. Revise plan to provide a minimum twenty-four (24) foot
drive width connecting Parcels #2 and #3.
A plan delineating said modifications shall be submitted to
the Secretary of the Board. If such plan complies with the
modifications out by the Board, said plan shall be
approved and made a permanent part of the administrative file.
In its approval action, the Board of Zoning Adjustments considered
the following issues relating to the conceptual plan:
Traffic circulation and drives;
Parking layout;
Lot area;
Lot width and lot depth;
Type of use and its relation to property and improvements in the
immediate vicinity;
Past administrative action regarding this property.
2. The following plans shall be submitted to the Secretary of
the Board:

Messrs. Dayton Meyer and Michael Lasley were present to represent the
application.
Chairman'Crosby outlined -the proposal to the Board. The -public hearing
was opened.
Mr. Dayton Meyer addressed the Board and -stated his request for a
6,000 square'foot disco in'a!shopping center now under construction.
Mr. Meyer stated that an acoustical analysis has been completed and
that he has received input of pitfalls of other.disco's in the area,
thereby attempting to'eliminate problems before they start..
There being no other parties present to speak on`the application, the
public hearing was closed. 1 ..
Secretary--Lipps''informed- the: application .that the City of Huntington
Beach has recently adopted a new Noise Ordinance and further stated
that it would be strictly enforced. He then.cautioned the Board that
the Board must find that -a proposal -will not be detrimental to
surrounding -properties under a use permit application. Board dis-
cussion followed.
