PLOT PLAN AMENDMENT NO. 79-6
Applicant: Church of Religious Science
To permit reduction of two (2) parking spaces and addition of a
300-square foot nursery for a previously approved church facility
located at the southwest corner of Main and Florida Streets.
This request is covered by Negative Declaration No. 79-17,
previously approved.
The Chairman opened the public hearing. Mr. Robert Hippe, archi-
tect for the proposal, was present to represent the application.
Secretary Lipps outlined the proposal to the Board stating that
it was a revision to a previously approved Conditional Use Permit
whereby the applicant intends to add a nursery facility to be used
only in conjunction with church services. He further outlined
that the Board must find the amendment to result in a better plan
and that it must be within ordinance code conformance. It was
noted by the Board that the parking would be impacted by the pro-
posal, however, the reduced seating in the church would offset
parking requirements.
There being no other parties present to speak on the application,
the public hearing was closed. Board discussion ensued. Conditions
of approval were discussed.

CONDITIONS' OF APPROVAL:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The conceptual plot plan and elevations received August 1,
1979, shall be the approved layout.
In its approval action, the Board of Zoning Adjustments considered
the following issues relating to the conceptual plan:
Traffic circulation and drives;
Parking layout;
Lot area;
. Lot width and lot depth;
. Type of use and its relation to property and improvements in
the immediate vicinity;
. Past administrative action regarding this property.
2. A landscape and irrigation plan, complying with Article 979
.of the Huntington Beach Ordinance Code and landscaping specifi-
cations on file in the Department of Public Works for new
or modified landscaping only shall be submitted to the Secre-
tary of the Board:
B. GENERAL CONDITIONS:
1. The new addition is to be used for a nursery in conjunction with
church services only. If applicant proposes a day care facility
it will be necessary to file a new Conditional Use Permit.
2. All conditions of approval of Conditional Use Permit No. 79-6
'and Conditional Exception No. 79-1 shall be complied with.

CONDITIONAL EXCEPTION NO. 79-35
Applicant: Mark & Crystal Phillips
To permit a four (4) foot encroachment into a required ten (10) foot
side yard setback in order to allow an addition to an existing dwelling
located on the southwest corner of the intersection of Spartan and
Quickstep Circles in an R1 zoning district.
This application is a categorical exemption, Class V, California
Environmental Quality Act, 1980.
The Chairman opened the public hearing. Mrs. Crystal Phillips was
present to represent the application.

Mrs. Phillips addressed the Board and stated she was requesting
the variance to construct a breakfast nook to allow her family
a place to eat their meals. She further stated that the encroach-
ment was not a true four foot due to curvature of the lot in a
certain area.
The Board reviewed the request and also reviewed a map of the
entire tract showing lot dimensions and shapes. Secretary Lipps
said that the proposed lot was not unique in comparison to the
other lots in the tract. Alternatives to the proposal were dis-
cussed, perhaps making the addition smaller or the relocation
of same.
There being no other parties present to speak on the application,
the public hearing was closed. Board discussion ensued. It was
the consensus of the Board that the proposed lot was not unique
in shape, size, or topography, and that a conditional exception
was not warranted.
ON MOTION BY RENNA AND SECOND BY LIPPS, CONDITIONAL EXCEPTION NO.
79-35 WAS DENIED FOR THE',FOLLOWING REASON, BY THE FOLLOWING VOTE:
REASON FOR DENIAL:
1. The subject site is not unique in its size and configuration as
compared with the bulk of the lots throughout the tract and
approval of this Conditional Exception would be a grant of
special privilege as well as establishing a precedent within
the City.

ADMINISTRATIVE REVIEW NO. 79-79
Applicant: Donald G. Penkoff
To permit construction of a 10,061 square foot industrial building
located on the south side of Oceanus Drive, approximately 720 feet
west of Graham Street.
This application is covered by EIR 73-16, approved by the City Council
on March 18, 1974.
Mr. Penkoff was present to represent the application.
Secretary Lipps introduced the application to the Board and noted
that a preliminary plan check revealed the proposal to be within
ordinance code conformance. Conditions of approval were discussed.

USE PERMIT NO. 78-57/CONDITIONAL EXCEPTION NO. 78-55
REVISED SITE PLAN REVIEW
Applicant: Commissariat Design
To permit zero construction on an interior side yard and to permit
a portion of a six -unit apa,rtment'building to be more than 150 feet
from a'public street located on the south side of Aldrich Street,
approximately 100 feet east of Parkside Lane in an R3 District.
Board reviewed'the'revised-site plan, originally approved by the
Board on August 8, 1979 and noted that the applicant had reversed
(flip flop) his design in an attempt to accommodate one of the
adjacent property'owners, thereby eliminating the zero setback
construction on the.easterly property line, and placing the zero
construction along the westerly'property'line. It was the con-
sensus of the Board to approve the revised site plan.

AUGUST 15; 1979 FOR USE PERMIT NO. 78-57 AND CONDITIONAL EXCEPTION

Applicant: Meine Construction Company
To permit the use of a garage as a temporary sales office not to
exceed one (1) year period of time located on the northeast corner
of Huntington.Street and Clay Avenue.
This request is a categorical exemption, Class I, California Environ-
mental Quality Act, 1970.
The applicant was not present.
Board reviewed the proposal and found same to be within ordinance
code conformance. Conditions of approval were discussed.
