BOARD MEMBERS: Lipps, Noble, Burney APPROVAL OF MINUTES: ON MOTION BY LIPPS AND SECOND BY BURNEY, THE MINUTES OF THE REGULAR MEETING OF AUGUST 15, 1979, WERE APPROVED BY THE FOLLOWING VOTE: AYES: Lipps, Burney NOES: None ABSENT: None ABSTAIN: Noble REGULAR AGENDA ITEMS: USE PERMIT NO. 79-27 (Cont. from 8/8/79) Applicant: Craig Combs Association To permit the construction of a 68 unit apartment building located on the west side of Beach Boulevard, approximately 500 feet south of Taylor Drive. This request is covered by Negative Declaration No. 79-55, approved by the Board of Zoning Adjustments on August 8, 1979. Secretary Lipps outlined the proposal to the Board and noted that the application had been continued due to an error in earlier adjacent property notification. He further stated that proper notification had been completed and that the proposal was now ready to be heard by. the Board. The public hearing was opened. Mr. Stan Uchizono was present to represent the application. Mr. Lambright and Mr. Gasken, adjoining property owners, were also present to state their concerns. Concern was expressed by these gentlemen over the proposed three story portion of the proposal. However, Mr. Uchizono showed elevations of the proposal whereby he explained that the three story portion of the proposed buildings would be centered and that the portion of the buildings closest to the residential area would be two story. The applicant's repre- sentative also attempted to explain to the concerned citizens that the proposed setback (even for the two story portion of the buildings) would'be far greater than what is allowed by ordinance code. Board of Zoning Adjustments Wednesday, August 22, 1979 Page Two further stated that plans have been made to use intensified land- scaping along the portion of the property that will abut the resi- dential portion of the proposed development, thereby providing a greater aesthetical buffer between the two properties in addition �o the proposed six foot block wall. Secretary Lipps read into the record a letter from an adjoining property.owner stating that she was opposed to apartment development on the proposed site. There being no further parties present to speak on the application, the public hearing was closed. Board discussion ensued, regarding relocation of tennis court fence section, relocation of laundry building along the westerly property line, walk- way treatment and landscaping, and circulation within the project. Conditions of approval were discussed. ON MOTION BY LIPPS AND SECOND BY NOBLE, USE PERMIT NO. 79-27 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS• 1. The establishment, maintenance, and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2. The granting of a Use Permit will not adversely affect the General Plan of the City of Huntington Beach. 3. The proposal is consistent with the City's General Plan of Land Use. CONDITIONS OF APPROVAL: A.. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan received July 19, 1979, shall be the approved layout, subject to the modifications described herein: a. Submit revised building elevations (front, side and rear) showing type of materials for approval by the Board. b. Submit elevations of carport structure showing tennis court fence section and location. C. Relocate laundry building shown at westerly property line to reflect required setback to meet requirements of S.9320.21 of the Huntington Beach Ordinance Code. Minutes: H.B. Submit sections including walkway treatment and land- scaping on the 52 foot access easement along the southerly line of Parcel 44. f. Redesign plan to reflect required setback of two story building along westerly property line. A plan delineating said modifications shall be submitted to the Secretary of the Board. If such plan complies with the modifications outlined by the Board, said plan shall be ap- proved and made a permanent part of the administrative file. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: Traffic circulation and drives; Parking layout; Lot area; Lot width and lot depth; Type of use and its relation to property and improvements in the immediate vicinity; Past administrative action regarding this property. 2. The following plan shall be submitted to the Secretary of the Board: a. Landscape and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code and landscaping specifications on file in the Department of Public Works. Sufficient tree planting along the westerly property line to provide a suitable visual buffer shall be provided by the applicant. B. GENERAL CONDITIONS: 1. Tennis court fence to be located ten (10) feet from north property line or approval of a Conditional Exception for zero feet setback. 2. All conditions of approval of Parcel Map No. 79-55 shall be complied with. 3. Access easement through Parcel 44 to Parcel 43 shall be submitted to the City and recorded with the County prior to issuance of building permits. 4. All mitigating measures as set forth in Negative Declaration No. 79-55 Measure B-4) shall be complied with. 5. Developer shall provide a minimum six (6) foot masonry perimeter wall. 6. Developer shall provide "RIGHT TURN ONLY" sign at inter- section of 52 foot access easement and Beach Boulevard. 8. No parking shall be permitted along the -curb at Beach Boule- vard for a distance specified by the Traffic Engineer. AYES:, Lipps, Noble, Burney NOES: None ABSENT:- None CONDITIONAL EXCEPTION NO. 79-36 . Applicant: Witold & Sonia T. Muller To permit an eight (8) foot windscreen in exterior side yard setback located at the northwest corner of Carousel Lane and Wanderer Lane. This request is a categorical exemption, Class 5, California Environ- mental Quality Act, 1970. Secretary Lipps outlined the proposal to the Board. The public hear- ing was opened. Mr. and Mrs. Muller were present to represent the application. Mr. Muller stated,that,his purpose for the proposal was to seek privacy for his swimming pool area. Mr. Muller then stated that in addition to the privacy he was seeking, the proposal would afford great wind reduction by allowing extra height to the exist- ing wall. He further explained how he planned to make the pool area more aesthetically pleasing by the addition of hanging plants, etc. The Board discussed the proposal citing the lot to be uniquely shaped, however, also noting that the developer had placed the house on the lot to afford as large a house as the lot would accommodate. Further discussion ensued regarding the unusal configuration of the house on the lot. Secretary Lipps stated for.the record that he had received several telephone calls whereby adjoining property owners cited opposition to the proposal. Secretary Lipps explained to the applicant that in order for the Board to be able to approve a conditional exception request, it is faced with having to provide proper findings as set out in the Ordinance Code, and that however, the proposal does not meet this criteria. There being no further parties to'speak on the application, the public hearing was closed. ON MOTION BY LIPPS AND SECOND BY BURNEY, CONDITIONAL EXCEPTION NO. 79-36 WAS DENIED FOR THE FOLLOWING REASONS, BY THE FOLLOWING VOTE: Minutes: H.B. Board of Zoning Adjustments Wednesday, August 22, 1979 Page Five REASONS FOR DENIAL: 1. The granting of the Conditional Exception would constitute a grant of special privilege inconsistent upon other properties in the vicinity and under an identical zone classification. 2. The property is not unique to the extent that granting of a Conditional Exception would be permitted under the Huntington Beach Ordinance Code. 3. The proposed Conditional Exception is unable to meet the criteria of standard findings as set forth under Section 9811.1.1 of the Huntington Beach Ordinance Code.
