BOARD MEMBERS: Lipps, Crosby, Ott APPROVAL OF MINUTES: ON MOTION BY CROSBY AND SECOND BY OTT THE MINUTES OF THE REGULAR MEETING OF SEPTEMBER 5, 1979 WERE APPROVED BY THE FOLLOWING VOTE: AYES: Lipps, Crosby, Ott NOES: None ABSENT: None ON MOTION BY CROSBY THE MINUTES OF THE SEPTEMBER 10, 1979 FOLLOWING VOTE: AYES: Lipps, Crosby, Ott NOES: None ABSENT: None MISCELLANEOUS AGENDA ITEM: SPECIAL EVENT NO. 79-20 Applicant: St. Bonaventure Parish AND SECOND BY LIPPS SPECIAL MEETING OF WERE APPROVED BY THE To permit an annual fall festival to be held October 12, 13, and 14, 1979 located at 16400 Springdale Street, Huntington Beach, California. Chairman Crosby stated that this application had been denied at the Board of Zoning Adjustments' meeting of September 5, 1979 and then reconsidered at a special meeting of the Board held September 10, 1979, and therefore, being re -heard by the Board on this date. He further stated that this was not a public hearing, however, if anyone had any additional information, the Board would be happy to receive further testimony. Mr. Robert Armstrong addressed the Board and stated that he was the originator of a petition circulated in his neighborhood in opposition to the proposal, which he submitted to the Board. He further stated that he has been a resident of the neighborhood for 14 years and has seen the festival grow each year. He has also had a chance, while circulating the petition, to talk to some of the neighbors and noted that many have indicated that the festival has outgrown the neighborhood and should be moved else- Minutes: H.B. Major concerns cited by Mr. Armstrong were: excessive speed of autos, especially on Bradbury; the possibility of an accident involving a drunk driver; improper notification of residents regarding barricading of streets. He further stated that it was not his intent, nor the intent of the residents, to have the festival canceled, but rather to have it moved to a more suitable location where traffic could be handled easier than in a residential area. Mr. Armstrong concluded by stating that during last year's festival, a knife attack was made on a resident of Bradbury, and asked the Board to deny the appli- cation to avoid the occurrence of a tragedy. Ms. Mason addressed the Board and stated that the Board should be made aware that since the inception of the festival, three additional large buildings have been added to the existing church which consequently resulted in the reduction of the lot's square footage.. Lt. Patton addressed the Board and reiterated the traffic problems stated by him at the September 5, 1979 meeting. He reviewed where barricades might be placed to avoid intrusion of people attending the festival on the residential streets, and the problems barricading streets would also present to the residents. The number of officers stationed at various locations was dis- cussed, and it was agreed by the Board that the placement and number of officers needed would be left to the discretion of the Police Department. Mr. Tom Fourmont, representing the St. Bonaventure Parish presented a revised plot plan to the Board whereby the entire operation of the festival was moved to the southerly end of the lot, away from residential area. Ingress and egress was discussed, and it was noted that it was more feasible to enter and exit the festival off of Springdale Street and to keep the flow of traffic on an arterial highway versus residential streets. It Was further noted that all on -site drives shall be kept clear for emergency access and circulation. Times of closing the festival and hours of operation of the festival, cleanup, and clearance of school grounds was discussed and are included in the conditions of approval. The trash problem was still a major concern of the adjoining property owners. Mr. Fourmont assured the residents that arrange- ments have been made to have the trash picked up after the festival had ended. The existance of sanitary facilities during the festival was discussed, and Secretary Lipps stated that the applicant would have to meet the requirements of the Plumbing Inspector for sanitary facilities. Board of Zoning Adjustments Wednesday, September 12, 1979 Page Three Board discussion followed, and it was the consensus of the Board that the applicant had demonstrated a great deal of good faith to hold the festival with the least amount of disturbance to the adjoining neighborhood. ON MOTION BY LIPPS AND SECOND BY CROSBY, SPECIAL EVENT NO. 79-20 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. The plot plan received September 12, 1979, shall be the approved layout. 2. The applicant shall obtain all necessary electrical permits. 3. An on -site inspection by the Fire Department shall be required prior to the event. 4. A certificate of insurance form shall be filed in the Finance Department five (5) days prior to the event. 5. All trash, debris and garbage as well as special dumpsters shall be removed from the site within two (2) days of closing of the festival. 6. Use of amplifiers and speakers are to be discontinued as of 9:30 p.m. each day. 7. Refrigeration truck to be placed on site as near the inter- section of Springdale and Heil as possible to minimize noise from the unit. 8. Barricades shall be placed at the intersections of Springdale and Brassie, Springdale and Orlando and Heil and Bradbury as approved by the Huntington Beach Police Department Traffic Division. Number of officers, assignment of location of officers, and duty hours of officers shall also be to the Huntington Beach Police Department specifications. 9. All equipment and manpower required by Condition No. 8 shall be provided at the applicant's expense. 10. Appropriate signs (temporary) for the direction of traffic and on -site parking shall be provided by the applicant. 11. The vehicular access off Orlando and Bradbury shall be secured and not used for ingress -egress to the site except for emergency purposes. 12. No machinery of any type other than necessary refrigeration unit shall operate between the hours of 10:00 p.m. and 7:00 a.m. Minutes: H.B. In the event there are any violations of the foregoing conditions or any violations of life safety codes, the festival activity will be terminated and not permitted to reopen. AYES: Lipps, Crosby, Ott NOES: None ABSENT: None REGULAR AGENDA ITEMS: ADMINISTRATIVE REVIEW NO. 79-87 Applicant: McDonnell Douglas Astronautics To permit the addition of a 82,500 square foot manufacturing building located on the northeast corner of Bolsa Avenue and Bolsa Chica Street. This request is covered by Negative Declaration No. 79-60. ON MOTION BY LIPPS AND SECOND BY OTT THE BOARD, HAVING FOUND THAT THE PROPOSED PROJECT WILL NOT HAVE A SIGNIFICANT ADVERSE EFFECT ON THE PHYSICAL ENVIRONMENT, ADOPTED NEGATIVE DECLARATION NO. 79-60 WITH THE MITIGATING MEASURES CONTAINED IN ADMINISTRATIVE REVIEW NO. 79-87 B-2 THROUGH B-7 IMPOSED ON THE ADMINISTRATIVE REVIEW APPLICATION, BY THE FOLLOWING VOTE: AYES: Lipps, Crosby, Ott NOES: None ABSENT: None Mr. Joe Valinsky was present to represent the application. Secretary Lipps reviewed the proposal with the Board and noted that the application was within substantial compliance of -the Huntington Beach Ordinance Code. Conditions of approval were discussed. ON MOTION BY LIPPS AND SECOND BY CROSBY ADMINISTRATIVE REVIEW NO. 79-87 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: u Minutes: H.B. Board of Zoning Adjustments Wednesday, September 12, 1979 Page Five CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received August 21, 1979, shall be the approved layout. B. GENERAL CONDITIONS: 1. Development shall meet all requirements of the Huntington Beach Ordinance Code. 2. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility, equipped to handle them. 3. If lighting is included in the parking lot, energy efficient lamps shall be used (e.g. high pressure sodium vapor, metal halide). All outside lighting shall be directed to prevent "spillage" onto adjacent properties. 4. A detailed soils analysis shall be prepared by a registered soils engineer. This analysis shall include on -site soil' sampling and laboratory testing of materials to provide detailed recommendations regarding grading, chemical and fill properties, foundations, retaining walls, streets, and utilities. 5. If foil -type insulation is to be used, a fire retardant type shall be installed as approved by the Building Department. 6. A plan for silt control for all storm runoff from the property during construction and during initial operation of the project shall be submitted to the California Regional Water Quality Control Board staff for their review prior to the issuance of grading permits. 7. Information on equipment or facilities which may generate air pollutants shall be submitted to the South Coast Air Quality Management District staff for their review prior to the issuance of a Certificate of Occupancy for any use within the building. AYES: Lipps, Crosby, Ott NOES: None ABSENT: None ADMINISTRATIVE REVIEW NO. 79-88 Applicant: Frank Fossati, Shell Oil Co. To permit an island canopy addition to an existing service station located at the southeast corner of Magnolia and Garfield. Minutes: H.B. Board of Zoning Adjustments Wednesday, September 12, 1979 Page Six This application is a categorical exemption, Class I, California Environmental Quality Act, 1970. Mr. Frank Fossati was present to represent the application. Secretary Lipps reviewed the application with the Board noting that the Administrative Review Application was required in the modernization of an existing service station. Mr. Fossati outlined his request as allowing the placement of two canopies over existing service station islands. Board informed the applicant that the Ordinance Code required six (6) percent of the site to be landscaped and that perhaps additional landscaping was required. The placement of miscel- laneous signs was discussed and the applicant was informed that he would be notified as to the location and number of signs he could utilize, after a field check. Conditions of approval were discussed. ON MOTION BY LIPPS AND SECOND BY OTT ADMINISTRATIVE REVIEW NO. 79-88 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOL- LOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received August 22, 1979, shall be the approved layout, subject to the modifications described herein: a. Revise plan to indicate compliance with Section 9482.1 and Section 9482.1.1 of the Huntington Beach Ordinance Code. A plan delineating said modifications shall be submitted to the Secretary of the Board. If such plan complies with the modifications outlined by the Board, said plan shall be approved and made a permanent part of the administrative file. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: Traffic circulation and drives; Lot area; Lot width and lot depth; Type of use and its relation to property and improvements in the immediate vicinity; Past administrative action regarding this property. Board of Zoning Adjustments Wednesday, September 12, 1979 Page Seven AYES: Lipps, Crosby, Ott NOES: None ABSENT: None CONDITIONAL EXCEPTION NO. 79-38 Applicant: Chris William Caras To permit a reduction in minimum six (6) foot separation wall located on the east side of Beach Boulevard, approximately 258 feet north of Newman. This application is a categorical exemption, Class 5, California Environmental Quality Act, 1970. The Chairman introduced the application to the Board. The public hearing was opened. Mr. Caras outlined his proposal to the Board as requesting a reduction or elimination of a six (6) foot high separation wall between two adjoining commercial properties. He further stated that although there is a non -conforming residential use on the adjacent property at this time, that the adjoining property would eventually be developed in a commercial manner. He further stated that at the time of his Use Permit approval, no mention had been made of the required six foot high masonry wall. Mr. Caras then presented photographs of the property in question. Mr. Yamata, adjoining property owner, addressed the Board citing his opposition to the request. He stated that he felt a block wall was necessary between the commercial building and his property which has a residential house situated within the 50 foot setback of his property to insure the privacy of those occu- pants. He further stated at this point that if the applicant did not wish to erect a block wall, that he should erect a six foot high redwood fence. Secretary Lipps informed the Board that the building on the subject property could have been built at zero foot setback, whereby a natural separation of the two properties would have been created, however, due to a utility easement along the north side of the property, the developer was unable to build at zero foot setback. The possibility of a wood fence was discussed between Board members, the applicant, and Mr. Yamata, and it was agreed that such a fence would be the best possible solution to insure privacy for the adjacent residential neighbor and would not impose the burden of a block wall on the applicant. Findings and conditions of approval were discussed. ON MOTION BY LIPPS AND SECOND BY OTT ADMINISTRATIVE REVIEW NO. 79-88 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS• 1. The intent of Section 9730.25 of the Huntington Beach Ordinance Code is not applicable in this instance because of the changing character of the neighborhood from residential agricultural uses to office professional and commercial uses. 2. The use of the adjacent property to the north is a non -conforming residential use and is zoned C-4. The parcel is approximately 341560 square feet in area and the dwelling unit is located within the required fifty (50) foot setback. Because of this location of the residential building, there would be no separation wall between that structure and the office professional and commercial use. 3. The installation of the six (6) foot wall would create a corridor on the north side of the office building approximately four (4) feet wide for a length of approximately one hundred fifty (150) feet. 4. The north wall of the office building could have been built at zero foot setback had there not been a utility easement along the north property line. 5. The purpose of a six foot six inch (6'6") masonry wall is to separate a more permanent residential use from a commercial use, and a redwood fence would serve the same purpose. CONDITIONS OF APPROVAL: 1. A thirty (30) inch high decorative masonry wall shall be constructed along the northerly property line for a distance of fifty (50) feet, however, said wall shall not exceed forty- two (42) inches above curb level. 2. A redwood fence shall be constructed along the remainder of the northerly property line to the rear of setback line. Said redwood fence shall be placed atop the existing retaining wall to a total height of six (6) feet measured from finished floor level.of the subject property. 3. A plan of the wall and fence shall be approved by the Board of Zoning Adjustments prior to issuance of building permits. Minutes: H.B.
