ON MOTION BY BAZIL AND SECOND BY RUSSELL CODE AMENDMENT NO. 79-5 WAS CONTINUED TO THE MEETING OF OCTOBER 2, 1979, BY THE FOLLOW- ING VOTE: AYES: Higgins, Russell, Stern, Cohen, Bazil NOES: None ABSENT: . Paone ABSTAIN: None SIGN CODE VIOLATIONS: Commissioner Russell, at whose request the list of sign violations on Beach Boulevard had been compiled, discussed the violations, pointing out the inequities which result when responsible business owners try to comply with the code and other (perhaps directly competing) businesses do not. The Commission considered possible amendments to the sign code to strengthen the staff's legal en- forcement capability. Pat Spencer outlined the present enforcement procedures for the Commission's information, and legal counsel James Georges described the position of the Attorney's office in regard to prosecution of violators. Commissioner Russell indicated that what he had in mind was a public relations meeting with the cited violators without the threat of prosecution, in order to try to obtain voluntary compliance. ON MOTION BY RUSSELL AND SECOND BY STERN STAFF WAS DIRECTED TO PURSUE A MEETING WITH THE BUSINESS PEOPLE FOR THE PURPOSE OF: 1) DISCUSSING LACK OF COMPLIANCE WITH VIOLATION NOTICES, AND 2) TO SEE WHETHER IN THE EYES OF THE VIOLATORS THE EXISTING SIGN PRO- VISIONS ARE REALISTIC. MOTION CARRIED BY THE FOLLOWING VOTE: AYES: Higgins, NOES: None ABSENT: Paone ABSTAIN: None COMMISSIONER ITEMS: Russell, Stern, Cohen, Bazil Commissioner Stern questioned the status of the landscape review for Tentative Tract 9580 and the entitlement for the Old World Okterberfest. Savoy Bellavia reported that the requested information relevant to TT 9580 has not been received from the office of the City Minutes, H.B. Planning Commission September 27, 1979 Page 6 Attorney. The status of entitlement for the Oktoberfest is being researched and will be available for the Commission's review at the next meeting. Commissioner Cohen inquired as to the effect on Conditional Use Permit No. 79-23 and Tentative Tract 10853 in the event that no vote can be obtained on either a negative declaration or an envir- onmental impact report before the mandatory processing date for the tract of October 22, 1979. After discussion, James Georges was instructed to provide the Commission with his written opinion as to whether or not the projects would automatically be deemed approved under those circumstances, citing specific sections of the law in support of that opinion. Mr. Georges agreed to do this, but cautioned the Commission that it would be his opinion only and would not carry validity unless approved also by the City Attorney.
