TENTATIVE PARCEL MAP NO. 79-578
Applicant: H. E. Hartge
To subdivide one lot into four lots located at the southwest
corner of Davenport and Edgewater.
This application is covered by Negative Declaration No. 77-17,
previously approved.
Mr. H. E. Hartge was present to represent the application.
Chairman Crosby outlined the proposal to the Board. Mr. Hartge
explained his proposal as requesting the subdivision of one lot,
currently a parking lot, into four separate lots. He further
stated that he had communicated with several of the neighboring
property owners regarding his overall'proposal for modification
of the existing marina (filed under Conditional Use Permit No.
79-27) .
Secretary Lipps noted that the proposal before the Board at this
point in time was for a lot division only, and that the aspects
of the proposed modification to the marina would be discussed
at the time the Conditional Use Permit is heard before the Plan-
ning Commission. Secretary Lipps suggested that the Tentative
Parcel Map be referred to the Planning Commission to be heard
in conjunction with the Conditional Use Permit. Board and
applicant concurred with the referral.

Applicant: Mola Development
To permit a recreation building to be temporarily used for a sales
center located on the southwest corner of Main and Garfield.
This request is a categorical exemption, Class.l, California
Environmental Quality Act, 1970.
Mr. Jerry Simon was present to represent the application.
Chairman Crosby outlined the proposal to the Board. Parking
concerns were expressed, and it was requested that the appli-
cant submit an on -site parking plan. It was further noted
that the proposal was within substantial Ordinance Code con-
formance.
ON MOTION BY LIPPS AND SECOND BY OTT, ADMINISTRATIVE REVIEW NO.
79-95 WAS APPROVED,WITH THE FOLLOWING CONDITIONS, BY THE FOL-
LOWING VOTE:
CONDITIONS OF APPROVAL:
A. TO BE*COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The conceptual plot plan and elevations received September
21, 1979, shall be the approved layout, subject to the
modifications described herein:
a. Indicate on -site parking area.
A plan delineating said modifications shall be submitted to
the Secretary of the Board. If such plan complies with the
modifications outlined by the Board, said plan shall be
approved and made a permanent part of the administrative
file.
In its approval action, the Board of Zoning Adjustments considered
the following issues relating to the conceptual plan:
Traffic circulation and drives;
Parking layout;
Lot area;
Lot width and lot depth;
Type of use and its relation to property and improvements in
the immediate vicinity;
Past administrative action regarding this property.
B. GENERAL CONDITIONS:
1. Applicant shall comply with Section 9730.18 of the Huntington
t Beach Ordinance Code.

CONDITIONAL EXCEPTION NO. 79-40
Applicant: William Cyril
To permit the encroachment of 418" into rear yard setback located
at the north end of Pebble Lane, approximately 250 ft. north of
Saline Drive.
This application is a categorical exemption, Class 5, California
Environmental Quality Act, 1970.
Mr. Cyril was present to represent the application. Chairman
Crosby outlined the proposal to the Board. The public hearing
was opened.
Mr. Cyril addressed the Board and presented a petition from
adjoining property owners in favor of the proposal. He further
stated his proposal as requesting the enclosure of a patio and
an encroachment into the rear yard setback. Justifications
were presented by Mr. Cyril as follows: The rear of the proposed
property lies only 17 feet from Indianapolis Street; other resi-
dences at the north end of the cul-de-sac are angled from the
street providing deeper lots behind the homes, located approxi-
mately one half block from main intersection of Brookhurst and
Indianapolis. Mr. Cyril further cited additional factors that
greatly contribute to the noise problem. He further stated
that the proposal would not harm adjacent property owners be-
cause of the curviture of the street, therefore, the addition is
not visible _f0___the-rieii4hb rS.
There being no other parties present to speak on the application,
the public hearing was closed.
Board discussion followed. Secretary Lipps stated that the
proposed lot is shallow compared to most every other lot in the
tract. Therefore, it was his opinion that a unique situation
exists in lot configuration and depth. ;lVindings and conditions
of approval were discussed.
ON MOTION BY CROSBY AND SECOND BY LIPPS, CONDITIONAL EXCEPTION
NO. 79-40 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITION

FINDINGS:
1. The unique configuration of this lot with a depth at mid -point
of approximately 80 feet justified granting of ,this exception.
2. The granting of the Conditional Exception will not constitute
a grant of special privilege inconsistent upon other properties
in the vicinity and under'an identical zone classification,
3. Because of special circumstances applicable to the subject property,
including size, shape, topography, location, or-surrbundingp, the
strict application of the zoning ordinance is found to deprive the
subject property of privileges enjoyed by other properties in the
vicinity and under identical zone classifications.
4. The granting of a Conditional Exception is necessary in order to
preserve the enjoyment of one or more substantial property rights.
5. The granting of a Conditional Exception will not be materially
detrimental to the public welfare, or injurious to property in
the same zone classification.
6. The granting of the Conditional Exception will not adversely affect
the General Plan of the City of Huntington Beach.

These applications are categorical exemptions, Class 5, California

Mr, 'Robert Corona, the applicant, was present. The public hearing
was 'opened.
Mr., "Corona explained his proposal to the Board and stated that
he, has checked with other cities to see whether their code allows
measurement from curb to curb, or property line to property line,
and has concluded that both methods are used in surrounding cities.
Mr,. Corona then gave a brief history of chronological events that
took place from initiation of the fourteen house project he is
proposing.

Chairman Crosby noted that the Planning Division took a survey
of surrounding cities as to method of measurement their code
sets -forth.- He stated that all cities contacted measure from
property line not curb to curb. Chairman Crosby then pointed
out a "significant number of deficiencies he has detected after
redrawing the proposal to scale. He further stated that no
studies.'have been conducted to date on the effect of changing
the corner cut-off as it is currently listed in the Code. He
also pointed out that after -requiring dedication, some portion
of the corner cut-off area could -be on City property if the cut-
off is measured from curb to curb.
There being no other parties present to speak on the application,
the public hearing was closed.
Board discussion ensued. It was the consensus of the Board
to continue the applications to allow applicant to meet with
staff and further discuss the proposal. Applicant concurred
with continuance.

To permit a Children'-s Craft Fair to be held in the Barbeque
Area on Saturday, October 13, 1979 from 9:00 a.m. to 1:00 p.m.
in Lake Park:
The applicant was not present. Board reviewed the proposal
and found same to be within Ordinance Code conformance. It
was noted, however, that applicant must also have approval
from the Department of Harbors, Beaches, Parks, and Recreation
to hold the proposed event.
ON MOTION BY CROSBY AND SECOND BY OTT, SPECIAL EVENT NO. 79-23

Extension request for a permit for the use of a temporary trailer
as a church office pending completion of permanent facilities on
property located at the northwest corner of Newland Street and
Talbert Avenue.
Secretary Lipps outlined the requested use and the future plans
of the church.
ON MOTION BY LIPPS AND SECOND BY OTT THE BOARD GRANTED AN EX-
TENSION OF TIME FOR USE OF A TEMPORARY TRAILER AS A CHURCH OFFICE
TO OCTOBER 6, 1980, BY THE FOLLOWING VOTE:
