Secretary Lipps informed the Board that'the applicant had requested a continuance of one week to allow proper time for their presentation. Board concurred with continuance. Applicant concurred with continuance. There being no other parties present to speak on the applications, the public hearing was closed. ON MOTION BY CROSBY AND SECOND BY OTT CONDITIONAL EXCEPTION NOS. 79-41, 79-42, 79-43, 79-44, 79-45, 79-46, AND 79-47 WERE CON- TINUED TO OCTOBER 24, 1979, BY THE FOLLOWING VOTE: AYES: Lipps, Crosby, Ott NOES: None ABSENT: None TENTATIVE PARCEL MAP NO. 79-577 Applicant: John Cappocciama To permit the creation of four parcels from one existing parcel located on the northeast corner of Slater and Keelson. This application is covered by Negative Declaration No. 79-66. ON MOTION BY LIPPS AND SECOND BY CROSBY THE BOARD, HAVING FOUND THAT THE PROPOSED PROJECT WILL NOT HAVE A SIGNIFICANT ADVERSE EFFECT ON THE PHYSICAL ENVIRONMENT, ADOPTED NEGATIVE DECLARATION NO. 79-66 WITH THE MITIGATING MEASURES CONTAINED IN TENTATIVE PARCEL MAP NO. 79-577 GENERAL CONDITIONS 1 THROUGH 8 IMPOSED ON THE TENTATIVE PARCEL MAP APPLICATION, BY THE FOLLOWING VOTE: AYES: Lipps, Crosby, Ott NOES: None ABSENT: None Mrs. Anna Cappocciama was present to represent the application and acknowledged receipt of the suggested conditions of approval through the mail. The Board discussed access rights to the subject property as well as necessary street improvements at time of development. Board discussion followed. Conditions of approval were discussed. ON MOTION BY LIPPS AND SECOND BY OTT, TENTATIVE PARCEL MAP NO. 79-577 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: Minutes: H.B. The proposed Division of 2 parcels into 4 parcels for the purposes of residential development is in compliance with the size and shape of property necessary for that type of development. 2. The General Plan has set forth provisions for this type of land use as well as setting forth objectives for implementation of this type of use. 3. The property was previously studied for this intensity of land use at the time the land use designation for Medium -High Density Residential District which allows apartment buildings, was placed on subject property. 4. The size, depth, frontage, street width, and other design and improvement features of the proposed subdivision are proposed to be constructed in compliance with standard plans and specifi- cations on file with the City as well as in compliance with the State Map Act and supplemental City Subdivision Ordinance. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCELS FOR ANY PURPOSE: 1 1. The tentative parcel map received by the Department of Develop- ment Services on September 24, 1979 shall be the approved layout. 2. A copy of the recorded parcel map shall be filed with the Department of Development Services. 3. A parcel map shall be filed with, and approved by, the Department of Public Works, and recorded with the Orange County Recorder. 4. Existing structures, drive approaches and driveways to be removed or brought into compliance with current code require- ments at the time of development. 5. Access rights to Slater Avenue shall be dedicated.to the City at the time of development. GENERAL CONDITIONS: 1. Natural gas and 220V electrical shall be stubbed in at the .location of clothes dryers. 2. Natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 3. Low volume heads shall be used on all indoor spigots. Minutes: H.B. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 5. The structures on the subject property, whether attached or detached, shall be constructed in compliance with the state acoustical standards set forth for units that lie within the 60 CNEL contours of the property. Evidence of compliance shall consist of submittal of an acoustical analysis report, prepared under the supervision of a person experienced in the field of acoustical engineering, with the application for building permits. All measures recommended to mitigate noise to acceptable levels shall be incorporated into the design of the project. 6. If lighting is included in the parking lot, energy efficient lamps shall be used (e.g. high pressure sodium vapor, metal halide). All outside lighting shall be directed to prevent "spillage" onto adjacent properties. 7. A detailed soils analysis shall be prepared by a registered soils engineer. This analysis shall include on -site soil sampling and laboratory testing of materials to provide detailed recommendations regarding grading, chemical and fill properties, foundations, retaining walls, streets, and utilities. 8. A plan for silt control for all storm runoff from the property during construction and during initial operation of the project shall be submitted to the California Regional Water Quality Control Board staff for their review prior to the issuance of grading permits. AYES: Lipps, Crosby, Ott NOES: None ABSENT: None CONDITIONAL EXCEPTION NO. 79-48 Applicant: Robert Blinn To allow a zero foot setback in lieu of 30 foot setback located on the east side of Gothard Street, approximately 295 feet south of Slater Avenue. IN CONJUNCTION WITH: ADMINISTRATIVE REVIEW NO. 79-92 (Cont. from 10/3/79) Applicant: Robert Blinn To permit the construction of a 5,568 square foot industrial building located on the east side of Gothard Street, approximately 295 feet south of Slater Avenue. Minutes: H.B. Board of Zoning Adjustments Wednesday, October 17, 1979 Page Six. Mr.'Robert Blinn, the applicant, was present to represent the application. Chairman Crosby outlined the proposals to the Board. The public hearing was opened on Conditional Exception No. 79-48. Mr. Blinn explained his request as follows: He requested to construct his.building to be placed at zero foot setback to allow him access to the adjoining building, and if the pro- posed building would have to be cut down thirty feet, it would be too small to be properly utilized. He further stated that by allowing the building to be constructed at zero setback, he would have access all around the building. The Board discussed a previous Tentative Parcel Map that was approved by the Board on the subject property, however, Bruce Crosby noted that the Tentative Parcel Map has not been recorded as of this date. Secretary Lipps further noted that discussion took place at the time of the Tentative Parcel Map review that the existing building (adjoining the proposed building) must be brought into Ordinance Code conformance. Variations to lot split were discussed. There being no other parties present to speak on the applications, the public hearing was closed. Board discussion followed. Secretary Lipps explained to the applicant that the Board must find a hardship to grant a conditional exception, and that he felt the existing building would not be sufficient hardship to grant the request. Alternatives to the proposal were discussed. The Board suggested a continuance to the applicant of his applications to allow him time to redesign his plans for further Board review. Applicant concurred with continuance. ON MOTION BY CROSBY AND SECOND BY OTT CONDITIONAL EXCEPTION NO. 79-48 AND ADMINISTRATIVE REVIEW NO. 79-92 WERE CONTINUED TO OCTOBER 31, 1979, BY THE FOLLOWING VOTE: AYES: Lipps, Crosby, Ott NOES: None ABSENT: None PLOT PLAN AMENDMENT NO. 79-8 Applicant: Bernard Steinbera To permit the building of a storage garage approximately 400 square feet in size located on the north side of Bravata Drive, approxi- mately 750 feet west of Trinidad Lane. This request is a categorical exemption, Class 1, California Environ- mental Quality Act, 1970. Minutes: H.B. Board of Zoning Adjustments: Wednesday, October 17, 1979 Page Seven The applicant was not present. The public hearing was opened. Board discussed the proposal. The findings for a plot plan amendment were reviewed, and it was determined that the proposal met the findings of the Ordinance Code. There being no other parties to speak on the proposal, the public hearing was closed. Board discussion followed. ON MOTION BY LIPPS AND SECOND BY CROSBY, PLOT PLAN AMENDMENT NO. 79-8 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGSā€¢ 1. The Amendment does not constitute a substantial change. 2. The proposed use of property remains the same. 3. The dwelling unit density will not be increased. 4. The adjustment results in an improved plan. 5. The approval of this amendment does not alter the original approval date. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The plan received and dated April 30, 1979, shall be the approved layout. 2. The applicant shall comply with all conditions of approval as set forth in Tentative Tract 5483. AYES: Lipps, Crosby, Ott NOES: None ABSENT: None ADMINISTRATIVE REVIEW NO. 79-105 Applicant: Nick Becker To permit the construction of a 35,015 sq. ft. industrial building located at the southeast corner of Bolsa and Bolsa Chica. This request is covered by EIR 73-16, approved by the City Council on March 18, 1974. Minutes: H.B. Board of Zoning Adjustments Wednesday, October 17, 1979 Page Eight Messrs. Nick Becker and Fred Mayer were present to represent the application. Board reviewed the request and found same to be within Ordinance Code conformance. However, Secretary Lipps noted that the plan check revealed improper landscape dimensions which would have to be corrected for final plan check. Conditions of approval were discussed; ON MOTION BY LIPPS AND SECOND BY OTT, ADMINISTRATIVE REVIEW NO. 79-105 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOL- LOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received October 4, 1979, shall be the approved layout. In its approval action, the Board of Zoning Adjustments considered the following issues relating to tt+e conce}pttal plan: - Traffic circulation and drives; - narking layout; - Lot area; - Lot width and lot depth; - Tvpe of use and its relation to property and improvements in the immediate vicinity; - "ast administrative action regarding this property. 2. The following plans shall be submitted to the Secretary of the Board: a. Landscape and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code and landscaping specifications on file in the Department of Public Works. b. Rooftop mechanical equipment screening plan. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment. Board of Zoning Adjustments Wednesday, October 17, 1979 Page Nine ADMINISTRATIVE REVIEW NO. 79-106 Applicant: Dewayne Brown To permit construction of a 11,360 sq. ft. industrial building located on the south side of Oceanus, and west of Graham. This request is covered by EIR 73-16, approved by the City Council on March 18, 1974. Mr. Dewayne Brown, the applicant, was present. Secretary Lipps introduced the application to the Board. It was noted that the turning radius was six inches short, also landscaping was approximately 500 sq. ft. short of that required. Otherwise, the proposal was within substantial Ordinance Code conformance. Conditions of approval were discussed. ON MOTION BY LIPPS AND SECOND BY CROSBY, ADMINISTRATIVE REVIEW NO. 79-106 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received October 4, 1979 shall be the approved layout, subject to the modifications described herein: a. Revise plan to provide 25' turning radius b. Revise plan to show landscaping in compliance with Article 979 1 , A plan delineating said modifications shall be submitted to the Secretary of the Board. If such a plan complies with the modifications outlined by the Board, said plan shall be approved and made a permanent part of the administrative file. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan; - Traffic circulation and drives; - Parking layout; - Lot area; - Lot width and lot depth; - Type of use and its relation to property and improvements in the immediate vicinity; Past administrative action regarding this property. 2.
