IN CONJUNCTION WITH: CONDITIONAL EXCEPTION NO. 79-46 (Cont. from 10/17/79) Applicant: Corona Construction & Development Company To permit a. measurement of corner cutoff from curb line to curb line located on the southeast corner of 21st Street and Palm. IN CONJUNCTION WITH: CONDITIONAL EXCEPTION NO. 79-47 (Cont. from 10/17/79) Applicant: Corona Construction & Development Company To permit a measurement of corner cutoff from curb line to curb line located on the southeast corner of 20th Street and Palm. These applications are categorical exemptions, Class 5, California Environmental Quality Act, 1970. Mr. Eric Turshman was present to represent the applications. The public hearing was opened. Chairman Crosby -informed the Board that the Traffic Engineer had submitted a report based on the drawings submitted by the applicant. His findings were that on the lots in question the position of the buildings (as directed by the set back require- ments) does not encroach into the standard 25 ft. sight triangle used elsewhere in Huntington Beach. Furthermore, he will be recommending an Ordinance change which will change the method of measuring the sight triangle so that it can be applied equitably to the town lot areas as well as to the other residential land uses. Secretary Lipps noted that the request being considered was actually for a reduction in corner cut off as measured from the property lines rather than for a curb to curb measurement as stated in the applications. He'further stated that the sight distance for traffic is more restrictive in' the townlot area than in the rest of the City, and that the applicant meets the intent of the Code. Minutes: H.B. Board of Zoning Adjustments Wednesday, October 24, 1979 Page Three Secretary Lipps further informed the Board and the applicant's representative that Conditional Exceptions have been filed with the Planning Commission to relieve the requirement for dedication on Palm and Orange. A Precise Plan of Street Alignment request has been filed by the Huntington Beach Company to allow Palm Avenue to remain at its present 70 ft. width instead of the required dedication to 80 ft. as indicated on the Master Plan of Arterial Streets and Highways. There being no other parties present to speak on the applications, the public hearing was closed. Board discussion followed. Conditions of approval for Conditional Exception Nos. 79-44 and 79-45 were discussed. It was concluded that the remainder of the applications were to be referred to the Planning Commission to be heard in conjunction with other appli- cations filed by the applicant. Because of the comparably short curb radius and the oversized parkway widths at this location, a 25 foot by 25 foot sight angle would be inconsistent with the encroachment permitted in like residential developments on corner lots with standard curb radii. 2. Inasmuch as code sections intent is to provide traffic visibility this exception will create no greater degree of hazard than exists in other residential areas. 3. To impose the requirements of Section 9356.4(c)(2) would be to deny the subject property of parity with either 25 foot lots in the vicinity as well as other single family dwellings on standard lots. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received September 21, 1979, shall be the approved layout, subject to the modifications described herein: a. Revise plan to reflect corner cut off coinciding with typical cut off in R1 zone. b. Revise plan to show required dedications, radius at corner and dimension to centerline of street. A plan delineating said modifications shall be submitted to the Secretary of the Board. If such plan complies with the modifications outlined by the Board, said plan shall be approved and made a permanent part of the administrative file. B. GENERAL CONDITIONS: 1. This application is a categorical exemption, Class 3, California Environmental Quality Act, 1970. Messrs. Matalon, UCB,, Jack Higley, UCB; and Perlmutter, Architect; were present to represent the application. Secretary Lipps introduced the application to the Board and noted that the proposal was within substantial Ordinance Code conformance. Existing and future entrance drives were discussed. Board reviewed conditions of approval with applicant. ON MOTION BY CROSBY AND SECOND BY LIPPS ADMINISTRATIVE REVIEW NO. 79-96 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received October 1, 1979, shall be the approved layout. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: Minutes: H.B. The following plans shall be submitted to the Secretary of the Board: a. Landscape and irrigation plan complyj-ng with Article 979 of the Huntington Beach Ordinance Code and landscaping specifications on file in the Department of Public Works for new landscaping only. b. Rooftop mechanical equipment screening plan. Said plan shall indicate screening of all rooftop mechanical equip- ment and shall delineate the type of material proposed to screen said equipment. To permit an adjustment of the common line between Lots 9 and 10 of Tract 9580 located on the southeast corner of Delaware and Atlanta. This application is a categorical exemption, Class 5, California Environmental Quality Act, 1970. Mr. Frank Thompson was present to represent the application. Mr. Thompson addressed the Board and noted that the lot line adjustment request was made due to a Coastal Commission require- ment for 75 low cost housing units on the subject property, therefore HUD requested a physical connection to Delaware, thereby shifting the lot line to the proposed access point. Board reviewed the application and found same to be within substantial ordinance code conformance. Conditions of approval were discussed. ON MOTION BY CROSBY AND SECOND BY OTT LOT LINE ADJUSTMENT NO. 79-6 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: St Minutes: H.B. The conceptual plot plan and elevations received October 9, 1979, shall be the approved layout. B. GENERAL CONDITION: 1. Approval of this lot line adjustment is subject to all criteria as set forth in Section 9811.3.1 of the Huntington Beach Ordinance Code. AYES: Lipps, Crosby, Ott NOES: None ABSENT: None CONDITIONAL EXCEPTION NO. 79-49 Applicant: Robert Shaw To permit a reduction in front yard setback for courtyard wall to a minimum of 4-1/2 feet located on the north side of Trophy, at the Lark Lane intersection. This application is a categorical exemption, Class 5, California Environmental Quality Act, 1970. Mr. Robert Shaw, the applicant, was present. The public hearing was opened. Mr. Shaw explained his proposal to the Board noting that the lot configuration and depth at the westerly property line is unique because of the cul-de-sac street. He further stated that he received no objections from his neighbors to the proposal. The Board noted that the property line curved and that the minimum dimension is 10 ft. to the property wall. There being no other parties present to speak on the application, the public hearing was closed. Board discussion ensued. Findings and conditions of approval were discussed. ON MOTION BY LIPPS AND SECOND BY OTT CONDITIONAL EXCEPTION NO. 79-49 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: Minutes: H.B. Board of Zoning Adjustments Wednesday, October 24, 1979 Page Nine FINDINGS• 1. The lot configuration and depth at the westerly property line is unique because of the cul-de-sac street. 2. The amount of encroachment is limited to conform with the approxi- mate configuration of the front property line and affords adequate sight angle setback for traffic visibility as well as aesthetic view. 3. The granting of the Conditional Exception will not constitute a grant of special privilege inconsistent upon other properties in the vicinity and under an identical zone classification. 4. Because of special circumstances applicable to the subject property, including size, shape, topography, location, or surroundings, the strict application of the zoning ordinance is found to deprive the subject property of privileges enjoyed by other properties in the vicinity and under identical zone classifications. 5. The granting of a Conditional Exception is necessary in order to preserve the enjoyment of one or more substantial property rights. 6. The granting of a Conditional Exception will not be materially detrimental to the public welfare, or injurious to property in the same zone classifications. 7. The granting of the Conditional Exception will not adversely affect the General Plan of the City of Huntington Beach. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received October 9, 1979, shall be the approved layout, subject to the modifi- cations described herein: a. A revised plan showing a minimum ten (10) foot setback from the front property line beginning at approximately the easterly edge of the existing driveway and terminating at the westerly property line. A plan delineating said modifications shall be submitted to the Secretary of the Board. If such plan complies with the modifications outlined by the Board, said plan shall be approved and made a permanent part of the administrative file. Board of Zoning Adjustments Wednesday, October 24, 1979 Page Ten USE PERMIT NO. 79-36 Applicant: Edward Linse To permit an arcade to be located on the north side of Main Street, approximately 175 feet east of Walnut Avenue. This request is a categorical exemption, Class 1, California Environmental Quality Act, 1970. Mr. Dick McDonnell was present to represent the application. The public hearing was opened. Mr. McDonnell outlined his proposal to the Board stating that 30 machines are proposed in a carpeted and brightly lit location. Due to the fact that the arcade was geared towards school -age children, Mr. McDonnell stated that bike racks would be pro- vided for their needs. There being no other parties present to speak on the application, the public hearing was closed. Board discussed the proposal and Secretary Lipps noted that the proposed location had a similar use approved in 1976 at which time it was established that two parking spaces were to be provided behind the building, therefore, as a condition of approval, Secretary Lipps suggested that a revised plot plan be submitted to the Secretary of the Board depicting two parking spaces and the location of the proposed bicycle rack. ON MOTION BY CROSBY AND SECOND BY OTT USE PERMIT NO. 79-36 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS: 1.. The establishment, maintenance, and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in 'the vicinity; b. Property and improvements in the vicinity of such use or building. 2.• The granting of a Use Permit will not adversely affect the General Plan of the City of Huntington Beach. 3. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received October 11, 1979, shall be the approved layout subject to the modifications described herein: a. Submit revised plot plan showing parking and location of bicycle rack. A plan delineating said modifications shall be submitted to the Secretary of the Board. If such plan complies with the modifications outlined by the Board, said plan shall be approved and made a permanent part of the administrative file. B. GENERAL CONDITIONS: 1. There shall be two (2) parking spaces provided at the rear of the building and the bicycle rack shall be located in such a manner that it will not interfere with the opening of doors of automobiles using said parking spaces. 2. Signs shall conform with Article 976 of the Huntington Beach Ordinance Code. The applicant was not present. Board discussed the proposal and found same to be within Ordinance Code conformance. ON MOTION BY OTT AND SECOND BY CROSBY, SPECIAL EVENT NO. 79-27 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: Minutes: H.B.
