BOARD MEMBERS: Lipps, Crosby, Ott MINUTES: ON MOTION BY CROSBY AND SECOND BY OTT THE MINUTES OF THE REGULAR MEETING OF NOVEMBER 7, 1979, WERE APPROVED, AS AMENDED, BY THE FOLLOWING VOTE: AYES: Lipps, Crosby, Ott NOES: None ABSENT: None REGULAR AGENDA ITEMS: USE PERMIT NO. 79-35 (Cont. from 11/7/79) Applicant: Family Home Builders, Inc. To permit the construction of an 18,832 square foot office building located at the northeast corner of Graziadio Drive and Beach Boulevard. This request is covered by Negative Declaration No. 79-70. ON MOTION BY CROSBY AND SECOND BY LIPPS THE BOARD, HAVING FOUND THAT THE PROPOSED PROJECT WILL NOT HAVE A SIGNIFICANT ADVERSE EFFECT ON THE PHYSICAL ENVIRONMENT, ADOPTED NEGATIVE DECLARATION NO. 79-70 WITH THE MITIGATING MEASURES CONTAINED IN USE PERMIT NO. 79-35 GENERAL CONDITIONS B-3 THROUGH B-7 IMPOSED ON THE USE PERMIT APPLICATION, BY THE FOLLOWING VOTE: AYES: Lipps, Crosby, Ott NOES: None ABSENT: None Messrs. Ray Miller and Howard Coburn were present to represent the application. Secretary Lipps introduced the application to the Board noting that it had been continued previously due to driveway concerns. The public hearing was opened. Mr. Coburn stated that he had met with the City Engineer regarding driveway concerns, and has subsequently revised his plan to reflect the southerly driveway to be utilized as a one way exit only, thus alleviating possible traffic congestion. Board discussion revolved around the new driveway proposal, trash bin location, and the curbs along the north and south sides of Building "C", which Mel Ott requested to have painted red and "No Parking - Fire Lane" signs to be posted. Findings and con- ditions of approval were discussed. ON MOTION BY CROSBY AND SECOND BY LIPPS, USE PERMIT NO. 79-35 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS: 1. The establishment, maintenance, and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2. The granting of a Use Permit will not adversely affect the General Plan of the City of Huntington Beach. 3. The proposal is consistent with the City's General Plan of Land Use. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The revised conceptual plot plan and elevations received November 14, 1979, shall be the approved layout. In its approval action, the Board of Zoning Adjustments con- sidered the following issues relating to the conceptual plan: Traffic circulation and drives; Parking layout; Lot area; Lot width and lot depth; Type of use and its relation to property and improvements in the immediate vicinity; Past administrative action regarding this property. Landscape and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code and landscaping specifications on file in the Department of Public Works. b. Rooftop mechanical equipment screening plan. Said plan shall indicate screening of all rooftop mechanical equip- ment and shall delineate the type of material proposed to screen said equipment. B. GENERAL CONDITIONS: 1. The southerly driveway shall be posted as a one way exit only. 2. The curbs along the north and south sides of Building "C" shall be painted red and "NO PARKING - FIRE LANE" signs shall be posted to Fire Department approval. 3. Natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 4. Low volume heads shall be used on all indoor spigots. 5. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 6. If lighting is included in the parking lot, energy efficient lamps shall be used (e.g. high pressure sodium vapor, metal halide). All outside lighting shall be directed to prevent "spillage" onto adjacent properties. 7. Trees presently existing on site shall be preserved if possible. All trees removed shall be replaced with two 30 inch box trees in addition to the standard landscaping requirement. This application is covered by Negative Declaration No. 79-92. ON MOTION BY CROSBY AND SECOND BY LIPPS THE BOARD, HAVING FOUND THAT THE PROPOSED PROJECT WILL NOT HAVE A SIGNIFICANT ADVERSE EFFECT ON THE PHYSICAL ENVIRONMENT, ADOPTED NEGATIVE DECLARATION NO. 79-72 WITH THE MITIGATING MEASURES CONTAINED IN ADMINISTRATIVE REVIEW NO. 79-107 GENERAL CONDITIONS B-2 THROUGH B-6 IMPOSED ON THE ADMINISTRATIVE REVIEW APPLICATION, BY THE FOLLOWING VOTE: AYES: Lipps, Crosby, Ott NOES: None ABSENT: None Mr. Sam Sogoian, the applicant, was present. Chairman Crosby introduced the application to the Board and noted that the application had been continued previously due to improper turning radii. Secretary Lipps noted that a plan check revealed the application to be within substantial ordinance code conformance and that the radii deficiency could be -corrected throog'i-conditions of approval imposed on the application. It was suggested that the landscaping could be reduced, and it was further noted that the applicant was over in parking, thereby a redesign of the plan could result in proper turning radii. It was also noted by the Board that_a_ lot line was in existance on the proposal, and that a parcel map, com- bining the two parcels be approved by the City and recorded with the County prior to occupancy of the building. Conditions of approval were discussed. ON MOTION BY LIPPS AND SECOND BY CROSBY, ADMINISTRATIVE REVIEW NO. 79-107 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received October 15, 1979, shall be the approved layout, subject to the modifications described herein: 1 Minutes: H.B. Secretary Lipps introduced the applications to the Board. The possibility of reciprocal access and parking between the pro- posals was discussed in order to provide adequate parking within reasonable reach of all proposed buildings. It was further discussed by the Board to eliminate separation walls which might hinder access to and from the proposals. The Board further noted that a parcel map is required to combine lots 8 and 9. Conditions of approval were discussed. ON MOTION BY LIPPS AND SECOND BY CROSBY, ADMINISTRATIVE REVIEW NO. 79-97 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. This application is a categorical exemption, Class 5, California Environmental Quality Act, 1970. Mr. Donald Ball, the applicant, was present. The public hearing was opened. Chairman Crosby introduced the application to the Board. Mr. Ball addressed the Board and stated that his house sits on an irregular shaped lot and that one section of the house is presently located at the requested setback of 516". Board reviewed the proposal noting that the closest adjoing neighbor was approximately 20 feet away from the proposed encroachment. It was the consensus of the Board that the house was built on an irregular shaped lot and that justifiable hardship did indeed exist. There being no other parties present to speak on the application, the public hearing was closed.
