MINUTES: ON MOTION BY SPENCER AND SECOND BY OTT, THE MINUTES
OF THE REGULAR MEETINGS OF NOVEMBER 14, and 15, 1979,
WERE DEFERRED UNTIL THE NEXT REGULAR MEETING BY THE
FOLLOWING VOTE:

CONDITIONAL EXCEPTION NO. 79-55 (Cont. from 11/7/79)
Applicant: Kathleen Johnson
To permit a five foot encroachment into corner cut off located
on the southwest corner of 21st Street and Pecan Avenue.
This application is a categorical exemption, Class 5, California
Environmental Quality Act, 1970.
Kathleen Johnson, the applicant, was present.
Secretary Spencer introduced the application to the Board, giving
a brief background of the previous continuance. He stated that
the request was previously continued pending the outcome of a
Planning Commission hearing on a code amendment. He noted that
the code amendment was to alter the distance of corner cut off,
however, the amendment was denied by the Planning Commission
at its meeting of November 19, 1979. Therefore, Mr. Spencer
informed the Board and the applicant that the application would
be looked upon as a variance request whereby a demonstration of
justifiable hardship must be shown by the applicant.
The public hearing was opened.
Previous similar requests were discussed and their reason for
approval. The Board reiterated that the applicant must demon-
strate a hardship for the requested encroachment. The applicant
requested a two week continuance of the Board to allow her time
to prepare additional information for further Board consideration.
Board concurred with the request.

There being no other parties present to speak on the application,
the public hearing was closed.
ON MOTION BY SPENCER AND SECOND BY OTT CONDITIONAL EXCEPTION NO.
79-55 WAS CONTINUED TO DECEMBER 5, 1979, BY THE FOLLOWING VOTE:

CONDITIONAL EXCEPTION NO. 79-57
Applicant: Craig Combs Assoc.
To permit a zero setback at side of property line of a parking
structure located approximately 290 feet west of Beach Boulevard,
500 feet south of Taylor.
This request is a categorical exemption, Class 5, California
Environmental Quality Act, 1970.
Messrs. David Shubin and Cal Fletcher were present to represent
the application.
Secretary Spencer introduced the application to the Board, stating
that the applicant was requesting an encroachment into a proposed
tennis court setback which is proposed on top of a parking structure.
The public hearing was opened.
The applicants. explained their proposal to the Board noting that
if only one tennis court was built, according to code conformance
with proper setbacks, a considerably large space would be left
which could cause littering or other related problems.
The Board further noticed that the proposed tennis courts would
face the adjoining automobile dealer storage facility and would
not intrude in any residential visibility.
There being no other parties present to speak on the application,
the public hearing was closed.
Further discussion ensued regarding the proper turnaround radius
required in front of the parking structure and their proper drive-
way widths. It was the consensus of the Board that a hardship
did indeed exist and that the proposal would not have a detrimental
affect on the surrounding properties.

79-57 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS,

FINDINGSā¢
1. The proposed encroachment abuts property which is zoned, used,
and general planned commercial.
2. The physical makeup of the proposed encroachment consists of
a parking structure with a tennis facility on top surrounded
with a twelve (12) foot high fence which allows for the maximum
utilization for both usable and required open space.
3. The proposed parking/tennis structure is found not to have a
detrimental affect on the surrounding properties.
4. The proposed structure does not adversely affect the General Plan
of the City of Huntington Beach.
CONDITIONS OF APPROVAL: `
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The conceptual plot plan and elevations received November 2,
1979, shall be the approved layout for the Conditional Exception
request only.
2. All previous conditions of approval imposed on Use Permit No.
79-27 shall be complied with.

TENTATIVE PARCEL MAP NO. 79-580
Applicant: Jarrtrd Development
To permit the consolidation of two parcels into one parcel of land
located on the southeast corner of Florida and Kartron.
This request is a categorical exemption, Class 5, California
Environmental Quality Act, 1970.
The applicant was not present. Secretary Spencer noted that
according to the State Map Act, the applicant must be present
at the meeting to acknowledge receipt of the suggested conditions
of approval, therefore a one week continuance was suggested to
allow applicant to be present. Board concurred with continuance.

SPECIAL EVENT NO. 79-29
Applicant: Huntington Harbour Philharmonic Committee
To permit annual Symphony of Lights parade to be held December 8,
9, and from December 12 through 22, 1979. The subject project
will be held within the waters of Huntington Harbour channels,
with parking available in the Harbour Mall and Marina parking
lots.
The applicant was not present.
Secretary Spencer introduced the'application to.the Board noting
that the event had been held in -previous years with no registered
complaints on file. Secretary Spencer further noted that the
tram transportation had been done previously, also with no
registered complaints in the past.
ON MOTION BY SPENCER AND SECOND BY OTT, SPECIAL EVENT NO. 79-29
WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE:
CONDITIONS OF APPROVAL:
1. The site plan -and project description received and dated November
19, 1979, shall be the approved project.
2. The applicant shall obtain all necessary electrical permits.
3. An onsite inspection of the area by ,the Fire Department prior to
the event shall be required.
4. If the Committee proposes to rope off .any of the parking, a permit
shall be obtained from the City of Huntington Beach prior to any
such blockage to assure that there is sufficient access remaining
for emergency vehicles.
5. A certificate of insurance form shall be filed'in the License
Division of the Finance Department ten (10) days prior to the event.
