Planning Commission December 4, 1979 Page 3 CODE AMENDMENT NO. 79-6 (Cont. from 11-20-79) Initiated by the Department of Development Services Proposed amendment to the ordinance code to clarify the dimension and method of measurement of the required corner cutoff in the residential districts and to delineate restrictions on what is allowed within that triangular cutoff. The subject code amendment had been modified and accepted by the Commission at the meeting of November 20, 1979. Staff dis- cussed the implementing ordinance as drafted by the City Attorney's office and suggested minor revisions, with which the Commission concurred. The public hearing was opened and closed. City Engineer George Tindall informed the Commission that the Traffic Model should be available for the meeting of December 18. E. Hartge (Cont. from 11-20-79) To permit subdivision of one existinglot into four (4) lots and the modification of an existing marina located at the southwest corner of Davenport Drive and Edgewater Lane. Staff suggested that the Commission consider a recommendation to the City Council for the establishment of a pier head line in this marina at this time, such line drawn to maintain a minimal clear width of 90 feet through the channel area. _ The public hearing was reopened. Bill Hartge addressed the Commission to respond to the concerns which had been expressed at the prior meeting. He requested approval of his project, saying that it will result in a better living environment, an improved recreational area and better visual impact, and will provide a wider navigable channel than presently exists. There were no other persons to speak in regard to the matter, and the public hear- ing was closed. Commissioner Shea, noting that she had been absent at the first hearing, asked if -the neighbors' concerns had all been resolved. After some discussion with members of the audience, Chairman Bazil reopened the public hearing and requested input in regard to the presentation made at this meeting by the applicant. Orville Batchellor discussed the original intent for the parking lot at the marina, saying that in the beginning it had been required to pro- vide a certain number of spaces for visitors to the public beach but that that requirement had apparently been abandoned by the City at some past date. He strongly objected to a reduction of parking below the minimum required by code and expressed,concern that the landscaping be sufficient to screen the lot. Bill Craig also voiced concern on the parking and landscaping and asked that staff takelcare to asc.ertain that sufficient room remained for landscape screening, especially on the street side and the side adjacent to thd dwelling unit. Extensive discussion took place in regard to the negative declara- tion. Staff explained that upon review of the prior negative declaration a determination of no significant environmental effect had been made and a new negative declaration had been judged not to be necessary. The Chairman directed staff to check into whether or not a new negative declaration form had been accepted and a fee paid, as claimed by the applicant; if so, the fee was directed to be refunded. Consideration was also given to some means of assuring that the parking lot which will remain after completion of this project cannot in the future also be developed as a residential lot. The Commission gave staff detailed direction on the points they wanted included in conditions of approval for this project. Planning Commission December 4, 1979 Page 6 A recess was called at 9:20 p.m. Commissioner Stern arrived at the meeting during this recess; the Commission reconvened at 9:30 p.m. OLD CIVIC CENTER SPECIFIC PLAN NO. 79-1/EIR 79-1 Applicant: Department of Development Services Certification of the environmental impact report prepared for the construction of the senior citizens facility on the old civic center site and approval of redesignation of the subject location from CF-C to Old Civic Center Specific Plan No. 79-1. Stephen Kohler, Senior Community Development Specialist for the City, gave a brief overview of the project for the Commission's in- formation, identifying the main issues as compatibility with the downtown improvement efforts of the City, the consistency with the General Plan, and seismic considerations which might make more inten- sive development of the property questionable. Brian Norkaitis, representing the William Lyons Company, explained the rationalefor the reduced parking ratios and the assignments of parking spaces to tenants. The public hearing on the EIR and the specific plan was opened. The Lyons representative addressed the Commission to urge adoption of the proposals. There being no other persons to speak for or against the requests, the public hearing was closed. The Commission discussion which followed concerned the accuracy of the EIR in addressing the water and sewer impacts of the project and the assurance that public access will be provided through the project between 5th and 6th Streets, as required when the development plans had been approved previously. Planning Commission December 4, 1979 Page 7 Commissioner Bauer said that his abstention was based on his belief that the plan has not properly addressed itself to the concept of compatibility with the downtown revitalization efforts. CONDITIONAL USE PERMIT NO. 79-29/NEGATIVE DECLARATION NO. 79-73 Applicant: Robert E. Jarrard To permit construction of a 60-unit rooming and/or boarding house located on the east side of Florida Street approximately 850 feet south of Main Street. Jim Barnes outlined the project, noting that '.-he code contains no precise definition of "rooming house." However, after consulta- tion with the Attorney's office it has been determined that the project is more appropriately described as multiple -family housing which is specifically prohibited in the particular zone for which it is requested. Legal counsel Jim Georges gave a verbal legal opinion concurring with staff's interpretation. The public hearing was opened. Robert Jarrard addressed the Commission. He noted that while the ordinance code does allow establishment of rooming houses the code does not provide a definition of that use, leaving developers without guidance. He stated that he had received no cooperation from staff, had been granted no meetings in regard to his pro- posal, and had therefore been unable to carry his project forward. He also took exception to what he termed the incomprehensible legal opinion rendered on the proposal. The public hearing was closed. The Commission discussed the project, considering the need for the type of housing proposed, the alleged ambiguity in the code, the uniqueness of the particular property for which the project is proposed, and the intent of and uses allowed in the R5 district. A MOTION WAS MADE BY GREER AND SECONDED BY BAUER TO DENY CONDI- TIONAL USE PERMIT NO. 79-29. Commissioners Stern and Kenefick suggested that, rather than outright denial of the project, the Commission work with the ap- plicant as he has requested to try to resolve the situation by some means, such as a change of zone or a specific plan which would allow the use. Chairman Bazil also agreed that housing of this nature is needed in that location, but pointed out the effect of permitting such a use to go into the R5 district would be that there would be no basis in the future for refusing any other applicant who might want to put the same use in the same district in any other location in the city. Mr. Bazil also out- lined for the Commission's information the reasons why the multiple - family use had been specifically prohibited in the district by prior action. -7- 12-4-79 - P.C. Minutes, H.B. Planning Commission December 4, 1979 Page 8 Secretary Palin noted that it might -be possible to amend the bound- ary of the Pacifica Specific Plan to include the subject parcel. He also attempted to respond to the applicant's allegations, saying that the staff had tried to discuss alternative approaches with Mr. Jarrard; however, he was stopped by the chairman. ON MOTION BY BAUER AND SECOND BY GREER THE COMMISSION OVERRODE THE CHAIR'S RULING AND DETERMINED TO ALLOW MR. PALIN TO BE HEARD, BY THE FOLLOWING VOTE: AYES: Winchell, Kenefick, Stern, Bazil, Greer, Shea, Bauer NOES: None ABSENT: None ABSTAIN: None Mr. Palin then advised the Commission that the staff had informed the applicant early on in the application process that his project should in its opinion be classified as multiple -family and had suggested application for a code amendment or zone change rather than pursuit or the conditional use permit; the applicant, however, had indicated that he would prefer to continue the present application. He also said that the staff is encouraged by the desirability of such a pro- ject in the proposed location and had indicated to the applicant that the opinion on his project had by no means meant opposition to the type of housing he is proposing, but merely that the staff sees no way under the code where a housing density of 60 units per acre can be allowed without granting special privilege and unequal treat- ment under the law. Mr. Palin also noted that the staff has met with the developer on the subject application, and would continue to attempt to work with him. He suggested that perhaps a specific plan could be devised for the location, or that a code amendment could be prepared with very restrictive locational criteria written in to assure strict control over where such a.use could be permitted in the community. The Commission discussed the viability of the suggestions made. Commissioner Kenefick pointed out that, although the need is clear for lower cost housing, any efforts to provide it must be carefully worked out to avoid problems which could result from the high density. Timing involved with a code amendment was discussed. Minutes, H.B. Planning Commission December 4, 1979 Page 9 FINDINGS FOR DENIAL: 1. The proposed development is more appropriately defined as multiple -family development than as a rooming house. 2. Multiple -family development is expressly prohibited in the R5 District. AYES: Winchell, Kenefick, Bazil, Greer, Bauer NOES: Stern, Shea ABSENT: None ABSTAIN: None Staff was directed to initiate work immediately on some method- ology which will permit construction of the proposed nature to take place in certain narrowly specified areas of the city with application of restrictive criteria. Commissioner Shea left the meeting at 10:50 p.m. SIXTH YEAR HOUSING AND COMMUNITY DEVELOPMENT BLOCK GRANT APPLICATION Initiated by the Department of Development Services Stephen Kohler reviewed the process under which the application had been prepared. The public hearing was opened. Carol Rulard, Director of the Fair Housing Council, addressed the Commission to describe the activities and services offered by that body. There being no other persons present to address the Commission, the public hearing was closed. Commission discussion ensued. Commissioner Greer questioned the inclusion of so many public works projects in the program, ex- pressing the�opinion that these should perhaps be handled through regular city funding, leaving the HCD program to address low - and moderate -income needs. The possibility of modifying the program as it progresses was considered; staff agreed that it would probably be possible to change the program if it were found to be necessary or desirable to do so. A MOTION WAS MADE BY STERN AND SECONDED BY GREER THAT THE APPLI- CATION BE SENT BACK TO THE COMMITTEE WITH INSTRUCTIONS FOR REVISION THAT WOULD INCLUDE INNOVATIVE MECHANISMS THAT WOULD ALLOW FOR PROVISION OF LESS COSTLY HOUSING IN THE COMMUNITY. Mr. Kohler noted that the filing deadline under which he is working would make such a referral back to committee difficult to implementr and the motion was withdrawn. -9- 12-4-79 - P.C. Minutes, H.B. A motion was made by Bazil that the Commission recommend adoption of the Sixth Year Block Grant Application, with suggestions for revision forwarded to the City Council as items of concern. Motion failed for lack of a second. Savoy Bellavia noted that there are three separate issues and asked that they be addressed separately. He informed the Commission that the revisions to the site plan were necessitated by Coastal Commis- sion requirements for 75 units of low/moderate income housing within the project; these revisions consist only of rearrangement of the layout with no loss -of parking spaces or deviation from code. Mr. Frank Thompson, of W & B Builders, described the system, outlining gate mechanism, turning areas, and stacking areas at both the main and secondary entrances. Planning Commission December 4, 1979 Page 11 The conceptual landscaping plan was reviewed by the Commission in light of its prior consideration of an assessment district or other means of providing maintenance for the landscaping within the public right-of-way. Because of the attorney's opinion that an assessment district of this nature must be reinstituted each year, Mr. Thompson indicated a reluctance to impose the additional yearly cost of such a district upon the future owners of the project and asked that some other means of maintenance be devised. Legal counsel Jim Georges informed the Commission that after review it is his department's recommendation to proceed by way of a landscaping maintenance agreement providing that the appli- cant's concurrence can be obtained. Mr. Thompson said that his company is agreeable to such an approach. Staff informed the Commission that the Department of Public Works has agreed to the installation of the meandering sidewalk as shown on the plan. ON MOTION BY STERN AND SECOND BY KENEFICK THE CONCEPTUAL LAND- SCAPING PLAN FOR TENTATIVE TRACT 9580 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. Upon his concurrence received on December 4, 1979, the dev- eloper and/or the future homeowners' association as they proportionally hold title to the property shall be required to maintain the landscaping within the public right-of-way. This requirement shall be incorporated into the Conditions, Covenants, and Restrictions for the subject tract. 2. If the developer and/or the homeowners' association does not adequately maintain the landscaping within the public right-of- way, the City is authorized to do so and bill the developer or the association. If this fee is not paid, the City is authorized to assess the developer and/or the homeowners' association on the following year's property tax rolls for the costs incurred for such maintenance. This provision shall also be incorporated into the project Conditions, Covenents, and Restrictions. Savoy Bellavia explained that the applicant is requesting deletion of the requirement for installation of gas stub -ins at the location of _11- 12-4-79 - P.C. Minutes, H.B. Planning Commission December 4, 1979 Page 12 water heaters; this is being requested because it is the intention to install a solar heating system for this purpose with an electrical backup system. It was emphasized that this solar system will be ihstalled only in the future ownership units and not in the 75 rental unit portion of the complex. Jerry Ricco, representing the solar development firm which will install the devices, addressed the -Commission to explain the layout and function. He stated that there will be two 3 x 7 panels for each unit installed on south -facing roofs and faced with special silver glass with a stippled surface to reduce reflect' -on He also noted that the panels are planned to go as close as possible to the cone of the second story roofs so that they will look like skylights in the tile roofs and should present a good visual appearance from adjacent streets. Commission discussion ensued. ON MOTION BY STERN AND SECOND BY KENEFICK CONDITION NO. 5 OF THE ORIGINAL CONDITIONS IMPOSED ON THIS PROJECT WAS AMENDED TO DELETE THE REQUIREMENT FOR GAS STUB -INS AT THE LOCATIONS OF WATER HEATERS FOR THE PRIVATE OWNERSHIP UNITS ONLY, WITH THE PROVISION THAT THE GLASS USED IN THE SOLAR COLLECTOR SYSTEMS SHALL BE THE SILVER STIPPLED GLASS AS DESCRIBED BY THE APPLICANT AT THIS HEARING, BY THE FOLLOWING VOTE: AYES: Winchell, Kenefick, Stern, Bazil, Bauer NOES: Greer ABSENT: Shea ABSTAIN: None GENERAL PLAN AMENDMENT NO. 80-1 Initiated by Department of Development Services Amendment to consider requests by private property owners to change land use designations on a site south of Garfield Avenue, two sites east of Goldenwest Street, and one site south of Talbert Avenue and west of Beach Boulevard. Also included is a request by the Planning Division to add energy conservation policies to the Land Use Element. It was staff's request that discussion on this item be continued. Commissioner Greer requested that the economics aspects of the general plan amendment be clarified prior to the next hearing. COMMISSIONER ITEMS: Commissioner Greer requested a periodic update on the number and status of land use, zoning, etc., violations which are being handled by staff. In conjunction with this request, Secretary Palin indi- cated that he is considering asking the City Council to again review the possibility of using sworn officers as land use technicians. -14- 12-4-79 - P.C.
