Commissioner Stern pointed out that the conditions of approval for the conceptual landscaping plan for Tentative Tract 9580 had not included an authorization for the City to bill the developer and/or the homeowners' association for necessary maintenance of landscaping prior to adding such costs to the tax assessment roll for the following year. Commissioner Stern discussed Conformance with General Plan No. 79-21 and Resolution No. 1255, concerning the County's proposal for Bolsa Chica Linear Park. of concern to Mr. Stern was the pro- posed park's consistency with the Local Coastal Program and the relationship,of the linear park boundary to any future alignment of 38th Street along the bluff. Staff informed the Commission that the City has committed to preparing a conceptual alignment for 38th Street within 180 days and that, although no detailed plan for the park has been received from the County, it is the assumption that the eastern edge of the linear park would roughly set the western edge of 38th Street. However, the State is also involved in establishing setbacks from the bluffline and in the appeal to a housing project adjacent to the bluff, and the staff indicated a reluctance to including mention of the street con- figuration in either the finding of conformance or the resolution at this time. Peggy Williams of the Women's Transitional Living Center, a facility to.serve battered women of Orange County, addressed the Commission to describe the services offered by the center and request that the organization be considered for funding in the Sixth Year Block Grant. Dean Albright, a member of th- Citizens Advisory Board.. addressed the Commission to outline the problems and procedures of that body in its review of the sixth year application. He said that there had been some confusion and apparent misunderstanding of the Board's ability to change the previously adopted three-year program; a public meeting of the Board has been set for December 26 and it is proposed to provide additional input for the City Council's review of the Sixth Year Block Grant Application. There being no other persons to speak on the subject application, the public hearing was closed. Extensive discussion among Commission members and staff followed. A MOTION WAS MADE BY BAUER AND SECONDED BY WINCHELL THAT THE COMMIS- SION RECOMMEND ADOPTION OF THE SIXTH YEAR BLOCK GRANT APPLICATION TO THE CITY COUNCIL AND THAT THE COMMISSION'S TRANSMITTAL INCLUDE THE COMMENTS SUBMITTED BY TWO PLANNING COMMISSIONERS AND A REQUEST THAT THE CITIZENS' ADVISORY BOARD BE PERMITTED TO MAKE A PRESENTATION IN THE FORM OF A MINORITY REPORT. MOTION IS TO INCORPORATE A STATEMENT THAT THE LIST OF PROJECTS INCLUDED IN THE SIXTH YEAR BLOCK GRANT APPLICATION ARE NOT PRECISELY THOSE WHICH MEET THE PHILOSOPHY OF EITHER THE COMMISSION OR THE CITIZENS' ADVISORY BOARD. MOTION FAILED BY THE FOLLOWING VOTE: AYES: Shea, Bazil, Bauer NOES: Winchell, Kenefick, Stern, Greer ABSENT: None ABSTAIN: None Secretary Palin suggested that the Commission might like to advise the Council that it does not appear that the established review pro- cess under the three-year planning program is working successfully because of changing needs and philosophies in the community and that the Council might wish to establish some guidelines for staff, the Board, and the Commission to consider in amending that program. -2- 12-18-79 - P.C. December 18, 1979 Page 3 A motion was made by Stern that the Commission not accept the recommendations in the Sixth Year Block Grant Application and reallocate the funds. Motion failed for lack of a second. Steve Kohler cautioned the Commission that it is his feeling that the Commission cannot unilaterally change the recommenda- tions of the Citizens' Advisory Board. ON MOTION BY SHEA AND SECOND BY WINCHELL THE COMMISSION DETERM- INED TO FORWARD THE SIXTH YEAR BLOCK GRANT APPLICATION TO THE CITY COUNCIL WITH THE COMMENTS SUBMITTED IN WRITING BY MEMBERS OF THE COMMISSION AND THE RECOMMENDATION FOR ESTABLISHMENT OF GUIDELINES FOR FUTURE YEARS' APPLICATIONS, BY THE FOLLOWING VOTE: AYES: Winchell, Kenefick, Bazil, Greer, Shea, Bauer NOES: Stern ABSENT: None ABSTAIN: None Commissioner Stern indicated his desire to submit a minority re- port to include the fact that he would like to see $150,000 allocated to the construction of the Lake Street Fire Station and that some means of providing a clear understanding of the role of the Citizens' Advisory Board be worked out. Commissioner Kenefick stated that she might provide further input for the transmittal to the Council prior to its meeting. Additional in- formal discussion resulted in a consensus that the Commission would like in future to become involved in the selection process earlier in the year. PRECISE PLAN OF STREET ALIGNMENT NO. 79-5 (Cont. from 12-4-79) Applicant: Huntington Beach Company NEGATIVE DECLARATION 79-65 To permit a precise plan of street alignment to maintain the existing 70-foot right-of-way arterial width of Palm Avenue be- tween 17th arfd Goldenwest Streets in lieu of the 80-foot width as shown on the master plan. Savoy Bellavia informed the Commission that, although the com- plete Traffic Model has not been received, Public Works has been able to obtain information from the draft model for this specific street section. The public hearing was opened for the precise plan and the nega- tive declaration. Zayne Neugart spoke in regard to the information on traffic, noting that the analysis shows that the 70-foot street would be more than adequate to handle the projected traffic volumes and requesting approval of the request. The public hearing was closed. Commission discussion included consideration of the projected traffic count of 4200 vehicles on this section of Palm Avenue, the number of travel lanes which will actually be provided in the street, and the future construction of 38th Street. -3- 12-18-79 P.C. To permit development of single-family dwellings at 627 19th Street, 628 20th Street, and 628 21st Street without making a required ten (10) foot dedication of Palm Avenue frontage. The public hearing was opened. I Zayne Neugart addressed the Commission to ask approval of the requested exception. There were no other persons to speak for or against the proposal, and the public hearing was closed. Commissioner Winchell made a motion, seconded by Kenefick, that the conditional exception be denied based upon the fact t1lat granting of the request would be an assumption that the City Council will in fact approve Precise Plan of Street Alignment 79-5, and the Commission should not approve this application prior to the Council's action. Mr. Palin explained that the staff had expected that the precise plan and the conditional exception would be processed at the same time, and the exception request had been filed in order to expedite the con- struction of the dwellings. However, the delays encountered in processing the precise plan, as well as the intent that the alignment of Palm Avenue be processed through the City Council by resolution and become immediately effective, have made the conditional exception unnecessary. He therefore advised the applicant and the Commission that the most expeditious approach would be a withdrawal of the appli- cation. Commissioners Winchell and Kenefick withdrew their motion and second. Mr. Neugart, as representative, and Robert Corona, the actual appli- cant, thereupon formally withdrew Conditional Exception No. 79-05. -4- 12-18-79 - P.C. Minutes, H.B. Planning Commission December 18, 1979 Page 5 ON MOTION BY WINCHELL AND SECOND BY KENEFICK THE COMMISSION ACCEPTED THE APPLICANTS' REQUEST FOR WITHDRAWAL OF CONDITIONAL EXCEPTION NO. 79-05, BY THE FOLLOWING VOTE: AYES: Winchell, Kenefick, Stern, Bazil, Greer, Shea, Bauer NOES: None ABSENT: None ABSTAIN: None The Commission recessed at 9:15 and reconvened at 9:25 p.m. CONDITIONAL USE PERMIT NO. 79-27/TENTATIVE PARCEL MAP NO. 79-578 Applicant: H. E. Hartge To permit subdivision of one existing lot into four (4) lots and modification of an existing marina at the southwest corner of Davenport Drive and Edgewater Lane. Savoy Bellavia outlined slight modifications in the suggested conditions of approval which staff would like to see imposed. The possibility of requiring a keyed gate for the parking lot was discussed and rejected as not necessary. Consideration was given to inclusion of the leased boat slips when counting the parking spaces required in the lot, and it was the consensus of the Com- mission (opposed by both the applicant and Commissioner Bazil) that they should be counted. The public hearing was opened. Bill Hartge addressed the Commission to explain his reasons for opposition to the .75/space parking requirement. He agreed to all other suggested conditions of approval with the exception of the landscaping requirement, saying that his project would average 6 feet between the right-of-way and the parking lot for landscaping purposes, but in all areas the minimum 6 feet could not be accomplished. The public hearing was closed. Commission discussion ensued, centering on the parking require- ment. A lady in the audience requested permission to speak which was granted without, however, reopening the public hearing. Mrs. Mary Ellen Houseal, 16452 Baruna Lane, addressed the Commis- tion in regard to the dimension of the turning basin adjacent to the bridge, asking that it be a minimum of 120 feet and dedicated to the City so that in the future no dock could again be proposed on the channel side of Lot 1. The Commission unanimously by straw vote concurred with a condition imposing such requirement. ON MOTION BY BAUER AND SECOND BY SHEA CONDITIONAL USE PERMIT NO. 79-27 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: -5- 12-18-79 - P.C. Minutes, H.B. Planning Commission December 18, 1979 Page 6 FINDINGS: 1. The proposed marina and land parking area will not have a detri- mental effect upon the general health, welfare, safety, or conveni- ence of persons residing or working in the neighborhood, as such facilities are unclassified uses allowed within the General Plan designation as well as within the zoning on the property. 2. The location, site layout, and design of the proposed marina and parking facility have adequately preserved sufficient channel for a turning basin, and land parking area has been screened through the use of landscaping to make it harmonious with the neighborhood. 3. The access to and parking for the marina, with the conditions pro- posed, will not create an undue traffic problem. CONDITIONS OF APPROVAL: 1. The site plan received and dated September 25, 1979, shall be the approved layout for the marina area subject to modifications necessary by the conditions of approval and subject to the elimination of the parallel slip along the westerly side of the most westerly parcel in order to maintain a 120-foot turnaround area adjacent to the bridge. 2. The plan shall be revised to reflect a ratio of .75 parking spaces per boat slip, including leased slips, within the marina and shall conform with all other provisions of the code on striping, parking stall size, and drive widths. 3. A landscaping plan shall be submitted for review and approval to assure that there is adequate screening as required by code for this parking facility. All provisions of Article 979 of the Huntington Beach ordinance Code shall be complied with. 4. The ingress and egress for the residential lot proposed immediately adjacent to the bridge shall be reviewed by the Department of Public Works and Development Services for approval prior to the issuance of any building permit for a structure on such lot. If, in the opinion of the Department of Public Works, that access could create a safety problem by cars backing into a reduced lane of eastbound traffic, then a turnaround may be required onsite for vehicles. 5. There shall be no side ties allowed at the slips on the end of each headwalk, other than for loading or unloading. 6. The applicant shall be required to install a sanitary pumpout system at each boat slip within the marina in conjunction with these modifications. This system is to be installed at the time the modi- fications are constructed in the marina or phased in over a period not to exceed two (2) years from the date of passage of this request. -6- 12-18-79 - P.C. Minutes, H.B. Planning Commission December 18, 1979 Page 7 7. An outside pay telephone shall be. provided at some location within the land parking area to serve the marina facility. 8. An application shall be filed by the applicant for processing through the City to rezone the land parking area portion of the marina operation to ROS zoning prior to the recordation of the parcel map filed with this conditional use permit request (TPM 79-578). 9. Conditional Use Permit 79-27 shall apply to the facility as long as it is owned and operated by the present owner. Upon change of owner- ship a new conditional use permit application shall be filed. AYES: Winchell, Kenefick, Stern, Bazil, Greer, Shea, Bauer NOES: None ABSENT: None ABSTAIN: None Commissioner Bazil noted that this approval is appealable to the City Council within ten days, adding that if it is so appealed he wishes to submit a minority report to the Council indicating that he does not feel that the five leased slips should be included in computations for the parking requirement. His reasons for this are that the homes they serve are within walking distance of the slips and the marina is intended for smaller boats which should not require the same ratio of parking spaces to slip space which is required of marinas which accom- modate larger boats. Commissioner Shea concurred with this minority report. ON MOTION BY SHEA AND SECOND BY KENEFICK TENTATIVE PARCEL MAP NO. 79-578 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS: 1. The proposed'division of the subject property into four (4) parcels for the purpose of construction of three residential units and a parking lot to serve the marina is in compliance with the size and shape of property necessary for that type of development. 2. The General Plan has set forth provisions for this type of land use as well as setting forth objectives for implementation of this type of use. 3. The property was previously studied for this intensity of land use at the time the land use designation of low density residential and open space was placed on subject property. 4. The size, depth, frontage, street width, and other design and im- provement features of the proposed subdivision are proposed to be constructed in compliance with standard plans and specifications on file with the City as well as in compliance with the State Map Act and supplemental City Subdivision ordinance. -7- 12-18-79 - P.C. The tentative parcel map received and dated September 25, 1979, shall be the approved layout for the Rl lots proposed, subject to the conditions and stipulations as set forth by Conditional Use Permit No. 79-27. 2. A park and recreation fee shall be paid in accordance with the standards in effect at the time the tentative parcel map was filed. 3. A pierhead line for the Rl lots, as well as a pierhead line separating the marina facility from the open channel to the west shall be designated on the plan. This pierhead line shall be drawn so that a clear width of not less than ninety (90) feet at any point rema- ns in the navigable channel, and so that a turnaround area of 120- minimum width is maintained from the Davenport Bridge to the southerly end of Parcel 1. A perpendicular line shall extend southerly from the south edge of Lot 1 to intersect with the 90-foot channel pierhead line. These pierhead lines shall be shown and recorded with the final parcel map. 4. The parcel map shall be filed with and recorded by the office of the Orange County Recorder. 1 5. Copies of the recorded parcel map shall be filed with the Departments of Public Works and Development Services of the City of Huntington Beach. CONDITIONAL USE PERMIT NO. 79-26/TENTATIVE TRACT 10888/NEGATIVE DECLARATION NO. 79-64 (Reconsideration - Cont. from 12-4-79) Applicant: Paul Shapiro To permit construction of 28 airspace condominiums and demolition of existing structures on the north side of Newman Avenue approximately 1000 feet west of Beach Boulevard. I Savoy Bellavia explained that the reconsideration had been requested because of a question as to the consistency between the zoning and the General Plan designations on the property. Planning Commission December 18, 1979 Page 9 The Commission discussed the difference between the units per acre permitted by the medium high density zoning on the property and the medium density general plan designation for the site. Commissioner Kenefick pointed out that the project will provide a good buffer between lower density residential and a manufactur- ing zone adjacent to the proposal, and could therefore be inter- preted to meet the intent of the general plan. Secretary Palin added that the staff had felt that the size of the project was extremely close to the size criteria of one acre which would require it to be shown on the general plan (the project is 1.13 acre). He also felt that it would be a good buffer between industrial and low -density residential uses. Legal counsel Jim Georges noted that the general plan becomes somewhat ambiguous when referring to densities and that the project could be determined to be within the intent of the general plan. Savoy Bellavia explained that the applicant had requested the re- consideration in order that the Commission might consider expansion of the allowed seating capacity of the use. Planning Commission December 18, 1979 Page 10 ON MOTION BY WINCHELL AND SECOND BY KENEFICK THE COMMISSION ACCEPTED THE APPLICANT'S REQUEST FOR WITHDRAWAL AND REAFFIRMED ITS PRIOR APPROVAL OF CONDITIONAL USE PERMIT NO. 79-28 BY THE FOLLOWING VOTE: AYES: Winchell, Kenefick, Stern, Bazil, Greer, Shea, Bauer NOES: None ABSENT: None ABSTAIN: None CONDITIONAL EXCEPTION NO. 79-04/TENTATIVE PARCEL MAP NO. 79-576 Applicant: George Rogers To create four (4) new parcels from three (3) existing parcels, and to permit reduction in minimum lot frontage of Parcel 4 from the required 60 feet to 29 feet and a reduction of the minimum square foot- age of Parcel 4 from 6000 to 2090 square feet. Also to permit a reduc- tion in minimum lot frontage of Parcel 3 from the required 60 feet to 42 feet and a reduction in minimum square footage of Lot 3 from 6000 to approximately 4683 square feet on property located on the west side of Pomona Lane between Auburn and Lafayette Drives. Savoy Bellavia informed the Commission that one of the parties in- volved in the tentative parcel map (not the applicant) has requested a continuance on the matter to permit investigation by her attorney. This woman had signed authorization for the parcel map application but had not been aware of the conditional exception and had not sub- mitted authorization for it to be filed on her property. The public hearing was opened. Les Norton, representing the second involved property owner, told the Commission that the reason for his mother's requesting the continuance was that the parcel map had not been laid out as she had understood it was to be. There were no other persons to address the Commission, and the public hearing was closed. Commissioner Stern asked that the staff submit its basis for the finding that the above tentative parcel map and conditional exception would not constitute a grant of special privilege. Savoy Bellavia informed the Commission that the staff is propos- ing an amendment to the suggested conditions of approval to pro- vide for the street dedication necessary because of the designated arterial status of Crystal Street. The public hearing was opened. John Gustafson addressed the Commission in support of his request. The public hearing was closed. Commission discussion ensued. ON MOTION BY SHEA AND SECOND BY KENEFICK NEGATIVE DECLARATION NO. 79-77 WAS ADOPTED BY THE FOLLOWING VOTE: AYES: Winchell, Kenefick, Bazil, Greer, Shea, Bauer NOES: None ABSENT: Stern ABSTAIN: None ON MOTION BY SHEA AND SECOND BY GREER CONDITIONAL USE PERMIT NO. 79-30 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS: 1. The proposed use complies with the provisions of the recently adopted ordinance allowing temporary relocation of a displaced use (Ordinance 2398). 2. The proposed parking can accommodate the use. 3. Onsite improvements proposed with the use will substantially upgrade the existing site. 4. The proposed auto repair shop is compatible with surrounding land uses. CONDITIONS OF APPROVAL: 1. The applicant shall, in compliance with Department of Public Works standards, replace that portion of the water main located in Crystal Street in front of the subject property. 4. The applicant shall install a fire hydrant per the Fire Depart- ment's location criteria and standards. 5. The property shall participate in the local drainage assessment district's requirements and fees. 6. Low -volume heads shall be used on all spigots and water faucets. 7. If lighting is included in the parking lot, energy efficient lamps shall be used (e.g., high-pressure sodium vapor, metal halide). All outside lighting shall be directed to prevent spillage onto adjacent properties. 8. A plan for silt control for all storm runoff from the property during construction and during initial operation of the project shall be submitted to the California Regional Water Quality Control Board staff for its review prior to the issuance of grading permits. 9. Information on equipment or facilities which may generate air pollutants shall be submitted to the South Coast Air Quality Management District staff for its review prior to the issuance of a certificate of occupancy for any use within the building. 10. The Planning Commission reserves the right to rescind this Condi- tional Use Permit approval in the event of any violation of the terms of this approval or violation of the applicable zoning laws. Mr. Holman reviewed the history of the Ellis Avenue proposals and said that the purpose of the amendment is to improve east/west access across the City. The key issues to consider in any realignment of Ellis are its effects on Central Park and on emergency response time for the police, fire, and paramedic units. The new alignment could be useful in setting a southern boundary for the park, but a determ- ination must be made on whether or not the City wishes to bisect the park or maintain peripheral circulation around the park. The realignment of Ellis will also have a bearing on the relationship of Huntington Central Park with the proposed County linear park and will require careful study in this regard. The Main Street amendment is a proposal to reinstate Main as an arterial to reflect the Planning Commission's recommendation when the precise planned extension of Lake Street north of Yorktown was deleted earlier this year. The issues to be considered are the need to provide arterial access from Garfield to Yorktown Avenues, the treatment of the intersections of Garfield and Main and Main and Seventeenth Street, and the effects on abutting land uses, as well as the effects on the existing residential areas to the south. General discussion ensued. The Director of the Department of Community Services, Vince Moorhouse, addressed the Commission in regard to the alignment of Ellis Avenue. He informed them that the City has been working on the master plan for the park, and his department will be returning to the Commission with a request to establish Ellis as the southern boundary of the central park. He pointed out recent acquisitions which the City has made (from Sig- nal Landmark, for instance) which will be included in the park boundaries. He also reviewed the City's and County's actions for acquisition of parkland for the proposed linear park. Fire Chief Ray Picard also spoke on the concerns of his department for adequate east/west circulation in the area, pointing out that if some means of serving the area to the west can be provided by the Heil and Gothard fire stations the City may be able to avoid constructing another station; this will necessitate a street configuration that will provide a free flow access on Ellis down into the Talbert/Springdale sections of the City. In response to a question from Commissioner Stern, it was indicated that there is agreement among the Fire, Community Services, and Development Ser- vices Departments on the conceptual layout of Ellis as indicated in the proposed amendment. Commissioner Shea left the meeting at this point (12:05 p.m.). A motion was made by Stern and seconded for discussion by Kenefick that Section 2.3 of this Circulation Element Amendment 80-1 be amended to include deletion of Palm Avenue as a secondary arterial between Goldenwest and 17th Streets with the recent Precise Plan of Street Alignment 79-5 as a basis for such action. -17- 12-18-79 - P.C. Planning Commission December 18, 1979 Page 18 Chairman Bazil spoke in opposition to the motion, pointing out that the street at 70 feet is substantially wider than a local street and removing its arterial designation would preclude options for handling additional traffic at a later date if a heavier load than anticipated should materialize. Secretary Palin also pointed out that designation as a local street would require vacation of right-of-way, posing a problem as to which side of the street this vacation would be taken from and resulting in an offset centerline. He also indicated that problems would result in issuance of permits should this proposed deletion take place prior to total buildup along the street. Commissioner Kenefick withdrew her second, and the motion failed. Commissioner Bauer left the meeting at this point (12:25 p.m.). Savoy Bellavia informed the Commission that there would be a delay in setting a public hearing for the general plan amendments, due to the timeframe for processing the environmental document, and the matter will probably be back before the Commission for the second meeting in February, 1980. CONFORMANCE WITH GENERAL PLAN NO. 79-20 Initiated by the Department of Community Services For the acquisition of two lots at Palm Avenue and Sixteenth Street for the City gym parking lot. I Commissioner Stern indicated that he had pulled this from the con- sent agenda for the purpose of seeing what action would be taken on the precise plan on Palm Avenue and to point out that, based on the cost of these lots, the acreage is valued at $754,700 per acre. Commissioner Bazil requested that the termination of Gothard Street at Garfield Avenue be studied for inclusion in the next amendment to the Circulation Element of the General Plan.
