ON MOTION BY BAUER AND SECOND BY PORTER THE CONSENT CALENDAR, CONSISTING OF THE MINUTES OF THE REGULAR MEETING OF JANUARY 2, 1980, WAS APPROVED AS PRESENTED, BY THE FOLLOWING VOTE: AYES: Winchell, Bazil, Bauer NOES: None --ABSENT: Greer, Shea ABSTAIN: Kenefick, Porter ORAL COMMUNICATIONS: None REGULAR AGENDA ITEMS: CONDITIONAL EXCEPTION NO. 79-04/TENTATIVE PARCEL MAP NO. 79-576 Applicant: George Rogers (Continued from January 2, 1980) To create three (3) new parcels of land from three (3) existing parcels and to permit reduction in minimum lot frontage of Parcel 3 from the required 60 feet to 42 feet and a reduction in the minimum square footage of Parcel 3 from the required 6,000 to approximately 4,683 square feet. Subject property is located on the west side of Pomona Lane between Auburn and Lafayette Drives. Savoy Bellavia reported that the property owners involved have resolved their differences and the parcel map as submitted now reflects the concurrence of the owners of each of the three parcels. The public hearing was reopened. There being no persons present to speak for or against the proposals, the public hearing was closed. Minutes, H.B. Planning Commission January 15, 1980 Page 2 Legal counsel Jim Georges ruled that Ms. Kenefick could participate in the discussion and vote on these requests even though she had been absent at the last meeting, inasmuch as no actual public hear- ing had taken place at that time. The Commission reviewed the original conditions of purchase of the subject parcels and the prior parcel map which had been granted by the Board of Zoning Adjustments but not complied with when the prop- erty was sold. Commissioner Porter questioned whether a finding of no special privilege could be made, and Jim Palin expressed the opinion that the property should revert to the orginally granted lot configuration even though it would cause some expense to be incurred for the relocation of fences. Extensive discussion of the lot sizes, frontages, and possible future use took place. A motion for continuance to allow the property owners to be present was made; however, the motion was withdrawn when staff pointed out the mandatory processing date of the applications. A MOTION WAS MADE BY WINCHELL AND SECONDED BY BAUER TO APPROVE CONDI- TIONAL EXCEPTION NO. 79-04 AND TENTATIVE PARCEL MAP NO. 79-576, AMENDING THE EAST PROPERTY LINE OF PARCEL NO. 2 TO PROVIDE A 60-FOOT FRONTAGE. MOTION FAILED BY THE FOLLOWING VOTE: AYES: Winchell, Bazil, Bauer NOES: Porter ABSENT: Greer, Shea ABSTAIN: Kenefick Ms. Kenefick explained her abstention by the fact that there had been one speaker at the meeting of January 2 who addressed these ap- plications and she did not wish to vote without having heard his remarks. A MOTION WAS MADE BY PORTER TO DENY CONDITIONAL EXCEPTION NO. 79-04 AND TENTATIVE PARCEL MAP NO. 79-576 BECAUSE OF THE FACT THAT GRANT- ING THE REQUESTS WOULD CREATE ILLEGAL PARCELS AND WOULD CONSTITUTE THE GRANT OF A SPECIAL PRIVILEGE. MOTION FAILED FOR LACK OF SECOND. Further discussion ensued. Leo Norton requested permission to ad- dress the Commission and stated that the property owner whom he was representing was satisfied with the property division as outlined on the submitted parcel map. ON MOTION BY BAUER AND SECOND BY PORTER TENTATIVE PARCEL MAP NO. 79-576 AND CONDITIONAL EXCEPTION NO. 79-04 WERE APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: TENTATIVE PARCEL MAP 79-576: FINDINGS 1. The General Plan has set forth provisions for this type of land use as well as setting forth objectives for implementation of this type of use. -2- 1-15-80 - P.C. Minutes, H.B. Planning Commission January 15, 1980 Page 3 CONDITIONS OF APPROVAL: TPM 79-576 1. The tentative parcel map received by the Department of Dev- elopment Services on January 11, 1980, shall be the approved layout. 2. A parcel map shall be filed with and approved by the Depart- ment of Public Works and recorded with the Orange County Recorder. 3. A copy of the recorded parcel map shall be filed with the Department of Development Services. CONDITIONAL EXCEPTION NO. 79-04: FINDINGS 1. Granting of the conditional exception will not be detrimental to the health, safety, or welfare of residents of neighboring properties or injurious to improvement of property in the vicinity. 2. Granting of this conditional exception will not adversely affect the General Plan of the City of Huntington Beach. 3. Granting of this conditional exception does not constitute a grant of special privilege from other properties in the vicinity. 4. Because of special circumstances applicable to the subject topography, location, or surroundings, the strict application of the zoning ordinance is found to deprive the subject prop- erty of privileges enjoyed by other properties in the vicinity and under identical zone classifications. CONDITION OF APPROVAL: CONDITIONAL EXCEPTION 79-04 1. The lot layout received and dated January 11, 1980, shall be the approved layout. AYES: Winchell, Porter, Bazil, Bauer NOES: None ABSENT: Greer, Shea ABSTAIN: Kenefick TENTATIVE TRACT NO. 10446X(Rev.)/NEGATIVE DECLARATION NO. 79-76 Applicant: Pacific Design & Development To revise street layout and ingress/egress easement for a pro- posed industrial development located on the east side of Gothard Street approximately 791 feet south of Heil Avenue. -3- 1-15-80 - P.C. Planning Commission January 15, 1980 Page 4 Savoy Bellavia presented proposed mitigating measures for the con- sideration of the Commission, as well as a new proposed condition of approval in regard to the timing of any proposed commercial use within this industrial development. The public hearing was opened. Kim Anderson, representing the developer, addressed the Commission in support of his project and discussed the conditions of approval for fencing, street improvements and sidewalks, curb cuts, and the sound attenuation requirements required by proposed mitigating meas- ure No. 5. After review, it was the consensus of the Commission that the sound requirements were applicable to residential and should be deleted from this project. The other questions raised by Mr. Anderson were reviewed and explained, and the applicant thereupon concurred with the requirements. There being no other persons to address the proposed development, the public hearing was closed. The street layout and access were reviewed by the Commission. ON MOTION BY KENEFICK AND SECOND BY PORTER NEGATIVE DECLARATION NO. 79-76 WAS ADOPTED AS AMENDED, BY THE FOLLOWING VOTE: AYES: Winchell, Kenefick, Porter, Bazil, Bauer NOES: None ABSENT: Greer, Shea ABSTAIN: None ON MOTION BY KENEFICK AND SECOND BY PORTER TENTATIVE TRACT NO. 10446X(Rev.) WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS: 1. The General Plan has set forth provisions for this type of land use as well as setting forth objectives for the development of industrial land. 2. The property was previously studied for this intensity of land use at the time the zoning was applied to the subject property. 3. The street design will not preclude subsequent parcels which may be established from meeting or exceeding ordinance code require- ments. 4. The street width and all other design improvements features of the proposed subdivision are proposed to be constructed in com- pliance with standard plans and specifications on file with the City as well as in compliance with the State Map Act and supple- mentary City subdivision ordinance. -4- 1-15-80 - P.C. Minutes, H.B. Planning Commission January 15, 1980 Page 5 CONDITIONS OF APPROVAL: 1. The tentative map received and dated January 8, 1980, shall be the approved layout. 2. If the applicant wishes to pursue a mixed commercial/industrial development on the project, a plan as required by the ordinance code for such mixed development shall be processed prior to issuance of the first building permits for any of the buildings on the site. 3. The sewer, water, and fire hydrant systems shall be subject to City standards. The sewer and water laterals shall be bored if installed after completion of the street surface. 4. Drainage for the proposed subdivision shall be approved by the Department of Public Works prior to the recordation of a final map. This system shall be designed to provide for siltation and erosion control both during and after construction of the project. 5. Vehicular access rights along Gothard Street, except at the intersection of Gothard Street and the street presently desig- nated as Baker and the proposed driveways per a master plan of driveway cuts, shall be dedicated to the City of Huntington Beach. The applicant shall submit a master plan of curb cuts to the Department of Public Works for approval prior to the recordation of a final map or parcel maps. 6. A six (6) foot high by six (6) inch thick decorative masonry wall shall be constructed along the east property line. Said wall shall be completed prior to the occupancy of the first industrial building. The developer of the project shall also install a six (6) foot high chain link fence with slats along the southerly property line adjacent to the flood control channel. 7. Sidewalks shall be installed along Gothard Street in accord- ance with standard plans. 8. Gothard Street shall be posted "no parking." 9. Full street improvements shall be constructed on each of the streets prior to the recordation of the map or parcel maps. 10. The curb cut located on Gothard Street at the adjoining prop- erty line (between the subject property and the parcel to the north) shall be eliminated unless it appears and is approved as a driveway on the approved master plan of curb cuts noted above. If said curb cut does not appear on the master plan and is eliminated as street access, the drive may remain but shall serve only as internal circulation. -5- 1-15-80 - P.C. Minutes, H.B. The street names as shown on the tentative tract shall be re- moved from the map, and all street names shall be subject to the approval of the Huntington Beach Fire Department. 12. Natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 13. Low -volume heads shall be used on all indoor spigots. 14. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 15. If lighting is included in the parking lots, energy efficient lamps shall be used (e.g., high pressure sodium vapor, metal halide). All outside lighting shall be directed to prevent "spillage" onto adjacent properties. 16. A detailed soils analysis shall be prepared by a registered soils engineer. This analysis shall include onsite soil sampling and laboratory testing of materials to provide detailed recom- mendations regarding grading, chemical and fill properties, found- ations, retaining walls, streets, and utilities. 17. If foil -type insulation is to be used, a fire retardant type shall be installed as approved by the Building Division. 18. An engineering geologist shall be engaged to submit a report indicating the ground surface acceleration from earth movement for the subject property. All structures within this development shall be constructed in compliance with the g-factors as indicated by the geologist's report. Calculations for footings and struc- tural members to withstand anticipated g-factors shall be sub- mitted to the City for review prior to the issuance of building permits. 19. A plan for silt control for all storm runoff from the property during construction and during initial operation of the project shall be submitted to the California Regional Water Quality Control Board staff for its review prior to the issuance of grad- ing permits. 20. Information on equipment or facilities which may generate air pollutants shall be submitted to the South Coast Air Quality Management District staff for its review prior to the issuance of a certificate of occupancy for any use within the building. Planning Commission January 15, 1980 Page 7 DISCUSSION ITEMS: TENTATIVE TRACT 9843 (REQUEST FOR WAIVER OF CONDITIONS) Applicant: Conroy Properties Request for waiver of conditions on a previously approved nine - lot industrial subdivision located on the south side of Hamilton Avenue approxiamtely 820 feet east of Newland Street. Savoy Bellavia explained that the subject development was pre- viously conditioned to construct decorative masonry walls along both its easterly and westerly property lines; however, as the property abuts the mud dump to the east and Edison easements to the west, the applicant is asking instead to be allowed to install some type of chain link fences at these locations. Staff is recommending that his request be granted. The Commission discussed the request, taking into consideration the location of the property and the possibility of traffic on adjacent streets being able to see into the project after con- struction. ON MOTION BY PORTER AND SECOND BY KENEFICK THE CONDITIONS OF APPROVAL FOR TENTATIVE TRACT 9843 WERE REVISED AS FOLLOWS, BY THE FOLLOWING VOTE: REVISED CONDITIONS OF APPROVAL: 1. Original Conditions 16 and 19 imposed upon this development are hereby deleted. 2. A new condition is added to require that prior to the issuance of a certificate of occupancy for any of the buildings in Tract 9843 a six (6) foot high chain link fence, slatted with slats wide enough to obstruct view into the property, shall be installed along the east and west property lines of the tract. AYES: Winchell, Kenefick, Porter, Bazil, Bauer NOES: None ABSENT: Greer, Shea ABSTAIN: None CONDITIONAL USE PERMIT NO.78-2 (Cont. from Jan. 2, 1980) Applicant: Gold Bar Stables Review of a previously approved horse stable on Goldenwest Street for compliance with conditions of approval. Savoy Bellavia reported that the applicant had previously re- quested a continuance to February 20, 1980; staff had inadvertently recommended a continuance to January 15, 1980, and is now asking that the Commission concur with the applicant's original request. Planning Commission January 15, 1980 Page 8 ON MOTION BY WINCHELL AND SECOND BY KENEFICK CONDITIONAL USE PERMIT NO. 78-2 WAS CONTINUED TO THE MEETING OF FEBRUARY 20, 1980, WITH THE STIPULATION THAT INFORMATION PREVIOUSLY REQUESTED BY THE COM- MISSION BE SUPPLIED BY STAFF AT THAT TIME, BY THE FOLLOWING VOTE: AYES: Winchell, Kenefick, Porter, Bazil, Bauer NOES: None ABSENT: Greer, Shea ABSTAIN: None CONFORMANCE WITH GENERAL PLAN NO. 80-1 Initiated by the Department of Development Services Request for finding of conformity for proposed locations for transportation centers, in Huntington Beach. Ralph Leyva, City Traffic Engineer, presented a brief report on the process by which site selection was narrowed to two proposed locations, one at the northeast corner of Gothard Street and Center Drive and the other at the northeast corner of Pacific Coast High- way and Lake Street. He stated that the feasibility studies which had been conducted for the sites had considered the types of services and routes to be served, the design treatments and site layouts, the possibilities for expansion if necessary, and preliminary cost figures. Dave Eadie, representing the Huntington Beach Company, spoke on the subject, saying that because of the absence of environmental docu- ments, the lack of any fiscal impact reports or any detailed analysis of the railroad corridor, and the absence of any public input a finding of conformity at this time should be considered pre- mature and urged the Commission not to take such a step without further study. A representative from the Transit District also addressed the Commis- sion to explain the need for the projects and the steps the county expects to follow in implementing such transportation centers. The Commission discussed the proposal. In response to a question in regard to zoning regulations for such uses, Secretary Palin replied that such a facility is an unclassified use and would be permitted through a conditional use permit application in practically any zoning designation in the city. June Catalano informed the Commission that staff is recommending approval of the proposed sites as a general concept, not necessarily as specific projects, in order to allow the planning efforts to go forward. COMMISSION ITEMS: Commissioner Bauer expressed the Commission's best wishes to resigned former Commissioner John Stern and appreciation for his work on the Commission. Commissioner Kenefick discussed attendance at Commission meetings and participation in Commission duties by all commissioners. Chairman Bazil appointed Commissioner Porter to the Subdivision Committee. DEVELOPMENT SERVICES ITEMS: Secretary Palin briefly discussed Commission goals and policies and suggested scheduling of study sessions to review specific areas of concern.
