MEMBERS PRESENT: Spencer, Tindall, Kelly MINUTES: ON MOTION BY SPENCER AND SECOND BY KELLY, THE MINUTES OF THE REGULAR MEETING OF JANUARY 9, 1980, WERE APPROVED BY THE FOLLOWING VOTE: AYES: Spencer, Tindall, Kelly NOES: None ABSENT: None REGULAR AGENDA ITEMS: To permit a car repair and maintenance use in an existing light industrial multi -tenant facility located on the east side of Gothard Street, approximately 1000 ft. south of Slater. This request is a categorical exemption, Class I, California Environmental Quality Act, 1970. Mr. Lauer, the applicant, was present. Secretary Spencer gave a brief history of the application stating that the proposal is a portion of an approved industrial building of eight suites on Gothard Street. He further stated that during the original approval of Administrative Review No. 79-12, for the entire building, parking was figured at a ratio of 1 parking space per 500 sq. ft. of floor area, thus ample parking existed for the proposal. Secretary Spencer stated that in the past some problems have been discovered with outside storage and outside repair work being done, however, felt that this problem could be eliminated through conditions of approval. The public hearing was opened, Mr. Lauer addressed the Board and stated that he proposes a foreign car repair service whereby all work will be done inside the building, as well as storing the vehicles inside the building. There being no other parties present to address the application, the public hearing was closed. Board discussion ensued. It was the consensus of the Board that the proposal would not be detrimental to the neighborhood and that with proper conditions of approval, the proposal would be compatible with the surrounding businesses. Board of Zoning Adjustments Wednesday, January 16, 1980 Page Two ON MOTION BY SPENCER AND SECOND BY KELLY, USE PERMIT NO. 79-43 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS: 1. The establishment, maintenance, and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2. The granting of a Use Permit will not adversely affect the General Plan of the City of Huntington Beach. 3. The proposal is consistent with the City's General Plan of Land Use. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received December 21, 1979, shall be the approved layout. B. GENERAL CONDITIONS: 1. No outside storage or repair of motor vehicles shall be permitted. 2. A review shall take place six (6) months from the date of approval of this application, to assure that all the above conditions of approval have been met. AYES: Spencer, Tindall, Kelly NOES: None ABSENT: None USE PERMIT NO. 79-45 Applicant: Moe Saeed Butt/Kalla Moiez To permit an auto body repair shop located on the west side of Redondo Circle, approximately 300 ft. south of Talbert. This request is a categorical exemption, Class I, California Environmental Quality Act, 1970. The applicant was not present. Minutes: H.B. Secretary Spencer noted that in the past some problems have been discovered with outside storage and outside repair work being done, however, felt that this problem could be eliminated through conditions of approval. The public hearing was opened. There being no parties present to speak on the application, the public hearing was closed. Conditions of approval and findings were discussed. ON MOTION BY SPENCER AND SECOND BY TINDALL, USE PERMIT NO. 79-45 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS• 1. Applicant shall obtain a certificate of Compliance from the South Coast Air Quality Management District if spray booth is proposed prior to issuance of Certificate of Occupancy. 3. A review shall take place six (6) months from the date of approval of this application, to assure that all the above conditions of approval have been met. Board of Zoning Adjustments Wednesday, January 16, 1980 Page Four CONDITIONAL EXCEPTION NO. 79-61 Applicant: Ron Montgomery To permit a two (2) foot reduction in the area abutting main access to building located on the west side of Alabama Street, north of Atlanta Avenue. This application is a categorical exemption, Class 5, California Environmental Quality Act, 1970. Mr. Ron Montgomery, the applicant, was present. Secretary Spencer outlined the proposal to the Board stating that four similar applications had been approved previously whereby a hardship was recognized due to code provisions contained in the Old Town Specific Plan being primarily designed to apply to lots with alley access. Furthermore, in the absence of such access on the subject property, the applicant cannot comply with the code and provide front on garages. The public hearing was opened. There being no parties present to speak on the application, the public hearing was closed. Board discussion followed. Findings and conditions of approval were discussed. ON MOTION BY SPENCER AND SECOND BY KELLY, CONDITIONAL EXCEPTION NO. 79-61 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS• 1. The code provisions contained in the "Old Town Specific Plan" were designed primarily to apply to lots with alley access. In the absence of such access on the subject property, applicant cannot comply with the Code and provide front on garages. To meet setback requirements and provide minimum width for garage would be a dimensional impossibility. 2. Adequate access is provided into the dwelling units through the front -on garages to permit moving of furniture, appliances, etc. 11 3. Granting of.this conditional exception will not be detrimental to the health, safety, or welfare of residents of neighboring properties or injurious to improvements of property in the vicinity. 4. Granting of this conditional exception will not adversely affect th General Plan of the City of Huntington Beach. 5. Granting of this conditional exception does not constitute a grant of special privilege from other properties in the vicinity as other similar applications have been approved. Minutes: H.B. The conceptual. plot plan and elevations received January 16, 1980, shall be the approved layout. B. GENERAL CONDITIONS: 1. The proposed unit shall be limited to one central source of heating. 2. The garage door itself shall be a minimum of 16-1/2 feet in width. 3. The easement for the future Atlanta Avenue interchange shall be dedicated prior to issuance of Building Permits. AYES: Spencer, Tindall, Kelly NOES: None ABSENT: None MISCELLANEOUS AGENDA ITEMS: TENTATIVE PARCEL MAP NO. 79-584 - RECONSIDERATION OF CONTINUANCE Applicant: RMG Engiftee'ripa TO JANUARY 30, 1980 To permit the subdivision of approximately 2.75 acres of land into four parcels located on the south side of Slater Avenue, and west of Nichols. This request is covered by Negative Declaration No. 79-35, previously approved. ON MOTION BY SPENCER AND SECOND BY KELLY, TENTATIVE PARCEL MAP NO. 79-584 WAS RECONSIDERED OF CONTINUANCE TO JANUARY 30, 1980, BY THE FOLLOWING VOTE: AYES: Spencer, Kelly, Tindall NOES: None ABSENT: None The applicant was not present. Secretary Spencer informed the Board that this map is now within substantial conformance with the Huntington Beach Ordinance Code. Findings and conditions of approval were discussed by the Board. ON MOTION BY SPENCER AND SECOND BY TINDALL, TENTATIVE PARCEL MAP NO. 79-584 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: Minutes: H.B. Board of Zoning Adjustments Wednesday, January 16, 1980 Page Six FINDINGS• 1. The proposed creation of a portion of residual parcel within Tentative Parcel Map No. 79-567 into four (4) lots for purposes of light industrial manufacturing is in compliance with the size and shape of property necessary for that type of development. 2. The General Plan has set forth provisions for this type of land use as well as setting forth objectives for implementation of this type of use. 3. The property was previously studied for this intensity of land use at the time the land use designation for light industrial manufacturing, which allows industrial development, was placed on subject property. 4. The size, depth, frontage, street width, and other design and improvement features of the proposed subdivision, are proposed to be constructed in compliance with standard plans and specifi- cations on file with the City as well as in compliance with the State Map Act and supplemental City Subdivision Ordinance. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCELS FOR ANY PURPOSE: 1. The tentative parcel map received by the Department of Development Services on January 16, 1980, shall be the approved layout. 2. A parcel map shall be filed with, and approved by, the Department of Public Works, and recorded with the Orange County Recorder. 3. A copy of the recorded parcel map shall be filed with the Department of Development Services. 4. Prior to recordation, Lots 3 and 4 will be subject to a site plan approval by the Board of Zoning Adjustments. 5. Prior to development, an off -site and on -site sewer force main from Crabb Lift Station to Slater Avenue shall be constructed. 6. Applicant shall file an improvement bond and agreement for required public improvements prior to recordation of final map. 7. The Residual Parcel shall be included as Parcel No. 5 of the tentative parcel map. 1 Minutes: H.B.
