MEMBERS PRESENT: Spencer, Tindall, Ott MINUTES: ON MOTION BY SPENCER AND SECOND BY TINDALL, THE MINUTES OF THE REGULAR MEETING OF JANUARY 23', 1980, WERE APPROVED AS TRANSCRIBED, BY THE FOLLOWING VOTE: AYES: Spencer, Tindall NOES: None ABSENT: None ABSTAIN: Ott REGULAR AGENDA ITEMS: CONDITIONAL EXCEPTION NO. 80-1 Applicant: Westfield Huntington Company To permit a two foot (21) balcony encroachment into the rear yard setback located on the south side of Warner Avenue, between Green and Lynn Streets. This request is a categorical exemption, Class 5, California Environmental Quality Act, 1970. The applicant was not present. The public hearing was opened. There being no parties present to speak on the application, the public hearing was closed. It was the consensus of the Board to continue the application to allow applicant to be present. ON MOTION BY SPENCER AND SECOND BY OTT, CONDITIONAL EXCEPTION NO. 80-1 WAS CONTINUED TO FEBRUARY 13, 1980, BY THE FOLLOWING VOTE: AYES: Spencer, Tindall, Ott NOES: None ABSENT: None CONDITIONAL EXCEPTION NO. 80-2 Applicant: Westfield Huntington Company To permit a two foot (21) balcony encroachment into the rear yard setback located on the north side of Jennifer Circle, at the south- east corner of Lynn and Warner. ON MOTION BY SPENCER AND SECOND BY OTT, CONDITIONAL EXCEPTION NO. 80-2 WAS CONTINUED TO FEBRUARY 13, 1980, BY THE FOLLOWING VOTE: AYES: Spencer, Tindall, Ott NOES: None ABSENT: None MISCELLANEOUS• 4 ADMINISTRATIVE REVIEW NO. 80-3 (Tentative Tract 9671) Applicant: James L. Foxx To permit a model home complex and sales office and temporary sales trailer located on the north side of Warner Avenue, approxi- mately 300 yards west of Beach Boulevard. This request is a categorical exemption, Class 3, California Environmental Quality Act, 1970. Mr. William Smolen was present to represent the application. Board reviewed the application noting that the area of the pro- posed model home site has been identified in red ink on the overall plot plan. Accessibility off of Warner onto the model home site was discussed. Mr. Smolen stated that his overall plan was to frame eleven units, however, utilizing only four for model homes. He was then informed by the Board that if he intended to frame the additional seven units, Warner Avenue would have to be improved in its entirety. Mr. Smolen then asked the plan to be modified to include all eleven units within the model home complex and post bond for all eleven units. Board informed the applicant's representative as to parking requirements, and interim improvements that must be made during the construction of models and which would also accommodate the sales trailer. Further conditions of approval were discussed by the Board. Minutes: H.B. Board of Zoning Adjustments Wednesday, January 30, 1980 Page Three ON MOTION BY SPENCER AND SECOND BY TINDALL, ADMINISTRATIVE REVIEW NO. 80-3 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOL- LOWING VOTE: CONDITIONS OF APPROVAL: 1. All proposed signing shall conform to Article 976 of the Huntington Beach Ordinance Code. 2. A plan delineating access from Warner Avenue and on -site parking to accommodate the model home complex shall be ap- proved by the Fire and Development Services Departments prior to building permits being issued. 3. Prior to final inspection of models, Warner Avenue shall be improved across front of entire tract. 4. In order to accommodate sales trailer, and during construction of Models, interim improvements on Warner Avenue shall be to the approval of the Department of Public Works. 5. Prior to issuance of building permits, applicant shall obtain approval from the Fire Department as to location of fire hydrants. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: Traffic circulation and drives; Parking layout; Lot area, width, and depth; Type of use and its relation to property and improvements in the immediate vicinity. AYES: Spencer, Tindall, Ott NOES: None ABSENT: None USE PERMIT NO. 79-28 - REVISED SITE PLAN Applicant: Paul J. Hamilton To permit the sale of automobiles located on the west side of Beach Boulevard, approximately 500 feet north of Holland Drive. Board reviewed the revised site plan depicting the elimination of one driveway along Beach Boulevard. Secretary Spencer stated that according to the Traffic Engineer, the elimination of one driveway would prevent future traffic problems. Board concurred with the revised plan dated December 14, 1979.
