ON MOTION BY WINCHELL AND SECOND BY PORTER, THE CONSENT CALENDAR, CONSISTING OF THE MINUTES OF FEBRUARY 5, 1980, WAS APPROVED BY THE FOLLOWING VOTE: AYCS: Winchell, Porter, Bazil, Greer NOES: None ABSENT: Kenefick, Shea, Bauer ABSTAIN: None ORAL COMMUNICATIONS: None REGULAR AGENDA ITEMS: ZONE CHANGE NO. 80-1/NEGATIVE DECLARATION NO. 80-3 Applicant: Robert F. Curtis To permit rezoning of an approximate one -acre parcel of land from R-2 to C-4. Subject property is located on the east side of Bolsa Chica Street, approximately 732 feet north of Warner Avenue. Savoy Bellavia reviewed the request, informing the Commission that the applicant's request is for C-4 zoning, however, he indicated that staff suggests a "Q" (Qualified classification) be added to the proposed C-4 request and a condition that subject property be developed concurrently with adjacent property to the south. He further stated that staff would like an additional condition of approval to be placed on the proposal requesting a 50 ft. setback on the property to be compatible with property to the south. Commission expressed concern over the possibility of too much commercial in the presently dominant residential area and felt that this warrants a review of the General Plan for that area. Commissioner Bazil felt that the applicant was asking for a small C-4 portion to be incorporated in the overall plan of the area, and that with the restriction of the "Q" zone, the property would allow for a better commercial center. Commissioner Bazil further stated that the staff proposed a condition whereby this particular piece would have to be developed at the same time with the one acre parcel to the south. Commissioner Greer inquired as to whether the sewer and other services will be increased due to the construction on subject property. George Tindall indicated that there would be no major change. A MOTION WAS MADE BY BAZIL AND SECONDED BY PORTER TO APPROVE ZONE CHANGE NO. 80-1 WITH THE ADDITION OF THE "Q" (QUALIFIED CLASSIFICATION) ZONE AND WITH THE RESTRICTION THAT THIS PARCEL WILL BE INTEGRATED AND DEVELOPED SIMULTANEOUSLY WITH THE PARCEL TO THE SOUTH, AND THE ADDITION OF A 50 FT. SETBACK. VOTE: AYES: Porter, Bazil NOES: Winchell, Greer ABSENT: Kenefick, Shea, Bauer ABSTAIN: None THE MOTION FAILED. Commissioner Winchell suggested that a commercial analysis be conducted of the entire area. Jim Palin stated that the Advance Planning Section of the Development Services Department had been assigned with high priority items, and that it was unlikely that the staff had time to complete a commercial analysis at this time. Savoy Bellavia informed the Commission that the failure of the motion, due to the lack of four votes for or against the application was automatically continued to the next Planning Commission meeting. MINUTES, Huntington Beach Planning Commission February 20, 1980 Page 3 /ONE CHANGE NO. 80-2 Applicant: Department of Development Services To permit a change of zone from R-2 to R-2-PD and the deletion of the 50 ft. setback requirement on Beach Boulevard. Subject property is located on the east side of Beach Boulevard and approximately 1314 feet south of Atlanta Avenue. Zone Change No. 80-2 is exempt from the California Environmental Quality Act, 1970 requirement, and no environmental assessment is required at this time. Savoy Bellavia reported that the subject property was previously rezoned from RA and C-4 to R-2 on December 4, 1978. At that time, the "Planned Development" suffix was inadvertently omitted from the proposed zone change. The deletion of the 50 ft. setback requirement on Beach Boulevard was also overlooked and was not removed from the subject property. The public hearing was opened. There being no parties present to speak on the application, the public hearing was closed. Commission discussed the application. ON MOTION BY PORTER AND SECOND BY GREER ZONE CHANGE NO. 80-2 WAS APPROVED WITH THE FOLLOWING FINDINGS BY THE FOLLOWING VOTE: FINDINGS: 1. The "Planned Development" (PD) suffix is compatible with the zoning and the surrounding land uses. 2. The addition of the "Planned Development" suffix is consistent with the General Plan. AYES: Winchell, Porter, Bazil, Greer NOES: None ABSENT: Kenefick, Shea, Bauer ABSTAIN: None ZONE CHANGE NO. 80-3 Applicant: Development Services Department To request a change of zone from C-4 to C-4 with inclusion of a 50 ft. setback on Springdale Street and Warner Avenue. Subject property is located on the northeast corner of Springdale Street and Warner Avenue. Zone Change No. 80-3 is exempt from the California Environmental Quality Act, 1970 requirements, and no environmental assessment is required at this time. MINUTES, Huntington Beach Planning Commission February 20, 1980 Page 4 Savoy Bellavia reported that in August of 1978, the Planning Commission approved Zone Change No. 78-8 which changed the zoning of the subject property from RA (Residential Agriculture) to C-4 (Highway Commercial). At that time, a 50 ft. setback requirement was inadvertently omitted from the change of zone request. The Department of Development Services is now requesting the Planning Commission impose a 50 ft. setback on the subject property in order to be consistent with the majority of C-4 property in the city. The public hearing was opened. There being no parties present to speak on the application, the public hearing was closed. Commission discussed the application. ON MOTION BY PORTER AND SECOND BY WINCHELL ZONE CHANGE NO. 80-3 WAS APPROVED WITH THE FOLLOWING FINDINGS BY THE FOLLOWING VOTE: FINDINGS: 1. The Zone Change is compatible with surrounding land uses. 2. The addition of the 50 ft. setback requirement is consistent with the policy of requiring all commercial properties abutting major arterial streets and highways to have the 50 ft. setback requirement. AYES: Winchell, Porter, Bazil, Greer NOES: None ABSENT: Kenefick, Shea, Bauer ABSTAIN: None CONDITIONAL USE PERMIT NO. 79-22/TENTATIVE PARCEL MAP NO. 79-585/NEGATIVE DECLARATION NO. 80-8 Applicant: Jerwel Laderbel To permit a change of use from previously permitted office/commercial/hotel complex of approximately 270,000 sq. ft. of floor area to an office complex of 407,000 sq. ft. of floor area. Subject property is an area bounded by the San Diego Freeway on the northeast, Center Drive on the south, and Huntington Village Way on the west. On February 3, 1976, the Planning Commission adopted a combined residential/commercial project on a 30-acre site identified as the North Huntington Center Specific Plan area. Negative Declaration No. 75-86 was approved for the original site plan with the finding that the proposed project would not have a significant adverse effect on the environment. With the major revisions that have taken place between the original approval of the site plan and the revised site plan, the staff has requested that the applicant submit an additional initial study to supplement the originally approved negative declaration. 1 MINUTES. Huntington Beach Planning Commission February 20, 1980 Page 5 tentative Negative Declaration No. 80-8 was published in the local newpaper and posted in the Office of the City Clerk for a 10-day public review period ending February 11. 1980. No comments have been received in writing or orally on the proposed project. The applicant supplemented Negative Declaration No. 80-8 with a traffic report which analyzed traffic impacts of the proposed project in and around the general area. After reviewing this traffic study, the staff concurred that several deficiencies exist in the report and, therefore, recommends that the applicant provide an addendum to the traffic report prior to the March 4, 1980 meeting. These deficiencies include an analysis of traffic capacities at the following intersections: Gothard at McFadden, McFadden at Beach, Gothard at Center Drive, and Center Drive at Huntington Village Way (a private road). Savoy Bellavia reported that the staff recommended a continuance of these applications to the March 4, 1980 Planning Commission meeting to allow the applicant time to file a conditional exception application to be heard in conjunction with the subject applications. He further reported that staff will be prepared to present the analysis of all four applications, and that the applicant wishes to forego his presentation at this time and present the entire four applications at the March 4 Planning Commission meeting. The public hearing was opened. Jerry Klein of Jerwel Laderbel addressed the Commission and stated that he concurs with the extension of time and requested that he be allowed to give his presentation at the March 4 Planning Commission meeting. The public hearing was continued to the March 4. 1980 Planning Commission meeting. Commissioner Porter expressed concern regarding the environmental status on this project in that he felt the traffic impact was significant and questioned why an EIR and a traffic study of greater impact had not been required. Jim Palin stated that the staff had evaluated whether or not the proposed use would generate additional traffic to the present use, and it was determined that the traffic generation from the new plan would be about the same as the previously approved plan. George Tindall, City Engineer, also stated that the Traffic Engineer, and subsequent traffic studies concluded that the traffic impact would not be significantly increased by the proposed development. Commissioner Winchell questioned whether or not the Traffic Model would have the capability of incorporating this project into their proposed system and Mr. Tindall said that it would have that capability. Commissioner Porter requested that the staff bring back the approved June 1979 plot plan of the previously approved facility to the March 4, 1980 meeting. Bates, Ashwill-Burke To permit a mixed commercial/office uses within an existing industrial complex. Subject property is located at the southeast corner of Heil Avenue and Gothard Street on 10.4 acres of property. In April of 1978. the Board of Zoning Adjustments approved Negative Declaration No. 78-32 which assessed the environmental impacts of the subject project's original construction entitlement. This negative declaration addressed the development of an industiral park, which included some commercial and office uses. Therefore, no additional environmental assessment is required for the proposed mixed development project. Savoy Bellavia reported that in December of 1979, the Planning Commission and City Council approved an ordinance which would allow mixed use development within the industrial districts. These mixed use developments would allow a certain percentage of commercial, service, and office professional uses within an industrial complex. Conditional Use Permit No. 79-33 is a request to establish such a mixed use development at the southeast corner of Heil Avenue and Gothard Street. The project consists of a 10.4 acre site which will ultimately be developed with approximately 166,000 square feet of floor area. The commercial, service and office uses as requested by the applicant will occupy approximately 43,500 square feet of floor area which would comprise approximately 26 percent of the overall square footage for the project. The application is the first to be heard under this new ordinance. Commission discussed concerns regarding the possibility of creating strip commercial within the industrial area with this type of use. Jim Palin explained to the Commission how the ordinance came about and the reasoning behind it. It was the consensus of the Commission that the Ordinance was intended for new projects and not for the conversion of existing industrial projects. The public hearing was opened. Mr. Chris Bates of, Ashwill-Burke addressed the Commission and stated that he had originally discussed the creation of this ordinance with the former Planning Director in 1978 and was assured at that time that this type of project was feasible. Due to financial considerations, he had to continue with construction and again was assured that the forthcoming ordinance would assure him of the present request. He further stated that he is at the point now that he would like to go ahead with the establishment of commercial retail under the ordinance to fulfill his original intent. MINUTES, Huntington Beach Planning Commission Fehruary 20, 1980 Page 7 Commissioner Bazil felt that the applicant was not entitled to request more floor area than is designated under the ordinance. Gene Ashwill of Ashwill-Burke addressed the Commission and presented the Commission with a list of projects that had been completed by his company. He stated that his company was working with the City at the time it was originally presented to the City. He felt at that time that the program would be beneficial to both his company and to the City. He further outlined the financial constraints his company had to endure due to the change of personnel within the City. Therefore he requested the application be approved. There being no further parties present to speak on the application, the public hearing was closed. Commissioner Porter stated that he was not opposed to this type of combined use, however, was opposed to combined use to the degree proposed by the applicant. Commissioner Greer was opposed to any type of commercial in the industrial zone and felt the code should be rewritten to reflect same. Commissioner Bazil felt that this type of request should be used for new construction, whereby code requirements can be easily met. He also felt that the entire Commission should be present to review this request and requested that the Commissioners absent should review the tape prior to the March 4, 1980 meeting. Commissioner Greer requested staff to prepare a list of commercial uses permitted in the industrial zone. Commissioner Winchell concurred with this request. Mr. Ashwill again addressed the Commission and requested his application be withdrawn from further Planning Commission consideration. Commissioner Bazil informed Mr. Ashwill that the consensus of the Commission was to continue the application for full Commission review, however, he was free to withdraw his application if he so desired. Mr. Ashwill then stated that he accepted the continuance and that he would outline his position at the March 4, 1980 meeting. Mickelson To permit mixed commercial/industrial uses in an existing industrial complex. Subject property is located on the southwest corner of Gothard Street and Heil Avenue on 17.5 acres of land. In March of 1978 Tentative Tract 7534 was approved by the Planning Commission as a 17.5 acre industrial subdivision. This tentative tract and subsequent development was assessed for environmental effects under Negative Declaration No. 78-11. The Planning Commission approved both the tentative tract and the negative declaration; therefore, no additional environmental assessment is required for the proposed mixed development project. Savoy Bellavia reported that in December of 1979 the Planning Commission and City Council approved an ordinance which would allow mixed use developments within the industrial districts. These mixed use developments would allow a certain percentage of commercial, service, and office/professional uses within an industrial complex. Conditional Use Permit No. 80-1 is a request to establish such a mixed use development at the southwest corner of Heil Avenue and Gothard Street. The project consists of a 17.5 acre site which will ultimately be developed with approximately 301,000 square feet of floor area. The commercial, service, and office uses will utilize approximately 56,300 square, feet of floor area, which comprises approximately 19 percent of the overall square footage for the project. The public hearing was opened. Bob Mickelson addressed the Commission and stated that he was instrumental in working with staff during the inception of the Ordinance. He said that his proposal is within the purpose and intent of the ordinance, avoiding the possibility of strip commercial. He further stated that he was proposing uses that would be compatible with industrial uses and outlined a strict sign program, and ample parking to frontage of streets. Chris Toland addressed the Commission and stated that he has worked with staff to come up with objective uses for this project. He requested the Commission not be influenced by an earlier application, because they were not attempting to exceed what the ordinance outlined. Jim Palin asked where the auto truck leasing vehicle storage would be located and where the actual storage for equipment, etc. would be. Daniel Ardgll addressed the Commission and stated that he was not proposing any storage of vehicles at all on the site. Mr. Mickelson then stated that the auto truck leasing was intended as an agency not a leasing lot for equipment rental. James Georges, Deputy City Attorney, stated that the City cannot refuse taking applications without a moratorium on mixed uses being initiated. LAND USE ELEMENT NO. 80-1 Jim Palin reported that the staff had transmitted for public hearing Land Use Element Amendment 80-1, which includes two requests from private applicants for changes in land use and one request from Development Services to add energy conservation policies to the Land Use Element. Mr. Palin then outlined the areas of concern to the Commission and their subsequent requests. Mr. Patin then presented suggested action to the Commission of receiving public testimony on Environmental Impact Report 79-5 and Land Use Element Amendment No. 80-1; then continuing the public hearing on Area of Concern 2.3 and deferring action on Environmental Impact Report 79-5 and Land Use Element Amendment 80-1 until the March 4. 1980 regular meeting to allow the designation to be changed from open space to institutional. The public hearing was opened. Mr. John Gustafson addressed the Commission and stated that he was in concurrence with the suggested continuance of Land Use Element No. 80-1 to the March 4, 1980 meeting. Mr. Joe Whaling addressed the Commission regarding Area of Concern 2.2, south of Talbert Avenue, west of Beach Boulevard requesting redesignation from Low Density Residential to Medium Density Residential. Mr. Whaling said that he was opposed to the proposal stating that Medium Density would create additional problems brought on through increased density. Mr. Serge Zweibel addressed the Commission regarding Area of Concern 2.2, and spoke in favor of the proposed redesignation to allow more affordable housing with greater densi ty. MINUTES, Huntington Beach Planning Commission February 20, 1980 Page 10 William Scott addressed the Commission stating that he owns three acres in Area of Concern 2.1, south of Garfield Avenue east of Goldenwest Street requesting redesignation from Medium Density Residential to Industrial and spoke in favor 'of the proposal. There being no other parties present to speak on the application, the public hearing was closed. ON MOTION BY PORTER AND SECOND BY WINCHELL, LAND USE ELEMENT NO. 80-1 WAS CONTINUED TO MARCH 4, 1980, BY THE FOLLOWING VOTE: AYES: Winchell, Porter, Bazil, Greer NOES: None ABSENT: Kenefick, Shea, Bauer CIRCULATION ELEMENT AMENDMENT NO. 80-1 Jim Palin reported that the City Council had reviewed with the Community Services Commission plans for Huntington Central Park and the Council requested that the Community Services Department review the park plans and the proposed alignment of Ellis Avenue. Mr. Palin recommended the Commission continue the hearing to the March 18, 1980 Planning Commission meeting in order to receive input from the Community Services Division regarding the park and the Ellis Alignment. The public hearing was opened. A gcntlernan from the audience addressed the Commission (no name given) and spoke in opposition to Item 2.1 as outlined in the staff report, the realignment of Ellis Avenue between Edwards and Goldenwest Streets northward to intersect with Talbert Avenue at Edwards Street. He felt that if the EIR were reviewed, it would be clear that this short stretch of street would increase traffic, and subsequently traffic signals would have to be erected along Goldenwest Street. He further felt that the proposal would interfere with equestrian use of the streets in question. There being no other parties present to speak on the application, the public hearing was closed. Planning Commission concurred that the application should be continued to the March,18, 1980 Planning Commission meeting to allow for proper input from the Development Services Department. ON MOTION BY WINCHELL AND SECOND BY PORTER, CIRCULATION ELEMENT AMENDMENT NO. 80-1 WAS CONTINUED TO MARCH 18, 1980, BY THE FOLLOWING VOTE: AYES: Winchell, Porter, Bazil, Greer NOES: None ABSENT: Kenefick, Shea, Bauer ABSTAIN: None MINUTE-S, Huntington Beach Planning Commission February 20, 1980 Page 11 APPLICATIONS NOT FOR PUBLIC HEARING: REVISED SITE PLAN FOR CONDITIONAL USE PERMIT NO. 79-18 Applicant: James Foxx To permit a three lot subdivision for 130 units on 8.69 gross acres located on the north side of Warner, west of Beach Boulevard. Savoy Bellavia reported that the applicant had submitted a revised site plan indicating the building pad location of the original approved site plan and the modification of the location of most of the building area. Neither the building size or the number of units have been increased with this revision. Several large open space areas designated on the original site plan have now been relocated to other areas. The applicant is requesting that the Planning Commission review and approve the revised site plan. In conclusion Mr. Bellavia stated that the revision of the site plan results in a better plan. The Commission concurred with staff. ON MOTION BY PORTER AND SECOND BY GREER, REVISED SITE PLAN FOR CONDITIONAL USE PERMIT NO. 19-18 WAS APPROVED BY THE FOLLOWING VOTE: AYES: Winchell, Porter, Bazil, Greer NOES: None ABSENT: Kenefick, Shea, Bauer ABSTAIN: None CONSENT CALENDAR ITEMS (Pulled Off Consent Calender Earlier) CONFORMANCE WITH GENERAL PLAN (CGP 80-3) PURCHASE OF PROPERTY AT THE NORTHWEST CORNER OF ELLIS AVENUE AND GOTHARD STREET Commissioner Porter stated that after reviewing the two alternatives as presented by staff, the second alternative was preferred and requested staff to make necessary amendments so that CGP 80-3 could be found in conformance with the General Plan. Commissioner Bazil felt that a conformance cannot be made on property that is not within the park and that the Commission did not have the right to place a park use on property until the property has been acquired. Jim Palin stated that in order for the City to buy the property with State Funds, the property has to be designated on the General Plan as Open Space, however, the open space designation cannot be found consistent with the General Plan until the Park Master Plan has been completed and shows the ultimate expansion of the Park. He further suggested a continuance to the March 4, 1980 Planning Commission meeting to allow Vince Moorhouse. Director of Community Services, to be present to answer any questions the Commission may have. Commission concurred with continuance. He further stated he was opposed to any interference with bike lanes. George Tindall, City Engineer, informed the Commission that the residents would be notified prior to parking being restricted along Edinger Avenue between Bolsa Chica Street and Beach Boulevard. Mr. Tindall also stated that a limited parking zone is being studied as an alternative. ON MOTION BY PORTER AND SECOND BY WINCHELL, THE COMMISSION FOUND CGP 80-4 IN CONFORMANCE WITH THE GENERAL PLAN BY THE FOLLOWING VOTE: AYES: Winchell, Porter, Bazil, Greer NOES: None ABSEi'JT: Kenefick, Shea, Bauer ABSTAIN: None DEVELOPMENT SERVICES ITEMS: None COMMISSION ITEMS: Commissioner Winchell discussed the importance of the Local Coastal Program Citizens Committee and invited all Commission members to attend. Commissioner Porter questioned as to when the resolution on the Surplus Property would come back to the Commission. Commissioner Porter discussed the Planning Commission By -Laws as to number of absences without an excuse are allowed. ON MOTION BY PORTER AND SECOND BY GREER, STAFF WAS DIRECTED TO REDRAFT THE BY-LAWS OF THE PLANNING COMMISSION REFLECTING NUMBER OF UNEXCUSED ABSENCES ALLOWED. VOTE: 4 AYES 3 ABSENT. Commissioner Porter questioned about the items to be included in the upcoming General Plan Amendment, and suggested the possibility of including an alignment in the next General Plan Amendment in the area south of Ellis and East of Goldenwest. MINUTES, Huntington Beach Planning Commission February 20, 1980 Page 13 ON MOTION BY PORTER AND SECOND BY GREER, STAFF WAS DIRECTED TO INCLUDE IN THE GENERAL PLAN AMENDMENT THE FEASIBILITY OF REDESIGNATION OF RESIDENTIAL PROPERTY WITHIN THE ELLIS/GOLDENWEST/AND RAILROAD RIGHT-OF-WAY AND GARFIELD AREA TO M1. VOTE: 4 AYES 3 ABSENT. Commissioner Porter discussed two applications that had been continued earlier in the meeting, requesting mixed commercial/industrial uses in existing industrial complexes. He stated that he foresees problems with this type of request when the industrial buildings have already been constructed. Commissioner Bazil stated that he was not opposed to the request, but would prefer that such a use could be approved prior to any kind of construction. Commissioner Greer felt the entire ordinance should be restructured with definite uses outlined. Commissioner Bazil discussed the Traffic Plan and expressed favorable opinion of Gothard to end at Garfield deverting traffic onto Goldenwest, thereby controlling the flow of traffic at an early stage. Mr. Palin stated that this will be amended in the next General Plan. Commissioner Greer inquired whether the two transportation sites on the northerly and southerly portion of the City were deleted from the study. Mr. Palin stated that the study had been referred back to the Planning Commission for public hearing and also to include alternative sites. Commissioner Greer inquired whether it would be possible to initiate a transportation corridor study. Commissioner Greer discussed the Goldbar Stable area. He felt it was getting worse and that now two tack stores have been opened up in the area. He felt the area must be tidied up somewhat. Commissioner Greer questioned whether there had been any new developments in the stock co-op situation. Mr. Georges stated that a moratorium could be placed on all conversion for people who have not filed for their "white paper" before July 1, 1979. Commissioner Bazil discussed the proposed "Ranch" Project, and questioned whether it could be possible to retain the railroad right-of-way as a transportation corridor.
