Mr. Newlove was present to represent the application.
Secretary Spencer noted that the application had been continued
to allow the applicant an opportunity to revise the plot plan
for resubmittal to the Board for approval. The public hearing was
opened.
Discussion followed regarding joint driveway access with the adjacent
property, location of drive -up teller windows, clearly defined lot striping
and signage and aisle markings.
Conditions of Approval were discussed. The public hearing was closed.
ON MOTION BY TINDALL AND SECOND BY SPENCER CONDITIONAL EXCEPTION NO.
80-6 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS BY THE
FOLLOWING VOTE:
FINDINGS:
1) The granting of this application would not constitute a grant of
special privilege.
2) Because of special circumstances applicable to the property,
strict application of code requirements is found to have
deprived the property of privileges enjoyed by other properties
in the vicinity.
3) The approval of this application will not be detrimental to
public welfare and is found not to adversely affect the General
Plan.
REASON FOR APPROVAL:
1) Board felt that since base district requirements allow a Zero side yard setback
and that the fact that the twenty (20) feet driveway requirement
adjacent to the buildings was primarily intended for two (2) way
traffic into parking compound, that proponents design of clearly
marking proposed ten (101) foot driveway as one way for "drive -up"
customers and a second means of ingress and egress for indoor customers
was being provided.
CONDITIONS OF APPROVAL:
A) TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1) The revised conceptual plot plan and elevations received
February 27, 1980 shall be the approved layout, subject to
the modification described herein:
a) The one-way driveway shall be clearly delineated with
striping, one way arrows and signage.

A plan delineating said modification shall be submitted to
the Secretary of the Board. If such plan complies with the
modification outlined by the Board, said plan shall be approved
and made a permanent part of the administrative file.
In its approval action, the Board of Zoning Adjustments considered
the following issues relating to the conceptual plan:
- Traffic circulation and drives;
- Parking layout;
- Lot area;
- Lot width and lot depth;
- Type of use and its relation to property and improvements in the
immediate vicinity;
- Past administrative action regarding this property.
2) The following plans shall be submitted to the Secretary of

Landscape and irrigation plan complying with Article 979
of the Huntington Beach Ordinance Code and landscaping

CONDITIONS OF APPROVAL:
A) TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1) The revised conceptual plot plan and elevations received
February 27, 1980, shall be the approved layout, subject

3) Natural gas shall be stubbed in at the locations of cooking
facilities, water heaters, and central heating units.

4) Low volume heads shall be used on all indoor spigots.
5) All building spoils, such as unusable lumber, wire, pipe, and
other surplus or unusable material, shall be disposed of at
an offsite facility equipped to handle them.
6) If lighting is included in the parking lot, energy efficient
lamps shall be used (e.g. high pressure sodium vapor, metal
halide). All outside lighting shall be directed to prevent
"spillage" onto adjacent properties.
7) A detailed soils analysis shall be prepared by a registered
soils engineer. This analysis shall include on -site soil
sampling and laboratory testing of materials to provide
detailed recommendations regarding grading, chemical and
fill properties, foundations, retaining walls, streets and
utilities.

located on the west side of Beach Boulevard, approximately 210 feet
south of Cypress.
This request is a categorical exemption, Class 1, California Environmental
Quality Act, 1970
Secretary Spencer introduced the applications to the Board. He stated
.that there were several violations regarding on -site and off -site
improvements per the Huntington Beach Ordinance Code. The public hearing
was opened.
Mr. Carlos Sanches, the applicant was present. He stated that at the
time be bought the business it had been in operation approximately ten
(10) years. He further explained that he had no prior knowledge that
improvements both on -site and off -site were required. Mr. Sanches
requested the Board allow him reasonable time to comply with the Ordinance
Code requirements for improvements.

The Board discussed the Conditions of Approval: There being no other
parties present, Chairman Tindall closed the public hearing.
ON MOTION BY SPENCER AND SECOND BY TINDALL CONDITIONAL EXCEPTION NO.
80-8 WAS APPROVED WITH THE FOLLOWING'FINDINGS, REASONS AND CONDITIONS
OF APPROVAL, BY THE FOLLOWING VOTE:
FINDINGS:
1) The granting of this application is found not to constitute a grant
of special privileges.
2) Granting of this application will not be detrimental to the public
welfare nor will it adversely affect the City's General Plan.
REASONS FOR APPROVAL:
1) Applicant's use has been in operation for a period exceeding ten
years both on .a conforming and non -conforming basis. And that
outside display or rental equipment has been within the -required
setback for same period of time.
2) Numerous other displays (boats, -trailers, garden equipment) are
allowed within the setbacks along Beach Boulevard with certain
screening provisions being required.
CONDITIONS OF APPROVAL:
A) TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1) The conceptual plot plan and elevations received February 4,
1980 shall be the approved layout. -

2) The following plan shall be submitted to the Secretary of the
Board:
a) Landscape and irrigation plan complying with Article 979 of
the Huntington Beach Ordinance Code and landscaping specifi-
cations on file in the Department of Public Works.
B) GENERAL CONDITIONS:
1) A ten (101) foot minimum landscape area be provided along
frontage adjacent to property line.
2) A minimum of a 32" inch high garden wall be located within said
landscape area.
3) If security fencing is proposed, that all such fencing within
fifty (50') feet setback be of a decorative material subject
to the approval of the Secretary of the Board of Zoning Adjustments.
4) That the driveway approaches from Beach Blvd. be limited
to one/size and location to be approved by the Department of
Public Works.

5) Surfacing of the outside display shall be of a paved
surface approved by the Department of Pebl-tc— Vorks-.
6) That if a gate is proposed, that said gate set back a
minimum of twenty (20') feet from back of sidewalk.
7) All on -site parking shall comply with Article 979 of the
Huntington Beach Ordinance Code.
8) That Beach Blvd. be fully improved to both State Division
of Highways and Department of Public Works Standards.
9) All existing non -conforming signs be removed and all new
signing comply with Article 976 of the Huntington Beach
Ordinance Code.
10) All the above Conditions be complied with within one (1)
year or this entitlement will become null and void.

NO. 80-4 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE
FOLLOWING VOTE:
CONDITIONS OF APPROVAL:
A) TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1) The revised conceptual plot plan and elevations received
February 4, 1980 shall be the approved layout, subject
to the modification described herein:
a) Revised site plan (minimum scale 111= 401) incorporating
General Conditions 1 through---7.
A plan delineating said modification shall be submitted to
the Secretary of the Board. If such plan complies with
the modifications outlined by the Board, said plan shall be

To permit the consolidation of two (2) parcels into one (1) located
on the north side of Pacific Coast Highway, approximately 730 feet
east of Mariner Drive.
This request is covered by Negative Declaration No. 79-1, approved by the
Board of Zoning Adjustments on February 7, 1979.
Mr. King You Chai was present to represent the application.
Secretary Spencer outlined the application to the Board. The Board
found the application to be within Ordinance Code conformance.
Findings and Conditions of Approval were discussed.
ON MOTION BY SPENCER AND SECOND BY TINDALL TENTATIVE PARCEL MAP NO.
80-552 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS OF
APPROVAL BY THE FOLLOWING VOTE:
FINDINGS:
0
1) The proposed consolidation -of two (2) lots into one (1)
lot for purposes of commercial development is in compliance
with the size and shape of property necessary for that type
of development.
2) The General Plan has set forth provisions for this type of
land use as well as setting forth objectives for implementation
of this type of use.
3) The property was previously studied for this intensity of land
use at the time the land use designation for commercial. develop-
ment which allows commercial buildings, was placed on subject
property.

4) The size, depth, frontage, street width, and other design and
improvement features of the proposed subdivision are proposed
to be constructed in compliance with standard plans and speci-
fications on file with the City as well as in compliance with
the State Map Act and supplemental City Subdivision Ordinance.
CONDITIONS OF APPROVAL:
A) TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCELS
FOR ANY PURPOSE:
1) The tentative parcel map received by the Department of
Development Services on February 8, 1980 shall be the
approved layout (with the amendments as noted thereon). '
2) A parcel map shall be filed with, and approved by the
Department of Public Works, and recorded with the Orange
County Recorder prior to issuance of Occupancy Permits.
B) GENERAL CONDITIONS:
1)' A 7' foot dedication shall be dedicated to.City standards
at the time said parcels are developed.
2) A copy of the recorded parcel map shall be filed with the

Mr. Steve Park and Mr. Russ Perkins were present to represent the
application.
Board members expressed concern regarding the location of trash sites
in relation to the alley public right-of-way, alley and street improve-
ments, storage of incoperable vehicles, and the on -site well.
After reviewing the revised plot plan the Board found the application
to be in compliance with the Huntington Beach Ordinance Code, subject
to Findings and Conditions which were discussed with the applicant.
Chairman Tindall closed the public hearing as there were no other
parties present to speak.
ON MOTION BY TINDALL AND SECOND BY SPENCER USE PERMIT NO. 80-1 WAS
APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS BY THE FOLLOWING

relocation of trash enclosures so as not to conflict
with the alley right-of-way.
b) A parcel map for the purpose of lot consolidation shall be
filed and approved prior to issuance of permits.

4) On site water well shall be improved to visual attractivenss
per Huntington Beach Ordinance Code.
S) Parcel map shall be recorded with Orange County Recorder
prior to final building inspection. -

Applicant: David R. Benson
To permit the use of two trailers as subdivision offices located
on the north side of Pacific Coast Highway, approximately 150 feet
west of Anderson Street.
This request is a categorical exemption Class 3, California Environ-
mental Quality Act, 1970.
Dr. Noble, the property owner was present to represent the application.
The Board reviewed the the plot plan regarding the location of the
trailers.
Dr. Noble stated that the trailers were approximately 60 x 12 and
30 x 6. The trailers would be moved prior to the construction of
any building.
Board member Kelly expressed his concern with the fire safety requirements.
The Board found the application to be in conformance with the Huntington
Beach Ordinance Code.

Applicant: James Lumber Company
To permit a permanent lumber storage facility located on the west
side of Nichols Street approximately 5,881 feet north of Slater.
This request is a categorical exemption Class 1, California Environ-
mental Quality Act, 1970.
Mr. James Harrington was present to represent the application.
Secretary Spencer briefly described the application to the Board.
Board Member Kelly stated his concerns regarding the lack of cooperation
between the applicant and the Fire Department. He stated that the
applicant had been sited for several violations regarding fire lane
access and stacking. He explained that the applicant had been prosecuted
for Fire Code requirements.
Land Use Technician Douglas Heite was present, and stated that the
applicant was at present in violation of the Huntington Beach Ordinance
Code. He suggested that the application be continued until the
applicant had met all requirements.
Deputy City Attorney Charles Matheis, was present and stated that an
on -going prosecution was in effect, and requested that the application
be denied until all violations had been cleared.
The Board discussed the problems with the applicant and it was
decided to continue this application one month in order to allow the
applicant an opportunity to bring the property up to Huntington Beach
Ordinance Code requirements.
