BOARD MEMBERS PRESENT: Spencer, Tindall, Ott MINUTES: ON MOTION BY TINDALL AND SECOND BY OTT, THE MINUTES OF THE REGULAR MEETING OF MARCH 26, 1980 WERE APPROVED BY THE FOLLOWING VOTE: AYES: Spencer, Tindall, Ott NOES: None ABSENT: None ON MOTION BY SPENCER AND SECOND BY TINDALL, THE MINUTES OF THE REGULAR MEETING OF APRIL 2, 1980 WERE APPROVED BY THE FOLLOWING VOTE: AYES: Spencer, Tindall NOES: None ABSENT: Kelly REGULAR AGENDA ITEMS: SPECIAL EVENT NO. 80-10 Applicant: U.S. Rental To permit a one day auction on May 24, 1980 at 10:00 A.M. located on the west side of Nichols Street, approximately 338 feet south of Warner. Mr. Vince Solorzano was present to represent the application. Mr. Solorzano stated that the proposal was for a request to liquidate rental equipment, and the event had been successful in several local cities in Orange County. Chairman Tindall expressed concern regarding the lack of parking for the event and the layout location of equipment for sale. Minutes: H.B. Board of Zoning Adjustments April 9, 1980 Page 2 Mr. Solorzano stated that an additional application had been submitted to provide for additional parking if necessary (Special Event No. 80-11). Secretary Spencer noted that the application was found to be within substantial ordinance code conformance. The Board discussed the Conditions of Approval with the applicant. ON MOTION BY SPENCER AND SECOND BY TINDALL SPECIAL EVENT NO. 80-10 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. The plot plan received March 20, 1980 shall be the approved layout. 2. An on -site inspection by the Fire Department shall be required prior to the event. 3. Applicant shall provide a certificate of insurance in the amount of one (1) million dollars to defend and hold harm- less the City of Huntington Beach in the event of legal action. Said certificate shall be submitted to the Secretary of the Board of Zoning Adjustments five (5) days prior to the event. AYES: Spencer, Tindall, Ott NOES: None ABSENT: None SPECIAL EVENT NO. 80-11 Applicant: U.S. Rental To permit off -site parking for a one -day auction on May 24, 1980 beginning at 7:00 A.M. located on the northeast corner of Warner and Nichols Street. Mr. Vince Solorzano was present to represent the application. He stated that additional parking may be necessary, therefore, parking across from the auction site (with the church approval) has been requested. Chairman Tindall expressed his concerns regarding pedestrian crossing at Warner Avenue. He sited a similar event at which there had been serious problems. He further stated his concern of poor access from Warner Avenue onto the site. Mr. Solorzano stated that he would be willing to work out any problems resulting in the pedestrian crossing. ON MOTION BY SPENCER AND SECOND BY OTT, SPECIAL EVENT NO. 80-11 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. AYES: Spencer, Tindall, Ott NOES: None ABSENT: None ADMINISTRATIVE REVEIW NO. 80-11 Applicant: Donald Penkoff To permit the construction of an 11,253 sq. ft. industrial building located on the west side of Transistor approximately 493.5 feet south of Engineer Drive. This application is covered by Negative Declaration No. 73-16, previously approved. Mr. Penkoff was present to represent the application. He stated that the application is for a tilt -up building for sail making. Mr. Penkoff also requested that a mast type pole be included in the approval in order to "run" the sails for inspection before selling. He stated that the pole would not be used as display or signing. Secretary Spencer stated that the plan was found to be within conformance with the ordinance code and was considered a good use for the area. ON MOTION BY SPENCER AND SECOND BY OTT ADMINISTRATIVE REVIEW NO. 80-11 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING VOTE: Minutes: H.B. Board of Zoning Adjustments April 9, 1980 Page 4 CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received March 12, 1980 shall be the approved layout, subject to the modification described herein: a. Applicant shall submit a plan depicting a minimum 27 foot driveway approach per Department of Public Works standards A plan delineating said modification shall be submitted to the Secretary of the Board of Zoning Adjustments. If such plan complies with the modification outlined by the Board, said plan shall be approved and made a permanent part of the administrative file. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: - Traffic circulation and drives; - Parking layout; - Lot area; - Lot width and lot depth; - Type of use and its relation to property and improvements in the immediate vicinity; - Past administrative action regarding this property. 2. The following plans shall be submitted to the Secretary of the Board: 1. Landscape and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code and landscaping specifications on file in the Department of Public Works. 2. Rooftop mechanical equipment screening plan. Said plan shall indicate screening of all rooftop mechanical equip- ment and shall delineate the type of material proposed to screen said equipment. B. GENERAL CONDITIONS: 1. Applicant shall dedicate five (5) feet easement and make all improvements to the Department of Public Works specifications and standards. Board of Zoning Adjustments April 9, 1980 Page 5 PLOT PLAN AMENDMENT NO. 80-2 Applicant: Huntington Harbour Yacht Club To permit additional storage space (260 sq. ft.) and revised rear entry located on the north side of Warner Avenue approximately 100 yards east of Pacific Coast Highway. This application is a categorical exemption, Class I, California Environmental Quality Act, 1970. Mr. Don Hartfelder was present to represent the application. Secretary Spencer stated that the proposal was within substantial ordinance code conformance. The public hearing was opened. Mr. Hartfeld stated that Conditional Use Permit No. 76-8, previously approved allowed for rear entry to the facility and the addition of storage space. He further stated that the proposal does not affect parking area or a change in the existing use of the building. There being no other parties present to speak the public hearing was closed. ON MOTION BY SPENCER AND SECOND BY TINDALL PLOT PLAN AMENDMENT NO. 80-2 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL BY THE FOLLOWING VOTE: FINDINGS: 1. The amendment does not constitute a substantial change. 2. The existing use of the property remains the same. 3. The proposed addition will result in an approve plan. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan received March 24, 1980 and elevations received March 27, 1980 shall be the approved layout. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: Minutes: H.B. B. GENERAL CONDITIONS: 1. There shall be no change in the existing use of the building. AYES: Spencer, Tindall, Ott NOES: None ABSENT: None ADMINISTRATIVE REVIEW NO. 80-12 Applicant: Sid Crossley To permit the construction of a 6,000 sq. ft. office building (two story) located on the east side of Bolsa Chica approximately 145 feet north of Warner Avenue. This application is covered by Negative Declaration No. 80-23. ON MOTION BY TINDALL AND SECOND BY SPENCER, THE BOARD HAVING FOUND TH THE PROPOSED PROJECT WILL NOT HAVE A SIGNIFICANT ADVERSE EFFECT ON THE PHYSICAL ENVIRONMENT, ADOPTED NEGATIVE DECLARATION NO. 80-23 WITH THE FOLLOWING MITIGATING MEASURES CONTAINED IN ADMINIST_R_AT_IVE REVIEW NO. 80-12 GENERAL CONDITIONS 4 AND 5 IMPOSED ON ADMINISTRATIVE REVIEW REVIEW NO. 60-12 BY THE FOLLOWING VOTE: AYES: Spencer, Tindall, Ott NOES: None ABSENT: None The Board reviewed the application. He noted that the application was found to be within substantial ordinance code conformance. Chairman Tindall expressed concern regarding driveway approach and the location.. He suggested that the driveways be moved easterly to provide better ingress and egress. Also, that driveway approaches be widened to 30 feet. Secretary Spencer discussed whether there was an existing lot line, as the Accessor's Parcel Map doesn't clearly indicate a lot line. Minutes: H.B. Mr. Spencer stated that the applicant may have to file an application for a parcel map if it is found not to have been legally created. The public hearing was closed as there were no other persons present to speak. The Board discussed the Conditions of Approval. ON MOTION BY TINDALL AND SECOND BY OTT ADMINISTRATIVE REVIEW NO. 80-12 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received March 13, 1980 shall be the approved layout, subject to the modifications described herein: a. Applicant shall submit a plot plan reflecting on - site fire lanes, curb markings, and signing per Fire Department standards. b. Existing lot configuration shall be substantiated as being legally created. If found not to have been legally created, the applicant shall file an application for a parcel map. c. A reciprocal access agreement shall be entered into with adjacent property owner to the north to provide for adequate ingress and egress. A plan delineating said modifications shall be submitted to the Secretary of the Board. If such plans comply with the modifications outlined by the Board, said plan shall be approved and made a permanent part of the administrative file. Landscape and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code and landscaping specifications on file in the Department of Public Works. 2. Rooftop mechanical equipment screening plan. Said plan shall indicate screening of all rooftop mechanical equip- ment and shall delineate the type of material proposed to screen said equipment. B. GENERAL CONDITIONS: 1. Trash enclosures shall be of a decorative material to blend with surrounding structures as required in Section 9730.30 of the Huntington Beach Ordinance Code. 2. __ Existin—g-driveway approac es on-Tarner P.venue and Bolsa Chica Street shall be reconstructed to a minimum width of thirty (30) feet per Department of Public Works Standard Plan and Specifications. 3. Signing shall indicate right turn only onto Bolsa Chica and Warner Avenue. 4. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 5. If lighting is included in the parking lot, energy efficient lamps shall be used (e.g. high pressure sodium vapor, metal halide). All outside lighting shall be directed to prevent "spillage" onto adjacent properties. AYES: Spencer, Tindall, Ott NOES: None ABSENT: None ADMINISTRATIVE REVIEW NO. 80-9 Applicant: John J. Peranteau To permit the modernization of an existing service station located on the east side of Ocean at the intersection of Seventh Street. This request is a categorical exemption, Class I, California Environmental Environmental Quality Act, 1970. 1 Minutes: H.B. Board of Zoning Adjustments April 9, 1980 Page 9 The Board reviewed the application. Secretary Spencer noted that the application was within substantial ordinance code conformance. Discussion follow6d regarding landscaping, trash enclosures and signing requirements. Conditions of Approval were discussed. ON MOTION BY SPENCER AND SECOND BY OTT ADMINISTRATIVE REVIEW NO. 80-9 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING VOTE: A. TO BE COMPLTED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received March 11, 1980 shall be the approved layout, subject to the modification described herein: a. All proposed signing shall conform to Article 948 of the Huntington Beach Ordinance Code. All non- conforming signs shall be removed. A plan delineating said modification shall be submitted to the Secretary of the Board. If such plan complies with the modification outlined by the Board, said plan shall be approved and made a permanent part of the administrative file. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan. - Traffic circulation and drives; - Parking layout; - Lot area; - Lot width and lot depth; - Type of use and its relation to property and improvements in the immediate vicinity; - Past administrative action regarding this property. 2. The following plan shall be submitted to the Secretary of the Board: 1. Landscape and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code and landscaping specifications on file in the Department of Public Works. Minutes: H.B. Applicant shall dedicate 2h feet of adjacent alley way and 27 foot property line radius at Pacific Coast Highway to Public Works standards. 2. Applicant shall comply with Section 9482.1 of the Huntington Beach Ordinance Code regarding trash enclosures and Section 9482.1.1 regarding landscaping.
