USE PERMIT NO. 80-8
Applicant: Braxton Dennis
To permit the establishment of retail stores located at the north-
east corner of Warner Avenue and Springdale Street.
This application is covered by Negative Declaration No. 80-12.
ON MOTION BY LIPPS AND SECOND BY KELLY, THE BOARD HAVING FOUND
THAT THE PROPOSED PROJECT WILL NOT HAVE A SIGNIFICANT ADVERSE
EFFECT ON THE PHYSICAL ENVIRONMENT, ADOPTED NEGATIVE DECLARATION
NO. 80-12 WITH THE MITIGATING MEASURES CONTAINED IN USE PERMIT
NO. 80-8 GENERAL CONDITIONS 3 AND 4 IMPOSED ON USE PERMIT NO. 80-8
BY THE FOLLOWING VOTE:
AYES: Lipps, Tindall, Kelly

Mr. Braxton Dennis representing the application was present.
Chairman Tindall introduced the application to the Board. Secretary
Lipps gave a brief background on the application stating the appli-
cation was in substantial ordinance code conformance.
Chairman Tindall opened the public hearing.
Chairman Tindall expressed his concern regarding driveway widths
and turning radius. He recommend that the one way driveway

being proposed be eliminated as it is not functionable and has
poor visability to on -coming traffic. He further recommended that
right turns only be allowed from the site onto Warner and Springdale.
Secretary Lipps expressed his concern regarding the location of
trash enclosures. He recommended that the enclosures be relocated
to a less conspicious area such as the parking area northwest and
nearer the building.
Discussion followed regarding the abutting property. Mr. Dennis
stated that a mobilehome park surrounded the proposed development.
and that a six (6') foot block wall separated the property. He
further stated that many large trees separating the mobilehome park
and the development would be left to use as an additional buffer.
Conditions of Approval were discussed with the applicant.
As there were no other parties present to speak, Chairman Tindall
closed the public hearing.
ON MOTION BY LIPPS AND SECOND BY KELLY USE PERMIT NO. 80-8 WAS
APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS BY THE FOLLOWING
VOTE:
FINDINGS:
1. The establishment, maintenance, and operation of the
use will not be detrimental to:
a. The general welfare of persons residing or working
in the vicinity;
b. Property and improvements in the vicinity of such
use or building.
2. The granting of a Use Permit will not adversely affect the
General Plan of the City of Huntington Beach.
3. The proposal is consistent with the City's General Plan
of Land Use.
CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The conceptual plot plan and elevations received March
24, 1980 shall be the approved layout, subject to the
modifications described herein:
a. Applicant shall remove driveway from northwesterly
corner of site.

b. A minimum thirty (30') foot radius driveway approach
shall be provided per Public Works standards, Section
217 A & B.
c. Applicant shall relocate trash bin enclosure to parking
area nearest northwesterly corner of building.
d. A fully dimensioned plot plan showing minimum six (61)
foot landscaped strip along street frontages, turn radius,
and corner radius shall be submitted per the Department
of Public Works standards.
e. Applicant shall provide elevations of east and north side
of building prior to issuance of building permits.
A plan delineating said modifications shall be submitted to
the Secretary of the Board. If such plan complies with the
modifications outlined by the Board, said plan shall be
approved and made a permanent part of the administrative file.
In its approval action, the Board of Zoning Adjustments considered the
following issues relating to the conceptual plan:
- Traffic circulation and drives;
Parking layout;
Lot area;
Lot width and lot depth;
Type of use and its relation to property and improvements in the
immediate vicinity;
- Past administrative action regarding this property.
2. The following plans shall be submitted to the Secretary of the
Board:
a. Landscape and irrigation plan complying with Article 979
of the Huntington Beach Ordinance Code and landscaping
specifications on file in the Department of Public Works.
A landscape plan shall also include landscaping of the ten
(101) foot strip along the north and east property lines.
b. Rooftop mechanical equipment screening plan. Said plan
shall indicate screening of all rooftop mechanical equipment
and shall delineate the type of material proposed to screen
said equipment.
B. GENERAL CONDITIONS:
1. Applicant shall provide "right -turn only" signs at exit
points of both driveways.
2. A lighting plan to be submitted and approved by the Secretary
of the Board of Zoning Adjustments prior to final inspection
of the building.

3. All building spoils, such as unusable lumber, wire, pipe,
and other surplus or unusable material, shall be disposed
of at an offsite facility equipped to handle them.
4. If lighting is included in the parking lot, energy efficient
lamps shall be used (e.g. high pressure sodium vapor, metal
halide). All outside lighting shall be directed to prevent
"spillage" onto adjacent properties.

SPECIAL EVENT NO. 80-10 & No. 80-11
Applicant: U.S. Rentals
To permit a change of date for a public auction from May 24, 1980
to May 31, 1980.
Mr. Vince Solorzano requested a reconsideration of the date for
this event as the original date was the Memorial Day weekend.
The Board concurred that May 31st was more acceptable, however,
Chairman Tindall reminded the applicant that all Conditions of
Approval previously sited were still valid.
