BOARD MEMBERS: Tindall, Spencer, Ott MINUTES: ON MOTION BY TINDALL AND SECOND BY OTT, THE MINUTES OF THE REGULAR MEETING OF APRIL 23, 1980 WERE APPROVED BY THE FOLLOWING VOTE: AYES: Tindall, Ott NOES: None ABSENT: Spencer REGULAR AGENDA ITEMS: SPECIAL EVENT NO. 80-4 Applicant: Saint Bonaventure Parish To permit a fall festival, October 10 thru 12, 1980 located at 16400 Springdale Street Father Fumo and Mr. Foremont were present to represent the application. Mrs. Virginia Mason, a resident of the area was also present. Mrs. Mason explained that she had met with the applicant•and several problems had been resolved, which she felt would provide better relations between the Church and the local residents. Secretary Spencer distributed a list of suggested Conditions of Approval prepared by the Board which included the suggestions of both Mrs. Mason and the applicant. Mr. Foremont and Father Fumo both agreed to the suggested conditions. ON MOTION BY TINDALL AND SECOND BY SPENCER SPECIAL EVENT NO. 80-4 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. The plot plan received January 30, 1980 shall be the approved layout. 2. The applicant shall obtain all necessary electrical permits. Minutes: H.B. Board of Zoning Adjustments May 7, 1980 Page 2 3. An on -site inspection by the Fire Department shall be required prior to the event. 4. A certificate of insurance form shall be filed in the Finance Department at least five (5) days prior to the event. 5. All trash, debris and garbage as well as special dumpsters shall be removed from the site within two (2) days of closing of the festival. 6. Use of amplifiers, speakers, musical instruments and playing of recorded music, are to be discontinued as of 9:00 P.M. each day. 7. Refrigeration truck to be placed on site as near the intersection of Springdale and Heil as possible to minimize noise from the unit. 8. Barricades shall be placed at the intersections of Springdale and Brassie, Springdale and Orlando, Heil and Bradbury, Orlando and Bradbury and Orlando and Angler. The applicant shall provide, at their expense, uniformed police officers to man the barricades, at all locations except Orlando and Angler, 1 hour prior to the opening of the festival to the close of each day. 9. All equipment and manpower required by Condition No. 8 shall be provided at the applicant's expense. 10. Appropriate signs (temporary) for the direction of traffic and on -site parking shall be provided by the applicant. Said signs, location, and content to be as recommended by Traffic Division of the Department of Public Works and the Traffic Division of the Police Department. 11. The vehicular access off Orlando and Bradbury shall be secured and not used for ingress -egress to the site except for emergency purposes. 12. All operations of the festival, including machinery, other than necessary refrigeration units shall desist between the hours of 9:30 P.M. and 8:00 A.M. 13. All activity on the site or clean-up activity off -site shall be shut down by 11:00 P.M. 14. In the event there are any violations -of the foregoing conaitions or any violations of life safety codes, the festival activity will be terminated and not permitted to reopen. 15. The applicant shall provide clean-up crews to clear the adjacent streets of trash and debris each evening after closing of the activit 1 Minutes: H.B. All evidence of the activity (booths, rides and other materials) shall be completely removed from the site within two (2) weeks of the closing of the festival. 17. All vehicular ingress and egress to the site shall be via the church driveway located mid -block on Springdale. AYES: Tindall, Ott, Spencer NOES: None ABSENT: None PLOT PLAN AMENDMENT NO. 80-3 Applicant: Mansion Properties, Inc. To permit a plot plan amendment to a previously approved residential development located southwesterly of Huntington Seacliff Golf Course (Goldenwest and Palm). This request is a categorical exemption, Class V, California Environmental Quality Act, 1970. The applicant was not present. Secretary Spencer stated that a letter requesting that the application be tabled until the applicant revises the tentative maps and the Conditional Use Permit and is approved by the Planning Commission. It was the consensus of the Board to grant the request. ON MOTION BY SPENCER AND SECOND BY OTT, PLOT PLAN AMENDMENT NO. 80-3 WAS TABLED UNTIL SUCH TIME AS THE APPLICANT REVISES BOTH THE TENTATIVE MAPS AND THE CONDITIONAL USE PERMIT AND IS APPROVED BY THE PLANNING COMMISSION. AYES: Tindall, Ott, Spencer NOES: None ABSENT: None ADMINISTRATIVE REVIEW NO. 80-16 Applicant: Gaetano DiLisio To permit joint use of parking area located on the south side of Warner approximately 120 feet west of Bolsa Chica. This request is a categorical exemption, Class V, California Environmental Quality Act, 1970. Minutes: H.B. Board of Zoning Adjustments May 7, 1980 Page 4 Secretary Spencer introduced the application to the Board stating that the request was within substantial ordinance code conformance. Fire Representative Ott noted that the occupancy load of the proposed restaurant would possibily exceed the permitted number allowed. He stated that the building may need additional sprinkler systems installed. He requested that the applicant submit an updated plot plan to determine the occupancy. This plan should include the floor plan, the location and dimension of the added dance floor, seating arrangements, etc. Secretary Spencer reminded the Board that the application was for a joint use of a parking area. Mr. DiLisio stated that the business would only be open during the evening hours and that most of the other commercial businesses in the center are closed at approximately 6:00 P.M. with the exception of another restaurant. Board Member Ott addressed the applicant, stating that prior to opening of the business, all building and fire code requirements must be met and suggested he contact the Fire Department immediately. ON MOTION BY SPENCER AND SECOND BY OTT ADMINISTRATIVE REVIEW NO. 80-16 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS BY THE FOLLOWIN VOTE: FINDINGS: The majority of parking demand for the existing commercial center is between the hours of 10:00 A.M. and 5 P.M. and the proposed restaurant would primarily be an evening use. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received April 17, 1980 shall be the approved layout. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: - Traffic circulation and drives; - Parking layout; - Lot area; - Lot width and lot depth; - Type of use and its relation to property and improvements in the immediate vicinity; - Past administrative action regarding this property.
