Michael Seeley
To permit an automotive restoration, body and paint shop in an existing
building located at the northwest corner of Pipeline an6'"achine Drive.
This request is a categorical exemption Class 1, Califo,:nia Environmental
Quality Act, 1970.
Mr. Michael Seeley was present to represent the application. The public
hearing was opened.
Secretary Spencer briefly outlined the application, notinj that it was
within substantial ordinance code conformance.
The Board discussed Conditions of Approval regarding star:=age of inoperable
vehicles, equipment and parts.
The public hearing was closed.

APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS BY THE FOLLOWING

FINDINGS:
1. The establishment, maintenance, and operation of the use will
not be detrimental to:
a. The general welfare of persons residing or working in
the vicinity.
b. Property and improvements in the vicinity of such use
or building.
2. The granting of a Use Permit will not adversely affect the
General Plan.
3. The proposal is consistent with the City's General Plan of
Land Use.
CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The conceptual plot plan and floor plan received April 24,
1980, shall be the approved layout.
In its approval action, the Board of Zoning Adjustments considered the
following issues relating to the conceptual plan:
- Traffic circulation;
- Parking layout;
- Lot area;
- Lot width and lot depth;
- Type of use and its relation to property and improvements in
the immediate vicinity;
- Past administrative action regarding this property.
B. GENERAL CONDITIONS:
1. The automotive repair shall be conducted wholly within the
building.
2. There shall be no:outside storage of inoperable vehicles, parts
or equipment.
3. A review by the Board of Zoning Adjustments will be scheduled
within six (6) months of approval to verify compliance with
all Conditions of Approval and Article 951 of the Huntington
Beach Ordinance Code. If at any time compliance has not been
met, Use Permit No. 80-20 shall become null and void.

To permit the c3i-�solidation of 3 lots into 1 parcel located on the north
side of Warner approximately 301 feet east of Beach Blvd.
This request is a categorical exemption Class 5, California Environmental
Quality Act, 1970.
Mr. Ron Winterburn representing the application was present. Chairman
Tindall_ introduced the application to the Board. Secretary Spencer
gave a brief background on the application stating that the application
was within substantial ordinance code conformance.
The Board discussed the dedication of Warner Avenue, "A" Street and the
alleywith the
applicant.
ON MOTION BY TINDALL AND SECOND BY SPENCER, TENTATIVE PARCEL MAP NO. 80-553
WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS BY THE FOLLOWING
VOTE:
FINDINGS:
The proposed creation of three (3) lots into one (1) parcel
for the purposes of commercial development is in compliance
with the size and shape of property necessary for that type
of development.
2. The General Plan has set forth provisions for this type of land
use as well as setting forth objectives for implementation of this
! type of use.
3. The property was previously studied for this intensity of land
use at the time the land use designation for commercial develop-
ment was placed on subject property.
4. The size, depth, frontage, street width, and other design and
improvement features of the proposed subdivision are proposed
to be constructed in compliance with standard plans and specifi-
cations on file with the City as well as in compliance with the
State Map Act and supplemental City Subdivision Ordinance.
CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCELS FOR
ANY PURPOSE:
1. The tentative parcel map received by the Planning Department
on April 24, 1980 shall be the approved layout.
2. A parcel map shall be filed with, and approved by, the
Department of Public Works, and recorded with the Orange
County Recorder.

3. c•:arner Avenue, "A" Street and alley shall be dedicated to
City standards at the time said parcel is developed.
4. A copy of the recorded parcel map shall be filed with the
Planning Division of the Department of Development Services.

CONDITIONAL EXCEPTION NO. 80-16
Applicant: Edwin J. Evans
To permit a reduction in the required 22 foot setback for a garage located
on the east side of Gilbert at the immediate terminus of Peale Lane.
This request is a categorical exemption Class 5, California Environmental,
Quality Act, 1970.
Mr. Edwin J. Evans was present to represent the application.,
Secretary Spencer introduced the application to the Board. He explained
that the request is for a twelve (12') foot encroachment into the
setback for a front entry garage. He further stated that he had surveyed
the area that morning and found there were no other homes in the area wit
a driveway apron the length being requested. He noted that in order for
the Board to grant a Conditional Exception, a hardship must be establishe
by the applicant.
Mr. Evans stated that as there is no traffic control at the intersection
of Peale and Gilbert Streets, traffic crossing the bridge and travelling
east creasts an unsafe condition. Mr. Evans sited that cars have come
onto his property and a front yard tree had been hit once and then knocked
down. He stated that his two children occupy the front two bedrooms
and feared that a car would become uncontrolable and hit the front of his
home.
He further noted that there was poor visability when travelling from Peale
onto Gilbert. Also, the streets are not striped and there is no traffice
control devices to slow traffic at the intersection. He stated he
had made requests to the Department -of Public Works for some type of
control, however, was informed that as a result of a traffic study, that
that particular intersection did not necessitate control.
Mr. Walter Smith, a neighbor to the immediate north spoke in favor of
the request. He also stated the concern of the lack of safety, siting
that a car had over turned turning the corner. He stated that his bed-
rooms had been located at the front of the house, however, because of the
lack of safety had converted those rooms into a den area.

hairman Tindall stated that perhaps alternatives should be investigated
uch as stop signs, striping, e4c.
Secretary Spencer was concerned with the poor visability while backing
out of the driveway onto a major throughfare.
Mr. Evans stated that he is now backing onto the major street and the
approval of this request would not change that fact.
Several neighbors spoke in favor of the application siting the safety
hazards.
Board member Kelly felt that from a safety angle, the plan was acceptable.
Chairman Tindall recommended continuing the request to research the recent
traffic study on the area and to investigate various alternatives.
ON MOTION BY TINDALL AND SECOND BY SPENCER, CONDITIONAL EXCEPTION NO.
80-16 WAS CONTINUED TO MAY 21, 1980 IN ORDER TO INVESTIGATE THE APPLICATION
AND ALTERNATIVES FURTHER.
