In response to questioning from Commissioner Kenefick as to the
difference between the conformance presently before the Commission
for the acquisition of small lots north of Ellis Avenue and the
request which was tabled at a prior meeting, Legal Counsel Jim
Georges explained the differences in present zoning, General Plan
designations, and purpose of the proposed acquisitions which make
it possible for the Commission to act on the present request but
not on the prior one.

ZONE CHANGE NO. 80-9
Applicant: Woodtree Development Company
To permit a change of zone from R1 to Q-R2-PD on an 11.81 acre parcel
located on the south side of Talbert Avenue approximately 650 feet
west of Beach Boulevard.
Jim Barnes reviewed the requested zone change for the Commission's
information.
The public hearing was opened. No one was present to speak for or
against the proposal, and the public hearing was closed.
Commission review included discussion of setbacks from the abutting
residential and industrial parcels, treatment of building elevations
next to R1 lots, and provision of a pedestrian walkway through the
project to the neighborhood park.
ON MOTION BY BAZIL AND SECOND BY KENEFICK ZONE CHANGE NO. 80-9 WAS
APPROVED FOR RECOMMENDATION TO THE CITY COUNCIL WITH THE FOLLOWING
FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE:
FINDINGS:
1. The Land Use Element of the General Plan designates the subject
property as Medium Density Residential; therefore, the requested
medium density zoning is consistent with the General Plan
designation.
2. Medium density residential development on the property will be
compatible with surrounding properties, provided that adequate
measures are taken to buffer the site from industrially zoned
properties to the west.
CONDITIONS OF APPROVAL:
1. A site plan indicating one integrated scheme of development for
the entire 11.81 acres shall be submitted to the Planning Com-
mission for its review and approval prior to the approval of any
development on the site.
2. Any residential unit constructed on the site shall be provided
with a minimum 25-foot setback from the west property line of
this 11.81 acre site ,if such property line abuts industrially
zoned property at the time of development approval.
3. Access to the 11.81 acre site shall be limited to two points of
ingress/egress and shall be subject to approval by the Depart-
ments of Development Services and Public Works.
4. A minimum 20-foot setback shall be provided on the subject site
from the abutting R1 zone, with special architectural treatment
of any units abutting that R1 zone.

5. The overall design of the development on the 11.81 acre site
shall provide for pedestrian access to the existing neighbor-
hood park located south of the site; said walkway shall be
designed to connect the existing walkway to the south and
Talbert Avenue and shall be open to the public.

CONDITIONAL USE PERMIT NO. 80-14/CONDITIONAL EXCEPTION NO. 80-3/
NEGATIVE DECLARATION NO. 80-31
Applicant: Christ Presbyterian Church
To permit the construction of additional classroom facilities
at an existing church and an encroachment of nine (9) feet into
the required front yard setback on property located on the east
side of Magnolia Street approximately 500 feet south of Adams
Avenue.
The public hearing was opened.
Ray Salmi, architect for the project, addressed the Commission
to explain that the reduced setback is for only about 20 percent
of the frontage, with the buildings stepped back from the
property line. He outlined the phasing under which the project
will be constructed.
Commissioner Kenefick discussed with the applicant's representa-
tive the proposed landscaping for the project, suggesting that
it be intensified around the parking lot.
There being no other persons to address the Commission, the pub-
lic hearing was closed. -
The proposed project was reviewed by the Commission. Secretary
Palin pointed out that the rear one-third of the church property
is still zoned R1 and it would be possible for later applications
to be filed for standard residential dwellings thereon, thereby
eliminating much of the church parking as shown. He suggested
rezoning that area to preclude that possibility, and the Commis-
; Sion discussed alternative zoning to accomplish that objective.

ON MOTION BY KENEFICK AND SECOND BY WINCHELL, CONDITIONAL EXCEPTION
NO. 80-03 WAS APPROVED WITH T;IE FOLLOWING FINDINGS AND CONDITION,
BY THE FOLLOWING VOTE:
FINDINGS:
1. Exceptional circumstances apply to this property that deprive
the applicant of privileges enjoyed on other properties in the
vicinity and under the identical zone classifications. The 50-
foot setback requirement was established to provide a uniform
setback for all commercial uses. This property has been developed
with a quasi -public use.
2. This conditional exception will not constitute a grant of special
privilege inconsistent with limitations upon other properties
and under identical classification insofar as this property has
not been developed as a typical C2 use.
3. This conditional exception is necessary for the preservation and
enjoyment of one or more substantial property rights. The loca-
tion and arrangement of existing structures on the -site dictate
the proposed design of the development. -
4. This conditional exception will not be materially detrimental to
the public welfare or injurious to property in the same zone
classification. The:�proposed front yard setback provides a suffi-
cient greenbelt area along the arterial street, considering the
scale and intensity of the proposed development.
CONDITION OF APPROVAL:
1. The Planning Commission reserves the right to rescind this condi-
tional exception approval in the event of any violation of the
terms of this approval or violation of the applicable zoning laws.
Any such decision shall be preceded by notice to the applicant
and a public hearing and shall be based upon specific findings.

1. The parking indicated on the proposed master plan is adequate
to accommodate the additional church facilities.
2. The proposed use is compatible with surrounding land uses and
conforms with development standards stated in Division 9 of the
ordinance code.

CONDITIONS OF APPROVAL:
1. The site plan, floor plan, and elevations received and dated
April 4, 1980, shall be the approved layout.
2. The project shall comply with all Fire Department standards.
3. The project shall comply with all Department of Public Works
standards.
4. All building spoils, such as unusable lumber, wire, pipe, and
other surplus or unusable material, shall be disposed of at
an offsite facility equipped to handle them.
5. If lighting is included in the parking lot, energy efficient
' lamps shall be used (e.g., high-pressure sodium vapor, metal
halide). All outside lighting shall be directed to prevent
spillage onto adjacent properties.
6. Prior to the issuance of building permits, the proponents
shall make application for a change of zoning for the rear
one-third of the church property not proposed to be developed
under the subject application. This change of zoning shall
be from R1 (low density residential) to RA (residential agri-
cultural district).
7. Intensified landscaping shall be installed around the large
parking lot, between the subject project and the R1 proper-
ties abutting the southerly property line of subject site.
8. The Planning Commission reserves the right to rescind this
conditional use permit approval in the event of any violation
of the terms of this approval or violation of the applicable
zoning laws. Any such decision shall be preceded by notice
to the applicant and a public hearing and shall be based upon
specific findings.

Savoy Bellavia revieWed the history of this project and outlined
changes which the staff has made to the list of permitted uses as
submitted to the Commission in Resolution 1258. Commissioner
Winchell discussed the dance studio which had previously been
approved in the subject location and expressed the need for a sign-
ing program. After review, staff was directed to amend the

resolution to include stipulations on signing.
The public hearing was opened.
Christopher Bates, applicant, addressed the Commission to concur
with the suggested conditions of approval, except that he would
prefer the approved layout date to reflect the revised map which he
has submitted. Savoy Bellavia informed the Commission that the re-
vised map is on display and has been reviewed by staff for compliance
with code.
There being no other persons to address the Commission, the public
hearing was closed.
Commissioner Greer expressed the desire to have parking spaces
allocated for specific users within the complex. This was discussed
extensively and it was determined by consensus of the Commission to be
a matter to be decided. between tenants and management. The staff was,
however, requested to evaluate the parking required in the mixed use
complexes to assure that there is enough parking for both industrial
and commercial uses.
Mr. Bellavia explained that the existing sign program in the indus-
trial tract was very similar to the.program approved for the mixed
use project to the west, except that the signs for the subject proposal
are internally illuminated.
The list of uses, as revised, contained in Resolution 1258 were con-
sidered by the Commission.

by the Planning Commission and adopted by a resolution of

tive Review No. 78-49 shall remain valid.
4. The signing for the subject uses shall conform to the
planned sign program as outlined in the communication from
the applicant received and dated May 12, 1980.
5. The Planning Commission reserves the right to rescind this
conditional use permit approval in the event of any viola-
tion of the applicable zoning laws. Any such decision shall
be preceded by notice to the applicant and a public hearing
and shall be based upon specific findings.

CONDITIONAL USE PERMIT NO. 80-16
Applicant: Pacific Design & Development
To permit a mixed use industrial development with limited commer-
cial/office/professional uses on property located on the east
side of Gothard Street approximately 790 feet south of Heil
Avenue.
Savoy Bellavia pointed out that this application differed from
the immediately previous one in that this project was designed
from its inception to accommodate the mixed uses, which will be
housed in Buildings 15 and 17 along Gothard Street. He reminded
the Commission that an "X" map had previously been processed and
that drive accesses have been approved by the Department of Public
Works on its master plan of curb cuts. The subject request is
for approval both of the project itself and the mixed uses as
outlined in Resolution 1263.
The public hearing was opened.
Kim Richards, representing the applicants, addressed the Com-
mission to urge approval of the project. There being no persons
present to speak for or against the proposal, the public hear-
ing was closed.
The project was reviewed. Commissioner Kenefick asked that in the
future any mixed development of this size be presented originally
with a landscaping plan and a signing program, particularly -as
they relate to the frontages on arterial streets. The list of
uses was discussed and approved.

ON MOTION BY KENEFICK AND SECOND BY BAZIL CONDITIONAL USE PERMIT
NO. 80-16 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS,
BY THE FOLLOWING VOTE:
FINDINGS:
1. The proposed use is compatible with the existing and surrounding
land uses in the general area insofar as all of the surrounding
properties are zoned and master planned for industrial use.
2. The proposed project complies with the provisions set forth in
Article 953, M1 Industrial Standards.
3. The proposed project is consistent with the land use element and
the provisions set forth in the City's General Plan.
CONDITIONS OF APPROVAL:
1. The site plan received and dated April 7, 1980 shall be the
approved layout for the entire project.
2. The elevations of Buildings 15 and 17, received and dated April
7, 1980, shall be the approved -elevations.
3. Any revision to the list of proposed uses as outlined in Resolu-
tion 1263 shall be reviewed by the Planning Commission and adopted
by further resolution of that Commission.
4. All of the conditions imposed upon the approval of Tenatative
Tract No.10446X, Revised, shall still be valid and shall still
apply to all subsequent development of the proposed project.
5. The Planning Commission reserves the right to rescind this condi-
tional use permit approval in the event of any violation of the
terms of this approval or violation of the applicable zoning
laws. Any such decision shall be preceded by a notice to the ap-
plicant and a public hearing and shall be based.on specific
findingg of fact.
6. Natural gas shall be stubbed in at the locations of cooking facili-
ties, water heaters, and central heating units.
7. Low -volume heads shall be used on all indoor spigots.

8. All building spoils, such as unusable lumber, wire, pipe, and
other surplus or unusable material, shall be disposed of at
an offsite facility equipped to handle them.
9. The structures on the subject property, whether attached or
detached, shall be constructed in compliance with the state
acoustical standards set forth for units that lie within the
60 CNEL contours of the property. Evidence of compliance
shall consist of submittal of an acoustical analysis report,
prepared under the supervision of a person experienced in the
field of acoustical engineering, with the application for
building permit(s). All measures recommended to mitigate
noise to acceptable levels shall be incorporated into the de-
sign of the project.
10. If lighting is included in the parking lot, energy efficient
lamps shall be used (e.g., high-pressure sodium vapor, metal
halide). All outside lighting shall be directed to prevent
spillage onto adjacent properties.
11. A detailed soils analysis shall be prepared by a registered
soils engineer. This analysis shall include onsite soil
sampling and laboratory testing of materials to provide de-
tailed recommendations regarding grading, chemical and fill
properties, foundations, retaining walls, streets, and utili-
ties.
12. If foil -type insulation is to be used, a fire retardant type
shall be installed as approved by the Building Division.
13. An engineering geologist shall be engaged to submit a report
indicating the ground surface acceleration from earth move-
ment for the subject property. All structures within this
development shall be constructed in compliance with the
g-factors as indicated by the geologist's report. Calcula-
tions for footings and structural members to withstand anti-
cipated g-factors shall be submitted to the City for review
prior to the issuance of building permits.
14. A plan for silt control for all storm runoff from the property
during construction and during initial operation of the
project shall be submitted to the California Regional Water
Quality Control Board staff for its review prior to the
issuance of grading permits.
15. Information on equipment or facilities which may generate air
pollutants shall be submitted to the South Coast Air Quality
Management District staff for its review prior to the issuance
of a certificate of occupancy for any use within a building.
16. A signing program shall be submitted for approval by the
j Director of Development Services. Such signing program shall
j incorporate a requirement for external lighting of any and
all signs.

17. A landscaping plan for the project shall be submitted for
the approval of the Director of Development Services.

DISCUSSION ITEMS:
Commissioner Kenefick was appointed to serve as the Commission's
representative on the Ad Hoc Committee for the Design Review
Board.
Commissioner Porter was appointed to the Ad Hoc Condominium Conver-
sion Ordinance Committee.
Secretary Palin reported the City Council action of May 19, 1980
for the Commission's information.
DEVELOPMENT SERVICES ITEMS:
CONDITIONAL USE PERMIT 80-7/TENTATIVE PARCEL MAP 79-586 (Revised)
Applicant: The Roman Catholic Bishop of Orange
Savoy Bellavia reported that the applicant for this previously
approved church facility had concluded that future circulation
would warrant an additional drive cut on Talbert Avenue. This re-
quest has been reviewed by the City Engineer and the City Traffic
Engineer and they have concurred with the additional curb cut at
the location proposed. George Tindall explained that the drive
has been realigned with a drive across the street, which will
serve to minimize traffic conflict. Commission discussion ensued.
ON MOTION BY KENEFICK AND SECOND BY WINCHELL THE COMMISSION
APPROVED THE REVISED PLAN RECEIVED AND DATED MAY 7, 1980, FOR AN
ADDITIONAL DRIVE ACCESS, WITH THE PROVISION THAT THE NEW DRIVE SHALL

COMMISSION ITEMS:
Commissioner Bazil suggested that it was advisable to amend the
mixed use ordinance to incorporate an approved list of commercial
uses which would be allowed in the mixed industrial tracts, rather
than reviewing them project by project. Another revision should
be to eliminate the provision that allows an existing industrial
tract to apply for mixed use.

After discussion and review, the Commission concurred.
