BOARD MEMBERS PRESENT: Tindall, Lipps, Ott REGULAR AGENDA ITEMS: CONDITIONAL EXCEPTION NO. 80-16 Applicant: Edwin J. Evans To permit a reduction in the required twenty-two (22') foot setback for a garage located on the east side of Gilbert at the immediate terminus of Peale Lane. This request is a categorical exemption Class 5, California Environ- mental Quality Act, 1970. Chairman Tindall introduced the application to the Board, noting that. the application was a continued item. He Abported that the traffic division had studied the intersection and found that it did not warrant any major type of traffic control. Traffic records indicated three (3) accidents within the last ten (10) years. Public Works recommendation: Install a one way stop sign on Peale Lane. Mx. Tindall stated that the review also indicated that by granting approval on site circulation would be improved. At this time, two cars cannot park side by side in the driveway. The front entry garage would allow sufficient room to maneuver vehicles. Chairman Tindall opened the public hearing. Mr. and Mrs. Evans, applicants, and Mr. Walter Smith, a neighbor to the immediate north were present to represent the application. Mr."Evans stressed that the configuration of the house exposes the bed- rooms to possible uncontrollable vehicles. He sited day and night car racing, failure to come to a full stop at intersections, poor visibility. i Minutes: H.B. He further stated that approval would enable front entry into the garage which would protect the front bedrooms from on -coming vehicles. He further stated that a pilaster fence would be erected for further protection. He noted that two children occupy the front rooms of the house. Mel Ott, Fire Department representative to the Board stated he felt the application does not establish a hardship, nor, would the redesigning of the entrance to the garage or the proposed fence stop a careening car. Mrs. Evans stated that the safety of her children created a hardship and that no other alternatives were feasible to protect her home, property and .family. On street parking was discussed. Secretary Lipps informed the Board that an adjacent neighbor was in opposition as on street parking would be reduced. It was noted that parking along Peale Lane is only available on one side of the street. As there were no other parties present to speak on the application, Chairman Tindall closed the public hearing. ON MOTION BY LIPPS AND SECOND BY TINDALL, CONDITIONAL EXCEPTION NO. 80-16 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL BY THE FOLLOWING VOTE: FINDINGS: 1. The granting of the Conditional Exception will not constitute a grant of a special privilege inconsistent upon other properties in the vicinity and under an identical zone classification. 2. Because of special circumstances applicable to the subject property, including size, shape, topography, location, or surroundings, the strict application of the zoning ordinance is found to deprive the subject property of -privileges enjoyed by other properties in the vicinity and under identical zone classifications. 3. The granting of a Conditional Exception is necessary in order to preserve the enjoyment of one or more substantial property rights. 4. The granting of a Conditional Exception will not be materially detrimental to the public welfare, or injurious to property in the same zone classification. Minutes: H.B. BOARD OF ZONING ADJUSTMETNS May 21, 1980 Page 3 5. The granting of the Conditional Exception will not adversely affect the General Plan of the pity of Huntington Beach. 6. The location of the property is unique in that it is exposed to probable traffic hazards. 7. On street parking will not be impacted to the detriment of the neighborhood. CONDITIONS OF APPROVAL: 1. The conceptual plot plan and elevations received April 23, 1980 shall be the approved layout. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: - Traffic circulation and drives; - Parking layout; - Lot area; - Lot width and lot depth; - Type of use and its relation to property and improvements in the immediate vicinity; - Past administrative action regarding this property. B. GENERAL -CONDITIONS: 1. All curb cuts shall meet the Department of Public Works standards. 2. Applicant shall maintain twenty (201) feet of the existing curb and gutter to allow for off street parking south of the new driveway. 3. Said garage door to be fitted with an automatic garage door opener. AYES: Lipps, Tindall NOES: Ott ABSENT: None SPECIAL EVENT NO. 80-13 Applicant: Richard Penjoyan To permit a bar-b-que picnic on July 20, 1980 at Lake Park, Huntington Beach, CA. Minutes: H.B. BOARD OF ZONING ADJUSTMENTS May 21, 1980 Page 4 Secretary Lipps introduced the application to the Board, noting that application did not state what -type of organization was requesting approval. The applicant was not present. The Board discussed -the -.Conditions of Approval. ON MOTION BY LIPPS AND SECOND BY OTT SPECIAL EVENT NO. 80-13 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY.THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. The plot plan received May 5, 1580 shall be the approved layout. 2. Applicant shall identify organization and verify that said organization is a non -profit -association. 3. An on -site inspection by the Fire Department shall be required prior to the event. 4. A certificate of insurance form shall_be-filed-in-the Finance Depart- ment five (5) days prior to the event. AYES: Tindall, LippS, Ott NOES: None, ABSENT: None ADMINISTRATIVE -REVIEW NO. 80-21 Applicant: New Life Tabernacle Church To permit selling cherries from May 24, 198.0 to July-1, 1980 located at 19871 Main Street, Huntington --Beach. This request is a categorical exemption Class'I, California'Environmental Quality Act, 1970. Secretary Lipp9 introduced the appli.oation_.to the Board.'' noted that the application was an annual event and had no problems from previous years. The applicant was not present to represent the applicatiori. The Board discussed the Conditions of Approval. ON ,MOTION BY LIPPS AND SECOND BY OTT, ADMINISTRATIVE REVIEW NO. 80-21 WAS APPROVED BY THE FOLLOWING VOTE WITH,THE FOLLOWING CONDITIONS. CONDITIONS OF APPROVAL: 1. An on site inspection by -the Fire Department shall be required prior to the event. Brill, Jr. To permit a parking lot sale May 30, 31, 1980 and June 1, 1980 located at 18582 Beach Blvd. Chairman Tindall introduced the application to the Board. The applicant was not present. Secretary Lipps briefly explained that the application was for a furniture and hot tub parking lot sale. The location of display was discussed. Also discussed was the flow of traffic through drive way areas. ON MOTION BY LIPPS AND SECOND BY TINDALL, SPECIAL EVENT NO. 80-16 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. The plot plan received May 16, 1980 shall be the approved layout. 2. An on site inspection by the Fire Department shall be required prior to the event. 3. The applicant shall obtain all necessary electrical permits. 4. A certificate of insurance form shall be filed in the Finance Department five (5) days prior to the event. 5. Outside storage and sale of all merchandise shall be restricted to that area of the parking lot adjacent to the west side of the building and south of the southerly most driveway. 6. All driveways on the site shall be kept clear at all times to ensure free flow of vehicular traffic. Minutes: H.B.
