BOARD MEMBERS PRESENT: Spencer, Tindall, Ott MINUTES: ON MOTION BY SPENCER AND SECOND BY TINDALL, THE MINUTES OF THE REGULAR MEETING OF MAY 14, 1980 WERE APPROVED BY THE FOLLOWING VOTE: AYES: Spencer, Tindall NOES: None ABSTAIN: Kelly ON MOTION BY OTT AND SECOND BY TINDALL, THE MINUTES OF THE REGULAR MEETING OF MAY 21, 1980 WERE APPROVED BY THE FOLLOWING VOTE: AYES: Ott, Tindall NOES: None ABSTAIN: Spencer REGULAR AGENDA ITEMS: ADMINISTRATIVE REVIEW NO. 80-18 Applicant: Ray Galvin To permit the construction of an 8,360 sq. ft. industrial building located on the east side of Gothard, approximately 100 feet south of Cain. This application is covered by Negative Declaration No. 80-35. ON MOTION BY TINDALL AND SECOND BY SPENCER THE BOARD, HAVING FOUND THAT THE PROPOSED PROJECT WILL NOT HAVE A SIGNIFICANT ADVERSE EFFECT ON THE PHYSICAL ENVIRONMENT, ADOPTED NEGATIVE DECLARATION NO. 80-35 WITH THE MITIGATING MEASURES CONTAINED IN ADMINISTRATIVE REVIEW NO. 80-18 GENERAL CONDITIONS B-4 THROUGH B-7 IMPOSED ON THE ADMINISTRATIVE REVIEW APPLICATION, BY THE FOLLOWING VOTE: AYES: Tindall, Spencer, Ott NOES: None ABSENT: None Minutes: H.B. BOARD OF ZONING ADJUSTMENTS June 4, 1980 Page 2 Mr. Ray Galvin, representing the application was present. Chairman Tindall introduced the application to the Board. Secretary Spencer gave a brief background on the application, stating that a preliminary plan check revealed the application to be within substantial ordinance code conformance. Mr. Galvin stated that the building use is intended for a repair and body shop. Some outside storage of vehicles being repaired is planned, an existing block wall fence will be retained to screen the storage portion from the public view. Secretary Spencer noted that the outside storage of vehicles being repaired is acceptable in this particular zoning area. Chairman Tindall expressed concern regarding parking, specifically, handicapped, in relation to building access. He recommended that the handicapped parking be relocated to the front of the proposed building. Secretary Spencer noted that the plan was deficient in the required 6% landscaping. He stated that a revised plan, reflecting the required onsite landscape coverage must be submitted prior to issuance of building permits. The Board discussed the existing block wall fence along Palmdale. Chairman Tindall recommended that the fence be lowered in height at the driveway to allow for better visability. Location and standard specifications regarding trash enclosures were discussed with the applicant. ON MOTION BY SPENCER AND SECOND BY TIN_DALL, ADMINISTRATIVE REVIEW NO. 80-19 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received May 15, 1980 shall be the approved layout, subject to the modifications described herein: a. Landscaped area totaling 6% of site shall be reflected. b. Parking shall be in conformance with Article 979 of the Huntington Beach Ordinance Code, showing all dimensions. c. Existing block wall at rear property line shall be lessened in height to forty-two (42") inches maximum for a dimension of ten (10) feet on either side of proposed driveway. A plan delineating said modifications shall be submitted to the Secretary of the Board. If such plan complies with the modifications 1 Minutes: H.B. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: - Traffic circulation and drives; - Parking layout; - Lot area; - Lot width and lot depth; - Type of use and its relation to property and improvements in the immediate vicinity; - Past administrative action regarding this property. 2. The following plans shall be submitted to the Secretary of the Board: 1. Landscape and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code and landscaping specifications on file in the Department of Public Works. 2. Rooftop mechanical equipment screening plan. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment. B. GENERAL CONDITIONS: 1. A parcel map shall be filed and recorded with the Orange County Recorders Office reflecting consolidation of parcels prior to issuance of Certificate of Occupancy. 2. The handicapped parking shall be located to the front of the proposed building. 3. Applicant shall make improvements and dedicate portions of Palmdale and Gothard Streets to Public Works standards and specifications. 4. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 5. If lighting is included in the parking lot, energy efficient lamps shall be used (e.g. high pressure sodium vapor, metal halide). All outside lighting shall be directed to prevent "spillage" onto adjacent properties. Minutes: H.B. BOARD OF ZONING ADJUSTMENTS June 4, 1980 Page 4 6. A detailed soils analysis shall be prepared by a registered soils engineer. This analysis shall include on -site soil sampling and laboratory testing of materials to provide detailed recommendations regarding grading, chemical and fill properties, foundations, retaining walls, streets, and utilities. 7. If foil -type insulation is to be used, a fire retardant type shall be installed as approved by the Building Department. AYES: Spencer, Tindall, Ott NOES: None ABSENT: None ADMINISTRATIVE REVIEW NO. 80-19 Applicant: Professional Group To permit the construction of a 24,000 sq. ft. office building located on the northeast side of Pacific Coast Highway, approximately, 100 feet east of Mariner Drive. This request is covered by Negative Declaration No. 80-37. Mr. Perez stated that the application is for a three (3) story office building with a portion of the required parking located on the ground floor. Secretary Spencer noted that parking for the proposed building is 80 spaces. The subject plan reflects a portion of required parking as compact which is unacceptable. Chairman Tindall questioned the applicant regarding height clearance for the parking garage, particularly for trucks and campers. Minutes: H.B. BOARD OF ZONING ADJUSTMENTS June 4, 1980 Page 5 Secretary Spencer stated that a six (61) foot high, six (6") inch wide block wall was required along the northerly property line. Mr. Perez stated that an existing block wall is located on the adjacent property. Chairman Tindall stated that the applicant is responsible for sewer line tie-in into the sanitary sewer. He recommended that the applicant meet with the Mariner Drive Homeowners Association to coordinate the tie-in. Louisa Finn, a member of the Huntington Beach Planning staff was present. She stated that the site was proposed as a visitor serving use on the draft Local Coastal Element and that approval to build must be given by the Coastal Commission. The location of underground utilities were discussed. Mr. Perez stated that if possible, utilities would be underground. The Board discussed a reciprocal access agreement in the event of future development to the north and south of the subject property. ON MOTION BY SPENCER AND SECOND BY OTT ADMINISTRATIVE REVIEW NO. 80-19 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received May 12, 1980 shall be the approved layout, subject to the modifications described herein: a. Parking shall conform to Article 979, with the standard dimensioned stalls for the required parking any -excess can be compact. A plan delineating said modification shall be submitted to the Secretary of the Board. If such plan complies with the modi- fication outlined by the Board, said plan shall be approved and made a permanent part of the administrative file. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: - Traffic circulation and drives; - Parking layout; - Lot area; - Lot width and lot depth; - Type of use and its relation to property and improvements in the immediate vicinity; - Past administrative action regarding this property. 2. AYES: Spencer, Tindall, Ott NOES: None ABSENT: None CONDITIONAL EXCEPTION NO. 80-20 Applicant: Jerwel Enterprises To permit the installation of an oversized, 500+ sq. ft., 39.5' high subdivisional directional sign located on the north side of Center Drive approximately 900 feet east of Gothard Street. Minutes: H.B. BOARD OF ZONING ADJUSTMENTS June 4, 1980 Page 7 This request is a categorical exemption Class 1, California Environmental Quality Act, 1970. Chairman Tindall introduced the application to the Board. Secretary Spencer briefly outlined the application stating that the code allows for a sign width of one hundred (1001) feet and a height of twenty (20') feet. He further noted that the applicant is required to establish a hardship in order for the Board to grant approval (i.e. being deprived of privileges enjoyed by other properties in the vicinity.) Chairman Tindall opened the public hearing on Conditional Exception No. 80-20. Mr. Jerry Klein and Mr. Earl Welk were present to represent the application. Mr. Klein stated that the proposed sign is a two faced, v-board type sign, supported by ten (10) power pole type supports and is the only sign intended for the project. He further stated that the location was selected so as not to interfer with the construction of the first phase of development. Secretary Spencer noted that due to the grade differential between the property and the freeway, a standard size sign would in ineffective for the success of the project. There being no other parties present to speak, Chairman Tindall closed the public hearing. Discussion ensued regarding conditions of approval. ON MOTION BY TINDALL AND SECOND BY OTT, CONDITIONAL EXCEPTION NO. 80-20 WAS APPROVED WITH THE FOLLOWING REASONS, FINDINGS AND CONDITIONS OF APPROVAL BY THE FOLLOWING VOTE: REASONS: 1. Said subdivisional sign is temporary and shall expire one (1) year from issuance of building permits, or at such time all buildings/units are sold, leased or rented, which ever occurs first. 2. Due to the grade differential between the 405 Freeway and the subject propety a proposed sign at code required height would be unseen by freeway traffic. _ 3. In order for the sign to have proper visual impact, the sign must be visable from the freeway. FINDINGS: 1. The granting of this application is found not to constitute a grant of special privilege inconsistent upon other properties in the vicinity. Minutes: H.B. Due to topographical conditions and the temporary nature of the proposed sign, strict application of the Huntington Beach sign ordinance is found to deprive subject property of privileges enjoyed by other properties in the vicinity. 3. The granting of this application is found not to be materially detrimental to public welfare. 4. The granting of this Conditional Exception will not adversely affect the General Plan of the City of Huntington Beach. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received May 15, 1980 shall be the approved layout. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: - Traffic circulation and drives; - Parking layout; - Lot area; - Lot width and lot depth; - Type of use and its relation to property and improvements in the immediate vicinity; - Past administrative action regarding this property. B. GENERAL CONDITIONS: 1. If sign is to be illuminated, lights shall be installed so as not to glare onto freeway or residential areas. 2. Said sign shall not be placed over a public use or easement. AYES: Tindall, Spencer, Ott NOES: None ABSENT: None SPECIAL EVENT NO. 80-17 Applicant: American Youth Soccer Organization To permit a picnic August 9, 1980 from 12:00 to 4:00 P.M. at Lake Park, Huntington Beach, CA. Secretary Spencer noted that there had been similar requests and there had been no previous problems. ON MOTION BY SPENCER AND SECOND BY OTT, SPECIAL EVENT NO. 80-17 WAS APPROVED WITH THE FOLLOWING CONDITION BY THE FOLLOWING VOTE: Minutes: H.B.
