BOARD MEMBERS PRESENT: Tindall, Ott, Lipps AGENDA ITEMS TO BE CONTINUED OR WITHDRAWN: REGULAR AGENDA ITEMS: TENTATIVE PARCEL MAP NO. 80-556 Applicant: Terry Adams To permit the division of a site into two parcels of 8,523 sq. ft. and 7,928 sq. ft. creating two legal building sites loca,..:d on the north side of Gateshead Drive and Harwich Lane. Chairman Tindall introduced the application to the Board. Secretary Lipps briefly outlined the proposal. Mr. Kirk Evans was present to represent the application. Mr. Evans stated that the proposed project is for 3,200 sq. ft. which will blend architecturally with the surrounding area. The Board found the application to be within Ordinance Code conformance. Findings and Conditions of Approval were discussed. ON MOTION BY LIPPS AND SECOND BY TINDALL TENTATIVE PARCEL MAP NO. 80-556 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL BY THE FOLLOWING VOTE: FINDINGS: 1. The proposed division of a site into two (2) parcels for purposes of creating two legal buildings sites is in compliance with the size and shape of property necessary for that type of development. 2. The General Plan has set forth provisions for this type of land use as well as setting forth objectives for implementation of this type of use. 3. The property was previously studied for this intensity of land use at the time the land use designation for residential development, which allows residential buildings, was placed on subject property. The size, depth, frontage, street width, and other design and improvement features of the proposed subdivision are proposed to be constructed in compliance with standard plans and specifications on file with the City as well as in compliance with the State Map Act and supplemental City Subdivision Ordinance. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCELS FOR ANY PURPOSE: 1. The tentative parcel map received by the Department of Develop- ment Services on May 16, 1980 shall be the approved layout (with the amendments as noted thereon). 2. A parcel map shall be filed with, and approved by, the Department of Public Works, and recorded with the Orange County --corder. 3. Gateshead Drive shall be dedicated to City stanu-ids at the time said parcels are developed. 4. Water supply shall be through the City of Huntington Beach's water system at the time said parcels are developed (if such system exist within 200 feet of said parcels.) 5. Sewage disposal shall be through the City of 1,1-_'-i_ngton Beach's sewage system at the time said parcels are developed (if such systems exist within 200 feet of said parcels.) 6. All utilities shall be installed undergound at the time said parcels are developed. 7. Compliance with all applicable City Ordinances. 8. A copy of the recorded parcel map shall be filed with the Department of Development Services. AYES: Lipps, Tindall, Ott NOES: None ABSENT: None CONDITIONAL EXCEPTION NO. 80-21 Applicant: Ronald Coleman To permit a reduction in required open space dimension from 25' to 21'6" located on the east side of Running Springs, approximately 300 feet north of Peck Drive. This request is a categorical exemption No. 5, California Environmental Quality Act, 1970. Chairman Tindall introduced the application to the Board. Secretary Lipps briefly explained the request. Mr. Lipps stated that the appli- cation was in compliance with the ordinace code except for ti. reduction Minutes: H.B. BOARD OF ZONING ADJUSTMENTS June 11, 1980 Page 3 in open space. He further stated that a portion of the existing building has a twentyone (21') foot setback and the proposed addition would not extend beyond the existing structure. Mr. Ronald Coleman was present to represent the application. Chairman Tindall opened the public hearing. Mr. Coleman stated that a breezeway between the existing structure and the additions is being proposed, and the additions would not extend beyond an existing structure. There being no other parties present, the public hearing was closed. ON MOTION BY TINDALL AND SECOND BY LIPPS CONDITIONAL EXCEPTION NO. 80-21 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDTIONS BY THE FOLLOWING VOTE: FINDINGS: 1. The granting of the Conditional Exception will not constitute a grant of a special privilege inconsistent upon other properties in the vicinity and under an identical zone classification. 2. Because of special circumstances applicable to the subject property, including size, shape, topography, location, or surroundings, the strict application of the zoning ordinance is found tG deprive the subject property of privileges enjoyed by other properties in the vicinity under identical zone classifications. 3. The granting of a Conditional Exception is necessary in order to preserve the enjoyment of one or more substantial property rights. 4. The granting of a Conditional Exception will not be materially detrimental to the public welfare, or injurious to property in the same zone classification. 5. The granting of the Conditional Exception will not adversely affect the General Plan of the City of Huntington Beach. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received May 29, 1980 shall be the approved layout. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: Minutes: H.B. BOARD OF ZONING ADJUSTMENTS June 11, 1980 Page 4 - Traffic circulation and drives; - Parking layout; - Lot area; - Lot width and lot depth; - Type of use and its relation to property and improvements in the immediate vicinity; - Past administrative action regarding this property. AYES: Tindall,-Lipps, Ott NOES: None ABSENT: None LOT LINE ADJUSTMENT NO. 80-2 Applicant: John D. Lusk & Son To permit moving -common lot line between parcels located betwpprn Spring- dale Street and Transistor Lane, south of Engineer Drive and ..orth of Machine Drive. This request is a categorical exemption Class 5, California Environmental Quality Act, 1970. Chairman Tindall introduced the application to the Board. Secretary Lipps outlined the application stating that a preliminary plan check revealed the request to be within compliance with the general and specific plan for the area. J Chairman Tindall opened the public hearing. Mr. Jerry Clark was present to represent the application. Mr. Clark stated that the adjustment does not affect any existing building. The closest building to the adjusted lot line would be ten (101) feet. He further stated that a five (5') foot planter would be affected. There being no other parties present to speak on the application, the public hearing was closed. The Board discussed the conditions of approval. ON MOTION BY LIPPS AND SECOND BY TINDALL LOT LINE ADJUSTMENT WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL BY THE FOLLOWING VOTE: FINDINGS: 1. Lot Line Adjustment No. 80-2 is consistent with the General Plan and Specific Plan of the City of Huntington Beach. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan received May 29, 1980 shall be the approved layout. 1 Minutes: H.B. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: - Traffic circulation and drives; - Parking layout; - Lot area; - Lot width and lot depth; - Type of use and its relation to property and improvements in the immediate vicinity; - Past administrative action regarding this property.
