Staff briefly reviewed the requested zone change. The public hearing was reopened. Dick Nerio submitted a letter to the Commission describing the history of the property and the economic changes which have affected the existing airport on the site. Mr. Nerio outlined the benefits which he feels would accrue to the City if his zone change is implemented and questioned the negative fiscal impact as outlined in the report submitted to the Commission. Planning Commission June 17, 1980 Page 2 The following other persons also addressed the Commission in support of the change of zoning: Pat James, representing Goldenwest Mobile - home Manufacturing; Jean Cowan, nearby resident; Norman Bush, owner of other mobilehome parks; Elvin Randall; Art Nerio; Ed Chadowski, representing Huntington -by -the -Sea Homeowners' Association; Lillian Myketuk, mobilehome resident; Tom Livengood; Edna Mier; Charles Dirks- mier; Betty Imamena; and Mike Rodgers, representing senior citizens. The speakers addressed the desirability of providing low- and moderate - cost housing in the City, the provision of jobs and additional tax base, and the possible impact of the projected mobilehome park on sur- rounding areas, which they felt would not result in any lowering of adjacent property values. The accuracy of the fiscal impact report was also brought into question, and Chuck Clark of the City staff ex- plained how the figures contained in that report in regard to school financing, police and fire protection, and City revenues had been arrived at. Mr. Dick Nerio and Tom Livengood also submitted lists of signatures of residents in support of the proposed zone change. Chris Leonard, 230 Elmira Street, Huntington Beach, spoke to the Com- mission in favor of retaining Meadowlark Airport on the property. There being no other persons to address the Commission, the public hearing was closed. Commission discussion ensued. Commissioner Porter reviewed with the applicant what the improved value of the developed site would be, noting that it is necessary to determine within a reasonable range what the improvements will cost in order to determine the financial effect upon the City revenue/expenditure figures. After discussion among staff, applicant, and the Commission, Chuck Clark agreed that the staff's estimate is probably on the low side but that the differential between staff's figures and Mr. Nerio's are not significant in terms of property taxes which can be expected to be generated from the project. Commissioner Kenefick indicated her feeling that this may be the City's last opportunity to obtain such a large block of affordable housing; she also noted, however, that she did not support the "adults only" aspect of the proposal. Commissioner Bauer suggested that there were perhaps other alternatives for affordable housing which would be consistent with the existing R1 zoning. He also discussed the desirability of providing housing for other segments of the community besides the elderly, the fiscal impacts of the project, and soil conditions on the site. Commissioner Bazil cited previous City Council direction for seeking to'add mobilehome spaces to the City's housing inventory. He also objected to the adult designation, and suggested that perhaps a por- tion of any park could be designated for family occupation. Commissioner Winchell pointed out that approval would effectively isolate an already developed Rl area, and that she could not favor approval of the entire 64 acres for MH zoning. -2- 6-17-80 - P.C. Planning Commission June 17, 1980 Page 3 Extensive discussion between staff and the project applicant followed, taking into consideration new legislation affecting operation of mobilehome parks and Mr. Nerio's specific intentions for the operation of his project. Commissioner Porter expressed the opinion that if the zoning is granted it should be desig- nated as Qualified MH, to allow requirements for setbacks, landscaping, and buffering to be imposed. A motion was made by Commissioner Bauer that staff be directed to return to the Commission at an early date with a proposal incorporating features of mobilehome zoning in the 64 acres as well as any other alternatives which may be consistent with good planning practice, and that Zone Change No. 80-7 be contin- ued to allow the above action to be taken. Commission was informed by staff and legal counsel that it would need the concurrence of the applicant for any continuance because of the mandatory processing date of the application. A recess was called at 8:55 p.m. to permit Mr. Nerio to make a decision on a continuance. The meeting was reconvened at 9:10 p.m. Mr. Dick Nerio informed the Commission that he would request a decision of some sort from the Commission at this meeting. The motion to continue was declared out of order by the Chairman. Possible requirements to be included in any "Q" zoning designa- tion and the parliamentary methods of imposing such a designation were reviewed. ON MOTION BY KENEFICK AND SECOND BY PORTER NEGATIVE DECLARATION NO. 80-17 WAS ADOPTED BY THE FOLLOWING VOTE: AYES: Winchell, Kenefick, Porter, Bazil, Greer NOES: Bauer ABSENT: None ABSTAIN: None ON MOTION BY PORTER AND SECOND BY KENEFICK ZONE CHANGE NO. 80-7 WAS APPROVED WITH A "Q" (QUALIFIED) PREFIX WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL FOR "Q" (QUALIFIED)MH ZONING: 1. Special attention shall be paid to the setbacks and buffering along arterial highways bordering the property. 2. A perimeter landscaped buffer zone of no less than twenty (20) feet from any coach to the property line shall be provided around any boundary of the property adjacent to residential properties. Planning Commission June 17, 1980 Page 4 SPECIAL SIGN PERMIT NO. 80-4 (Cont. from 6-3-80) Applicant: First Southern Corporation To allow six (6) freestanding signs and miscellaneous flags and banners for the purpose of identifying a condominium project located on the southeast corner of Warner Avenue and Edwards Street. Jim Barnes reviewed the application and submitted an added suggested condition of approval for consideration. The public hearing was reopened. Kurt Yeager, attorney for the applicant, spoke in favor of the request as submitted. He agreed to the nedd for a time limit on the signs; however, the applicant does not agree with the staff's recommendation regarding dimensioning and placement of the signs. In response to questioning from Commissioner Winchell, Mr. Yeager indicated that the signs are a critical part of their marketing program and denial would cause a substantial financial impact to that program. He also discussed the timing of the application for the special sign permit, which was made approximately six weeks after the signs were in existence. _ There were no other persons to speak for or against the proposal, and the public hearing was closed. The Commission viewed slides of the existing signs and discussed the proposal. ON MOTION BY WINCHELL AND SECOND BY BAZIL SPECIAL SIGN PERMIT NO. 80-4 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOL- LOWING VOTE: FINDINGS: 1. Strict compliance with the sign code will result in a substantial economic hardship to the applicant because it will deprive him of the primary means to identify the project. 2. The proposed sign will not adversely affect other signs in the area because there are no signs within the vicinity of the proposed sign. 3.' The proposed sign will not be detrimental to the property located in the vicinity of the subject sign because the signs are located along Warner Avenue and Edwards Street. 4. The proposed sign does not obstruct pedestrian and vehicular traffic because the sign is not located near any points of egress or ingress. CONDITIONS OF APPROVAL: 1. The total square footage of sign area shall be limited to no more than one hundred (100) square feet, and the flags shall be eliminated. -4- 6-17-80 - P.C. Minutes, H.B. Planning Commission June 17, 1980 Page 5 2. Signs shall be mounted in such a manner that they will not interfere With traffic vision on Warner Avenue or Edwards Street. 3. Any of the signs erected to advertise the units in the project for sale shall be removed one year from the date of approval of this application. 4. The Planning Commission reserves the right to rescind this special sign permit approval in the event of any violation of the applicable zoning laws. Any such decision shall be preceded by notice to the applicant and a public hearing, and shall be based upon specific findings. AYES: Winchell, Kenefick, Bazil, Greer, Bauer NOES: Porter ABSENT: None ABSTAIN: None ZONE CHANGE NO. 80-10/NEGATIVE DECLARATION NO. 80-40 Applicant: Initiated by the City of Huntington Beach Proposal to rezone 130 ± acres of property from RA-O-CD (Resi- dential Agriculture combined with Oil Production, Civic District), LU-O-CD (Limited Use combined with Oil Production, Civic District), and Ml-CD (Light Manufacturing, Civic District) to ROS (Recrea- tional Open Space District). Said property is located north of Ellis Avenue between Edwards Street and Gothard Street. Secretary Palin explained that, although this zone change had been initiated at the direction of the City Council, unresolved questions arising on the conceptual planning for Central Park and the economic feasibility of that planning have resulted in a decision to postpone any action on a rezone at this time.' The Council has therefore directed the Commission to remove the item from its agenda to permit further studies to be made. Regina Goss and Gary Turman, property owners in the area affected by this proposed change of zone, addressed the Commission to discuss land uses in the area and to request to be notified of any future public hearing on the zoning. ON MOTION BY WINCHELL AND SECOND BY PORTER ZONE CHANGE NO. 80-10 AND NEGATIVE DECLARATION NO. 80-40 WERE PULLED FROM THE AGENDA AT THE DIRECTION OF THE CITY COUNCIL, BY THE FOLLOWING VOTE: AYES: Winchell, Kenefick, Porter, Bazil, Greer, Bauer NOES: None ABSENT: None ABSTAIN: None -5- 6-17780 - P.C. Planning Commission June 17, 1980 Page 6 CODE AMENDMENT NO. 80-4 Initiated by the Department of Development Services Proposal to amend the ordinance code by amending Section 9511 and Section 9512 to allow recreational vehicle storage within the M1-A Light Manufacturing Districts subject to a conditional use permit. The public hearing was opened. No one was present to address the Commission, and the public hearing was closed. Commissioner Porter spoke against amending the code, saying that there is sufficient allowance for storage in the M1 districts and any expansion of such use would serve to dilute the economic base of the industrial areas and reduce employment potential. Commissioner Greer concurred with that opinion; Commissioner Kenefick requested that staff include a fiscal report on items of this or a similar nature so that the Commission could know in advance the financial ef- fects of whatever action it might decide to take. Commissioner Bazil pointed out that the amendment would restrict any such storage use which might be granted to a five year term and the use could not therefore be regarded as a permanent use of the land, nor would erection of structures be allowed. Legal counsel Jim Georges discussed the uses as presently permitted, informing the Commission that the City Attorney's office interprets the code as now permitting such storage as that which is requested. Secretary Palin noted that the Department of Development Services does not agree with that interpretation. A MOTION WAS MADE BY BAZIL AND SECONDED BY GREER THAT CODE AMENDMENT NO. 80-4 BE APPROVED FOR RECOMMENDATION TO THE CITY COUNCIL TO ALLOW RECREATIONAL VEHICLE STORAGE IN THE Ml-A DISTRICT. MOTION FAILED BY THE FOLLOWING VOTE: AYES: Bazil NOES: Winchell, Kenefick, Porter, Greer, Bauer ABSENT: None ABSTAIN: None ON MOTION BY BAUER AND SECOND BY GREER CODE AMENDMENT NO. 80-4 WAS DENIED BY THE FOLLOWING VOTE: AYES: Winchell, Kenefick, Porter, Bazil, Greer, Bauer NOES: None ABSENT: None ABSTAIN: None Later in the meeting, Secretary Palin requested that the Commission reconsider its action on the code amendment proposal, noting that if the Commission has concerns about storage of recreational vehicles in the Ml-A Districts it would be advisable to clarify the code so that future applicants are not faced with a conflict in interpreta- tion between departments. He suggested deletion of Section 2 of the proposed amendment and some clarification of language in the re- mainder. 1 -6- 6-17-80 - P.C. Minutes, H.B. Planning Commission June 17, 1980 Page 7 ON MOTION BY BAZIL AND SECOND BY KENEFICK THE COMMISSION DETERMINED TO RECONSIDER CODE AMENDMENT NO. 80-4, BY THE FOLLOWING VOTE: AYES: Winchell, Kenefick, Porter, Bazil, Greer, Bauer NOES: None ABSENT: None ABSTAIN: None In the following discussion the consensus became clear that it was the Commission's intent to prohibit storage of recreational vehicles in the M1-A districts while continuing to permit such storage in the M1 districts. Legal counsel Georges indicated that the changes as recommended by Mr. Palin would satisfy the Attorney's office and would be enforceable. ON MOTION BY WINCHELL AND SECOND BY KENEFICK CODE AMENDMENT NO. 80-4 WAS APPROVED FOR RECOMMENDATION TO THE CITY COUNCIL, DELETING SECTION 2 OF THE AMENDMENT AS PROPOSED TO REMOVE THE CLAUSE WHICH WOULD HAVE PERMITTED STORAGE OF RECREATIONAL VEHICLES IN THE M1-A DISTRICTS AND TO CLARIFY LANGUAGE IN THE REMAINING SEC- TIONS, BY THE FOLLOWING VOTE: AYES: Winchell, Kenefick,Porter, Bazil, Greer, Bauer NOES: None ABSENT: None ABSTAIN: None APPLICATIONS NOT FOR PUBLIC HEARING: SEACLIFF PHASE IV Applicant: Mansion Properties To permit certain revisions to formerly approved Conditional Use Permit No. 77-23, Tentative Parcel Map No. 78-37, and Tenta- tive Tracts 10067, 10068, 10069 which comprise a 531-unit Planned Residential Development located west of Goldenwest Street and north of Palm Avenue. Secretary Palin reported that the changes as requested by the developer have been made necessary by conditions of approval im- posed by the Coastal Commission. These changes include the realignment of 38th Street from its original layout; the redesign of Product C; redesign of the street between Product Areas B and C; and changes in the circular nodes in Product B. The total unit count in the project has not changed. Mr. Palin also reviewed the proposed changes in some conditions of approval which had been imposed on the project. Composite plans for the project were submitted and reviewed by the Commission. Dave Eadie, representing the developers, informed the Commission that his company has reviewed and agreed with the suggested revisions to the conditions of approval. -7- 6-17-80 - P.C. Minutes, H.B. Planning Commission June 17, 1980 Page 8 ON MOTION BY KENEFICK AND SECOND BY BAZIL THE COMMISSION APPROVED THE REVISIONS TO CONDITIONAL USE PERMIT NO. 77-23 WITH PRIOR FIND- INGS AND CONDITIONS OF APPROVAL, EXCEPT FOR THE REVISIONS LISTED BELOW, BY THE FOLLOWING VOTE: REVISED CONDITIONS OF APPROVAL: 1. The revised composite site plan received and dated June 5, 1980, reflecting those details and amenities as required by the Planning Commission and those shown upon the supporting plans re- ceived and dated October 18, 1978, shall be constructed as indi- cated within the development, including but not limited to open space, water areas, textured pavements, fencing, schematic eleva- tions, materials and colors, recreational facilities, pedestrian walkways, and oil well treatments. 18. The revised plan for Product C, received and dated June 5, 1980 shall be the approved layout for the minimum parking requirements on Product C. Each parking node shall reflect total circulation around and through such areas and the design of such circulation shall be subject to the approval of the Fire Department. 21. Recreational facilities shall be provided within the common open area of Product A. The revised plans received and dated June 5, 1980, shall be the approved layout for the facilities. 32. At the time the oil operations within the blue borders of Tenta- tive Tracts Nos. 10067, 10068, and 10069 cease to operate, the lot configuration of these parcels shall comply with the map re- ceived and dated June 5, 1980. The wall design and landscaping treatment around the oil operations within the three (3) tentative tracts or adjacent to the blue borders of these tracts shall be submitted to the Department of Development Services for review and approval action. Walls and landscaping shall be instal -Led by the developer and the homeowners' association shall be responsible for maintaining the landscaping around the islands within the blue borders, while the developer shall be responsible for maintaining the landscaping for those islands adjacent to the blue borders until such time as oil opera- tions have terminated upon subject site and the alternative use has been established thereon. 35. The tentative parcel map received and dated June 5, 1980, shall be the approved layout, subject to prior conditions of approval and adjustment to reflect the boundary line changes resulting from the final adoption of Zone Change No. 78-4. Condominium Conversion Special Report June Catalano presented the report, noting that it contains in- formation and background studies which will be used later in the preparation of a specific condominium conversion ordinance. Staff is soliciting input from the Commission on any facets of the problem which it may wish to have investigated further. -9- 6-17-80 - P.C. Minutes, H.B. Planning Commission June 17, 1980 Page 10 General Plan Amendment Items: Submittal of these items was in response to a prior Commission request. Review and discussion followed. Amendment of the C2 District: Staff requested input from the Commission on a code amendment which would allow professional office buildings within the C2 (Community Business) Districts. Following review it was the consensus of the Commission that staff be instructed to initiate such a code amendment. ON MOTION BY KENEFICK AND SECOND BY BAZIL THE STAFF WAS INSTRUCTED TO PREPARE A CODE AMENDMENT TO ALLOW PROFESSIONAL OFFICE BUILDINGS IN THE C2 DISTRICT AND BRING IT BACK TO THE COMMISSION FOR PUBLIC HEARING, BY THE FOLLOWING VOTE: AYES: Winchell, Kenefick, Porter, Bazil, Greer, Bauer NOES: None ABSENT: None ABSTAIN: None ORAL COMMUNICATIONS: None DEVELOPMENT SERVICES ITEMS: Secretary Palin reviewed for the Commission's information the proposed ordinance and resolution to set fees for filing of applications under Division 9 of the Code. Commissioners are invited to attend. COMMISSION ITEMS: Commissioner Bauer requested that staff investigate the proliferation of signs which seems to be occurring at the gas station at the corner of Goldenwest Street and Yorktown Avenue. Planning Commission June 17, 1980 Page 11 Commissioner Bazil discussed the feasibility of incorporating the mobilehome park zoning into the Planned Residential Development ordinances, to permit greater control of such use. Commission concurred by consensus. STAFF ITEMS: City Engineer George Tindall introduced Bruce Gilmer of his staff, who has recently been reassigned to serve in the Development Section of Public Works.
