To permit a room addition in rear yard with five (5') feet rear
yard setback located on the west side of Antiqua Lane (21441 Antiqua Lane)
This request is a categorical exemption Class 5, California Environmental
Quality Act, 1970.
Chairman Tindall introduced the application to the Board. Secretary
Lipps briefly outlined the application stating that the applicant is
required to establish a hardship in order for the Board to grant approval
(i.e. being deprived of privileges enjoyed by other properties in the
vicinity).
Chairman Tindall opened the public hearing on Conditional Exception No.
80-25.
Mrs. Gay Boyer was present to represent the application. Mrs. Boyer
described the configuration of the home, stating that additional space
was desired as her family was growing.
Chairman Tindall questioned the applicant if other alternatives had been
explored. He suggested that an addition of 9 feet in lieu of the requested
14 feet would seem more feasible.
Mrs. Boyer stated that an addition of 9 feet would not be financially
equitable nor would it make that much difference to the overall -interior,
space -'of the home.

Secretary Lipps noted that the lot is'unique in shape as the depth is
short compared to adjacent lots. Also, the subject property backs to Newl
Street and would not infringe upon other residential property.
Fire Representative Hosmer stated that the addition would pose no problems
from a fire standpoint.
Chairman Tindall stated he was opposed to the request as there were
several different options available with less of an impact on the
property.
ON MOTION BY LIPPS AND SECOND BY HOSMER, CONDITIONAL EXCEPTION NO. 80-25
WAS APPROVED WITH THE FOLLOWING FINDINGS, REASONS AND CONDITIONS OF
APPROVAL BY THE FOLLOWING VOTE:
FINDINGS:
1. The granting of a Conditional Exception will not constitute a grant
of a special privilege inconsistent upon other properties in the
vicinity and under an identical zone classification.
2. Because of special circumstances applicable to the subject property,
including size, shape, topography, location, or surroundings, the
strict application of the zoning ordinance is found to deprive the -
subject property of privileges enjoyed by other properties in the
vicinity and under identical zone classifications.
3. The granting of a Conditional Exception is necessary in order to
preserve the enjoyment of one or more substantial property rights.
4. The granting of a Conditional Exception will not be materially detri-
mental to the public welfare, or injurious to property in the same
zone classification.
S. The granting of the Conditional Exception will not adversely affect
the General Plan of the City of Huntington Beach.
REASONS:
1. The lot depth and configuration is such that it deprives the applicant
of the property rights enjoyed by adjacent property owners.
CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The conceptual plot plan and elevations received June 9, 1980
shall be the approved layout.

Traffic circulation and -drives;

Applicant: Conroy Properties
To permit the construction of a 5,500+ sq. ft. industrial building located
on the east side`of Surveyor Circle approximately 470 feet south of
Newland.
This' -request is covered by Negative Declaration No. 79-69, previously
assessed.
Chairman Tindall introduced the application to the Board. Secretary
Lipps stated that this application was conditionally approved by the
Board, however, the original approval was for the construction of one
building on lots eight and nine, with the condition that a tentative
parcel map be filed and approved by the City combining lots eight and
nine. The applicant decided to develope the lots separately, which
requires the approval of a new administrative review application.
Mr. Dean Royce was present to represent the application.
The Board expressed concern regarding the necessary amount of parking
spaces. It was noted that lot 8 is deficient, however, a reciprocal
parking agreement between the two lots would accomodate the deficiency.
Mr. Royce stated that he is trying to conform to the original map. Chair-
man Tindall noted that any building on lot 8 would have to stay within
the property line or an adjustment to the lot line would be necessary,
in ---which case a parcel map must be filed prior to issuance of building
permits:
Chairman Tindall noted his concerns regarding the maintenance of land-
scaping and access ways.

Fire Representative Hosmer expressed his concern regarding the crude
oil tanks located adjacent to the subject property. He noted that the
required space between the proposed buildings and the tanks must be
twice the diameter of the tanks. He suggested that the applicant research
the distance between the tanks and proposed building in order to comply
with fire department standards.
Fire Representative Hosmer also noted that two (2) two (2) hour
fire walls would be required with space in between the buildings.
It was the consensus of the Board to continue the application to July
9, 1980 in order to allow the applicant to research Fire Department
requirements regarding the crude oil tanks, the location of the existing
lot line.
ON MOTION BY TINDALL AND SECOND BY HOSMER, ADMINISTRATIVE REVIEW NO. 80-24
WAS CONTINUED TO THE MEETING OF JULY 9, 1980 IN ORDER FOR THE APPLICANT
TO RESEARCH FIRE DEPARTMENT REQUIREMENTS REGARDING THE LOCATION OF CRUDE
OIL TANKS ADJACENT TO THE SUBJECT PROPERTY AND THE LOCATION OF THE EXISTING
LOT LINE IN RELATION TO THE PROPOSED BUILDINGS BEING CONSIDERED FOR
CONSTRUCTION.

To permit a projecting deck to encroach into required side yard setback.
Subject property is located at 16352 Maruffa Circle, Huntington Beach, CA.
This request is a categorical exemption, Class 5, California Environmental
Quality Act, 1970.
Chairman Tindall introduced the application to the Board. Secretary
Lipps explained the application to the Board.
It was noted that the applicant was not present to represent the application.
Chairman Tindall opened the public hearing.
Secretary Lipps stated that the proposed deck would overhang 5 feet
over the bulkhead. He further noted that a harbor permit is required
for this particular application.
Chairman Tindall suggested continuing the application to July 9, 1980
in order to allow the applicant to be present.

To permit the elimination of a six (6') foot masonry separation wall
located on the east side of Beach Boulevard at Beach Boulevard and

To permit the construction of a 4 story, 36,000 sq. ft. general office
building located on the east side of Beach Boulevard at Beach and
Indianapolis.
This request is covered by Negative Declaration No. 80-43.
Secretary Lipps outlined the application to the Board. He suggested that
because of a conflict of zoning the application be referred to the Planning
Commission.

The applicant was not present. Secretary Lipps stated that there
had been previous problems with this particular event in the past,
regarding poor coordination.
Secretary Lipps-also stated that insufficient data had been submitted
in order for the Board to act on the application.
