Mayor Bailey called the Special Meeting of the City Council of the City of
Huntington Beach to order.at 7.30 P.M.

The Deputy City Clerk was directed to read the Call for Special Meeting.

You are hereby notified that a Special Meeting of the City Council of the City
of Huntington Beach, California, is called for and will be held in the Council
Chamber of the Civic Center, at the hour of 7:30 P.M., on Monday, July 28, 1980,
for the purpose of discussing the refuse collection contract with Rainbow
Disposal Company.

Councilman Kelly presented the Council Committee report relative to refuse dis-
posal service to the community and the provisions of the proposed agreement with
Rainbow Disposal. Councilman Mandic clarified some of the provisions of the
agreement, such as rates per dwelling units, inspection by the City of the company's
books, etc. The Director of Public Works reported on the count of units of service
to be conducted by his department and the Development Services Department.
Mr. Hohnstein,President of Rainbow Disposal, stated that he believed the subject had
been well -covered and that he would answer any questions. Councilman Mandic re-
quested clarification as to bin enclosures.
The City Attorney commented on the termination provisions of the proposed agree-
ment. She read Section 3 (c) into the record - "Any termination of agreement for
cause, or because of expiration of the term, or otherwise, shall constitute a
discontinuation of the right of contractor to provide services within City pursuant
to Health and Safety Code section 4272."
Tom Livengood, City resident addressed Council and stated that he believed the
contract was good, however, he stated that he believed the contract should be for
a shorter period, such as five years, as in the City of Fountain Valley.
Discussion was held by Council. The City Attorney clarified Section 16 of the
agreement relative to arbitration.
A motion was made by Pattinson, seconded by Kelly to approve and authorize execution
of the agreement between the City and.Rainbow Disposal Company, Inc., as amended by
the inclusion of Section 3 (c).
Mayor Bailey spoke regarding the agreement, stating that she believed the contract
should be put to bid.
The motion carried by the following roll call vote:
AYES: Pattinson, Finley, Mandic, Kelly.
NOES: Bailey
ABSENT: Thomas, MacAllister

The Clerk was directed to read Urgency Ordinance No. 2449 in full - "AN URGENCY
ORDINANCE OF THE CITY OF HUNTINGTON BEACH GRANTING TO RAINBOW DISPOSAL'CORPORATION
A FRANCHISE TO COLLECT REFUSE."
A motion was made by Pattinson, seconded by Mandic to adopt Urgency Ordinance
No. 2447. The motion failed by the following roll call vote:
AYES: Pattinson, Finley, Mandic, Kelly
NOES: Bai l.ey
ABSENT: Thomas, Mandic
It was determined that the Urgency Ordinance would be presented at the August 4,
1980 Council meeting.
The Mayor declared the Special Meeting of the Council adjourned.
