BOARD MEMBERS: Spencer, Tindall, Kelly MINUTES: ON MOTION BY SPENCER AND SECOND BY KELLY, THE MINUTES OF THE REGULAR MEETING OF JUNE 18, 1980 WERE APPROVED BY THE FOLLOWING VOTE: AYES: Spencer, Kelly, Tindall NOES: None ABSENT: None ON MOTION BY KELLY AND SECOND BY TINDALL, THE MINUTES OF THE REGULAR MEETING OF JULY 16, 1980 WERE APPROVED BY THE FOLLOWING VOTE: AYES: Kelly, Tindall NOES: None ABSTAIN: Spencer REGULAR AGENDA ITEMS: ADMINISTRATIVE REVIEW NO. 80-31 (Continued from 7/30/80) Applicant: Ian Baird To permit a temporary sign in conjunction with grand opening located at 17296 Beach Boulevard. This request is a categorical exemption Class 4, California Environmental Quality Act, 1970. Chairman Tindall introduced the application to the Board. Secretary Spencer briefly explained the proposal noting that the Huntington Beach Ordinance Code allows temporary signs for twenty-one (21) days during, a one year period. A Special Sign Permit would be necessary if sign exceeds the criteria as set forth in the Ordinance Code. Mr. Ian Baird was present to represent the application. He stated that eventually he will be erected. He further stated that business had been slow and the additional signs would attract passing vehicles. Minutes: H.B. BOARD OF ZONING ADJubimtN iz) August 6, 1980 Page 2 Secretary Spencer noted that the Board cannot grant approval for a temporary free-standing sign, however, a temporary sign attached to a permanent free-standing sign would be allowed for a certain length of time without a special sign permit. Chairman Tindall expressed concern regarding visability and safety of vehicle access. Secretary Spencer noted that the temporary sign must be three (3) feet from the ground, which would allow for adequate visability. It was the concensus of the Board to allow the use of a temporary sign. Conditions of Approval were discussed. ON MOTION BY SPENCER AND SECOND BY KELLY, ADMINISTRATIVE REVIEW NO. 80-31 WAS APPROVED WITH THE FOLLOWING CONDITIONS OF APPROVAL BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan received July 15, 1980, shall be the approved layout. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: - Traffic circulation and drives; - Parking layout; - Lot area; - Lot depth and lot width; - Type of use and its relation to property and improvements in the immeeiate vicinity; Past administrative action regarding this property. B. GENERAL CONDITIONS: 1. Placement of temporary signs shall be as shown on site plan dated July 15, 1980 2. Temporary sign shall be placed on existing free-standing sign and shall not exceed 21 days, beginning August 9, 1980 and ending August 31, 1980. Chairman Tindall introduced the application. Secretary Spencer briefly ex0lained the proposal. Chairman Tindall opened the public hearing. The applicant was not present. Chairman Tindall closed the public hearing. The Board discussed the application. It was noted that the property would meet the required footage of open space if approved. Conditions of approval were discussed. ON MOTION BY TINDALL AND SECOND BY KELLY, CONDITIONAL EXCEPTION NO. 80-35 WAS APPROVED WITH THE FOLLOWING FINDINGS, REASONS AND CONDTIONS OF APPROVAL BY THE FOLLOWING VOTE: FINDINGS: 1. The granting of the Conditional Exception will not constitute a grant of a special privilege inconsistent upon other properties in the vicinity and under an identical zone classification. 2. Because of special circumstances applicable to the subject property including size, shape, topography, location, or surroundings, the strict application of the zoning ordinance is found to deprive the subject property of privileges enjoyed by other properties in the vicinity and under identical zone classification. 3. The granting of a Conditional Exception will not be materially detrimental to the public welfare, or injurious to property in the same zone classifications. 4. The granting of a Conditional Exception is necessary in order to preserve the enjoyment of one or more substantial property rights. S. The granting of the Conditional Exception will not adversely affect the General Plan of the City of Huntington Beach. REASONS: 1. Remaining open space will meet or exceed minimum square footage requirements CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received July 17, 1980, shall be the approved layout. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: Traffic circulation and drives; Parking layout; Lot area; - Lot width and lot depth; Type of use -and its relation to property and improvements in the immediate vicinity; Past administrative action regarding this property. AYES: Spencer, Tindall, Kelly NOES: None ABSENT: None CONDITIONAL EXCEPTION NO. 80-39 Applicant: Michael Ray Cue To permit a one and one-half (1!1) foot encroachment into the required interior side yard located at 516 loth Street. Chairman Tindall introduced the application. Secretary Spencer outlined the proposal. It was noted that the applicant was not present to represent the application. Chairman Tindall opened the public hearing. There being no one present to speak in favor or opposition, the public hearing was closed. The Board discussed the proposal. It was the consensus of the Board to approve tha application. Conditions of Approval were discussed. ON MOTION BY SPENCER AND SECOND BY KELLY, CONDITIONAL EXCEPTION NO. 80-39 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL BY THE FOLLOWING VOTE: MINUTES: H.B. The granting of a Conditional Exception will not be materially detrimental to the public welfare, or injurious to property in the same zone classifications. S. To permit a model home and subdivision sales office located on the west side of 20th Street at the intersection of Pecan and 20th Street '411 20th Street) This request is a categorical exemption Class 3, California Environmental Quality Act, 1970. ON MOTION BY SPENCER AND SECOND BY KELLY, ADMINISTRATIVE REVIEW NO. 80-27 WAS APPROVED WITH THE FOLLOWING CONDITIONS OF APPROVAL BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received June 17, 1980 shall be the approved layout. In its approval action, the Board of Zoning Adjustments considered the following issues realting to the conceptual plan: - Traffic circualtion and drives; - Parking layout; - Lot area; - Lot depth and lot width; - Type of use and its relation to property and improvements in the immediate vicnity; - Past administrative action regarding this property. B. GENERAL CONDITIONS: 1. Applicant shall comply with Article 9730.18 of the Huntington Beach Ordinance Code. AYES: Spencer, Tindall, Kelly NOES: None ABSENT: None CONDITIONAL EXCEPTION -NO. 80-34 Applicant: Mr. $ Mrs. Peter Andres To permit a reduction in open space dimension from required 25' to minimum 181 for a proposed room addition located on the north side of Sunbreeze Drive at 7181 Sunbreeze Drive. Mrs. Peter Andres was present to represent the application. Chairman Tindall introduced the application. Secretary Spencer briefly outlined the proposal. Secretary Spencer noted that the property would exceed the minimum required open space. Chairman Tindall opened the public hearing. Mrs. Andres stated that as her family was growing, additional space was required. The proposed addition would not exceed past an existing wall. Secretary Spencer stated that the minim -um distance from the property line is ten (10) feet, which should be•,properly reflected on the site plan. MINUTES: H.B. It was the consensus that because the lot is of an irregular shape and the remaining opens space will exceed the minimum requirement, the Board voted to approve,the application. ON MOTION BY SPENCER AND SECOND BY KELLY, CONDITIONAL EXCEPTION NO. 80-34 WAS APPROVED WITH THE FOLLOWING FINDINGS, REASONS AND CONDITIONS OF APPROVAL BY THE FOLL©WING VOTE: FINDINGS: 1. The granting of the Conditional Exception will not constitute a granting of a special privilege inconsistent upon other properties in the vicinity and under an identical zone classification. 2. Because of special circumstances applicable to the subject property including size, shape, topography, location, or surroundings, the strict application of the zoning ordinance is found to deprive the subject propery of privileges enjoyed by other properties in the vicinity and under identical zone classifications. 3. The granting of a Conditional Exception is necessary in order to preserve the enjoyment of one or more substantial property rights. 4. The granting of a Conditional Exception will not be materially detrimental to the public welfare, or injurious to property in the same zone classifications. 5. The granting of the Conditional Exception will not adversely affect the General Plan of the City of Huntington Beach. REASONS: 1. The remaining area of open space exceeds minimum space footage require- ments CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received July 17, 1980 shall be the approved layout. AYES: Spencer, Tindall, Kelly NOES: None ABSENT: None SPECIAL EVENT NO. 80-21 Applicant: Montgomery Ward To permit a 3 day parking lot sale, August 8,9,10, 1980 located on the north side of Edinger at 7777 Edinger Avenue. The Board reviewd the application. It was noted that this event was a yearly event, and had not had any previous problems. ON MOTION BY TINDALL AND SECOND BY KELLY, SPECIAL EVENT NO. 80-21 WAS APPROVED WITH THE FOLLOWING CONDITIONS OF APPROVAL BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: T. The plot plan received July 28, 1980 shall be the approved layout. 2. An on -site inspection by the Fire Department shall be required prior to the event. 3. A certificate of insurance form shall be filed in the Finance Department five (S) days prior to the event.
