BOARD MEMBERS: Lipps, Tindall, Ott REGULAR AGENDA ITEMS: CONDITIONAL EXCEPTION NO. 80-37 Applicant: Ronald Coleman/Forcier Construction To permit a reduction in required open space from 1,200 sq. ft. to 1,061 sq. ft. located on the north side of Kings Canyon Drive at 9841 Kings Canyon Drive. This request is a categorical exemption Class 15, California Environ- mental Quality Act, 1970. Chairman Tindall introduced the application to the Board. Secretary Lipps briefly outlined the proposal. He stated that the applicant is requesting a reduction in open space to allow for a room addition on the rear portion of the property. The open space would be diminished (200 feet short), but would conform in every other aspect. Chairman Tindall opened the public hearing. Mr. Ronald Coleman and Mr.Khamis (property owner) were present to represent the application. Secretary Lipps noted that the property backs to Fedmart loading and receiving area. He explained that the Department of Development Services had received numerous complaints from Mr. Khamis regarding the large trucks loading and unloading at various times during the day. Secretary Lipps explained that a noise study had been conducted on the site by the County and that Fedmart had never been cited for extreme noise. Mr. Khamis stated that the noise study had been done on his property and not at the property line. He further stated that he had requested a study be one for one (1) week, which was not done. MINUTES: H.B. BOARD OF ZONING ADJUSTMENTS AUGUST 13, 1980 Page 2 Secretary Lipps noted that the noise study was .mentioned as a point information for the Board of Zoning Adjustments only. Mr. Comas stated that the addition would help to mitigate noise and visual intrusion, and that the addition would be used as a family and dining room. Chairman Tindall questioned the applicant on the type of windows to be installed. He stated that a double insulation type of glass would help further mitigate noise. Mr. Coleman (contractor) stated that a standard wood type window would be used. Chairman Tindall noted that the home (with the addition) would be even closer to the back wall. Further discussion followed. There being no other parties present to speak, Chairman Tindall closed the public hearing. Secretary Lipps requested that the minutes reflect that the Board advised the applicant that further structural modifications should be made to the addition in order to accomplish his intent. ON MOTION BY LIPPS AND SECOND BY TINDALL, CONDITIONAL EXCEPTION No. 80-37 WAS APPROVED WITH THE FOLLOWING FINDINGS, CONDITIONS OF APPR L BY THE FOLLOWING VOTE: FINDINGS: I. -The granting of the Conditional Exception is justified because of the location of the subject property to the adjacent commercial use and the applicant's statement that the addition will mitigate the noise and visual intrusion of the commercial use. 2 The granting of the Conditional Exception will not constitute a grant of a special privilege inconsistent upon other properties in the vicinity and under an identical zone classification. 3. Because of special circumstances applicable to the subject property, including size, shape, topograhpy, location, or surroundings, the strict application of the zoning ordinance is found to deprive the subject property of privileges enjoyed by other properties in the vicinity and under identical zone classifications. 4. The granting of a Conditional Exception is necessary in order to preserve the enjoyment of one or more substantial property rights. S. The granting of a Conditional Exception will not be materially detrimental to the public welfare, or injurious to property in the same zone classifications. 6. The granting of the Conditional Exception will not adversely affec the General Plan of the City of Huntington Beach. MINUTES: H.B. The conceptual plot plan and elevations received July 23, 1980 shall be the approved layout. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: - Traffic circulation and drives; - Parking layout; - Lot area; - Lot width and lot depth; - Type of use and its relation to property and improvements in the immediate vicinity; - Past administrative action regarding this property. AYES: Tindall, Lipps NOES: Ott ABSENT: None TENTATIVE PARCEL MAP NO. 80-562 Applicant: George T. Tanaka To permit the division of existing parcel into two (2) separate parcels located at the southwest corner of Newland Street and Slater, (17505 Newland Street) This request is a categorical exemption Class 15,California Environ- mental Quality Act, 1970. Chairman Tindall introduced the application to the -Board. Secretary Lipps explained the proposal stating that it is in conformance with the Huntington Beach Ordinance Code. Mr. Tanaka acknowledged the receipt of suggested Conditions. The Board discussed the driveway approach off Slater Avenue. The Board advised the applicant that a reciprocal access agreement between parcels one (1) and two (2) would be necessary to allow joint use of common driveway prior to the building permits being issued on parcel two (2). Iverson To permit a driveway entrance to garage from an arterial and not from an adjacent alley located on the southeast side of 7th Street at 402 7th Street. This request is a categorical exemption Class 5, California Environ- mental Quality Act, 1970. Mr. Iverson was present to represent the application. Chairman Tindall opened the public hearing. Secretary Lipps briefly described the proposal, stating that the applicant desired to construct a garage and build an addition to the home. Mr. Iverson stated that a garage had existed, but was destroyed by heavy wind. He was proposing to build on the exact area of the destroyed_ garage. He further stated that he is presently parking in the area where the garage was located. (A curb cut exists on Orange). Chairman Tindall suggested that an alternative location might be researche, He stated that the Code does not allow for vehicle access from an arterial unless there are no other access points. He recommended locating the garage in the alley. Mr. Iverson stated that a window protrudes and would not allow adequate space for a regular size car. Chairman Tindall explained to the applicant that Orange Avenue is designated as a four lane arterial which will be realigned with Atlanta. Therefore, backing onto a busy street would be extremely unsafe. Chairman Tindall recommended that the application be continued two weeks (August 27, 1980) to allow the Board to investigate and research the proposal further. ON MOTION BY LIPPS AND SECOND BY TINDALL, CONDITIONAL EXCEPTION NO. 80-38 WAS CONTINUED TO AUGUST 27, 1980 TO ALLOW FOR FURTHER INVESTIGATION AND RESEARCH OF THE PROPOSAL. Cervantes To permit the construction of a 21,470 sq. ft. industrial building located at 15102 Bolsa Chica Street, approximately 323 feet south of Bolsa Avenue. _ This request was assessed under the master environmental impact report No. 73-16 prepared for the. Lusk.Industrial Park, Chairman Tindall introduced the application to-the'Board. Secretary Lipps briefly outlined the proposal stating that it was within substantial Ordinance Code conformance. Chairman Tindall,noted that the location of the property is approximately S40 ft. south of Bolsa;Nand not ..323 ft. as noted in the agenda. The Board discussed;the,_driveway approach and how it relates to Bolsa Chica. `The common -easement between adjacent properties was also discussed. The location of truck doors were discussed with the applicant. Mr. Cervantes stated that parking would not interfere with the doors. Mr. Cervantes -submitted ' photographs of the property from several differ angles. `-Further-discuss'ibn ensued. Driveway approach design shall be submitted to, and approved by the Department of Public Works prior to issuance of Building Permits. This request was assessed under the master environmental impact report No. 73-16 prepared for the Lusk Industrial Park. The applicant was present. Chairman Tindall introduced the application to the Board. Secretary Lipps briefly outlined the proposal stating that the request was within substantial Ordinance Code conformance. The Board discussed with the applicant driveway approach widths, handicapped parking, which should be located toward the front of the building, and the location of trash enclosures. This request was -assessed under the master environmental impact report No. 73-16 prepared for the Lusk Industrial Park. Chairman Tindall introduced the application to the Board. He noted that the plot plan did not reflect the location of trash enclosures, and that the parking was deficient in handicapped parking. The Board discussed the on -site circulation, specifically the turning widths around the parking islands. It was recommended to widen the turning widths to twenty (20) feet. Secretary Lipps recommended that the applicant provide a fully dimensioned plot plan reflecting the requested changes prior to submission for plan check. ON MOTION BY LIPPS AND SECOND BY OTT, ADMINISTRATIVE REVIEW NO. 80-37 WAS APPROVED WITH THE FOLLOWING CONDITIONS OF APPROVAL BY THE FOLLOWING VOTE: CONDITIONS -OF APPROVAL: A.
