Crosby, Kelly MINUTES: ON MOTION BY CROSBY AND SECOND BY KELLY, THE MINUTES OF THE REGULAR MEETING OF JULY 30, 1980 WERE APPROVED BY THE FOL- LOWING VOTE: AYES: Crosby, Kelly NOES: None ABSENT: None ABSTAIN: Lipps The consideration of the minutes of August 6, 1980 was de- ferred to the meeting of August 27, 1980. REGULAR AGENDA ITEMS ADMINISTRATIVE REVIEW NO. 80-35 (Continued from August 13, 1980) Applicant: Robert Richards To permit the construction,of a 13,048 sq. ft. office/warehouse building located on the west side of Transistor Lane, approximately 411 ft. north of Machine Drive. This request was assessed under the master Environmental Impact Report No. 73-16, prepared for the Lusk Industrial Park. Mr. Robert Richards was present to represent the application. Secretary Lipps informed the Board that this application was con- tinued previously to allow the applicant to be present. He then introduced the application to the Board. Secretary Lipps stated that the parking proposed was suitable for the type of use pro- posed, however, should the use change at any time, parking revisions may have to be made. Mr. Richards then addressed the Board stating he does not anticipate any manufacturing on the premises other than prototype of installation. Board discussion followed. It was the consensus of the Board that the application was within substantial Ordinance Code conformance. ON MOTION BY LIPPS AND -SECOND BY KELLY, ADMINISTRATIVE REVIEW NO. 80-35 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: Minutes: H.B. Board of Zoning Adjustments Wednesday, August 20, 1980 Page Two CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received January 24, 1980, shall be the approved layout. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: Traffic circulation and drives; Parking layout; Lot area; Lot width and lot depth; Type of use and its relation to property and improvements in the immediate vicinity; Past administrative action regarding this property. 2. The following plans shall be submitted to the Secretary of the Board: a. Landscape and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code and landscaping specifications on file in the Department of Public Works. b. Rooftop mechanical equipment screening plan. Said plan shall indicate screening of all rooftop mechanical equip- ment and shall delineate the type of material proposed to screen said equipment. B. GENERAL CONDITIONS: 1. The drive approach shall be to Public Works Standard Plan 212 A & B. 1 2. The applicant shall submit to the Development Services Depart- ment a letter of understanding that parking requirements are based upon a specific use of the building as warehouse 10,504 square feet, and office 2,544 sq. ft. and any future use of the building will be limited to this specific use. The letter shall also include a statement that any future buyer of the property will be informed of this limitation in writing. The only exception permitted will be a modification of the ratio of office space to warehouse space which will conform to Article 979 (parking) and Article 951 uses permitted. Board of Zoning Adjustments Wednesday, August 20, 1980 Page Three USE PERMIT NO. 80-27 _Applicant: Tony Bartoli To permit the construction of a ten unit apartment building located on the east side of Green Street, approximately 400 feet south of Warner Avenue. This request was previously assessed under Negative Declaration No. 79-9. Mr. John Cowles was present to represent the application. Secretary Lipps introduced the application to the Board stating that this request has been previously approved in 1979, however, time has run out on the Use Permit, and subsequently the applicant was required to refile the application. The public hearing was opened. There being no parties present to speak on the application, the public hearing was closed. Board Member Kelly expressed some concern regarding meeting Fire Code requirements, i.e., overhangs are too great, two 12 ft. travel lanes are to be maintained, improper turnaround, and the location of a fire hydrant at the rear of the property. It was determined by the Board that the plan was within substantial Ordinance Code conformance and that the Fire Department concerns could be worked out between the applicant and the Fire Department and that a revised plan was to come back to the Secretary of the Board reflecting changes to the overhangs and radius turn -around at the east end of the common drive. Mr. Trahan was not present. Secretary Lipps reviewed the revocation stating that a number of complaints had been received by the Development Services Department regarding subject home occupation. Doug Heite, Land Use Technician, was present and stated that he had investigated complaints on various occasions and found violations to be present. ON MOTION BY LIPPS AND SECOND BY CROSBY THE HOME OCCUPATION PERMIT ISSUED TO RAYMOND TRAHAN WAS REVOKED WITH THE FOLLOWING STATEMENT TO.MR. TREHAN, BY THE FOLLOWING VOTE: Your Home Occupation Permit has been revoked by the Board of Zoning Adjustments based on violation of Section 9730.21 of the Huntington Beach Ordinance Code. It was found that the conduct of the business (parking of an oversized commercial vehicle in a residential zone) and the additional violation of Section 9106.5 of the Huntington Beach Ordinance Code - Parking Area detracts from the residential quality of the neighborhood. It was noted that the requested patio cover abuts a commercial parking lot, therefore the impact to surrounding properties would be minimual. Chairman Crosby opened the public hearing.
