Commissioner Schumacher arrived at the meeting at this point.
REGULAR AGENDA ITEMS:
CONDITIONAL USE PERMIT NO. 80-20/TENTATIVE TRACT 11140 (Cont. from
Applicant: Frank Sohaei August 5, 1980)
To permit the construction of an 8-unit condominium project and
to approve special permit request required for such construction
on property located on the west side of Newland Street approximately
580 feet south of Slater Avenue.
Savoy Bellavia announced that Negative Declaration No. 80-41, which
assessed the environmental impacts of the subject request, had
been adopted by the Commission on August 5, 1980.
Chairman Porter reopened the public hearing.
Don Hartfelder, architect for the project, addressed the Commission
to outline the changes which had been made to the plan -in response

to the concerns expressed by the Commission in its prior review of
the proposal. He cited the desirability of utilizing small lots such
as the one under consideration and the difficulties of designing
small projects which could comply with a code written for large com-
plexes.
There were no other persons present to speak for or against the re-
quest, and the public hearing was closed.
After extensive review it was the consensus -of the Commission that,
although the revisions to the plan had resulted in considerable im-
provement over the original proposal, the plan still had not suffi-
ciently addressed the concerns stressed at the prior meeting in regard
to bulk of building, lack of roof variation, open space, setbacks,
and distance between buildings. (In regard to the building separation,
Mr. Bellavia noted that staff had addressed the project as one build-
ing joined by the garage construction, and no separation was required.)
The density of construction was also considered to be at the upper
limit of the code; the bedroom count was found to be above that per-,
mitted by code.
The Commission discussed the possibility of formulation of an ordin-
ance which would specifically address the problem of designing planned
developments for small lots; this ordinance could be used to implement
an urban -strategy for in -filling remnant parcels in already developed
neighborhoods. Legal counsel Jim Georges advised that the present
code allows the Commission great flexibility in this regard through the
use of the special permit process.
Mr. Hartfelder requested permission to again address the plan to
possibly revise the floor plans and reduce the bedroom count to comply
with code.
ON MOTION BY KENEFICK AND SECOND BY GREER CONDITIONAL USE PERMIT NO.
80-20 AND TENTATIVE TRACT NO. 11140 WERE CONTINUED, WITH THE CONCUR-
RENCE OF THE APPLICANT, TO THE REGULAR MEETING OF OCTOBER 7, 1980, BY
THE FOLLOWING VOTE:

Applicant: Leo M. Ford
To waive installation of street improvements for a request to grow
and sell Christmas trees on property located on the southeast corner
of McFadden Avenue and Gothard Street.

Savoy Bellavia reported that Public Works finds no necessity
for installation of the street improvements on this property at
this time.
The public hearing on the conditional use permit was reopened.
Leo Ford addressed the Commission to request approval of these
proposals. There were no other persons present to speak in re-
gard to the project, and the public hearing was closed.
Commission -review ensued, considering its prior discussion and
the information submitted by Public Works.
ON MOTION BY KENEFICK AND SECOND BY SCHUMACHER ADMINISTRATIVE
REVIEW NO. 80746 WAS APPROVED AND CONDITIONAL USE PERMIT NO. 80-22
APPROVED WITH FINDINGS AND CONDITIONS AS FOLLOW, BY THE FOLLOWING
VOTE:
FINDINGS - ADMINISTRATIVE REVIEW NO. 80-46:
1. The proposed use is not of an intensity which requires right-
of-way improvements.
FINDINGS - CONDITIONAL USE PERMIT NO. 80-22:
1. THe proposed use is compatible with surrounding land uses.
2. The proposed use is in conformance with the City's General Plan
and zoning for the property.
CONDITIONS OF -APPROVAL:
1. The site plan received and dated May 27, 1980 shall be the
approved layout.
2. The Planning Commission reserves the right to rescind this
conditional use permit approval in the event of violation•of
the terms of this approval or violation of the applicable zon-
ing laws. Any such decision shall be preceded by notice to
the applicant and a public hearing and shall be based upon
specific findings.

CONDITIONAL USE PERMIT NO. 80-24 (Cont. from August 19, 1980)
Applicant: Huntington Beach Industrial Park
To permit a mixed use development on property located on the west
side of Springdale Street and the east side of Transistor Lane
between Engineer and Machine Drives in an existing industrial park.

The public hearing was opened.
John Alstrom, representing the applicant; spoke-tb--the Commission in
support of the request.
There were no other persons present to address the Commission, and
the public hearing was closed. - -
Savoy Bellavia pointed out that the recommended action should also in-
clude adoption -of Resolution`--Nb=:` 1266.=--He-=also noted that parking has
been added -to this -project beyond -the requirements of normal industrial
complexes ---in -=order--to--=comply with" -the' mixed "'use- 'requirements;` It was
also noted that some of the uses listed in the request are already per-
mitted under -the provisions of -the M1 zoning.
The Commission discussed the general concept of the mixed use ordin-
ance, the traffic and parking conflicts between industrial and commer-
cial uses,--and-th'e:specific uses outlined in the applicant's request.
It was the opinion of those present -that the -_lint, of. -uses needed to be
narrowed- and defined•,, for 'instance',-- "food .services"- could be -inter-
preted-to include a -full scale restaurant; -which was -not -the. -intention
of the Commission when -the mixed use ordinance was drafted. However,
it was also the opinion that if the-uses.permitted in any mixed use
development are•to be_restrict`ed beyond"those`already granted in at
least two other -instances, the full Commission should be present to act
on such restriction._ The applicant agree -?-to a continuance to permit
further consideration of the uses.

Applicant: _. Raymond Salmi- &-Associates., -
To permit a=change;of..zone from Rl, Single -Family Residential, to
RA, Residential Agricultural, on 1.55 acres - lobated on the east side
of Magnolia Street approximately 500 feet south of Adams Avenue.
Savoy Bellavia explained that the zone change is a condition of approval
on a -former action on church property at --this location, in order to
preserve the integrity of the church parking lot and prevent -future
residential subdivision of the subject parcel.

The public hearing was opened, and closed when no one was present
to address the Commission for or against the proposal.
Commission review ensued.
ON MOTION BY KENEFICK AND SECOND BY SCHUMACHER ZONE CHANGE NO.
80-12 WAS APPROVED FOR RECOMMENDATION TO THE CITY COUNCIL WITH
THE FOLLOWING FINDINGS, BY THE FOLLOWING VOTE:
FINDINGS
1. The proposed zone change is consistent with the General Plan
which is low density residential.
2. The proposed zone change is compatible with surrounding zoning.

DISCUSSION ITEMS:
Secretary Palin reviewed the City Council action of September 2,
1980, for the information of the Commission.
DEVELOPMENT SERVICES ITEMS:
Savoy Bellavia discussed the planned tour of the areas involved
in General Plan Amendment 80-2 and the scheduled study session for
review of the project on the landfill site at Warner Avenue and
Bolsa Chica Street.
June Catalano informed the Commission that the Local Coastal Plan -
Citizens Advisory Committee would like to schedule a joint study
session on September 23 or 25 for the consideration of the Local
Coastal Plan draft document. The Commission was informally
polled, and staff directed to set up the meeting for either date,
whichever would be more convenient to all concerned.
COMMISSION ITEMS:
Commissioner Greer expressed his understanding that it had been
the City's-intention to close Taylor Street to through traffic
once Ellis Avenue had been opened through to Edwards Street. Staff
will investigate the status of Taylor Street and report back to
the Commission.
Commissioner Schumacher inquired about the status of the new
Seacliff IV environmental impact report. Staff will check to be
sure that all commissioners have received a copy of that report.

Staff also informed the Commission that members of the public who
might wish to review this or any other EIR could inquire in the
Department of Development Services.
The Commission adjourned at 9:15 p.m. to the General Plan tour and
special study session on Tuesday, September-9, 1980 at'5:00 p.m. at
the Civic Center.
