BOARD MEMBERS: Spencer, Tindall, Vasile MINUTES: ON MOTION BY SPENCER AND SECOND BY TINDALL, THE MINUTES OF AUGUST 6, AUGUST 13, AUGUST 20, AND AUGUST 26, 1980 WERE DEFERRED TO THE NEXT REGULAR MEETING BY THE FOLLOWING VOTE: AYES: Spencer, Tindall, Vasile NOES: None ABSENT: None REGULAR AGENDA ITEMS: TENTATIVE PARCEL MAP NO. 80-565 Applicant: Frank Mola To permit the consolidation of five (5) parcels into three (3) parcels located at the southeast corner of Beach Boulevard and Adams Avenue. This application is a categorical exemption, Class 15, California Environmental Quality Act, 1970. Jerry Simon, Jerry Lundquist, and Peter Von Elten were present to represent tie application -and acTcnowle3g`ed receipt o suggested conditions of approval through the mail. Chairman Tindall introduced the application to the Board, noting that the existing lot lines area result of a former record of survey which are not valid lot lines. Therefore, the applicant has filed this application to allow the consolidation of five (5) parcels into three (3) parcels. He further noted that street dedication will be required, however, actual improvements would not have to commence until parcel is developed. Findings and conditions of approval were discussed. ON MOTION BY SPENCER AND SECOND BY VASILE, TENTATIVE PARCEL MAP NO. 80-565 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: Minutes: H.B. The proposed consolidation of five (5) parcels into three (3) parcels for purposes of development is in compliance with the size and shape of property necessary for that type of develop- ment. 2. The General Plan has set forth provisions for this type of land use as well as setting forth objectives for implementation of this type of use. 3. The size, depth, frontage, street width, and other design and improvement features of the proposed subdivision are proposed to be constructed in compliance with standard plans and specifi- cations on file with the City as well as in compliance with the State Map Act and supplemental City Subdivision Ordinance. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCELS FOR ANY PURPOSE: 1. The tentative parcel map received by the Department of Develo ment Services on August 11, 1980, shall be the approved layou 2. A parcel map shall be filed with, and approved by, the Depart- ment of Public Works, and recorded with the Orange County Recorder. 3. Adams Avenue and Beach Boulevard shall be dedicated to City standards at the time said parcels are developed. 4. Compliance with all applicable City Ordinances. 5. A copy of the recorded parcel map shall be filed with the Department of Development Services. B. GENERAL CONDITIONS: 1. Prior to development of the property, a drainage easement shall be granted to the City of Huntington Beach. Placement, width, and length to be determined by the Public Works Department. 2. Board of Zoning Adjustments Wednesday, September 3, 1980 Page Three CONDITIONAL EXCEPTION NO. 80-46 Applicant: David/Adele Heuer To permit a patio cover to be located in required side yard (6'6" encroachment into required 101) located at 9291 Fireside Drive. This request is a categorical exemption, Class 3, California Environ- mental Quality Act, 1970. Mr. & Mrs. Heuer were present to represent the application. Chairman Tindall.outlined the proposal to the Board. The public hearing was opened. Mr. Heuer addressed the Board stating that the slabe for the patio presently exists without a cover. The Board discussed the possible relocation of the patio posts as well as the elimination of two of the four proposed posts to support the patio cover. Mr. Heuer stated that he could relocated the posts to be within the five (5) ft. encroachment which had previously been approved on other projects. There being no other parties present to speak on the application, the public hearing was closed. Board discussion ensued. Findings and condtions of approval were dis- cussed. ON MOTION BY TINDALL AND SECOND BY SPENCER, CONDITIONAL EXCEPTION NO. 80-46 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS BY THE FOLLOWING VOTE: FINDINGS: 1. The granting of the Conditional Exception will not constitute a grant of special privilege inconsistent upon other properties in the vicinity and under an identical zone classification. 2. The grant of a Conditional Exception will not be materially detrimental to the public welfare, or injurious to adjacent properties. 3. The granting of the Conditional Exception will not adversely affect the General Plan of the City of Huntington Beach. Minutes: H.B. Board of Zoning Adjustments Wednesday, September 3, 1980 Page Four CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The plot plan received and dated August 7, 1980, shall be the approved layout. 2. The posts holding up the patio cover shall be set back a minimum of five (5) feet from the property line. 3. The patio shall remain open and unenclosed. AYES: Spencer, Tindall, Vasile NOES: None ABSENT: None ADMINISTRATIVE REVIEW NO. 80-47 Applicant: Alfred Mayer, E.B.M. Investments To permit the construction of a 21,404 sq. ft. industrial building located at Chemical Lane at Research. This 'request was assessed under the Master Environmental Impact Report No. 73-16, prepared for the Lusk Industrial Park. Mr. Nick Becker was present to represent the application. Chairman Tindall introduced the__application_ to the Boafid. Secre- tary Spencer noted that a plan check revealed the application to be within substantial Oidinance Code conformance. However, it was noted that the driveway widths would have to be increased to 25 ft. minimum and the square footage of the elevated office space has not been depicted. The removal of one parking space was discussed to afford a better turn -around for emergency vehicles. Board member Vasile apprised the applicant that an industrial building over 12,000 sq. ft. must be sprinklered. Conditions of approval were discussed. ON MOTION BY SPENCER AND SECOND BY VASILEr ADMINISTRATIVE REVIEW NO. 80-47 WAS APPROVED WITH THE FOLLOWING CONDITIONSI BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received August 8, 1980, shall be the approved layout, subject to the modifi- cations described herein: Minutes: H.B. Revise plan to comply with Section 9517(c) by increasing driveway widths to a minimum of 25 ft. b. -Revise plan to reflect total square footage including elevated office space. A plan delineating said modifications shall be submitted to the Secretary of the Board. If such plan complies with the modifi- cations outlined by the Board, said plan shall be approved and made a permanent part of the administrative file. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: Traffic circulation and drives; Parking layout; Lot area; Lot width and lot depth; Type of use and its relation to property and improvements in the immediate vicinity; Past administrative action regarding this property. 2. The following plans shall be submitted to the Secretary of the Board: a. Landscape and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code and landscaping specifications on file in the Department of Public Works. b. Rooftop mechanical equipment screening plan. Said plan shall indicate screening of all rooftop mechanical equip- ment and shall delineate the type of material proposed to screen said equipment. B. GENERAL CONDITIONS: 1. Drive approaches to be designed to Public Works Standard Plan A & B. AYES: Spencer, Tindall, Vasile NOES: None ABSENT: None ADMINISTRATIVE REVIEW NO, 80-48 Applicant: Sid Crossley To permit the construction of a 6,000 sq. ft., 2 story office build- ing located on the east side of Bolsa Chica, approximately 145 ft. north of Warner Ave. Minutes: H.B. BOARD OF ZONING ADJUSTMENTS Wednesday, September 3, 1980 Page Six Messrs. Sid Corssley, Jr. and Sid Crossley, Sr. were present to represen the application. Chairman Tindall outlined the proposal to the Board. Secretary Spencer gave a brief background of the proposal. At the time previous admini- strative review application (Administrative Review No. 80-12) was approved by the Board for subject property, it was stipulated that the applicant provide reciprocal drives. Mr. Crossley, Sr. addressed the Board stating that he did not wish to have to provide a reciprocal drive with the adjoining property (bank building) at this time, however, was amenable to perhaps provide the reciprocal drive at a later time when development would commence on his property. It was suggested that a meeting between the adjoining property owners, the applicant, and staff occur to attempt to resolve the problem of the reciprocal agreement. Applicant concurred,to a two week continuance of this application. ON MOTION BY TINDALL AND SECOND BY SPENCER, ADMINISTRATIVE REVIEW NO. 80-48 WAS CONTINUED TO SEPTEMBER 17, 1980 BY THE FOLLOWING VOTE: AYES: Spencer, Tindall, Vasile NOES: None ABSENT: None CONDITIONAL EXCEPTION NO. 80-31 Applicant: Foodmaker, Inc. (Lyle Gustaveson) To permit a reduction in the required amount of parking stalls located on the northeast corner of Beach Boulevard and Ellis Avenue. This request is a categorical exemption, Class 5, California Environmental Quality Act, 1970. The applicant was not present. The public hearing was opened. There be no parties present to speak on the applicant, the public hearing was closed. LJ Board discussed the application. It was noted that the application ha been incorrectly advertised, therefore, a continuance of the application was suggested to allow time for the application to be advertised correctly. �1_ Minutes: H.B. Board of Zoning Adjustments Wednesday, September 3, 1980 Page Seven ON MOTION BY SPENCER AND SECOND BY TINDALL, CONDITIONAL EXCEPTION NO. 80-31 WAS CONTINUED TO SEPTEMBER 17, 1980 BY THE FOLLOWING VOTE: AYES: Spencer, Tindall, Vasile NOES: None ABSENT: None SPECIAL EVENT NO. 80-22 Applicant: St. Simon & Jude Catholic Church To permit a fall festival to be held October 3, 4, and 5, 1980 located at 20444 Magnolia. The applicant was not present. Board reviewed the application and found same to be within sub- stantial Ordinance Code conformance. ON MOTION BY SPENCER AND SECOND BY VASILE, SPECIAL EVENT NO. 80-22 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE CONDITIONS OF APPROVAL: 1. The plot plan received August 11, 1980 shall be the approved layout. 2. The applicant shall obtain all necessary electrical permits. 3. An on -site inspection by Fire Department shall be required prior to the event. 4. A certificate of'insurance form shall be filed in the Finance Department five (5) days prior to the event.
