AYES: Spencer, Crosby, Vasile NOES: None ABSENT: None REGULAR AGENDA ITEMS: CONDITIONAL EXCEPTION NO. 80-31 (Continued from 9/3/80) Applicant: Foodmaker, Inc. To permit a reduction in the required parking, encroachments into front yard setback and sight angle requirement. Subject property is located on the northeast corner of Beach Boulevard and Ellis Avenue. This request is a categorical exemption Class 5, California Environmental Quality Act, 1970. Mr. I.yl.e Gustaveson was present to represent the application. Chairman Crosby opened the public hearing. It was noted that due to an oversight, the application had not been properly advertised with the .inclusion of encroachment in the front yard setback and sight angle requirement. Therefore, the application would have to be continued to allow for readvertisement. *MINUTES: H.B. Also, the plan is deficient by fourteen (14)•spaces. encroaches thirteen (13) feet in encroaching into the sight angle in the required,parking stalls Mr. Gustaveson stated that the code does not specifically address parking for a combination drive-thru/sit down restaurant. He further stated that the majority of business consists of drive-thru and out, and not parking after receiving food. He further stated that it was impossible to acquire additional land for parking. Mr. Gustaveson addressed the encroachment into the front yard setback and the sight angle requirement. He stated that a reduction in the size of the building would drasitcally reduce the needed seating. Secretary Spencer noted that no -other business on Beach Boulevard encroaches to the extent of this proposal. He suggested to the applicant, that he modify the dining -area to minimize the encroachment Secretary Spencer recommended that the application be continued to the meeting of October 1, 1980 in order to allow for readvertisement of the public hearing. ON MOTION BY CROSBY AND SECOND BY SPENCER, CONDITIONAL EXCEPTION NO. 80-31 WAS CONTINUED TO THE BOARD MEETING OF OCTOBER 1, 1980. AYES: Spencer, Crosby, Vasile NOES: None ABSENT: None TENTATIVE PARCEL MAP NO. 80-568 Applicant: Sid Crossley To permit the construction of a 6,000 sq.- ft. office building, and create one parcel from two (2) existing parcels located on the east side of Bolsa Chica at the intersection of Warner Avenue -and Bolsa Chica (16922-16970 Bolsa Chica). This request was previously assessed under Negative Declaration No. 80-23. Mr. Sid Crossley and Mr. John Kelly were present to represent the application. The applicant acknowledged receipt of the suggested Conditions of Approval. The Board discussed street improvements. It was noted that the improvements hake been completed. ON MOTION BY SPENCER AND SECOND BY CROSBY, TENTATIVE PARCEL MAP NO. 80-56 WAS APPROVED WITji THE FOLLOWING CONDITIONS OF APPROVAL AND FINDINGS BY TH FOLLOWING VOTE: MINUTES: H.B. The proposed consolidation of two (2) parcels into one (1) parcel for the purpose of commercial development is in compliance with the size and shape of property necessary for that type of development. 2. The General Plan has set forth provisions for this type of land use as well as setting forth objectives for implementation of this type of use. 3. The property was previously studied for this intensity of land use at the time the land use designation for general commercial which allows commercial buildings, was placed on subject property. 4. The size, depth, frontage, street width, and other design' and improve- ment features of the proposed subdivison are proposed to be constructed in compliance with standard plans and specifications on file with the City as well as in compliacce with the State Map Act and supplemental City Subdivision Ordinance.. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCELS FOR ANY PURPOSE: .1. The tentative parcel map received by the Department of Development Services on August 20, 1980 shall be the approved layout. 2. A parcel map shall be filed with, and approved by the Department Public Works, and recorded with the Orange County Recorder. 3. Bolsa Chica shall be dedicated to City standards at the time said parcels are developed. 4. Compliance with all applicable City Ordinances. 5. A copy of the recorded parcel map shall be filed with the Department of Development Services. AYES: Spencer, Crosby, Vasile NOES: None ABSENT: None ADMINISTRATIVE REVIEW NO. 80-48 (Continued from 9/3/80) Applicant: Sid Crossley To permit the construction of a 6,000 sq. ft., 2 story office building located on the east side of Bolsa Chica, approximately 145 feet north of Warner Avenue. This proposal was previously assessed under Negative Declaration No. 80-23. MINUTES: H.B. BOARD OF ZONING ADJUSTMENTS September 17, 1980 Page 4 Secretary Spencer briefly explained that' -the application was a repeat of a previously approved Administrative Review submitted by the applicant (AR 80-12). The applicant is requesting'a modification -of a conditions imposed regarding reciprocal drives. Mr. Crossley requested a'separate drive approach from that of a_proposed bank facility. He stated that stacking'And poor circulation flow would result with a reciprocal drive. Secretary Spencer noted that -a traffic study had been conducted and had indicated that the reciprocal assess was feasible for this particular site. Mr. Kelly stated -that he had noted similar complexes where the bank facility had separate ingress and egrQss from_the.surrounding office/commercial businesses. - Further Board discussion ensued. ON MOTION BY SPENCER AND SECOND BY CROSBY, ADMINISTRATIVE REVIEW NO. 80-48 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received August 11, 1980 shall be the approved layout. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: - Traffic circulation and drives; - Parking layout; - Lot area; - Lot width and lot depth;- _ - Type of use and its'relation to -property and improvements in the immediate vicinity;-. - Past administrative action regarding this property. B. GENERAL CONDITIONS: 1. Applicant shall adhere to all conditions of approval as imposed by the Board of Zoning Adjustments for Administrative Review No. 80-12, previously approved, with the exception of Condition A- c . To permit the creation of seven (7) parcels from one (1) 11.6+acre parcel located on the southwest corner of Bolsa and Springdale. Secretary Spencer briefly outlined the proposal.. The applicant acknowledged receipt of suggested Conditions of Approval. The Board discussed with the applicant drive approaches and access rights on Bolsa and Springdale. ON MOTION BY CROSBY AND SECOND BY VASILE, TENTATIVE PARCEL MAP NO. 80-566 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL BY THE FOLLOOING VOTE: FINDINGS: 1. The proposed creation of seven (7) parcels for purposes of commercial development is in compliance with the size and shape of property necessary for that type of development. 2. The tentative parcel map received by the Department of Develop- ment Services on -September 17, 1980-shall be the approved layout. 2. A parcel map shall be filed with, and approved by the Department of Public Works, and recorded with -the Orange;County. Recorder. 3. A copy of -the recorded parcel map-shall.be-filed with the Department of Development Services. 4. Vehicle access rights shall be dedicated to the City of Huntington Beach, except for those locations approved by the Board -of Zoning Adjustments. Thompson & Associates To permit commercial uses within the C4 zone located on.the southwest corner of Bolsa Avenue and Springdale Street. Mr. Howard Thompson was present to represent the application. Secretary Spencer briefly outlined the application noting that the proposal was within substantial ordinance code conformance. Chairman Crosby -opened the public hearing. Secretary Spencer stated that there was some confusion with the plan, as the applicant had submitted a revised plan and had then decided to -pursue the plan originally submitted. Secretary Spencer noted that Building C encroaches into the sight angle requirement. He.recommended that the applicant modify his plan so as not to encroach. Fire Representative Vasile expressed concern regarding the drive approach widths and location of same. ' It was the consensus of the Board to continue action'to allow the Fire Department and Traffic Engineering adequate time to research the application. AYES: Crosby, Vasil, Spencer NOES: None ABSENT: None TENTATIVE PARCEL MAP NO. 80-567 Applicant: Hartge Engineering Company To permit the consolidation of "postage stamp" lots into one parcel for (1) lot industrial subdivision located on the west side of Metzler Lane, approximately 670 feet south of Slater Avenue. This request is a categorical exemption Class 15, California Environmental Quality Act, 1970. Secretary Spencer introduced the application to the Board. The applicant acknowledged receipt of the suggested Conditions of Approval. ON MOTION BY CROSBY AND SECOND BY SPENCER, TENTATIVE PARCEL MAP NO. 80-567 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL BY THE FOLLOWING VOTE: FINDINGS: 1. The proposed consolidation of numerous substandard parcels into one parcel for purposes of industrial development is in compliance with the size and shape of property necessary for that type of develop- ment. 2. The General Plan has set forth provisions for this type of land use as well as setting forth objectives for implementation of this type of use. 3. The property was previously studied for this intensity of land use at the time the land use designation for general industrial which allows for ; restricted manufacturing buildings, was placed on the subject property-. 4. The size, depth, frontage, street width, and other design and improve- ment features of the proposed subdivision are pr.oposed to be constructed in compliance with standard plans and specifications on file with the City as well as in compliance with the State Map Act and supplemental City Subdivision Ordinances. . Secretary Spencer briefly outlined the proposal.- Board discussion followed regarding,reciprocal'parking and drives. = The applicant noted that the CC&R's for the property covered the reciprocal drives and parking. ON MOTION BY SPENCER AND SECOND BY CROSBY,-TENTATIVE PARCEL MAP NO. 80-569 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL BY THE FOLLOWING VOTE: FINDINGS: 1. Secretary Spencer introduced the application to the Board, noting that the request was within substantial ordinance code conformance. ON MOTION BY SPENCER AND SECOND BY CROSBY, LOT LINE ADJUSTMENT NO. 80-3 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL BY THE FOLLOWING VOTE: FINDINGS: 1. Lot Line Adjustment No. 80-3 is consistent with the General Plan and Specific Plan of the City of Huntington Beach. MINUTES: H.B. Mr. Johnson, Vice President of Construction and Mr. Endo, architect were present to represent the application., _ Chairman Crosby introduced the application -and opened"'the public hearing. The Board discussed the application. It was noted that the plan was deficient in landscaping, however, Secretary Spencer noted that the decorative brick work would be acceptable as part,of the landscaped area. Signs and display boards -were discussed:. Secretary Spencer suggested that the applicant contact the Planning Division of Development Services for signage requirements. Parking was discussed by -the Board. -..It was -recommended that the handicapped parking space be moved over one stall and the first stall off Beach Blvd. be landscaped. There being no other parties present to, speak on the "application, Chairman Tindall closed the public.hearing. The following plan shall be submitted to the Secretary of the Board: a. First parking stall parallel to Beach Boulevard shall be deleted and replaced with landscaping. Mr. Isadore Applebaum, a property owner in the immediate vicinity, spoke in opposition to the application if the business were to -be an all night operation. He stated that all night traffic and congreation of people at late hours would create excessive noise. MINUTES: H.B.
