REGULAR AGENDA ITEMS:
CONDITIONAL EXCEPTION NO. 80-55
Applicant: Theodore Grussing
To permit a 5h' reduction in open space dimension on 16% (144 sq. ft.)
of required open space located on the east side of Compass Lane, approx.
70 feet from Waterfront Drive (21332 Compass Lane).
This request is a categorical exemption Class 5, California Environmental
Quality Act, 1970.
Secretary Lipps briefly outlined the proposal stating that the request
was within substantial Ordinance Code conformance, however, Conditions
of Approval for the subject tract (Tract 6338), specify that any open
space dimension of not less than 20 feet in any direction shall be
unencumbered. Required overall open space would still be provided with
approval of this application.
Mr. & Mrs. Grussing were present to represent the application. Chair-
man Tindall opened the public hearing. Mr. Grussing stated that if
the addition was located such that the exception were not necessary,
several mature trees would have to be removed, and that the addition
would not fit into the overall plan of the existing house.
Further Board discussion ensued. Chairman Tindall closed the public
hearing.
ON MOTION BY TINDALL AND SECOND BY TRUPPELLI, CONDITIONAL EXCEPTION
NO. 80-55 WAS APPROVED BY THE FOLLOWING VOTE WITH THE CONDITIONS OF
APPROVAL AS FOLLOWS:
REASONS FOR APPROVAL:
1. The applicant provides approximately 200 sq. ft. of open space
in excess of that required by Ordinance.
2. The lot depth is four (4) feet short of a standard sized R-1
lot in the City.

FINDINGS:
1. The granting of the Conditional Exception will not constitute
a grant of a special privilege inconsistent upon other properties
in the vicinity and under an identical zone classification.
2. Because of special circumstances applicable to the subject -property,
including size, shape, topography, location, or surroundings, the
strict application of the zoning ordinance is found to deprive the
subject property of privileges enjoyed by other properties in the
vicinity and under identical zone classifications.
3. The granting of a Conditional Exception is necessary in order to
preserve the enjoyment of one or more substantial property rights.
4. The granting of a Conditional Exception will not be materially
detrimental to the public welfare, or injurious to property in
the same zone classifications.
5. The granting of the Conditional Exception will not adversely
affect the General Plan of the City of Huntington Beach.
CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The conceptual plot plan and elevations received October
16, 1980 shall be the approved layout.
In its approval action, the Board of Zoning Adjustments considered the
following issues relating to the conceptual plan:
- Traffic circulation and drives;
- Parking layout;
- Lot area;
- Lot width and lot depth;
- Type of use and.its relation to property and improvements in the
immediate vicinity;
- Past administrative action regarding this property.

CONDITIONAL EXCEPTION NO. 80-54
Applicant: Mr. & Mrs. Norbert R. Bunt
To permit a reduction (8 inches) into minimum open space dimension
and approximately 97 sq. ft. reduction in the minimum open space
located on the east side of Glacier Circle at 20112 Glacier Circle.
This request is a categorical exemption Class 5, California Environmental
Quality Act, 1970.

Chairman Tindall introduced the application to the Board. Secretary
Lipps briefly outlined the proposal, noting that the request is within
substantial Ordinance Code conformance except for the reduction in
open space.
Mrs. Norbert Bunt was present to represent the application. Chairman
Tindall opened the public hearing.
Mrs. Bunt stated that the addition would not extend past an existing
wall, also, that several homes adjacent to the subject site had added
on to their homes in the same manner as she is requesting.
The Board discussed impacts on the area. Chairman Tindall closed the
public hearing.
ON MOTION BY TINDALL AND SECOND BY TRUPPELLI, CONDITIONAL EXCEPTION
NO. 80-54 WAS APPROVED BY THE FOLLOWING VOTE WITH THE CONDITIONS OF
APPROVAL AS FOLLOWS:

excess of that required by Ordinance Code. The deficiency is only
in the dimension.
FINDINGS:
1. The granting of the Conditional Exception will not constitute
a grant of a special privilege inconsistent upon other properties
in the vicinity and under an identical zone classification.
2. Because of special circumstances applicable to the subject property,
including size, shape, topography, location, or surroundings, the
strict application of the zoning ordinance is found to deprive the
