ADMINISTRATIVE REVIEW NO. 80-32 (Continued from 11/12/80)
Applicant: Balboa Construction Company, Inc.
To permit the erection of mini -warehouse facility and to permit
a mobilehome as living quarters for on -site manager (including
office space.) Subject property is located on the east side of
Brookhurst Street directly north of easterly extension of.Banning
Avenue.
This request is part of Negative Declaration No. 80-49.
Secretary Spencer addressed the Board stating that the applicant
had requested a continuance in order to meet with the Orange County
Sanitation District to further discuss the lease agreement.
It was the consensus of the Board to grant the applicant a continuance
of two weeks, to the meeting of December 3, 1980.

REGULAR AGENDA ITEMS:
ADMINISTRATIVE REVIEW NO. 80-65
Applicant: Frank H. Ayres & Son Construction Co.
To permit a 62,550 sq. ft. warehousing project located on the south-
east corner of Ernest and Goldenwest Street at 7012 Ernest.
This request is part of Environmental Assessment No. 79-22 previously
approved.
Secretary Spencer briefly outlined the request, stating that an
Administrative Review (AR No. 79-22) had previously been approved for
this development. However, the gates were moved to within ten (10)
feet of the property line at the time of construction, instead of the
required twenty (20) feet as required at the time of approval. Therefore,
the applicant is essentially requesting that gates be allowed to remain
at ten (10) feet from the property line.
In addition, the fencing along Goldenwest between buildings B & D does
not meet the stadards of materials as approved by the Design Review
Board. Secretary Spencer stated that the Board of Zoning Adjustments
cannot address the issue, as the condition was imposed by another Board.
He recommended that the applicant contact the Design Review Board for
further assistance with this matter.
Bruce Ayres was present to represent the application. He stated that the
building was complete and occupied. He further stated that if the gates
were relocated to twenty (20) feet away from the property line, a storage
unit on Ernest and portable equipment on Goldenwest (Goldenwest ( entrances
to the complex are located on Goldenwest Street and Ernest), would be
outside the gates, creating security problems. He noted that the gate on
Goldenwest was always kept locked and was considered an emergency access.
Chairman Tindall expressed concern over the possible stacking problem,
which could occur with the approach of the short drive which the location
of the gates has created.
Mr. Ayres stated that the gate on Ernest is open from 7 A.M. to 7 P.M.
daily, and the vehicle drive into the complex. A security attendant
or office manager is always available, therefore, there is no waiting
for gates to be opened.
Discussion between the applicant and Board members centered around place-
ment of two (2) access gates adjacent to Ernest. Board Members felt that
the applicant's request to locate said gates within ten (10) feet of
property line could create a hazardous situation and that placement at t
previously approved twenty (20) foot dimension would help in reducing
any potential hazards.

NO. 80-65 WAS APPROVED BY THE FOLLOWING VOTE WITH THE CONDITIONS
OF APPROVAL AS FOLLOWS:
CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The conceptual plot plan and elevations received October
30, 1980 shall be the approved layout, subject to the
modification described herein:
a. A plan reflecting the location of proposed gates
at the dimension of twenty (20) feet from the
property line shall be submitted to the Secretary
of the Board.
A plan delineating said modification shall be submitted to
the Secretary of the Board. If such plan complies with the
modification outlined by the Board, said plan shall be approved
and made a permanent part of the administrative file.
In its approval action, the Board of Zoning Adjustments considered
the following issues relating to the conceptual plan:
- Traffic circulation and drives;
- Parking layout;
- Lot area;
- Lot width and lot depth;
- Type of use and its relation to property and improvements in the
immeidate vicinity;
- Past administrative action regarding this property.
B. GENERAL CONDITIONS:
1. Applicant shall adhere to all applicable Conditions of
Approval of Administrative Review No. 79-22 previously
approved.
2. Landscaping and treatment of fence material between
building along Goldenwest shall be subject to Design
Review Committees approval.

CONDITIONAL EXCEPTION NO. 80-60
Applicant: Faradane
To permit the reduction of four (4) parking spaces located on the
south side of Oceanus Drive, approximately 400 feet from Triton Lane,
at 5202 Oceanus Drive.
This request is a Categorical Exemption Class 5, California Environmental
Quality Act, 1970.
Mr. Sexton was present to represent the application. Chairman Tindall
opened the public hearing.
Secretary Spencer briefly explained the application, noting that the
Code does not allow for outside storage of equipment, however,
Conditions of Approval imposed would alleviate any problems of Code
violation. He further stated that the reduction in parking would
accommodate outside equipment, as a portion of the building is considered
warehousing.
The applicant explained the type of operation, noting that'no'explosive
materials are used. The equipment located outside (dust collector)
is necessary to production of batteries.
Fire Representative Vasile questioned the applicant regarding type of
materials used and the disposal of remnant materials.
The Board discussed necessary air quality control and industrial waste
discharge permits required for this sort of operation. Secretary Spencer
also advised the applicant of the Huntington Beach Noise Ordinance.
The applicant stated that permits had already been applied for, and can
foresee no problems.
Screening treatments of outside equipment was discussed with the applicant.
He was advised that a plan showing dimensions, type of material used,
etc. would need to be submitted and approved prior to issuance of occupancy
permits. Chairman Tindall closed the public hearing.
ON MOTION BY SPENCER AND SECOND BY TINDALL, CONDITIONAL EXCEPTION NO.
80-60 WAS APPROVED BY THE FOLLOWING VOTE WITH THE CONDITIONS OF APPROVAL
AS FOLLOWS:
REASON FOR APPROVAL:
In analyzing the applicant's interior building plan and discussing proposed
use, the Board felt that by taking into consideration amount of building
being used for warehousing and parking ratios normally associated with t
activity, subject site would be able to more than generate sufficient
parking area.

FINDINGS:
1. The granting of the Conditional Exception will not constitute
a grant of a special privilege inconsistent upon other properties
in the vicinity and under an identical zone classification.
2. Because of special circumstances applicable to the subject property,
including size, shape, topography, location, or surroundings, the
strict application of the zoning ordinance is found to deprive the
subject property of privileges enjoyed by other properties in the
vicinity and under identical zone classifications.
3. The granting of a Conditional Exception is necessary in order to
preserve the enjoyment of one or more substantial property rights.
4. The granting of a Conditional Exception will not be materially
detrimental to the public welfare, or injurious to property in
the same zone classifications.
5. The granting of the Conditional Exception will not adversely affect
the General Plan of the City of Huntington Beach.
CONnTTIONS OF APPROVAL!
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:

13, 1980 shall be the approved layout, subject to the
modifications described herein:
a. A plan reflecting landscaping, screening and/or wall
treatment of outside equipment shall be submitted to
the Secretary of the Board of Zoning Adjustments prior
to issuance of occupany permits.
A plan delineating said modification shall be'submitted to
the Secretary of the Board. If such plan complies with the
modification outlined by the Board, said plan shall be approved
and made a permanent part of the administrative file.
In its approval action, the Board of Zoning Adjustments considered
the following issues relating to the conceptual plan:
- Traffic circulation and drives;
- Parking layout;
- Lot area;
- Lot width and lot depth;

CONDITIONAL EXCEPTION NO. 80-63
Applicant: Thomas Wickstrom
To permit a two (2) foot encroachment into required main access to
dwellings located on the west side of Alabama at 1203, 1205 and 1207
Alabama.
This request is a Categorical Exemption Class 1, California Environmental
Quality Act, 1970.
Mr. Thomas Wickstrom was present to represent the application. Chairman
Tindall opened the public hearing. The Board discussed the application
with Mr. Wickstrom. Chairman Tindall closed the public hearing.
ON MOTION BY VASILE AND SECOND BY SPENCER, CONDITIONAL EXCEPTION NO.
80-63 WAS APPROVED BY THE FOLLOWING VOTE WITH THE CONDITIONS OF APPROVAL
IMPOSED AS FOLLOWS:
FINDINGS:
1. The Code provisions contained in the "Old Town Specific Plan" were
designed primarily to apply to lots with alley access. In absence
of such access on the subject property, applicant cannot comply with
Code and provide front -on garages. To meet the main accessway setback
2. Adequate access is provided into.the dwelling units through the
front -on garages to permit moving of furniture, appliances, etc.
3. Granting of this Conditional Exception will not be detrimental to
the health, safety, or welfare of residents of neighboring properties
or injurious to improvements of property in the vicinity.
4. Granting of this Conditional Exception will not adversely affect
the General Plan of the City of Huntington Beach.
5. Granting of this Conditional Exception does not constitute a grant
of special privilege from other properties in the vicinity as other
similar applications have been approved.

CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The conceptual plot plan and elevations received November 10,
1980 shall be the approved layout.
In its approval action, the Board of Zoning Adjustments considered
the following issues relating to the conceptual plan:
- Traffic circulation and drives;
- Parking layout;
- Lot area;
- Lot width and lot depth;
- Type of use and its relation to property and improvements in the
immediate vicnity;
- Past administrative action regarding this property.
B. GENERAL CONDITIONS:
1. Applicant shall comply with all applicable sections of the
Huntington Beach Ordinance Code pertaining to setbacks
and open space requirements.
2. Automatic garage door opening devices shall be installed
prior to occupancy.

Applicant: Ray Galvin
To permit the construction of. an 9,300 sq. ft. industrial building
located on the east side of Gothard, approximately 100 feet south
of Cain.
Secretary Spencer stated that the building area had been increased from
8,360 sq. ft. to 9,300 sq. ft. A plan check revealed that a minimum
drive approach of twenty-seven (27) feet (in lieu of the approved
twenty-five (25), would be required.
ON MOTION BY SPENCER AND SECOND BY TINDALL, ADMINISTRATIVE REVIEW NO.
80-18 WAS APPROVED WITH THE MODIFICATION AS STATED ABOVE.

approach of twenty-seven (27) feet at the Gothard Street
drive approach.

of the Board. If such plan complies with the modifications outlindd by
the Board, said plan shall be approved and made a permanent part of the
administrative file.
In its approval action, the Board of Zoning Adjustments considered.the
following issues relating to the conceptual plan:

1. The plot plan received November 18, 1980 shall be the approved
layout.
2. An on -site inspection by the Fire Department shall be required
prior to the event.
3. A certificate of insurance form shall be filed in the Finance Depart-
ment five (5) days prior to the event.
