To permit the construction of a two story, 30,752 sq. ft. structure

This request is part of Negative Declaration No. 80-61,

Mr. Stan,Ochizono was present to represent the application. -'Secretary
Spencer -introduced the application and gave"a�/brief background on
the application, stating that a preliminary plan check revealed the
application to be within substantial Ordinance Code conformance.
The Board discussed with the applicant drive.approaches and locations.
It was recommended that the applicant meet with staff from the Department
of Public Works for review and approval of same..
The applicant was advised that a reciprocal access and maintenance
agreement would be necessary, also, a parcel map would be required
in order to consolidate parcels into one.
Fire Representative Vasile suggested that the applicant check with
the Fire Department regarding placement of hydrants.

80-68 WAS APPROVED WITH THE FOLLOWING CONDITIONS OF APPROVAL BY THE

A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The conceptual plot plan and elevations received November
5, 1980 shall be the approved layout, subject to the
modifications described herein:
a. Applicant shall submit to the Secretary of the Board
for approval, a revised plot plan depicting driveway
locations and widths in order to conform with the
Department of Public Works and Fire Department standards.
A plan delineating said modifications shall be submitted to
the Secretary of the Board. If such plan complies with the
modifications outlined by the Board, said plan shall be approved
and made a permanent part of the administrative file.
In its approval action, the Board of Zoning Adjustments considered the,
following issues relating to the conceputal plan:

2. The following plans shall be submitted to the Secretary of the
Board:
a. Landscape and irrigation plan complying with Article 979
of the Huntington Beach Ordinance Code and landscaping
specifications on file in the Department of Public Works.
b. Rooftop mechanical equipment screening plan. Said plan shall
indicate screening of all rooftop mechanical equipment and
shall delineate the type of material proposed to screen said
equipment.
B. GENERAL CONDITIONS:
1. A reciprocal maintenance and acccess agreement between the
applicant and adjacent property owners shall be recorded
prior to issuance of Certificate of Occupancy.
2. A parcel map for lot consolidation purposes shall be filed
by the applicant prior to -issuance of building permits.
3. All building spoils, such as unusable lumber, wire, pipe,
and other surplus or unusable material, shall be disposed
of at an offsite facility equipped to handle them.
4. If lighting is included in the parking lot and/or recreation
area, energy efficient lamps shall be used (e.g. high
pressure sodium vapor, metal halide). All outside lighting
shall be directed to prevent "spillage" onto adjacent properties.
5. A detailed soils analysis shall be prepared by a registered
soils engineer. This analysis shall include on -site sampling
and laboratory testing of materials to provide detailed re-
commendations regarding grading, chemical and fill properties,
foundations, retaining walls, streets and utilities.
6. Installation of a fire hydrant on Green Street, location and
specifications per Fire Department standards.

Secretary Spencer -introduced the application, stating that the City is
currently.,purchasing land on Heil and Silver for street widening purposes.
The -subject property would be affected in that a substantial amount of
land would.,be;requiredcfor dedication to the City.
Mr. Turk was present to;represent,.the application. He stated that there
are several homes that have front -on garages in the immediate area.
Additionally, if the -garage were located -to the rear of the property,
the yard -.area would be.reduced significantly:,
Board discussion followed. It was the consensus of the Board to approve
the application.

FINDINGS:
1. The granting of the Conditional Exception will not constitute
a grant of a special privilege inconsistent upon other properties
in the vicinity and under an identical zone classification.
2. Because of special circumstances applicable to the subject property,
including size, shape, topography, location, or surroundings, the
strict application of the zoning ordinance is found to deprive the
subject property of privileges enjoyed by other properties in the
vicinity and under identical zone classifications.
3. The granting to a Conditional Exception is necessary in order to
preserve the enjoyment of one or more substantial property rights.
4. The granting of a Conditional Exception will not be materially
detrimental to the public welfare, or injurious to property in
the same zone classification.
5. The granting of the Conditional Exception will not adversely affect
the General Plan of the City of Huntington Beach.
CONDITIONS OF APPROVAL:

CONDITIONAL EXCEPTION NO. 80-61
Applicant: William Longley
To permit the construction of a 54'8" x 44' building to encroach
319" into 10' front yard setback located on the south side of Warner
Avenue, approximately 400 feet west of Gothard Street.
This request is a Cateogrical Exemption Class 5, California Environ-
mental Quality Act, 1970.
Mr. Longley was present to represent the application. Secretary
Spencer briefly outlined the request. Chairman Crosby opened the
public hearing.
Secretary Spencer stated that the structure had been constructed at
a five (5) foot setback, however, the Code has been changed requiring
a ten (10) foot setback. Mr. Longley, owner /operator of the building
materials yard, stated that additional storage Area is necessary.
Additionally, the applicant is requesting a front entry to the business
(present entrance is located to the rear), which the applicant feels,
would increase business.
The Board expressed concern regarding drive widths, also, no other
approvals have been granted in the area for such a large amount of
encroachment.
Secretary Spencer noted that a Use Permit (UP 80-3) had been previously
approved on the subject site.
The Board recommended continuance of one week, in order to further
research the proposal.
