BOARD MEMBERS PRESENT: Spencer, Tindall, Vasile MINUTES: Minutes of the Regular Meetings of November 51 and November 12, 1980 were deferred. AGENDA ITEMS: TO BE CONTINUED OR.WITHDRAWN: ADMINISTRATIVE REVIEW NO. 80-32 (Continued from 11/12/80) Applicant: Balboa Construction Co., Inc. To permit the erection of mini -warehouse facility and to,permit a mobile', *home as living quarters for on -site manager (including office space.) Subject -property is located on the east side of Brookhurst Street, - directly north of easterly extension of Banning Avenue. Secretary Spencer stated that the applicant had requested a continuance in order to be present, as he was unable to attend. ,t ON MOTION BY SPENCER AND SECOND BY TINDALL,"ADMINISTRATIVE, REVIEW NO. 80-32 AND NEGATIVE DECLARATION NO. 80-49 WAS CONTINUED ONE WEEK TO DECEIMBER 17, 1980 BY THE FOLLOWING VOTE: AYES: 'Tindall, Spencer, Vasile NOES": None ABSENT: None REGULAR AGENDA ITEMS: CONDITIONAL EXCEPTION NO. 80-61 (Continued from 11/26/80) Applicant: William Longley To permit the construction of a 54'8" x 44' building to encroach 3'9" into 10' front yard setback, located on the south side of Warner Avenue, approximately 400 feet west of Gothard Street,. - This request is a Categorical Exemption Class 5,.California Environmental Quality Act, 1970. MINUTES: H.B. BOARD OF ZONING ADJUSTMENTS December 3, 1980 Page 2 Mr. Longley and Mr. Harlow were present to represent the application. Chairman Tindall opened the public hearing. Mr. Harlow stated that the bulk of the properties improvements are located five (5) feet from the property line, and only a small per- centage of the addition would encroach into the front setback. Mr. Longley stated that he desired to relocate the entrance to be taken from the side of the building, which would allow more visability to walk-in traffic. Secretary Spencer noted that Use Permit No. 80-3 had previously been approved for this propertse_ y, and that Conditions impod_upon that application would become a part of this request. Fire Representative Vasile questioned the applicant concerning the distance between an existing block wall and the building. It was recommended that the block wall be removed. Further Board discussion followed. Chairman Tindall closed the public hearing. ON MOTION BY SPENCER AND SECOND BY VASILE, CONDITIONAL EXCEPTION NO. 80-6 WAS APPROVED BY THE FOLLOWING VOTE, WITH THE CONDITIONS OF APPROVAL AS FOLLOWS: REASON FOR APPROVAL: As applicants use was originally established when districts front yard setbacks were five (5) feet and being at -least eighty (80) percent of subject properties frontage exists with structure (6) feet high at that setback (5'), and with adjacent properties building being located at approximately the same setback (5'), it has been determined that the requested encroachment would not be detrimental to surrounding properties. FINDINGS: 1. The granting of the Conditional Exception will not constitute a grant of a special privilege inconsistent upon other properties .in the vicinity and under an identical zone classification.- 2. Because of special circumstances applicable to the subject property, including size, shape, topography, location, or surroundings, the strict application of the zoning ordinance is found to deprive the subject property of privileges enjoyed by other properties in the, vicinity and under identical zone classifications. The granting of a Conditional Exception is necessary in order to preserve the enjoyment of one or more substantial property rights. 4. The granting of a Conditional Exception will not be materially detrimental to the public welfare, or injurious to property in the same zone classifications. 5. The granting of the Conditional Exception will not adversely affect the General Plan of the City of Huntington Beach. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received November 11, 1980 shall be the approved layout, subject to the modifications described herein: a. A plan shall be submitted reflecting the relocation of the entrance to the west side of the structure. A plan delineating said modifications shall be submitted to the Secretary of the Board. If such plan complies with the modifications outlined by the Board, said plan shall be approved and made a permanent part of the administrative file. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: - Traffic circulation and drives; - Parking layout; - Lot area; - Lot width and lot depth; - Type of use and its relation to property and improvements in the immediate vicinity; - Past administrative action regarding this property. B. GENERAL CONDITIONS: 1. Required on -site and off -site improvements imposed on Use Permit No. 80-3, previously approved shall become a part of this application. 2. Existing block wall located in front of proposed building shall be removed. 3: Area between proposed building and front property line shall be fully landscaped. BOARD OF ZONING ADJUSTMENTS December 3, 1980 Page 4 CONDITIONAL EXCEPTION NO. 80-57 Applicant: Hallbeach Corporation To permit 10 less parking stalls under drive-thru classifications located on the east side of Beach Boulevard, approximately 300 feet from Indianapolis (20362 Beach Boulevard.) The request is a Categorical Exemption Class 5, California Environmental Quality Act, 1970. In Conjunction With: ADMINISTRATIVE REVIEW NO. 80-64 Applicant: Hallbeach Corporation To permit the addition of a drive-thru window located on the east side of Beach Boulevard, approximately 300 feet from Indianapolis. G This request is a Categorical Exemption Class 1, California Environmental Quality Act, 1970. Chairman Tindall introduced the application to the Board, Secretary Spencer briefly outlined the request stating that forty-seven parking stalls are required. Chairman Tindall opened the public hearing. Mr. Hank Mole and Mr. Hall, Sr. were present to represent the application. Mr. Mole stated that a parking survey had been conducted by his firm, which -included traffic counts during various times during the day. The report indicated that the site could adequately serve customers, both drive-thru and dining with the reduction of the ten (10) stalls. The Board discussed the type of parking, and it was recommended that angle parking be researched, which,;iwould create additional parking. Also discussed, was the most northerly drive approach, which is situated at a point where access from the south bound traffic is difficult. The Board recommended the applicant relocate the drive approach or research the possibility of modifying the island to -allow for easier access. Further discussion followed, Chairman Tindall closed the public hearing. ON MOTION BY SPENCER AND SECOND BY VASILE, CONDITIONAL EXCEPTION NO. 80-57 WAS.APPROVED WITH THE FOLLOWING REASONS, FINDINGS AND CONDITIONS OF APPROVAL BY THE FOLLOWING VOTE: 1 MINUTES: H.B. BOARD OF ZONING ADJUSTMENTS December 3, 1980 Page 5 REASON FOR APPROVAL: Based on Board's observation and a parking generation stuOy submitted by the applicant's traffic consultant, it has been determined that existing parking is sufficent to accommodate both customers and employees. Also, it has been determined that current parking requirements appear to be over -restrictive when dual use restaurant facilities (dining and drive-thru) are proposed. FINDINGS: 1. The conceputal plot plan and elevations received November 22, 1980, shall be the approved layout, subject to the modifications described herein: a. Applicant shall submit revised site plan reflecting; - 1) handicapped parking stall adjacent to Beach Boulevard shall be relocated and replaced with landscaping, 2) most northerly drive approach on Beach Boulevard shall be relocated as to discourage south bound left turn movements onto subject site per Public Works Department standards. b. Applicant is encouraged to incorporate angle type parking along easterly parking tier. MINUTES: H.B. If such plan complies with the modifications outlined by the Board, said plan shall he approved and made a parmenent part of the administrative file. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: - Traffic circulation and drives; - Parking layout; - Lot area; - Lot width and lot depth; -Type of use and its relation to property and improvements in the immediate vicinity; - Past administrative action regarding this property. 2. The following plan shall be submitted to the Secretary of the Board: a. Landscape and irrigation plan complying with Article 979 of the Huntington Beaah Ordinance Code and landscaping specifications on file in the Department of Public Works. B. GENERAL CONDITIONS: 1. Existing most northerly drive shall be relocated to the Department of Public Works standards and 212 A & B. AYES: Spencer, Vasile, Tindale NOES: None ABSENT: None ON MOTION BY SPENCER AND SECOND BY TINDALL, ADMINISTRATIVE REVIEW NO. 80-64 WAS APPROVED BY THE FOLLOWING VOTE, WITH THE CONDITIONS OF APPROVAL IMPOSED AS FOLLOWS: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received,November 22, 1980 shall be the approved layout, subject to the, modifications described herein: a. Revised site plan reflecting parking and driveway relocation shall be submitted prior to issuance of building permits. A plan delineating said modification shall be submitted to the Secretary of the Board. B. GENERAL CONDITIONS: 1. Applicant shall adhere to all applicable Conditions of Approval imposed on Conditional Exception No. 80-57. AYES: Spencer, Tindall, Vasile NOES: None ABSENT: None ADMINISTRATIVE REVIEW NO. 80-70 Applicant: Ruslen Distributing, Inc. To permit the display of pennants and grand opening signs located on the south side of Edinger at 7742 Edinger. This request is a Categorical Exemption Class 1, California Environmental Quality Act, 1970. The Board discussed the placement of temporary signs in relation to visability of traffic. The applicant was not present. ON MOTION BY TINDALL AND SECOND BY SPENCER, ADMINISTRATIVE REVIEW NO. 80-70 WAS APPROVED BY THE FOLLOWING VOTE, WITH THE CONDITIONS OF APPROVAL AS FOLLOWS: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received November 21, 1980 shall be the approved layout. Display of temporary signs shall be twenty-one (21) days from date of approval, ending December 24, 1980. AYES: Spencer, Tindall, Vasile NOES: None ABSENT: None TENTATIVE PARCEL MAP NO. 80-576 Applicant: Tallas Margrave To permit the consolidation of nine (9) parcels into two (2) parcels in order to construct industrial condominiums located on the south side of Hamilton and Surveyor Circle. Mr. Tallas Margrave was present to represent the application. Secretary Spencer noted that the applicant acknowledged receipt of. suggested Conditions of Approval. Also, Conditions imposed upon Tract 9843 will become a part of this request. ON MOTION BY TINDALL AND SECOND BY SPENCER, TENTATIVE PARCEL MAP NO. 80-576 WAS APPROVED WITH THE FOLLOWING CONDITIONS OF APPROVAL BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCELS FOR ANY PURPOSE. 1. The tentative parcel map received by the Department of Development Services on November 7, 1980 shall be the approved layout with the amendment as noted thereon. 2. 'A parcel map shall be filed with and approved by the Department of Public Works and recorded with the Orange County Recorder. 3. A copy of the recorded parcel map shall be filed with the Department of Development Services. 4. Applicant shall submit a revised site plan reflecting location and dimension of drive approaches. A copy of the CC & R's shall be reviewed by the office of the City Attorney prior to submittal of the City Council. 7. The sewer, water and fire hydrant system shall'be subject to City standards. 8. Vehicular access rights along Hamilton Avenue shall be dedicated to the City of Huntington Beach except for "A" Street opening. 9. The southerly property boundary of the subdivision shall be fenced to Orange County Flood Control District standards. 10. Natural gas shall be stubbed in at the locations of cooking facilities, water heaters and central heating units.• 11. Low volume heads shall be used on all spigots and water -faucents. 12. All building spoils such as unusable lumber, wire, pipe and other surplus or unusable material shall be disposed of at an off -site facility equipped to handle them. 13. If outside lighting is included on -site, high pressure sodium vapor lamps shall be used to prevent "spillage" onto adjacent areas and for energy savings. 14. If foil -type insulation is to be used, a fire retardent type shall be installed as approved by the Development Services Department. 15. The Hamilton Avenue sewer on the project shall.be extended from the east property line to Newland Street.
