This request is a Categorical Exemption Class 1, California Environ- mental Quality Act, 1970. Secretary Spencer briefly outlined the application. The -Board expressed concern. regarding the drive approach on Slater. It was _recommended that _ the Slater Avenue drive approach -be removed or closed. Main access would be taken from Moraan. He also stated tha-•_ the spray area would be require to be sprinklered. It was recommended that the vehicle maintenance area be screened from the street. ON MOTION BY SPENCER AND SECOND BY VASILE, ADMINISTRATIVE REVIEW NO. 80-69 WAS APPROVED BY THE FOLLOWING VOTE WITH THE FOLLOWING CONDITIONS OF APPROVAL: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received November 6, 1980 shall be the approved layout, subject to the modifications described herein: a. Applicant shall submit to the Secretary of the Board a revised plan reflecting circulation and drive widths. b. Slater Avenue driveway approach shall be removed or closed to the satisfaction of the Department of Public Works prior to occupancy. c. Revised parking layout shall be submitted to iksuance of building permits. A plan delineating said modifications shall be submitted to the Secretary of the Board. If such plan complies with the modifications outlined by the Board, said plan shall be approved and made a permanent part of the administrative file. Rooftop mechanical equipment screening plan. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment. B. GENERAL CONDITIONS: 1. Southern California.Air Quality Control Board approval shall be obtained prior to issuance of building permits. 2. Applicant shall comply with all uniform fire codes as required, particularly regarding.spray booth and sprinklering of same. This request is a Categorical Exemption Class 1, California Environmental Quality Act, 1970. In Conjunction With: ADMINISTRATIVE REVIEW NO. 80-67 (Continued from 12/10/80) Applicant: John Cowles To permit the construction of an 18,000 sq. ft. research and analysis building located on the northwest corner of McFadden and Electronics This request is a Categorical Exemption Class 1, California Environ- mental Quality Act, 1970. Mr, John Cowles and Mr. Anthony Delarnadis were present to represent the applicant. Secretary Spencer briefly explained the request. Chairman Tindall opend the public hearing. Secretary Spencer stated that the applicant and staff had been working together to resolve concerns regarding drive approaches, and parking layout. It was recommended that revised plans be submitted to reflect a revised parking layout and widths and dimensions of drive approaches MINUTES: H.B. BOARD OF ZONING ADJUSTMENTS December 17, 1980 Page 4 Fire Representative Vasile stated that turning radius and on -site circulation meets Fire Department standards for fire protection. The applicant was informed that public improvments and dedication would be necessary per Public Works standards. Chairman Tindall expressed concern regarding the parking area, particularly position of support columns in reiation'to the required parking spaces. Vasile recommended the applicant contact the Fire Department regarding sprinklering,of the garage area. The applicant was requested to submit a plan reflecting location and dimensions of trash enclosures. Chairman Tindall closed the public hearing. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan dated December 15, 1980 and elevations dated December 10, 1980 shall be the approved layout, subject to the modifications described herein: 1. A revised plan reflecting minimum drive approach width of twenty-six (26) feet, shall be submitted and approved prior to issuance of building permits. 2. Dulin Company To permit recreation of two (2) legal sized parcels located at 17198 Sims Street. This request is a Categorical Exemption Class 15, California Environmental Quality Act, 1970. Secretary Spencer outlined the proposal, noting that two parcels now exist, however, a formal application had never been applied for. The property will be developed as a single family residence. An existing home is located on,the rear lot, which conforms to district R-1 requirements. Reciprocal ingress and egress is required between properties. The applicant acknowledged receipt of the suggested conditions of approval. ON MOTION BY SPENCER AND SECOND BY VASILE, TENTATIVE PARCEL MAP NO. 80-578 WAS APPROVED WITH THE CONDITIONS OF APPROVAL AS FOLLOWS BY THE FOLLOWING VOTE: FINDINGS: 1. The proposed recreation of two (2) legal sized parcels for purposes of development of a single family dwelling is in compliance with the size and shape of property necessary for that type of development. 2. The General Plan has set forth provisions for this type of land use as well as setting forth objectives for implementation of this type of use. 3. The property was previously studied for this intensity of land use at the time the land use designation for single family dwelling development, which allows for single family residential buildings, was placed on the subject property. 4. The size, depth, frontage, street width, and other design and improve- ment features of the proposed subdivision are proposed to be constructed in compliance with standard plans and specifications on file with the City as well as in compliance with the State Map Act and supplemental City Subdivision ordinance. The tentative parcel map received by the Department of Develop- ment Services on November 25, 1980 shall be the approved layout with the amendments as noted thereon. 2. A parcel map shall be filed with and approved by the Department of Public Works, and recorded with the Orange County Recorder. 3. Sims Street shall be dedicated to City standards at the time said parcels are developed. 4. A copy of the recorded parcel map -shall be filed with the Development Services Department. 5. Position of drive approaches shall be approved by the Department of Public Works prior to issuance of building permits. 6. A reciprocal ingress and egress agreement across parcel #1 shall be approved by the Department of Development Services prior to recordation of the final map. AYES: Spencer, Tindall, Vasile CONDITIONAL EXCEPTION NO. 80-65. Applicant: Steven-F. Haynes To permit an addition to encroach 116" into the 10' rear setback and to allow required open space to be located within front two thirds (2/3) of lot depth, located on the east side of Chaucer Lane at 20632 Chaucer Lane. This request is a Categorical Exemption Class 5, California Environmental Quality Act, 1970. Mr. and Mrs. Steven Haynes were present to represent the application. Secretary Spencer briefly outlined the proposal. He noted that similar requests had been approved for the surrounding area. Chairman Tindall opened the public hearing. Mr. Haynes stated that the interior layout of the house would make it unreasonable to add to the front of the home, also, a second story addition would infringe upon the privacy of adjacent homeowners. He further noted that the home: -.to tbe:.rear, is,set close to the front property line, therefore, is a considerable distance from the proposed addition. MINUTES: H.B. ON MOTION BY SPENCER AND SECOND BY VASILE, CONDITIONAL EXCF-:)TION NO. 80-65 WAS APPROVED WITH THE FOLLOWING REASONS, FINDINGS AND CONDITIONS OF APPROVAL, BY THE FOLLOWING VOTE: REASONS FOR APPROVAL: In analyzing the applicant's interior building plan, and taking into consideration the amount of proposed encroachment, in addition the minimal impact of adjacent properties, the Board recommended approval. FINDINGS: 1. The granting of the Conditional Exception will not constitute a grant of a special privilege inconsistent upon other properties in the vicinity and under an identical zone classification. 2. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: - Traffic circulation and drives; - Parking layout; - Lot area; - Lot width and lot depth; - Type of use and its relation to property and improvements in the immediate vicinity; - Past administrative action regarding this property. Any subsequent second story addition shall not encroach into the rear ten (10) foot setback. AYES: Spencer, Tindall, Vasile NOES: None ABSENT: None CONDITIONAL EXCEPTION NO. 80-66 Applicant: Jeffrey D. Jacobs To permit a 73 sq. ft. reduction in required open space with an addition located at 3581 Aquarius Drive. This request is a Categorical Exemption Class 5, California Environmental Quality Act, 1970. Chairman Tindall introduced the application to the Board. Secretary Spencer outlined the request stating that the request is with substantial Ordinance Code conformance except for the encroachment into the required open space. Mr. Jeffrey D. Jacobs was present to represent the application. Chairman Tindall opened the public hearing. The Board discussed the interior layout of the home in relation to the property. It was the consensus of the Board that as the request of encroachment into the open space is minimal, approval waskrecommended. Chairman Tindall closed the public hearing. ON MOTION BY TINDALL AND SECOND BY VASILE, CONDITIONAL EXCEPTION NO. 80-66 WAS APPROVED BY THE FOLLOWING VOTE, WITH THE CONDITIONS, REASONS AND.FINDINGS AS FOLLOWS: REASON FOR APPROVAL: The encroachment is minimal, in addition, the structure configuration is such that it deprives the applicant of the property rights enjoyed by adjacent property owners. FINDINGS: 1. MINUTES: H.B. BOARD OF ZONING ADJUSTMENTS December 17, 1980 age 12 Chairman Tindall introduced the application. Secretary Spencer noted that the request was basically in compliance with the Ordinance Code. Parking was discussed by the Board. Mr. Mike Lasley was present to represent the application. He stated that the footage of the building was reduced to accommodate the necessary parking. Spaces on -site total 364. Secretary Spencer noted that a portion of the building is considered storage and warehousing, therefore, necessary parking is reduced by approximately four spaces. Mr. Lasley expressed concern regarding the signage of_the _property. Secretary Spencer informed the application that a copy of the sign ordinance is avail- able in the Department of Development Serivices. ON MOTION BY SPENCER AND SECOND BY VASILE, ADMINISTRATIVE REVIEW NO. 80-71 WAS APPROVED BY THE FOLLOWING VOTE WITH THE CONDITIONS OF APPROVAL AS FOLLOWS: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received December 2, 1980 shall be the approved layout. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: - Traffic circulation and drives; - Parking layout; - Lot width and lot depth; - Lot area; - Type of use and its relation to property and improvements in the immediate vicinity; - Past administrative action regarding this property. 2. This request is a Categorical Exemption Class 5, California Environ- mental Quality Act, 1970. The applicant acknowledged receipt of suggested Conditions of Approval. Secretary Spencer noted that Conditions imposed upon Use Permit No. 80-29 would remain, regarding this particular site. The Board discussed bonding of the property. ON MOTION BY SPENCER AND SECOND BY TINDALL, TENTATIVE PARCEL MAP NO. 80-577 WAS APPROVED BY THE FOLLOWING VOTE, WITH THE CONDITIONS AS FOLLOWS: FINDINGS: 1. The proposed combination of lots into one legal parcel for the purposes of commercial development is in compliance with the size and shape of property necessary for that type of development. 2. The General Plan has set forth provisions for this type of land use as well as setting forth objectives for implementation of this type of use. 3. The property was previously studied for this intensity of land use at the time the land use designation for development which allows commercial buildings, was placed on the subject property. 4. The size, depth, frontage, street width, and other design and improvement features of the proposed subdivision are proposed to be constructed in compliance with standard plans and specifications on file with the City as well as in compliance with the State Map Act and supplemental City Subdivision Ordinance. This request is a Categorical Exemption Class 1, California Environmental Quality Act, 1970. Secretary Spencer briefly outlined the application, noting that improvements on Coldwater Lane are existing. Further, ample parking is provided.' AYES: Tindall, Spencer, Vasile NOES: None ABSENT: None TENTATIVE PARCEL MAP NO. 80-580 Applicant: Dick Kelter To permit the division of land from 1 lot into 2 lots located on the north side of Glencoe Avenue approximately 370 feet west of Beach Boulevard. It was recommended that this request be referred to the Planning Commission in order to be heard in conjunction with Conditional Exception No. 80-8. This request is a Categorical Exemption Class 1, California Environmental Quality Act, 1970. Secretary Spencer briefly outlined the proposal noting that the site had .previously. been designated,as a motel/office commercial use (Use Permit No. 76-23 and Use Permit No. 79-25). The Board discussed parking area and improvements necessary for office uses. ON MOTION BY SPENCER AND SECOND BY TINDALL, ADMINISTRATIVE REVIEW NO. 80-73 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received December 15, 1980 shall be the approved layout, subject to the modifications described herein: a. A revised plan reflecting parking with full surface improve- ments on the previously approved motel/building "E" site shall be submitted prior to occupancy permits for office structure. A plan delineating said modifications shall be submitted to the Secretary of the Board. If such plan complies with the modifications outlined by the Board, said plan shall be approved and made a permanent part of the administrative file. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: - Traffic circulation and drives; - Parking layout; - Lot area; - Lot width and lot depth; - Type of use and its relation to property and improvements in the immediate vicinity; - Past administrative action regarding this property.
