BOARD MEMBERS PRESENT: Spencer, Vasile, Kelly MINUTES: Minutes of the Regular Meetings of November 5, December 10, and December 17 were deferred. REGULAR AGENDA ITEMS: TENTATIVE PARCEL MAP NO. 80-581 Applicant: Nick Becker To allow a one (1) lot subdivision located at the northwest corner of Chemical Land and McFadden. This request is a Categorical Exemption Class 1, California Environmental Quality Act, 1970. Secretary Spencer introduced the application to the Board. He noted that the property has been built upon, and the request is for condominimum purposes. Fire Representative Vasile stated that hydrant locations were within conformance with Huntington Beach Fire Department regulations. The applicant acknowledged receipt of suggested Conditions of Approval. ON MOTION BY SPENCER AND SECOND BY KELLY, TENTATIVE PARCEL MAP NO. 80-581 WAS APPROVED WITH THE FOLLOWING CONDITIONS OF APPROVAL AND FINDINGS BY THE FOLLOWING VOTE: FINDINGS: 1. The proposed subdivision of lots into one (1) lot parcel condominum purposes is in compliance with the size and shape of property necessary for that type of development. 2. The General Plan has set forth provisions for this type of land use as well as setting forth objectives for implementation of this type of use. 3. The property was previously studied for this intensity of land use at the time the land use designation for Light Industrial development which allows for this type of development was placed on the subject property. The size, depth, frontage, street width and other design and improvement features of the proposed subdivision are proposed. to be constructed in compliance with standard plans a_.d specifi- cations on file with the City as well as in compliance with the State Map Act and supplemental City Subdivision Ordinance. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCELS FOR ANY PURPOSE: 1. The tentative parcel map received by the Department of Develop- ment Services on December 10, 1980 shall be the approved layout. 2. A parcel map shall be filed with and approved by the Department of Public Works and recorded with the Orange County Recorder. 3. A copy of the recorded parcel map shall be file with the Department of Development Services. AYES: SPENCER, VASILE, KELLY NOES: None ABSENT: None CONDITIONAL EXCEPTION NO. 80-67 Applicant: Ambrosino & Brown To permit an encroachment into front yard setbacks located on the north side of Talbert, east of Gothard Street in Tract 10648. This request is a Categorical Exemption Class 5, California Environmental Quality Act, 1970. In Conjunction With: ADMINISTRATIVE REVIEW NO. 80-55 Applicant: Business Parks, Inc. To permit the construction of nineteen (19) industrial buildings of 141,815 sq. ft. located on the north side of Talbert, approximately 1,160 feet west of Beach Boulevard in Tract 10648. Secretary Spencer stated that the encroachment is minimal, the maximum being 3�- feet and a minimum of 1k feet at various points in the project. The Board discussed the location of drives, noting that the.minimum drive width shall be 30 feet. Secretary Spencer expressed concern regarding the area between residenti area and the parking compound. He recommended that trees be located every 100 feet in the parking compound adjacent to the residential area to act as a buffer. MINUTES: H.B. Fire Representative Vasile expressed concern regarding length of medians on Brookshire Lane in relation to turning radius'. Secretary Spencer informed the applicant that reciprocal drive agreements would be required with the adjacent property owners. Secretary Spencer recommended relocation of trash enclosures. It was noted that the design of the structure coincides with the light indiistrial zoning designation for this area. Secretary Spencer noted that all applicable Conditions of Approval imposed upon Tract 10648 will become a part of'this approval. ON MOTION BY KELLY AND SECOND BY SPENCER, CONDITIONAL EXCEPTION NO. 80-67 WAS APPROVED BY THE FOLLOWING VOTE, WITH CONDITIONS OF APPROVAL, FINDINGS AND REASONS AS STATED BELOW: REASONS FOR APPROVAL: 1. Major portion of buildings being considered are located behind the required setbacks, with extent of requested encroachments being small closet and office area projections having a maximum encroachment of three And one-half (3�), with a maximum total square footage of approximately forty (40) square feet. 2. Requested projections are found to meet intent of development standards associated with other projects located within the M-1 "Light Industrial Districts." FINDINGS: 1. The granting of the Conditional Exception will not constitute a grant of a special privilege inconsistent upon other properties in the vicinity and under an identical zone classification. 2. Because of special circumstances applicable to the subject property, including size, shape, topography, location, or surroundings, the strict application of the zoning ordinance is found to deprive the subject property of privileges enjoyed by other properties in the vicinity and under identical zone classifications. 3. The granting of a Conditional Exception is necessary in order to preserve the enjoyment of one or more substantial property rights. MINUTES: H.B. The granting of a Conditional Exception will not be materially detrimental to the public welfare, or injurious to property in the same zone classifications. 5. The granting of the Conditional Exception will not adversely affect the General Plan of the City of Huntington Beach. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERb1ITS: 1. The conceptual plot plan and elevations received December 9, 1980 shall be the approved layout. In its approval action, the Board -of Zoning Adjustments considered the following issues relating to the conceptual plan; - Traffic circulation and drives; - Parking layout; - Lot area; - Lot width and lot depth; - Type of use and its relation to property and improvements in the immediate vicinity; - Past administrative action regarding this property. B. GENERAL CONDITIONS: 1. Conditions of Approval imposed upon Administrative No. 80-55 shall become a part of this application. AYES: Spencer, Vasile, Kelly NOES: None ABSENT: None ON MOTION BY SPENCER AND SECOND BY KELLY, ADMINISTRATIVE REVIEW NO. 80-55 WAS APPROVED BY THE FOLLOWING VOTE, WITH CONDITIONS OF APPROVAL IMPOSED AS FOLLOWS: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received September 25, 1980 shall be the approved layout, subject to the modifications described herein: a. A plan reflecting the length and design of medians on Brookshire Lane shall be approved by the Department of Public Works and the Huntington Beach Fire Department and submitted to the Secretary of the Board. b. Fifteen gallon trees every 100 feet on center, shall be located in the parking compound adjacent to the residential area, and shall be incorporated in the landscaping -plan for approval by the Department of Public Works and Deveiopment Services. d. Location and widths of drive approaches shall be approved by the Department of Public Works and submitted to the Secretary of the Board. e. All applicable Conditions of Approval of Tract Map No. 10648 shall be complied with; A plan delineating said modifications shall be submitted to the Secretary of the Board. If such plan complies with the modifications outlined by the Board, said plan shall be approved and made a permanent part of the administrative file. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: Traffic circulation and drives; Parking layout; - Lot area; Lot width and lot depth; - Type of use and its relation to property and improvements in the immediate vicinity; - Past administrative action regarding this property. 2. The following plans shall be submitted to the Secretary of the Board: a. Landscape and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code and landscaping specifications on file in the Department of Public Works. b. Rooftop mechanical equipment screening plan. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment. B. GENERAL CONDITIONS: 1. A copy of recorded reciprocal drive easements shall be submitted to the Secretary of the Board prior to occupancy. 2. This request is a Categorical Exemption -Class 1, California Environmental Quality Act, 1970.'."- Secretary Spencer introduced the application to the Board. He stated that the request is to allow the additiori-of a master bedroom to the rear portion,of the property, during Phase. II and the addition of a garage during Phase I: Secretary Spencer opened the public hearing.` The applicant was not present. Secretary Spencer stated that,a revi,sed.plan would be required showing proper dimension and location 'of the'garage. Further Board discussion followed. Secretary Spencer closed the public hearing. ON MOTION BY SPENCER AND SECOND'BY'VASILE, USE PERMIT NO. 80-44 WAS APPROVED BY THE FOLLOWING VOTE, WITH CONDITIONS OF APPROVAL AND FINDINGS AS FOLLOWS: FINDINGS: 1. The establishment, maintenance, and -operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. Property and improvements' `in ,the' vicinity of such use or' building. 2. The granting of a Use Permit will not adversely affect the General Plan of the City of Huntington Beach. 3. The proposal"is_consistent'with the City's General Plan of Land'Use. CONDITIONS OF APPROVAL: A. TO,BE COMPLETED PRIOR TO ISSUANCE OF BUILDING_PERMITS: 1. The conceptual plot plan and elevations received December 8, 1980 shall be the approved layout, subject to the modifications described herein: a. A revised plan reflecting proper dimensions and locations of proposed garage shall be submitted to the Secretary of the Board. b. That portion of alley specified by the Department of Public Works, shall be dedicated to the City of Huntington Beach. MINUTES: H.B. AYES: Spencer, Kelly, Vasile NOES: None ABSENT: None USE PERMIT NO. 80-43 Applicant: Victor Ferrer To permit an auto body shop located at 5382 Oceanus. This request is a Categorical Exemption Class 1, California Environmental Quality Act, 1970. Because ofa clerical error_ regarding the advertising date,the Board continued the application to the meeting of January 7, 1981. ON MOTION BY SPENCER AND SECOND BY KELLY, USE PERMIT NO. 80-43 WAS CONTINUED TO THE MEETING OF JANUARY 7, 1980 BY THE FOLLOWING VOTE: AYES: Spencer, Kelly, Vasile NOES: None ABSENT: None USE PERMIT NO. 80-45 Applicant: Edwin Ramage To permit major mechanical equipment repair garage located at 5382 Oceanus. This request is a Categorical Exemption Class 1, California Environmental Quality Act, 1970. Mr. 111,amage and Mr. Penko£f were present to represent the application. Secretary Spencer introduced the application to the Board. The public hearing was opened. Mr. Roger Howell, attorney for Kacor Realty, Inc. was present to speak in opposition of the proposal. Mr. Howell stated that the use was not compatible with the area, in addition would not be an attractive use, as a business of this sort usually has an accumulation of parts, equipment MINUTES: H.B. BOARD OF ZONING ADJUSTMENTS December 24, 1980 , Page 8 and storage of vehicles. Mr. Ramage stated that the repair of forklifts is done wholly within the building. There is no outside storage of equipment, as most of his repair work is in the field. Noise'is minimal, and there is no body work done, being strictly mechanical equipment repair. Secretary Spencer stated that outside storage and/or activity is not allowed. Also, a six (6) month review of the site is standard policy. Mr. Ramage stated that loading and unloading of equipment will be off-street, directly into the building. Secretary Spencer closed the public hearing. ON MOTION BY SPENCER AND SECOND BY VASILE, USE PERMIT NO. 80-45 WAS APPROVED BY THE FOLLOWING VOTE WITH CONDITIONS OF APPROVAL AND FINDINGS AS STATED: FINDINGS: 1. A six month review of the site shall be conducted to assure conformance of applicable ordinance codes. AYES: Spencer, Kelly, Vasile NOES: None ABSENT: None MISCELLANEOUS ITEMS: ADMINISTRATIVE REVIEW NO. 80-53 Applicant: James Lumber Company A revision of original approved plan to include a twenty by thirty (20 x 30) foot storage shed. Fire Representative Vasile stated that a plan;reflecting the location of stacks in relation to the placement of the shed would be required. ON MOTION BY SPENCER AND SECOND BY VASILE, ADMINISTRATIVE REVIEW NO. 80-53 WAS APPROVED BY THE FOLLOWING VOTE, WITH CONDITIONS OF APPROVAL AS FOLLOWS: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The revised conceptual plot plan and elevations received December 21, 1980 shall be the approved layout, subject to the modifications described herein: a. A revised plan shall be approved by the Fire Department and submitted to the Secretary of the Board reflecting position of the proposed storage structure in relation to lumber stacks. MINUTES: H.B. Secretary Spencer noted that the total _square_footage of_the structure _ is 55,032 for the first building, 58,132 for the second building and 55,000 for the third building. Secretary Spencer stated that,all applicable Conditions imposed previously would remain. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The revised conceptual plan and elevations received December 22, 1980 shall be the approved layout.
