BOARD MEMBERS PRESENT: Lipps, Vasile, Kelly MINUTES: ON MOTION BY LIPPS AND SECOND BY VASILE, THE MINUTES OF THE REGULAR MEETING OF DECEMBER 10, 1980 WERE APPROVED BY THE FOLLOWING VOTE: AYES: Lipps, Vasile NOES: None ABSTAIN: Kelly ON MOTION BY LIPPS AND SECOND BY KELLY, THE MINUTES OF THE REGULAR MEETINGS OF NOVEMBER 5, DECEMBER 17, DECEMBER 24, 1980 WERE DEFERRED AYES: Lipps, Vasile, Kelly NOES: None ABSENT: None REGULAR AGENDA ITEMS: USE PERMIT NO. 80-46 Applicant: Terry Brown To permit a marine generator sales and service business located at 15886 Manufacture Lane at the intersection of Production and Manufacture Lane. This request is a Categorical Exemption Class 1, California Environmental Quality Act, 1970 Chairman Kelly introduced the application. Secretary Lipps briefly outlined the proposal. Chairman Kelly opened the public hearing. The applicant was not present. There being no one wishing to speak, Chairman Kelly closed the public hearing. The Board discussed ordinances pertaining to sales and services in the subject zoning area. Conditions of Approval were discussed. ON MOTION BY LIPPS AND SECOND BY VASILE, USE PERMIT NO. 80-46 WAS APPROVED BY THE FOLLOWING VOTE, WITH FINDINGS AND CONDITIONS OF APPROVAL AS STATED: MINUTES: H.B. BOARD OF ZONING ADJUSTMENTS December 31, 1980 Page 2 FINDINGS: 1. The establishment, maintenance and operation of the u�,!:� will not be detrimental to: a. The general welfare of persons residing or working in the vicinity. b. Property and improvements in the vicinity of such use or building. 2. The granting of a Use Permit will not adversely affect the Master Plan of the City of Huntington Beach. 3. The proposal is consistent with the City's General Plan of Land Use. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received December 11, 1980 shall be the approved layout. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceputal plan: - Traffic circulation and drives; - Parking layout; - Lot area; - Lot width and lot depth; - Type of use and its relation to property and improvements in the immediate vicinity; - Past administrative action regarding this property. B. GENERAL CONDITIONS: 1. Retail sales are not permitted in this zoning district at this location. Therefore, approval of this use shall be limited strictly to the sale of parts to be installed by the applicant either within the building or at the boat site. No retail sales shall be conducted to "walk-in" trade. 2. There shall be no outside storage or outside activity except that permitted by Article 951 of the Huntington Beach Ordinance Code. 3. A review of the use shall be conducted by the Board of Zoning Adjustments six months from date of approval to determine that compliance with these conditions and all applicable ordinances. If the use is found not to be in compliance Use Permit No. 80-46 will become null and void. MINUTES: H.B. BOARD OF ZONING ADJUSTMENTS December 31, 1980 Page 3 4. All previous conditions imposed by approval of Administrative Review No. 76-191 shall be adhered to. AYES: Lipps, Kelly, Vasile NOES: None ABSENT: None CONDITIONAL EXCEPTION NO. 80-68 Applicant: William M. Turk To permit the relocation of a garage to encroach 14' into required setback and 26V into side yard setback, located at 7742 Alhambra, at the inter- section of Silver Lane and Alhambra. This request is a Categorical Exemption Class 5, California Environmental Quality Act, 1970. Secretary Lipps briefly outlined the application. The applicant was not present. It was the consensus of the Board to continue this application one week in order for the applicant to be present to discuss various questions for Board clarification. ON MOTION BY LIPPS AND SECOND BY VASILE, CONDITIONAL EXCEPTION NO. 80-68 WAS CONTINUED TO THE MEETING OF JANUARY 7, 1981 TO ALLOW THE APPLICANT TO BE PRESENT: AYES: Vasile, Kelly, Lipps NOES: None ABSENT: None MISCELLANEOUS ITEMS: CONDITIONAL EXCEPTION NO. 80-3 Applicant: Mr. & Mrs. T.J. Rudd To permit a reduction in open space dimension from 20 feet to 15 feet located on the north side of Scotia Circle, approximately 300 feet south of Balmoral Drive. The Board reviewed revised plans submitted December 31, 1980. It was the consensus of the Board that the revised plan was within concept of previous approval of this application. 11 MINUTES: H.B. AYES: Lipps, Kelly, Vasile NOES: None ABSENT: None ADMINISTRATIVE REVIEW NO. 89-15 Applicant: A.C.O. Development To permit the construction of a 43,500 sq. ft. bank and office/professional complex in two phases located on the east side of Bolsa Chica approximately 300 feet north of Warner. The applicant requested revised Conditions of Approval regarding the reciprocal drive easements, which are no longer necessary'. ON MOTION BY LIPPS AND SECOND BY VASILE, GENERAL CONDITION B-1 REGARDING RECIPROCAL ACCESS AGREEMENTS BETWEEN SUBJECT PARCEL AND PARCEL ABUTTING THE SOUTHERLY PROPERTY LINE AT THE INTERCONNECTING DRIVEWAY SHALL NO LONGER BE APPLICABLE. ALL OTHER CONDITIONS OF APPROVAL IMPOSED SHALL REMAIN APPLICABLE.
